HomeMy WebLinkAboutR-1999-255r r, r Y r i�/�i L _. .f ._ . r r< RESOLUTION NO. 255-99 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA AUTHORIZING THE CITY MANAGER TO PURCHASE FIRE HYDRANT AND REPAIR SERVICES FROM MUELLER HYDRANT SERVICES AT A COST OF $35,000.00; SOLE SOURCE PROVIDER, UNDER BROWARD COUNTY BID #P- 10-96-01-24, WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part Ill, Article 3, Section 4, Subsection (J), authorizes the city manager to purchase supplies, services, equipment and materials for the city government in amounts in excess of $15,000.00 without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the city commission and if such purchases are made pursuant to a competitive bid obtained within the last twelve (12) months by other governmental agencies such as the Federal Government, State of Florida or a Florida \ county or municipality; and WHEREAS, the city manager has determined that it is necessary to purchase fire hydrant and repair services from Mueller Hydrant Service, 1315 Olympic Court, NW, Conyers, Georgia 30207, the sole source provider of said equipment, for use by the Public Works Department; and WHEREAS, the city manager has determined that such purchase can be made at the least cost to the city by purchasing said equipment from Mueller Hydrant Service, sole source provider, in the amount of$35,000.00, under Broward County Bid No. P-10- 96-01-24; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. INSURANCF REQUIREMENTS: (Continued) 4.4 The CONTRACTOR shall provide to the COUNTY Certificates of Insurance evidencing the insurance coverage specified in 4.1,4.2,and 4.3 above. The Contractor should provide these Certificates within fifteen (15)days after request by the Purchasing Agent. The required Certificates of Insurance shall not only name the types of policies provided, but also shall refer specifically to this Contract and section and the above paragraphs in accordance is as required by such paragraphs of this Contract. If the initial insurance expires prior to the completion of the work, renewal Certificates of Insurance shall be furnished thirty(30)days prior to the date of their expiration. 4.5 Certificates of insurance shall be provided as specified in sub-section 4.4 above unless any of these coverages are, for just cause, inapplicable, and upon specific request by the vendor are excepted by written determination of risk management and approved by the purchasing director. If an exception is requested, the bidder should indicate in the appropriate area on the bid sheet any such request including reason(s) thereto for exemption from insurance requirements as specified in this section of this invitation for bidlquotation request. 5. INDEMNIFICATION: (Supersedes paragraph 25 of General Conditions) The CONTRACTOR shall indemnify and save harmless the COUNTY, its officers, agents and employees,from or on account of any injuries or damages, received or sustained by any person or persons during or on account of any operations connected with the construe of this Project;or by or in consequence of any negligence (excluding negligence of COUNTY), in connection with the same; or by use of any improper materials or by or on account of any act or omission of the said Contractor or his Subcontractor, Agents, Servants or Employees. Contractor agrees to indemnify and save harmless the COUNTY against any claims or liability arising from or based upon the violation of any federal, state, county or city laws, by-laws, ordinances or regulations by the CONTRACTOR. The CONTRACTOR agrees to indemnify and save harmless the COUNTY from all such claims and fees,and from any and all suits and actions of every name and description that may be brought against COUNTY on account of any claims,fees, royalties,or costs for any invention or patent, and from any and all suits and actions that may be brought against COUNTY for the infringement of any and all patents or patent rights claimed by any person, firm, or corporation. The indemnification provided above shall obligate the CONTRACTOR to defend at his own expense or to provide for such defense, at the COUNTY'S option, any and all claims of liability and all suits and actions of every name and description that may be brought against the COUNTY which may result from the operations and activities under this Contract whether the construction operations be performed by the CONTRACTOR, his subcontractor or by anyone directly or indirectly employed by either. 6. LOCAL PREF RFN Aug: : In accordance with Interlocal Agreement between Broward and Dade County, (Resolution No. 50-96)the right is reserved by the Broward County Board of County Commissioners to provide for a local preference in an amount of one percent(1%)of the bid or proposal. In accordance with the Public Entity Crimes Act, Section 287.133,Florida Statutes,a person or affiliate who is a contractor, consultant or other provider, who has been placed on the convicted vendor list following a conviction for a Public Entity Crime may not submit a bid on a contract to provide any goods or services to the County, may not submit a bid on a contract with the County for the construction or repair of a public building or public work,may not submit bids on leases of real property to the County,may not be awarded or perform work as a contractor supplier, subcontractor, or consultant under a contract with the County, and may not transact any business with the County in excess of the threshold amount(currently$15,000.00) provided in Section 287.017, Florida Statutes,for category two purchases for a period of 36 months from the date of being placed on the convicted vendor list. Violation of this section shall result in cancellation of the County purchase and may result in debarment. 9. The County is particularly interested in the type of recycled material used (such as paper, plastic, glass, metal,etc.);and the percentage of recycled material contained in the product. The County also requests information regarding any known or potential material content in the product that may be extracted and recycled after the product has served its intended purpose. SCRAPF,WIRE BRUSH AND PAINT This procedure is distinctly different from SANDBLAST, PRIME AND PAINT All old rough spots, or rust shall be scraped bff and the hydrant wire brushed. The hydrant is then cleaned with a solvent, primed and painted in the approved County colors. The Contractor is responsible for maintaining OSHA standards when scraping as well as sandblasting fire hydrants. The County will take responsibility for disposal of hazardous lead particles after containment by the Contractor. OR At the option of the County. 7, SANDBLAST, PRIME AND PAINT The old coatings on the fire hydrants will be removed by abrasive blast cleaning. Blasting will be done to the complete above ground portion of the hydrant. "White metal"will be exposed to assure removal of all debris. Due to the age of some hydrants involved, lead based paint may be assumed to be present. The most current OSHA lead standard, 29 CFR 1910.1025, shall be used to control and monitor exposure,and its procedures followed for lead abatement. It remains the responsibility of the contractor to ensure no hazardous materials are released to the environment or affect the public. The Contractor is responsible for maintaining OSHA standards when scraping as well as sandblasting fire hydrants. The County will take responsibility for disposal of hazardous lead particles after containment by the Contractor. Immediately after reaching the"white-metal",a quick drying category primer,dry to the touch in two to three minutes,will be applied to prevent corrosion from exposure to the atmosphere. This primer will be applied in an approximate 4 mil thickness. The primer will be 1-16 Flash Dry. The finished coat's color will be per Broward County Specifications. Two coats of final paint [a phenolic urethane enamel]shall be applied over the clean and dry primer.
