RESOLUTION NO. 27-84
AN AMENDMENT TO THE RESOLUTION OF THE CITY
OF DANIA, FLORIDA, WHICH APPROVED THE FORT
LAUDERDALE - HOLLYWOOD INTERNATIONAL AIR-
PORT EXPANSION PROJECT DEVELOPMENT OF
REGIONAL IMPACT AND DEVELOPMENT ORDER; PRO-
VIDING FOR CHANGES OF CERTAIN CONDITIONS
SET FORTH IN SAID RESOLUTION; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Dania, Florida ,
approved the Fort Lauderdale-Hollywood International Airport
jExpansion Project Development of Regional Impact , hereinafter re-
ferred to as "Project , " and issued a Development Order for the
Project by Resolution No. 449 dated March 9 , 1982 ; and
WHEREAS , said Development Order incorporated a legal descrip-
tion and drawing depicting the area and features of the Project , and
incorporated by reference the Master Development Plan -- Airport
" Site and the Master Development Plan -- Terminal Area, which were

included in the Application for Development Approval ; and
WHEREAS, on November 30 , 1982 , the Board of County Commissioners
of Broward County , Florida, approved a revised design modifying the
Master Development Plan -- Airport Site and the Master Development
Plan -- Terminal Area; and

WHEREAS , the approval of the revised design for the Project

and the subsequent platting of portions of the Project area, has
necessitated an updated legal description and has necessitated the
deletion of the drawing previously incorporated in the existing
Development Order; and
WHEREAS, the revised design of the Project has additionally
created the need to make minor changes with respect to certain con-
ditions set forth in the Development Order; and
� WHEREAS, the City Commission of the City of Dania, Florida,
has determined pursuant to Section 380 . 17 , Florida Statutes , that
the changes set forth herein are not substantial deviations requiring
further review;
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA: I

Section 1. That Resolution No. 449 of the City Commission
of the City of Dania, Florida, adopted on March 9 , 1982 , approving
the Fort Lauderdale-Hollywood International Airport Expansion I
Project of Regional Impact and issuing a Development Order , is
hereby amended by the deletion of the existing drawing depicting

the area and features of the Project , and by the substitution of
an updated legal description, attached hereto and incorporated
herein as Exhibit "A" , the substitution of the Modified Master
Development Plan -- Airport Site, attached hereto and incorporated
herein as Exhibit "B" , and the substitution of Modified

Development Plan -- Terminal Area, attached hereto and incorporated t
herein as Exhibit "C".

1 Section 2. Section 2 of the Resolution of the City commis-
sion of the City of Dania, Florida , adopted on March 9, 1982 ,

approving the Fort Lauderdale-Hollywood International Airport

Expansion Project Development of Regional Impact and issuing a
Development Order, is amended as follows :
14. Applicant shall, subject to Florida Department of Trans-
portation and local government approval , implement, using airport
or other County revenue, those improvements to the SR 84/US 441
intersection graphically displayed on Page 39 of the Council DRI
Assessment , except for improvement #6 which provides for the widening
of the eastbound right turn lane and increasing the storage length
of the lane , within three years of the date of issuance of the
Development Order for the airport project .
15 . Applicant shall , subject to Florida Department of Trans-
portation and local government approval , construct a computerized
signal system along U. S. 1, south of the airport entrance, into
Hollywood, as described on page 41 of the Council DRI Assessment ,
as per FDOT programmed improvements which will increase the road
capacity and enhance the traffic flow in the area. The FDOT pro-
grammed improvements also include the resurfacing and the remarking
Of U.S. 1 in this area. The applicant and/or the County will com-
plete these improvements prior to or concurrent with the completion

� of relocated U. S . 1.
17. Applicant shall, subject to Florida Department of
Transportation and local government approval , implement , using
Airport or other County revenue, those improvements to the inter-
section of U.S . 1 and Southeast 17th Street/SR A-1-A displayed on
J page 44 of the Council DRI Assessment , except for improvements #5
and #6 . Improvement #5 refers to widening the westbound left turn
and increasing the storage length and improvement #6 refers to
widening the eastbound left turn and increasing the storage length.
The improvements shall be implemented within three years of the date
of issuance of the Development Order, except for improvement #3
which shall be implemented within four years of the date of issuance
of the Development Order.
24 . The Application for Development Approval , as revised
pursuant to Condition 25 , and as otherwise revised herein, is in-
corporated by reference into the Development Order for the Airport
as follows : ► ti
"The Application for Development Approval
is incorporated herein by reference and
relied upon by the parties in discharging
their statutory duties under Chapter 380 ,
Florida Statutes. Substantial compliance
with the representations contained in the
Application for Development Approval is a
condition for approval unless waived or
modified by agreement among the parties . "
25. Applicant shall consolidate all original and supplemental
information submitted to the Council into a revised Application for
Development Approval and submit the document to the Council , the
State land planning agency, the cities of Dania and Fort Lauderdale ,
and the Broward County Commission within 90 days from the date of
issuance of the Development Order.
26. The Development Order shall be null and void if sub-
stantial development of the Project is not completed within two (2)
years from the date of issuance of the Development Order. Substantial
development will be defined as : conduct and submittal of a new air
quality impact study and recommended mitigation measures to the

Br ow and County Environmental Quality Control Board (BCEQCB) and
the Council; submittal of an analysis and recommended improvements
to the Griffin Road-loth Street/U. S. 1 corridor to the Council;
and substantial completion of all stage 1 development activities .
i 27 . Applicant shall with regard to the City of Dania ' s loss
i
of revenue attributable to the airport expansion, support annexa-
tion of unincorporated land to the City of Dania sufficient to
offset such loss of revenue.
28 . Applicant shall through its County Administrator submit
I
an annual report as prescribed in Section 380 . 06 , Florida Statutes ,
,
to the official charged with monitoring compliance with the Develop-
j ment Order and each twelve (12) months thereafter until the project
is completed. Copies of the annual report shall be sent to the
South Florida Regional Planning Council and the Department of
Community Affairs , Division of Local Resource Management.
Section 3. If any section, sentence , clause or phrase of this
Resolution is held to be invalid or unconstitutional by any Court of
competent jurisdiction, then said holding shall in no way affect the
validity of the remaining portions of this Resolution.
Section 4. That all resolutions or parts of resolutions
in conflict herewith be and the same are hereby repealed to the
.. extent of such conflict .
Section 5 . That this resolution shall be in force and take
effect immediately upon its passage and adoption.
