REPRESENTING MICHAEL SIMMONS, PRESIDENT OF
PORT PETROLEUM, INC., FOR PROPERTY LOCATED AT
3141 SE 14T" AVENUE, PORT EVERGLADES, DANIA
BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS,Albert F. Webber III, P.E., representing Michael Simmons, President of
Port Petroleum, Inc., has applied for site plan approval for the proposed construction of a
a concrete containment area and installation of 12 vertical oil storage tanks with an asphalt
access drive to be located at 3141 SE 14"Avenue, Port Everglades, Dania Beach; and
WHEREAS, the Planning & Zoning Board on November 17, 1999, recommended
that the City Commission grant the site plan request (SP-80-99), based upon the criteria
set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of
Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-80-99)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit"A" is approved and it is
further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.

Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.
PASSED AND ADOPTED THIS 14" DAY OF DECEMBER, 1999.

SUBJECT: SP-80-99— Site Plan Request for Port Petroleum
APPLICANT: Albert F. Webber III, P.E. representing Michael Simmons,
President of Port Petroleum, Inc.
REQUEST: Site Plan Request for the construction of a concrete
containment area and installation of 12 vertical oil storage
tanks with an asphalt access drive.
LOCATION: 3141 SE 14"Ave. — Port Everglades
EXISTING ZONING: M-3
FUTURE LAND USE: T- Transportation
PROPERTY SIZE: 1.28 acres
SURROUNDING ZONING: M-3 (Port)
SURROUNDING LAND USE: Transportation & Utilities to the East
The subject site is located on the west side of Southeast 14" Avenue and north
of Southeast 32n° Street. The applicant proposes to install twelve (12) vertical
tanks with a tank capacity of 12,000 gallons and a concrete containment area on
the site. Access to the site is provided by Southeast 14"Avenue. The proposed
site plan has been reviewed by City staff as well as representatives of Port
Everglades. The site is in the general vicinity of a similar site plan that was
approved for Port Petroleum last year. The planned facility will store virgin tube
oil which has a flash point of 495 degrees, which indicates low volatility. The
operation anticipates one (1) to two (2) tanker trucks per day. Staff has met with

the engineer for the project to discuss the following comments and
recommendations:
Staff recommendation: Approval of the site plan subject to the following
conditions.
1. Demonstrate that the concrete containment area complies with BCDPEP
standards.
2. Provide a typical detail of the NFPA placard that will be placed on each
tank. (Applicant has complied.)
3. Provide a note on the site plan indicating that the NFPA placard will be
placed on each tank. (Applicant has complied.)
4. Indicate whether the sump in the concrete loading area has a recovery
tank, oil-water separator, etc. (The recovery system will be handled by
an independent contractor who will come to the site and pump out
on an as-needed basis.)
5. BCDPEP permit must be obtained prior to the issuance of a building
permit.
6. Provide demonstration of compliance with #6, 7, 8, and 9 in letter from
Louis M. Gagliardi, Port Everglades. (The applicant has met with the
Port Everglades officials to comply with their comments.) '.
7. Construction permits issued by Port Everglades must be obtained prior to
issuance of a building permit.
8. Identify the existing zoning, M-3, and the proposed use on the site plan.
(Applicant has complied with this request.)
9. Provide information regarding drainage, grading, slope. (Applicant has
complied with this request.)
10. Provide outdoor lighting plan prior to issuance of building permit.
11. Provide an irrigation plan or a note that the plan will be provided prior to
the issuance of a building permit. (Applicant will comply.)
12. The applicant has provided information regarding landscape materials.
They will incorporate live oaks, mahogany and cocoplum as the hedge.
13. Provide notes to address compliance with the landscape planting and
maintenance requirements.
14. Provide curbing to separate landscaped areas from vehicular use areas.
(The applicant has provided curbing along the northern and eastern
perimeters of the property.)
