HomeMy WebLinkAboutO-1998-016 i E ORDINANCE NO. 16-98 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, APPROVING THE "TREASURE COVE" PLAT, SUCH PROPERTY BEING LOCATED IN THE CITY OF DANIA AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; ACCEPTING THE DEDICATION FOR PUBLIC USE OF ALL STREETS, HIGHWAYS AND ALLEYS AS SHOWN ON SUCH PLAT OF "TREASURE COVE"; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That the plat of 'Treasure Cove", an Ordinance of the City Of Dania, Florida, approving the "Treasure Cove" plat, such property being located in the City Of Dania and legally described in exhibit "A", a copy of which is attached to this ordinance; is hereby accepted and approved. The City of Dania consents and agrees that such plat may be recorded in the Public Records of Broward County, Florida, upon further approval of all agencies of Broward County, Florida, having jurisdiction in the matter. Section 2. That the dedication for public use of all streets, highways and alleys, as shown on the plat of 'Treasure Cove", is accepted by the City of Dania, Florida. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. That this ordinance shall take effect immediately at its time of passage. Virta, AICP — Growth Management Director RE: PL-44-98 'Treasure Cove" Plat Date: October 7, 1998 This is a request to approve a final plat for the remainder of a partially built residential development. The plat is for 7.13 acres of land for which the applicant would like to build up to seventy (70) dwelling units. The problem that arises is how to best protect the existing residences that were built as part of the original project. This site has been a problem from its origin. The site was not properly laid out or platted and the existing owners have faced several problems related to their legal descriptions and access. The preliminary plat indicated a twenty-four (24) foot access easement for those properties located on the Dania Cut-Off Canal. Unfortunately, .I there was no provision shown for access easements for those properties that are adjacent to SW 27`h Terrace or SW 45th Street. Those properties derive their access from within the project and any platting at this time must include provisions to protect this access. RECOMMENDATION Staff believes that necessary provisions must be made to protect and enhance the access needs of the existing residences. In order to accomplish that the Planning and Zoning Board recommended that the City Commission approve the preliminary plat subject to access easements being provided to protect and enhance the right of all the residences existing at this location. At the time of the writing of this memorandum the applicant had not been able to finalize the locations of those access easements. They had submitted a proposal to staff but staff asked them to amend their proposal.
