RESOLUTION NO. 154-99
A RESOLUTION PERTAINING TO THE SUBJECT OF COMPREHENSIVE
PLANNING; APPROVING A PROPOSED AMENDMENT TO THE CITY OF
DANIA BEACH COMPREHENSIVE PLAN RELATING TO THE LOCATION
OF SCHOOL FACILITIES WITHIN THE CITY OF DANIA BEACH;
AUTHORIZING THE TRANSMITTAL OF SUCH AMENDMENT TO THE
APPROPRIATE GOVERNMENTAL AGENCIES; REQUESTING
INTERGOVERNMENTAL REVIEW OF SUCH PROPOSED
COMPREHENSIVE PLAN AMENDMENT; AUTHORIZING THE DIRECTOR
OF GROWTH MANAGEMENT TO PROCESS SUCH PROPOSED PLAN
AMENDMENTS; AND PROVIDING AN EFFECTIVE DATE THEREFOR.
WHEREAS, the City of Dania Beach, pursuant to the Local Government
Comprehensive Planning and Land Development Regulation Act, and in accordance with
all of its terms and provisions, has prepared and adopted a Comprehensive Plan; and
WHEREAS, the City of Dania Beach Comprehensive Plan has been found in
compliance by the Florida Department of Community Affairs; and
WHEREAS, the City of Dania Beach Comprehensive Plan has been certified by the
Broward County Planning Council as being consistent with the Broward County
Comprehensive Plan; and
WHEREAS, the City Growth Management Department has prepared a proposed
amendment to the Comprehensive Plan; and
WHEREAS, the draft, proposed amendment relates to the location of school
facilities within the City of Dania Beach; and
WHEREAS, the City Planning and Zoning Board, which is the designated city local
planning agency, has held an advertised public hearing on the proposed amendment and
has approved same; and
WHEREAS, the City Commission of the City of Dania Beach has, as the governing
body of Dania Beach, held an advertised public hearing pursuant to Section 163.3184(3)(a)
to consider the proposed amendment; and
WHEREAS, the City of Dania Beach governing body finds and determines that the
proposed amendment is internally consistent with the City of Dania Beach Comprehensive
Plan, and is beneficial and desirable to serve the public health, safety and welfare and
therefore approves same as a proposed plan amendment; and

WHEREAS, the City of Dania Beach governing body now wishes to transmit the
proposed plan amendment to the appropriate regulatory agencies for requested
intergovernmental review;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA, THAT:
Section 1. The foregoing recitals are approved and are incorporated by reference.
Section 2. The draft proposed comprehensive plan amendment attached as Exhibit
"A" is approved. The Director of Growth Management is authorized to take the necessary
steps to allow for the transmittal of the proposed comprehensive plan amendment to the
State Land Planning Agency, the Florida Department of Community Affairs, the South
Florida Regional Planning Council, the South Florida Water Management District, the
Florida Department of Transportation, the Broward County Planning Council, and to such
other regulatory agencies as deemed appropriate by the Director of Growth Management.
Section 3. The City of Dania Beach requests intergovernmental review of the
proposed comprehensive plan amendment.
Section 4. The Director of Growth Management is authorized to take all actions
needed to process the Exhibit "A" proposed plan amendment through the required
governmental and agency reviews with the object that same be appropriately and duly
incorporated into the Dania Beach Comprehensive Plan after all required, advertised
hearings.
Section 5. This Resolution shall become effective up%i adoption by the City of
Dania Beach after passage by the City Commissio

Policv 3.6 Dania Beach shall continue to Permit public schools (defined for the
purposed of the land use element to mean public schools K through 12)
which are classified by this Plan as a tvpe of community facility in the
following land uses categories:
a. Residential
b. Community Facilities
Policv 3.7 Dania Beach will utilize the following Broward Countv School Board land
area guidelines for individual school facilities
a. elementary school: 12 acres
b. middle school: 20 acres
c, high school: 45 acres
Policv 3.8: Collocation of Public schools with other community facilities will be
considered when:
a. New or replacement schools are funded in the School Board's Capital
Budget and are adjacent to other existing public facilities;
b. New facilities are funded in the Citv's Capital Improvement Element
and can be located adjacent to Public schools: and/or
c. Joint use projects are created and implemented
Policv 3.9 Dania Beach will encourage the collocation of public facilities such as
libraries, parks and community centers with public schools to the extent
practical and financially feasible The following criteria shall be
considered for collocating public schools and Public facilities
a. Availability of vacant land of suitable size and dimensions for the
collocated Public uses:
b. Compatibility of the collocated public uses with the adiacent land uses
(ex: noise, odors, glare debris dust traffic high voltage transmission
Imes. etc ) and the compatibility of the collocated Public uses' future
land use desianation(s) with the future land use designations of
adjacent areas:

