RESOLUTION NO. 236-99
A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY MICHAEL MORRISON, OWNER OF
MORRISON BUILDERS, INC., FOR PROPERTY LOCATED
AT 2765 SW 36'" STREET(COLLINS RD), DANIA BEACH,
FLORIDA; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Michael Morrison, owner of Morrison Builders, Inc., has applied for site
plan approval for the construction of a lumber storage warehouse, for property located at
2765 SW 36"Street (Collins Rd.); and
WHEREAS, the Planning & Zoning Board on October 20, 1999, recommended that
the City Commission grant the site plan request (SP-70-99), based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-70-99)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A" is approved and it is
further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.

Section 2. That based upon criteria set forth in Section 84(p)of Article 1 of Chapter
8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall
automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon
its passage and adoption.

MEMORANDUM

RE: SP-70-99 Morrison Builders
Date: November 2, 1999
The applicant is requesting site plan approval for a lumber storage building on a portion
of the property owned by Morrrison Builders, Inc. located o 361h Street (Collins Road) and west of Southwest 261h n the north side of Southwest Terrace. Several months ago, the
Plan for the frontserve las the office for the business• The prev ousnsite plan included helffiirstt ing 155l feet If
depth of this parcel while the current site plan includes the next 175 feet of the property.
The total property depth is approximately 650 feet. The entire parcel is a part of what is
known as the Clem Plat (which is recorded in Plat Book 167, Page 15). The Clem Plat
is restricted to 1,746 square feet of office use, which will require the note to be amended
to allow for warehouse use. The proposed use of the property is consistent with the
land use and zoning for the property.
Recommendation: The site plan has been reviewed for conformity with the codes.
Staff recommended approval of the site plan to the Planning and Zoning Board subject
to the following:
1• That the note on the plat be amended and approved by the Dania Beach City
Commission and the Broward County Commission to allow warehouse use. The
applicant has applied for a delegation request to amend the plat note to
accommodate this use.
2• Expand the aisle opening for the parking area to twenty-four (24) feet. This has
been done; the aisle width is twenty-four(24) feet
3• Verify terminal island at ten (10) feet per Code. The applicant has verified this.
4. A perimeter hedge is required. The applicant has agreed to accommodate
this requirement.
5• Document the location of the required handicap space. A handicapped space
has been provided in the original portion of this project so this requirement
has been met.
6• Verify compliance of existing dumpster enclosure with City Code. The applicant
has shown that a dumpster has been provided as required.
7. The perimeter trees along the north property limits/site plan limits, are located off
site. Either extend the limit of the project line north to include the subject trees,

or relocate them within the limits of the project. The applicant has agreed to
meet this requirement.
The Planning and Zoning Board recommend that the City Commission approve the site plan
subject to the above conditions.
