HomeMy WebLinkAboutR-1999-134 r, r 7 F � ..� .f �, .. �'=. r r 'i RESOLUTION NO. 134-99 A RESOLUTION APPROVING THE VARIANCE REQUEST SUBMITTED BY REDAN INTERNATIONAL, INC., FROM CHAPTER 26 VEGETATION, ARTICLE IV, LANDSCAPING, FOR PROPERTY LOCATED AT 202 SE 15TH ST., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 26 Vegetation,Article IV, sets the landscaping requirements for the City of Dania Beach; and WHEREAS, Redan international, Inc. applied for a variance (VA-33-99)to allow for the 5 foot buffering requirements to be reduced to 4 feet for property located at 202 SE 15'"Street, Dania Beach; and WHEREAS, the Planning &Zoning Board on June 16, 1999, recommended that the City Commission grant variance request VA-33-99 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-33-99, for a variance as described above (from requirements in Chapter 26, Vegetation), a copy of which is attached as Exhibit"A"is approved and the appropriate city officials are directed to execute same. Section 2 . That on July 13, 1999, the City Commission approved VA-33-99 from Chapter 28, Zoning, Article 4, "Schedule of Lot, Yard and Bulk Regulations"with an adjustment to the 10, rear setback requirement by allowing the petitioner to utilize an 8' rear setback in order to accommodate a six(6)foot landscape buffer and 4 additional Palm trees in the front of building. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. That this resolution shall be in force and take effect immediately upon its passage and adoption. Virta, AICP Growth Management Director RE: VA-33-99 Variance Request— Redan International SP-34-99 Site Plan Approval— Redan International Date: July 6, 1999 The applicant is seeking to build 5250 square feet of office on a site that is 17,830 square feet in area. In order to do this the applicant is seeking a variance to the City's landscaping requirements. The first of these is that he be allowed to provide a four foot landscape buffer along Sheridan Street when the code requires that there be five feet. On the whole the project appears as if it would be an admirable addition to the City. The building is intended to have five individual bays for professional offices and/or light retail uses. The building elevation indicates it will, if approved, have stucco walls and a pitched barrel tiled roof. The landscaping materials indicated on the plan do meet code. The code provides that if palm trees are to be utilized that they can represent no more than 20 percent of the total number of trees. Earlier plans, as submitted, indicated that palms would represent 64 percent of the total. The plans have subsequently been revised to better reflect the requirements of the landscape code. RECOMMENDATION The Planning and Zoning Board recommends to the City Commission that the variance as requested be approved. The Planning and Zoning Board also recommends that the City Commission approve the Site Plan as submitted. Staff felt that the applicant had not shown any grounds for hardship. The site is currently cleared and development can take place without any site constraint other than its overall area. Staff believes that there is not be any reason why a project such as this cannot be put forth in a manner that would bring it into full compliance with City requirements. Again. the Planning and Zoning Board is recommending that the project be approved as submitted. f