c. Availability of infrastructure Public services (ie roadways public
transit, notable water, sanitary sewer drainage and aquifer rechar e)
and utilities(electricity. Vas etc.);
d. Environmental limitations (ie• wetlands uplands soil conditions
contaminated sites- Potential brownfield sites etc )-
e. Access approaches including roadways public transit bikeways
recreational trails and pedestrianways;
f. Proximity to residential areas. Particularly urban residential areas and
areas of very low, low and moderate income housing; and
g. Demographic base for purposes of encouraging diversity.
Policy 3.10 Dania Beach shall incorporate provisions in the Land Development Code
requiring new nonresidential development located adiacent to an existing
or planned public school site, to incomorate features such as walls solid
hedges or increased setbacks where such use would be incompatible with
the public school.
Policv 3.11 Dania Beach shall incorporate Provisions in the Land Development Code
which provide for safe pedestrian and bic cle access to schools. y
Policy 3.12 Dania Beach shall_utilize the Technical Advisory Committee meetin s as
the mechanism for coordinating the school collocation planning process
with the Broward County School Board

RE: School Facilities Comprehensive Plan Amendment
Date: July 21, 1999
Section 163.3177(6)(a), Florida Statutes was amended in 1995 to require that local
government comprehensive plans be amended to include provisions addressing land
use issues related to future public school facilities needs. Section 163.3177(6)(a),
Florida Statutes was amended further in 1998 to require that local governments amend
their Comprehensive Plan to include the following:
• Identification of those future land use map designations that allow
public school facilities;
• Criteria that encourage the location of schools in close proximity to
residential areas and,
Policies related to collocation of schools with other public facilities
such as parks, libraries and community centers
The above referenced items must be included in the local government Comprehensive
Plans by October 1999 or the City will be prohibited from amending the Comprehensive
Plan until the requirements are met.
We have received correspondence from the Florida Department of Community Affairs
(DCA) indicating that the City Comprehensive Plan does not comply with the current
requirements in Section 163.3177(6)(a), Florida Statutes (See Attachment A).
Therefore, we propose that the City Commission amend the Comprehensive Plan to
include the changes identified in Attachment B. The City Attorney has proposed two
options for these changes. One alternative has a lesser number of land uses where
public schools would be permitted. This more conservative option does not match the
language proposed by the County.
These changes must be adopted separate from the EAR based amendments in order to
ensure compliance with the October 1, 1999 deadline. DCA representatives have
reviewed the revisions proposed in Attachment B and based on their preliminary review,
we believe that these changes will be acceptable to DCA.

School Facilities Comprehensive Plan Amendment
For your information, we have also provided excerpts from the land use plan map
identifying the existing school sites in the City of Dania Beach. See Attachments C, D
and E.
At the Commission's last meeting this item was continued over a question as to what
met the definition of a public school. A definition has been added to the proposed
revisions that would limit public schools to K-12 grades. It is believed that with this
definition the concerns of the Commission will have been met.

The Department has reviewed the letter from Leigh Robinson Kerr and Associates dated April 27,
1999,which provided verification information of the City's compliance with the school siting analysis
required by Section 163.3177(6)(a),Florida Statutes. 'Me information included in the letter verifies the
City meets all of the school siting analysis criteria except for collocation with libraries,parks and Nana
community centers.
The collocation of libranes,parks and community centers with future school sites will help provide
for compact and efficient public amenities areas. A technical memo,prepared by the Department,which
will help the City develop Future Land Use Element collocation policies was sent to the City's consultant
Leigh Robinson Kett and Associates earlier this month. The Department encourages the City to submit the
collocation policies as soon as possible. If the amendment is not adopted and effective by October 1, 1999,
no further amendments may be adopted,as provided by Section 163.3187(6), F.S., until the school siting
requirements(including collocation)are adopted and effective.

A Public Hearing will be conducted by the City Commission relating to the transmittal of an
amendment to the City of Dania Beach's Comprehensive Land Use Plan to the State of
Florida, Department of Community Affairs. The amendment relates to the location of school
facilities within the City of Dania Beach and reads as follows:
