RESOLUTION NO. 210-99
A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING THE
SITE PLAN REQUEST SUBMITTED BY RAYMOND J. JONES, GENERAL
INDUSTRIAL AGENT FOR FLORIDA EAST COAST RAILWAY,CO.,OWNER(S)
FOR PROPERTY LOCATED ALONG SW 3RD AVENUE ON THE NORTHWEST
CORNER OF STIRLING RD., FORMERLY KNOWN AS J & L FEED STORE,
DANIA BEACH;PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Raymond J. Jones, General Industrial Agent for Florida East Coast
Railway, Co., owner(s), has applied for site plan approval for the proposed renovation of
property located along SW 3rd Avenue on the northwest corner of Stirling Rd., formerly
known as J & L Feed Store, Dania Beach; and
WHEREAS, the Planning &Zoning Board on August 18, 1999, recommended that
the City Commission grant the site plan request (SP-67-99), based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-67-99)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A", is approved and it is
further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.
Section 2. That petitioner, Raymond J. Jones, General Industrial Agent for Florida

East Coast Railway, Co., owner(s), agrees to the following conditions to the site plan
approval:
1) The inclusion of a dumpster detail on the site plan;
2) Demonstration of compliance with Sec. 26-44(c), native plant requirements:
3) Submission of a site lighting plan prior to building permit;
4) Demonstration of compliance with Sec. 26-53(c), tree size requirements;
5) Monument sign must meet Mainstreet requirements.
Section 3. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 4. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 5. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SP-67-99 Site Plan for FEC Railroad
Date: September 21, 1999
The applicant is requesting site plan approval associated with the renovation of the existing
12,000 +/- square foot building located at the northeast corner of Stirling Road and the East
Coast Rail Road. The applicant is not proposing any additional building square footage on the
spaces where site. The site plan as proposed requires a parking variance to allow twenty-two (22) parking
required parking ontsite. (Based onthe26) are e quare applicant

required, however, the applicant has provided five (5) loading spaces adjacent to the dock in the
rear of the building. In addition, the applicant has provided two (2) truck pick-up spaces on the
site.
The parking area on the site has been redesigned to maximize the available parking facilities
and provide sufficient loading spaces for the proposed use. The rectangular shape of the
Property and the existing improvements on the site create constraints that prevent full
compliance with the Code. Therefore, the applicant has demonstrated compliance with the
criteria for a variance. This is the minimum variance required for the proposed use.
The site has lost its non-conforming status by nature of not being used for over a year.
Therefore, any redevelopment of this site requires that it be fully brought up to current
standards. Full compliance with the City Code could create a financial burden for the property
and could preclude redevelopment of the site. The applicant is
make
improvements that will substantially upgrade the site. It has been the polcysofgthe City to
consider existing development constraints on properties that are being redeveloped.
Staff Recommends: approval of the subject site plan, and the parking variance subject to the
following conditions:
1. Inclusion of a dumpster detail on the site plan.
2. Demonstration of compliance with Section 26-44 (C), native plant requirements.
3. Submission of a site lighting plan prior to building permit.
4. Demonstration of compliance with Section 26-53(C), tree size requirements.
The Planning and Zoning Board concurs in this recommendation that the City Commission
approve this site plan subject to the above conditions. The City Commission continued this it

to the September 28. 1999 Meeting so that the applicants architect could be present.
Recommendation remains that the City Commission approve this project.
