(NOW S.W. 3RD AVENUE) BEING ADJACENT TO LOT 25 , BLOCK 3 , OF "WOODHAVEN AMENDED" , AS RECORDED IN PLAT BOOK 10 , PAGE 56 , OF THE PUBLIC RECORDS OF BROWARD COUNTY , FLORIDA, LYING BETWEEN THE WESTERLY EXTENSION OF THE NORTH AND SOUTH LINE OF SAID LOT 25 . SAID LANDS SITU- ATE , LYING AND BEING IN THE CITY OF DANIA, BROWARD COUNTY, FLORIDA; AND PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PRO- VIDING FOR AN EFFECTIVE DATE. WHEREAS , Section 3, Article 3 , Part IX, as amended , of the Charter of the City of Dania , sets forth the procedure for va- cating and abandoning streets , alleys or other property dedicated to the public use ; and WHEREAS , D. Wynn Kenyon and Sheri Lynn Kenyon duly petitioned the City Commission, City of Dania , Florida , for the vacation of certain easement legally described as follows: THAT PORTION OF EATON ST. (NOW S .W. 3RD AVENUE) BEING ADJACENT TO LOT 25 , BLOCK 3 , OF "WOODHAVEN AMENDED" , AS RECORDED IN PLAT BOOK 10 , PAGE 56 , ,. OF THE PUBLIC RECORDS OF BROWARD COUNTY , FLORIDA, LYING BETWEEN THE WESTERLY EXTENSION OF THE NORTH AND SOUTH LINE OF SAID LOT 25. SAID LANDS SITU- ATE, LYING AND BEING IN THE CITY OF DANIA, BROWARD COUNTY, FLORIDA WHEREAS, the City Commission referred said petition to the City Planning and Zoning Board for its recommendation; and WHEREAS, at the meeting of the Planning and Zoning Board held on the 5th day of July 1988 , the Planning r and Zoning Board unanimously voted to recommend that the said easement b,- vacated and abandoned; and WHEREAS , after publication of notice as required by Section 3, Article 3, Part IX of the Charter of the City of Dania , a public hearing was held before the City Commission at its regular meeting held on the 26th day of Jules„lam, 1988 . NOW, THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That the City Commission of the City of Dania, Florida , does hereby vacate , abandon, renounce and disclaim all I J Resolution No. 29-88 3 i i F f- -1 td 1 1� of the right, title and interest of the City of Dania in and to i the following easement , to-wit: THAT PORTION OF EATON ST. (NOW S.W. 3RD AVENUE) BEING ADJACENT TO LOT 25 , BLOCK 3 , OF "WOODHAVEN AMENDED" , AS RECORDED IN PLAT BOOK 10, PAGE 56 , OF THE PUBLIC RECORDS OF BROWARD COUNTY , FLORIDA, LYING BETWEEN THE WESTERLY EXTENSION OF THE NORTH AND SOUTH LINE OF SAID LOT 25 . SAID LANDS SITU- ATE , LYING AND BEING IN THE CITY OF DANIA, BROWARD COUNTY, FLORIDA Section 2. That the City Commission does hereby find and determine that the procedure for the vacation and abandonment of the subject easement has been in strict conformity with the re- quirements of Section 3 , Article 3 , Part IX of the Charter of the City of Dania . Section 3 . That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the ex- tent of such conflict . Section 4 . That this resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on this 26th day of July 1988 .
