HomeMy WebLinkAboutO-1998-021 i ORDINANCE NO. 21-98 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING ARTICLE IV OF CHAPTER 18 OF THE CODE OF ORDINANCES, PROVIDING IN SECTION 18-40(10) AN INCREASE OF THE MAXIMUM RETIREMENT BENEFIT BY TEN PERCENT; PROVIDING IN SECTION 18-42(2)(b) AN INCREASE IN THE MONTHLY RETIREMENT BENEFIT FOR MEMBERS RETIRING ON OR AFTER 1/1/99 BY ONE PERCENT FOR THE 16"' THROUGH 2511' YEARS OF SERVICE AND INCREASING THE MAXIMUM BENEFIT BY TEN PERCENT; PROVIDING IN SECTION 18-42(9) FOR FUTURE BENEFIT RESERVE AND HEALTH INSURANCE SUBSIDY; PROVIDING IN SECTION 18-43(b) SPECIFIC LIMITATIONS ON PARTICIPATION IN THE D.R.O.P. PLAN; PROVIDING IN SECTION 18-44(1)(a) THAT EMPLOYEE CONTRIBUTIONS PICKED UP BY THE CITY SHALL BE CONSIDERED AS EARNINGS FOR CALCULATING AVERAGE MONTHLY EARNINGS; PROVIDING IN SECTION 18-44(1)(c)THAT AN INCREASE IN THE MAXIMUM ACCRUED BENEFIT LEVEL SHALL BE TEN PERCENT; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR A REPEALER; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach and Metro-Broward Professional Fire Fighters, Local 3080 have agreed in their recently ratified collective bargaining agreement for modified retirement benefits for those firefighters covered by the City of Dania Beach Police & Firefighters Retirement system,and WHEREAS, the City Commission has received and reviewed the actuarial impact statement concerning these benefit adjustments prepared by the Retirement System's actuary; and WHEREAS the proposed benefit has been approved and recommended by the Retirement systcm's Board of Trustees; ORDINANCE NO. 21-98 I NOW,THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE } CITY OF DANIA BEACH, FLORIDA, AS FOLLOWS: Section 1. Section 18-42 of the Dania Beach Code is hereby amended by adding the following subsection (9): (9) Future Benefit Reserve and Health Insurance Subsidy. All firefighter retirees and firefighter survivors receiving benefits shall be eligible for an annual health insurance subsidy computed as follows. Seventy-five percent (75%) of tlhe prior year's actuarial gain allocable to firefighters, firefighter retirees and firefighter survivors remaining after the application of Section 18-42(6)(a) plus seventy-five percent (75%) of any increase in the percentage of covered payroll received by the City pursuant to Section 175.121, Florida Statutes, over the amount received by the City in 1997 shall be defined as the "available actuarial gain". The available actuarial gain for a fiscal year shall be calculated by the following June first and shall be paid in the following October to the City of Dania Beach to be utilized per capita to subsidize up to one year's payments for retiree health insurance due from each firefighter retiree and firefighter survivor who receives benefits from the System, which payments shall be one-third of the premium cost for such insurance. Should the available actuarial gain not be fully expended by this health insurance subsidy, then the balance of actuarial gain shall be paid to the City of Dania Beach to subsidize the City of Dania Beaclrs cost of providing one year of retiree health insurance to such firefighter retirees and survivors, which cost shall be two-thirds of the premium cost for such insurance. Premium costs shall be determined in accordance with 5112.0801, Florida Statutes. Should the available actuarial gain not be fully expended by this subsidy to the city, then the balance, together with any unexpended available actuarial gain from prior years, shall be accrued by tlhe Retirement System in a "Future Benefit Reserve Account" which shall be used only to pay the full cost of additional future benefits to the Systems firefighter retirees and survivors, the determination and payment of which are hereby delegated by the City Commission•, to the board of trustees in its sole discretion. DROP participants shall receive credit for any such future benefits paid while participating in the DROP but not for the health insurance subsidy. J ORDINANCE NO. 21-98 4 Section 2. Section 18-42(2)(b) of the Dania Beach Code is hereby amended by adding the following: The monthly retirement benefit for firefighter members retiring on or after January 1, 1999 shall equal 3% of average monthly earnings for each of the first 15 years of continuous service and 4% of average monthly earnings for the each of the next 10 years of continuous service, up to a maximum benefit level of 85%. Section 3. Section 18-44(1)(c) of the Dania Beach Code is hereby amended as follows: (c) Extended (ontributions. A member whose contributions would otherwise cease due to his accrual of the benefit level of seventy-five (75%) percent for olice narticinants and eighty-fve (85%) percent for firefl )__ narticinants and whose benefit would therefor be fixed fi amount as of that date regardless of future changes in earnings, may elect to continue making contributions, but only based on future earnings increases arising front increa lases es in the regular and overtime rates of pay• irrevocable; for those so electing, average monthly earnings shall be determined as of actual date of retirement, disability, death or other termination as an employee. Section 4. Section 18-43(b) of the Dania Beach Code is hereby amended as follows: (b) Deferred Retirement ()plinn Plan. A member may enter into the deferred retirement option plan (DROP) which plan is to be created and administered by the board of trustees of the fund on the first day of any month following the completion of at least twenty-five (25) but less than thirty (30) years of credited service. lie maximum duration of artici anon in the DROP shall be the number of 'ears which, when added to the number of ears of all creditable service which the member has in the Retirement S stem ec i als a total of thirty 30 vears, or fora artici ant who is the Lead of a cit do artment e uals thirty-two and one-haff ears. The In nthly retirement benefits that would have been payable had the member elected to cease employment and receive a service retirement allowance, shall be credited to a deferred retirement option account. The deterred retirement option plan account shall earn interest at a rate set quarterly by the Board of Trustees. Such interest shall be e ual to the system's net rate of investment return for the year and shall be credited to each individual account balance in the account on a quarterly basis. Effective January 1 1999 the deferred retirement option Plan account shall not be subiect to any fees charges etc., of anv kind for any purpose. U on termination of employment a participant in the program