BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That certain Utility Relocation Agreement by and between the CITY OF DANIA, a Florida municipal corporation, 1 and the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, identified as County 86 , Section 095 , Utility Job No . 6408 , State Road No. 862 , County Name , Broward, and FAP No. EACI-595-1 (254) 24 , a true photo- copy of which is attached hereto as Exhibit "A", be and the same is hereby accepted and approved; and the Mayor-Commissioner, City i Manager and City Clerk-Auditor be and they are hereby directed to iexecute same on behalf of the City. Section 2. That all resolutions or parts of resolutions .. v in conflict herewith are hereby repealed to the extent of such conflict . Section 3. Public Law 627 of the 84th Congress, designated by the DEPARTMENT as Job No. 560 t_5_E 0 fill Road No. 862 Frcm Dania Cutoff Canal i'u Nir mi Road which shall call for the relocation of the CONIPAN}'•S facilities along, over, and/or under said highway, AND 11'}IEREAS, the plans for the said construction, reconstuuctior or other changes to be made, as ahme de4cribed. have been reviewed by the DEPARTMENT and the COMPANY. said above described utilirh relocation to hereinafter be designated as "Relocation Work," AND WHEREAS, the term "cost of relocation" shall include the entire amount paid h%- the COhJPANY properh attributable to such relocation after deducting therefrom any increase in the value of the new facility and any sal\age value of materials recovered from the old facilit . NOW. THEREFORE, in consideration of the mutual undertaking as herein set forth, the parities hereto aorec as folJovs: 1. The COMPANY hereby agrees to relocate the necessary parts of its facilities along said Road in accordance Mth the provisions set forth in the United States Department of Transportation Federal Aid MOB%3) Program Manual Volume 1. Chapter 4, Section 4, dated June 29, 1973, and any supplements or revisions thereof, which. Ly reference hereto, are made a part hereof. The COMPANY further agrees to do all of surh work with its own forces or by a contractor paid wider a contract let by the COMPANY, all under the supcnision and approval of the DEPARTMENT and the Federal Highway Administration. The COMPANY further agrees to fully comply with the provisions of Title VI of the Civil Rights Act of 1964 in connection with the "Relocation It covered by this agreement, and such compliance will be I governed by the method checked and described hereafter: i may_ (a) The COMPANY will perform all or part of such "Relocation Work" by a Contractor paid under a contract let by the COMPANY, and the Appendix "A"of.Assurances attached to this agreement will be included in said contract let by the COMPANY. (b) The COMPANY Hill perform all of such "Relocation Work" entirely with COMPANY'S forces, and Appendix "A" of Assurances is not required. (c) The "Relocation Work' involved is agreed to by way of just compensation for the taking of COMPANY'S facilities located on right of way in which the COMPANY holds a compensable interest, and Appendix "A"of Assurances is not required. i (d) The COMPANY will perform all such "Relocation Work"entirely by continuing contract, which contract to perform all future "Relocation Work" was executed with COMPANY'S Contractor prior to .August 3, 1965, and Appendix "A"of Assurances is not required. .A j 3. The DEPARTMENT hereby agrees to reimburse the C0MPANY for all costs incurred by it in the relocation of said facilities, in accordance with the provisions of said Federal Aid Ilighwav Program Manual Volume 1, Chapter 4, Section 4,and any supplements or revisions thereof. It is understood and agreed by and between the parties that preliminary engineerin',, costs not incorporated within this agreement shall not be subj,,rt to payment by the DEPARTMENT. 4. Attached hereto, and by reference made a part hereof, are plans and specifications of the work to be performed by the COMPANY pursuant to the terms hereof, and an estimate of the cost thereof in the amount of S 70,050.00 • All work performed by the COMPANY pursuant hereto, shall be performed according to these plans and specifications as approved by the DEPARTMENT and the Federal Highway Administration, and all subsequent plan changes shall likewise be approved by the DEPARTMENT and the Federal Highway Administration. All "Relocation Work" covering facilities to be relocated to a position within the highway right of way will be accommodated in accordance with the provisions of Federal Aid Highway Program Manual Volume 6, Chapter 6. Section 3, dated November 29, 1972, and any supplements thereto or revisions thereof. 5. All labor. scnices, materials and equipment furnished by the COMPANY in carving out the work to 1w performed hereunder shall he billed by the t:OMI'ANY direct to the DEPARTMENT. It is specifically agreed by and between the DEPARTMENT and the COMPANY that the DEPARTMENT shall receive fair and adequate credit for any salvage which shall accrue to the COMPANY as a result of the aliwe n•loration work. 11. It is further agreed that the cost of all improvements made during this relocation work shall be borne by the COMPANY, subject onlc to the DEPARTMENT bearing such portion of this cost as represents the cost of relocation of previously existing facility,less salvage credit as set forth in the immediately preceding paragraph. 12. Upon completion of the work the COMPANY shall, at the earliest date practicable, and in no event later than one hundred eighh (180) days following the date of completion of the "Relocation Fork" by the CO11PAM . furnish the DEPARTMENT with two (2) copies of its final and complete billing of all costs irxurred in connection with the work performed hereunder, such statement to follow as closely as possible lire order of the items contained in the estimate attached hereto.
