Y `�"`"` '� � .� .. _. r� / RESOLUTION NO. 251-99 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE SITE PLAN REQUEST SUBMITTED BY CLAUDETTE&ATHANASIOS ZAVALIS FOR PROPERTY LOCATED AT 2970 GRIFFIN RD., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Claudette &Athanasios Zavalis have applied for site plan approval for the proposed installation of a parking lot associated with renovation of the existing 1,000 +/- square foot building located at 2970 Griffin Rd., Dania Beach; and WHEREAS, the Planning &Zoning Board on August 18, 1999, recommended that the City Commission grant the site plan request (SP-63-99), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-63-99)for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit"A", is approved along with the original Site Plan dated September 22, 1999 with the condition that the five (5) Red Maple Trees be replaced with five (5) Gumbo Limbo Trees and placed along the back of the property for fuller separation between the residential community. It is further noted that the original Site Plan is maintained in the office of the Growth Management Department of the City of Dania Beach. 1 RESOLUTION NO. 251-99 f r, r r Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. It has been the policy of the City to consider existing development constraints on properties that are being redeveloped. The Planning and Zoning Board recommends approval of the site plan, subject to the following conditions: 1. Submission of a signage plan prior to issuance of a building permit, if signs are anticipated (the applicant indicates that the only signage will be on the building itself and will comply with code). 2. Inclusion of a dumpster detail and location on the site plan. 3. Demonstration of compliance with Section 26-44 (C), native plant requirements. 4. Submission of a site lighting plan prior to building permit. 5. Demonstration of compliance with Section 26-53 (C), tree size requirements. 6. Provision of a site data table pursuant to Section 26-40. 7. Demonstration of compliance with Section 26-49, non-vehicular open space. 8. Revision of the terminal island to comply with the ten (10) foot width requirement. 9. Compliance with Section 26-48, vehicular use area landscaping. 10. Demonstration of compliance with required parking. Providing the amount of customer service area is required in order to make this determination. The applicant has shown that parking is more than adequate to meet the requirements of the code. There are still remaining issues that the applicant needs to address.