shall receive at his or her option a lump sum payment from the account equal to the payments to the account plus earned interest, or an annuitv based upon his or her account or the participant may elect any other method of payment if Iapproved by the Board of Trustees The monthly benefits that were being paid into the fund during the period of participation shall begin being paid to the retiree. Section 5. Section 18-44(a) of the Dania Beach Code is hereby amended as follows: (a) Anwuni. All police members of the retirement system shall make regular contributions to the fund at a rate equal to seven percent (7%) of their respective earnings. All firefighter members of the retirement system shall make regular contributions to the fund at the following rates based upon their respective earnings: 0 Prior to October 1, 1989 7 ° October 1, 1989 to September '0, 1990 8.82% October 1, 1990 to September 30, 1991 13.42% October 1, 1991 to September 30, 1999 18.14% October 1, 1999 and thereafter 24.6% file increases in contributions commencing October 1, 1989, shall be used exclusively to fund the increased cost of any increases in firefighter benefit levels and adopted after that date and cannot be used to find the benefit levels in existence before October 1, 1989. For firefighter members, two percent (2%) of each employee's earnings shall be deducted from the employee's earnings, the remainder of the firefighter member employee contributions shall be paid and assumed by the City of Dania Beach in lieu of payroll deductions from firefighter members' earnings. For police members, all employee contributions shall be paid and assumed by the City of Dania Beach in lieu of payroll deductions from police members' earnings provided that the total of such police employee contributions paid by the City of Dania Beach plus the employer contribution for police members made pursuant to Section 18- 44(3) hereof shall not exceed the amount which the Sheriff of Broward County would have paid on behalf of said police members had they elected to join the Florida Retirement System. Should the total employer and employee contribution rate for police members for any year exceed the prevailing contribution rate to the Florida Retirement System for that year, the difference shall be paid by the police members by payroll deduction from 5 ORDINANCE NO. 21 98 I — I each employee's Broward Sheriffs Department earnings. The city and each police officer participant shall enter into a written contract providing for their respective obligations and rights as provided herein. No member shall have the option of choosing to receive the contributed amounts directly instead of having them paid by the city directly to the system. All such employee contributions picked ur) by the city shall be deemed and considered as part of the members' accumulated contributions of r.q and as earnings for the purposes of calculating average monthly earnings. The employee contributions picked up by the city shall be added to the members' earnings for the purpose of calculating average monthly earnings, however, for firefighter members entering the DROP after December 31. 1998, this amount shall be twenty-two and six tenths (22.6%) percent of the amounts earned after December 31 1998. This city "pick up" of contributions is intended to comply with Section 414(h)(2) of the Internal Revenue Code, the employee contributions of police and firefighter members shall be computed and accounted for separately. Section 6. Section 18-40(10)of the Dania Beach Code is hereby amended as [ollows: (10) AVERAGE MONTHLY EARNINGS means one twenty- fourth (1/24)of the arithmetic average of earnings for: (a) The twelve (12) months immediately preceding the member's date of termination or the date when he or she accrues the benefit level of seventy-five (75%) percent for police participants and eighty-five (85%) percent for firefighter participants; and (b) Any other consecutive prior twelve-month period, as selected by the member. Provided however, each member who has accrued the benefit level of seventy-five (75%) percent for police participants and eighty- five (85%) percent for firefighter participants may elect to make partial additional contributions as provided hereunder in order to have average monthly earnings determined as of his actual retirement or termination date. Section 7. That all sections or parts of sections of the Code of' Ordinances, all ordinances or parts of ordinances, all charter sections or parts of sections, and all resolutions or I parts of resolutions in conflict herewith, be and the same are hereby repealed to the extent of 6 ORDINANCE NO. 21-98 such conflict. 1 Section 8. If any word, phrase, clause, subsection or section of this ordinance is for any reason held unconstitutional or invalid, the invalidity thereof shall not effect the validity of any remaining portions of this ordinance. The source of this money would be the total of 75% of each year's actuarial gain in excess of that used for the System's COLA plus 75% of the increase in percent of covered payroll received in Chapter 175 revenue over the amount received in 1997. The money would be used first to pay one-third of health insurance premiums for those whose benefits are in pay status. If any money remains after the first use, it would be used to pay the remaining two-thirds of health insurance premiums for those whose benefits are in pay status. If there is still money remaining, it will be accrued in a "future benefit reserve account" to be used to provide future benefits for retirees and survivors. (2) The benefit accrual rate for firefighters who retire after 1998 would change from 3% per year with a maximum of 75% of average monthly earnings to 3% for each of the first 15 years of service plus 4% for each of the next 10 years of service with a maximum of 85% of average monthly earnings. (3) DROP provisions are being changed in certain respects. (4) The contribution rate by firefighters will change effective October 1, 1999 from 18.14% to 24.60% of covered pay. As indicated by the enclosed tables, the increase in member contribution rate is enough to keep the City's required contribution unchanged at 4.97% of covered payroll. As regards the Benefit Reserve and Health Insurance Subsidy described above, no advance funding is required. In valuing these changes, we used the same actuarial assumptions•and methods as were used in the October 1, 1997 Actuarial Valuation Report. In our opinion, the proposed changes are in compliance with Part VII, Chapter 112, Florida Statutes and Section 14, Article X of the State Constitution.
