HomeMy WebLinkAboutR-1986-059 a RESOLUTION NO. 59-86 i A RESOLUTION OF THE CITY OF DANIA, FLORIDA, REQUESTING THE DEPARTMENT OF COMMUNITY AFFAIRS OF THE STATE OF FLORIDA, TO INCLUDE, THE CITY OF DANIA'S APPLICATION AMONG THOSE REQUESTING FINANCIAL ASSISTANCE FROM THE LOCAL GOVERNMENT COMPREHENSIVE PLANNING ACT ASSISTANCE FUND PROGRAM FOR THE 1986-1987 PROGRAM YEAR; AND PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING FOR AN EFFECTIVE DATE . WHEREAS , the City Commission of the City of Dania, Florida , has recognized a need to provide for orderly growth and management as contemplated by the passage of the Florida Local Government Comprehensive Planning Act; and WHEREAS , the State of Florida has recognized a need to assist local governments in meeting the requirements of the Act; and WHEREAS , the Florida Legislature has charged the Department of Community Affairs with administering the Local Government ► Comprehensive Planning Assistance Fund Program. i NOW, THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1 . That the City Commission of the City of Dania, Florida, requests the Department of Community Affairs to include the application of the City of Dania, Florida, among those requesting financial assistance from the Local Government Comprehensive Planning Act Assistance Fund Program for the 1986-1987 year. Section 2 . That the City Commission of the City of Dania, Florida, does hereby indicate its commitment to comply with the appropriate and applicable state and local laws, rules and regulations for the administration of this program, which are more fully described in Chapter 9J-5 , Florida Administrative Code. Section 3 . That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict . J { j Section 4 . EARLY SUBMISSION (1) A county and all of the municipalities within that county may submit their plans to the Department for a compliance review earlier than the dates pursuant to 5. 163. 3167 (2) (a) and (b) if they comply with the following requirements: (a) A local government may not submit its revised comprehensive plan to the Department for a compliance review until the regional planning council, in whose area the local government falls, has adopted a comprehensive regional policy plan, which shall be no sooner than July 1, 1987. 2 Form NO: RPM/LRP(9/86 ) (b) The request for early submission must be made in writing. Fore example governmnts ofttheclounty ocal governments in Dade County are scheduled in 9J-12 . 006 to submit their plans over two months, July and August, 1988; therefore, if the local governments in Dade County request an early submission, the request must include a priority rank list of three groups of two consecutive months each. .—k (2) The Department shall try to allow early submission on one of the priority dates requested by the local governments. However, no more than 12 plans will be scheduled in a single month unless all plans are from the same county in which case 15 may be scheduled. Requests will be handled on a first come first serve basis. The Department shall respond in writing to requests for early submissions within 15 working days of receipt of the request by the Chief, Bureau of Local Resource Planning. This written response shall approve the early submission date or propose alternate dates in the event the originally requested dates are unavailable. (3) Should a local government rescind the resolution specified in paragraphs (1) (c) and (d) above, the local government must give notice to the Department and all other local governments in the county at least three months prior to the approved early submission date. Upon notice to the Department, the submission date of all local governments in the county shall revert to the dates pursuant to s. 163 . 3167 (2) (a) and (b) .
