HomeMy WebLinkAboutO-1998-022 ORDINANCE NO. 22-98 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING SECTION 18-29.2(b)(1), 18- 29.6(a)(1) AND 18-29.6(a)(4) OF ARTICLE III OF CHAPTER 18 OF THE CODE OF ORDINANCES, PROVIDING FOR AN INCREASE IN THE AMOUNT OF THE, MONTHLY RETIREMENT BENEFITS FOR GENERAL EMPLOYEES; PROVIDING FOR A CHANGE IN THE AMOUNT OF MEMBER CONTRIBUTIONS REQUIRED TO FUND SUCH INCREASE; PROVIDING FOR THE CITY'S "PICK UP" OF A PERCENTAGE OF MEMBER CONTRIBUTIONS; PROVIDING FOR A REPEALER; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach and the labor organization representing the city's general employees have agreed in their recently ratified collective bargaining agreement to certain improved retirement benefits,and WHEREAS, the City Commission has received and reviewed the actuarial impact statement concerning this benefit improvement prepared by the Retirement System's actuary, and WHEREAS, the proposed benefit has been approved and recommended by the Retirement System's Board of Trustees, and NOW, THEREFORE, be it ordained by the City Commission of the City of Dania Beach, Florida as follows: Section 1. That Section 18-29.2(b)(l) of Chapter 18 of the Code of Ordinances of the City of Dania Beach, Florida be and the same is hereby amended to add thereto the following underlined language: (b) Normal retirement heneftt. (1) For those who were not members of the prior plan: (a) Amount. "file monthly retirement benefit shall be an amount determined as follows: T,,vo and one-half percent (21/2%) of average monthly earnings times Credited service For members who retire on or after January 1 1999 the month retirement benefit shall be an amount determined as follows: 1 ORDINANCE:NO, 22-98 _l Three percent (3%) of average monthly earnings tiles Credited service Section 2. That Section 18-29.6(a)(1) of Chapter 18 of the Code of Ordinances of the City of Dania Beach, Florida be and the same is hereby amended to add thereto the following underlined language: (a) Member contributions. (1) Amount: Members of the retirement plan shall make regular contributions at a rate of eleven and sixty-six one hundred percent (11.66%) of earnings. Effective October 1 1999 members shall regularly contribute an additional eight and eight one-hundreds percent (8 08%) for a total rate of nineteen and seventy-four one-hundreds percent (19.74%) of earnings to the retirement plan. Member contributions shall be deposited in the fund on at least a monthly basis. Section 3. That Section 18-29.6(a)(4) of Chapter 18 of the Code of Ordinances of the City of Dania Beach, Florida be and the same is hereby amended to add thereto the following underlined language: (4) Duration: Contributions shall be deducted from said earnings before the same are paid and together with those member contributions which are "picked up" and paid by the city, shall continue until the member has reached his actual retirement date or his termination date whichever occurs first. Effective as of October 1, 1996, three and sixty-six one hundred percent (3.66%) of the member's earnings shall be deducted from the member's earnings. The remaining eight percent (8%) of member's earnings shall be paid and assumed by the city as member contributions, as the result of afive-percent (5%) reduction of each members earnings as of October I, 1987, together with a three percent (3%) reduction of each member's earnings which is scheduled to effective as of October 1, 1996. These reductions of member earnings were implemented in lieu of a five percent (5%) wage increase which was scheduled to become effective as of October 1, 1987, and in lieu of a three percent (3%) wage increase which is scheduled to become effective as of October 1, 1996. Effective October 1, 1999 an additional eight and eight one-hundreds percent (8.08%) of the member's earnings, for a total of sixteen and eight one-hundreds of each member's earnings, shall be paid and assumed by the city as member contributions, as the result of a eight and eight one-hundreds percent (8.08%) reduction of each member's earnings. This reduction of member earnings was implemented in lieu of an eight and eight one-hundreds percent (8.09%) wage increase. No member subject to such agreement shall have the option of choosing to receive the contributed amounts directly instead of having them paid by the city directly to the plan. All such member contributions by the city shall be deemed and considered as part of the member's accumulated contributions and subject to all provisions of this plan pertaining to accumulated contributions of members. The intent of this language is to comply with section 414(h)(2) of the Internal Revenue Code. 2 ORDINANCE NO. 22-98 i y I Section 4. That all sections or parts of sections of the Code of Ordinances, all ordinances or parts of ordinances, all charter sections or parts of sections, and all resolutions or parts of resolutions in conflict herewith, be and the same are hereby repealed to the extent of such conflict. Section 5. If any word, phrase, clause, subsection or section of this ordinance is for any reason held unconstitutional or invalid, the invalidity thereof shall not effect the validity of any remaining portions of this ordinance. Section 6. Codification of this ordinance in the City Code of Ordinances is hereby authorized and directed. Section 7. The provisions ofthis ordinance shall take effect immediately upon its final passage and adoption. PASSED AND ADOPTED on first reading this 24"' day of November, 1998. The City shall contribute 5% of the members' base pay to the General Employees Retirement Plan which shall be in lieu of their wage increase for 1987-1988, and shall offset the employees' current contribution rate. This five percent (5%) shall be paid directly (plus accrued interest) to members upon termination of employment unless said termination is due to retirement or the member has vested rights in the pension plan and elects to leave his/her funds in the plan until he/she is eligible to select a retirement option. A drop plan will be effective October 1, 1994. A. Effective October 1, 1995, employees will receive a 2.5% benefit accrual rate for all service. The City will contribute not more than 3% toward this benefit October 1, 1996. If additional amounts are required these shall be paid by the employees through payroll deduction. B. Employees will be permitted to buy back previous years of service with the City on terms worked out by the City and the Union. Employee shall bear all cost related to this item. C. Employees will also be permitted to buy back up to four years of time served in the armed services of the United States. Employee shall bear all cost related to this item. Lbe January 1, 1999, employees will receive a 3.0% fixed benefit accrual l service.
