HomeMy WebLinkAboutR-1999-233 A r '1 /r n> M1 f r -r b " RESOLUTION NO. 233-99 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY JEFF COLLIE, FOR PROPERTY LOCATED AT SOUTH DIXIE HWY.AND SW 14'"STREET; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Jeff Collie has applied for site plan approval for the proposed construction of a 2,368 sq. ft. retail building to be located on the west side of Dixie Hwy., and SW 14`h Street also known as lots 2 & 3, Block 2 of the Nassau Heights subdivision; and WHEREAS, the Planning&Zoning Board on June 16, 1999, recommended that the City Commission grant the site plan request(SP-24-99), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: 1 RESOLUTION NO. 233-99 a- L r, 7 I Section 1. That that certain application (SP-24-99)for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A", is approved with the following conditions (original Site Plan is maintained in the office of the Growth Management Department of the City of Dania Beach): a) Jeff Collie, petitioner, agrees to center the building on the property; b) Jeff Collie, petitioner, agrees to provide three (3) 96 gallon roll-out trash containers with housing block wall moved to accommodate the third container as shown on drawing; c) Jeff Collie, petitioner, agrees to plant four(4)trees on north side and one (1) tree on south side (total of five (5) trees) on the property with the understanding that the trees will be distributed symmetrically along the building; d) Jeff Collie, petitioner, agrees to grade the parking lot so that storm water will drain properly on both sides of the building. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Virta, AICP Growth Management Director RE: SP-24-99 Jeff Collie Site Plan Date: November 3, 1999 The site is located on the West Side of Dixie Highway near where SW 14th Street would intersect if it was extended across the FEC Railroad. The property to the rear of this site is currently vacant and at one time had been the intended location of a FP&L substation. The applicant is seeking approval to build a 2368 square foot retail building on a 7333 square foot site. The site now showsCity Code. The dumpster location has been identified and it does meet the double blind entrance specification of the City. The site plan also shows parking that meets the standards of the City Code. RECOMMENDATION Staff recommended approval of this site plan to the Planning and Zoning Board once the deficiencies noted in the previous comments were addressed. The Planning and Zoning Board in turn recommends that the City Commission approve this site plan. The City Commission continued this item so that the applicant and his architect could revisit the site plan particularly the dumpster placement. The applicant is now proposing that they utilize a roll out container similar to those used by homes and that the dumpster requirement be eliminated. The only problem with this approach would be that if such containers were not approved for commercial use a dumpster would ultimately have to be provided. if that should become the case the dumpster location/ problem will not have been previously resolved. Coincidentally if the site plan was approved as revised it would meet the now existing standard of having 30% of the site pervious. Blvd. Dania Beach, F1 33004 Ref: Petition SP-24-99 Lots 2 & 3/Block2 Nassua Heights Subdivision Dear Sirs: Since our last commision meeting, I have had discussions with Robert ( Bud) Palm, Public Works/Utilities Director, about trash service forour proposed building. Fie has stated to me that he, along with the city manager, have had discussions about changing the city' s policy for trash containers for small businesses and residential , the change would be to eliminate the standard trash dumpsters and enclosures, and use the stan- dard 94 gallon trash receptacles as used in other areas of the of The City of Dania Beach. Mr. Palm has stated that this policy has not been implemented as of this date, but expects it to be brought before the city for approval in the not too distant future. We would like to revise our proposed site plan to elim- inate the dumpster, dumpster enclosure and approximatly 800 sq.ft. of paving, which will be used for additional green space as shown.
