Home My WebLink AboutR-1999-243 F� l 7 \ �� ( � _ I /._:a L .. f �� r 7-- F I I RESOLUTION NO. 243-99 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA AUTHORIZING THE CITY MANAGER TO CONTRACT FOR THE PURCHASE OF SUPPLIES, SERVICES, EQUIPMENT AND MATERIALS IN THE AMOUNT OF $20,000.00 WITH SOLE PROVIDER, AMERICAN FIREWORKS COMPANY, FOR VARIOUS FIREWORKS DISPLAYS FOR A NEW YEAR'S CELEBRATION AT DANIA BEACH; WITHOUT COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT FOR BIDS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection (J), provides that during unusual conditions or emergencies, the city commission may, by resolution, authorize the purchase by the city manager of designated supplies, services, equipment and materials in amounts in excess of fifteen thousand dollars ($15,000.00) without competitive bids and without advertisement for bids; and WHEREAS, the City Manager has determined that it is necessary to purchase designated supplies, services, equipment and materials from American Fireworks Company for the New Year's celebration at Dania Beach; and WHEREAS, the City Manager has determined that such purchases can be made at the least cost to the City from American Fireworks Company in the amount of $20,000.00 to be paid from the Contingency Fund Budget; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain Contract with American Fireworks Company for the purchase of various fireworks displays, in substantial form as Exhibit 'A", attached, is approved and the appropriate city officials are authorized to execute it. The City Manager and City Attorney are authorized to make minor revisions to such Contract as are deemed necessary and proper for the best interests of the City. 1 RESOLUTION NO. 243.99 f 4� Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. That this resolution shall be in force and take effect immediately upon its passage and adoption. As per your request, the following are the changes to your program to reflect the new contract amount. The following quantities and sizes of shells will be eliminated from the proposal which was previously submitted to you. (30)- 3"shells, (30)- 4" shells, (18)-5"shells, (18)- 6"shells, (3)- 8" shells, (3)- 10" shells, & (2)- 12" shells. No changes will be made to the Grand Finale. It is also understood and stated in the contract that if the display cannot be fired on December 31, 1999 due to inclement weather,then the display will be fired on January 1, 2000. Also please take note of the necessity for a$ 5,000.00 deposit due with the return of the signed contract as stated in the contract. If you have any questions please contact me immediately.
