HomeMy WebLinkAboutO-1998-015 I ORDINANCE NO. 15-98 AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, REPEALING IN ITS ENTIRETY SECTION 25-46 OF THE CITY CODE OF ORDINANCES, WHICH SECTION IS ENTITLED "HANDICAPPED PARKING SPACES" AND REPLACING THE REPEALED SECTION WITH A NEW SECTION 25- 46 ENTITLED "PARKING SPACES FOR PERSONS WHO HAVE DISABILITIES"; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES AND ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT ARE REPEALED TO THE EXTENT OF SUCH CONFLICT; PROVIDING A SEVERANCE CLAUSE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That Section 25-46 of the City Code of Ordinances of the City of Dania is repealed in its entirety and the following new section is created and is substituted in its place: Sec. 25-46. Parking spaces for persons who have disabilities. (a) The provisions contained in F.S. §316.1955 entitled "Parking Spaces for Persons Who Have Disabilities" F.S. §316.1957 entitled 'Parking Violation; Designated Parking Spaces for Persons Who Have Disabilities"; F.S. §316.1958 entitled "Out-Of-State Vehicles Bearing Identification of Issuance to Persons Who Have Disabilities", F.S. §316.1959 entitled "Handicapped Parking Enforcement', and F.S. §316.1964 entitled "Exemption of Vehicles Transporting Certain Persons Who Have Disabilities for Payment of Parking Fees and Penalties" are adopted and incorporated by reference into this section, as amended from time to time by the Florida Legislature. (b) It is unlawful for any person to stop, stand, or park a vehicle within any such specially designated and marked parking space provided in accordance with this section, unless the vehicle displays a disabled parking permit issued under F.S. §316.158, or§320.0848 or a license plate issued under F.S. §320.084, F.S. §320.0842, F.S. §320.0843, ORDINANCE NO. 15 98 Q or F.S. §320.0845, and the vehicle is transporting the person to whom the displayed permit is issued. The violation may not be dismissed for failure of the markings on the parking space to comply with this section if the space is in general compliance and is clearly distinguishable as a designated space. Section 2. If any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. Dania Code Section 25-46 entitled "Handicapped parking spaces", currently reads as follows: (a) The provisions contained in Florida Statues ofctionpar 1 6.1954 fees; entitled "Disabled persons, exemption from payment issuance of identification stickers"; Section 316.1955 entitled "Parking " spaces for certain disabled persons , and Section 316.1956 entitled "Nonpublic parking spaces for certain disabled persons" are hereby adopted and incorporated by reference into this section. (b) Any person who parks, stops or stands a motor vehicle in any space designated "handicapped only" shall be in violation of this section unless the proper permit and license plate and tag designated by said statutes is properly and prominently displayed on such motor vehicle. Copies ofthese statutes are attached for your review. s 6 We recommend that the current ordinance be repealed and updated to refer to the current Florida Statutes and, further, that we include a phrase in the repealing and amending ordinance stating that these statutory sections are adopted and incorporated by reference, "as amended from time to time by the Florida Legislature". By incorporating the Florida Statutes, Section 25-46(b) of the Dania Code as it currently reads would also become unenforceable. In order to qualify as a designated handicapped space, the parking space must meet specific designation requirements as set forth in §316.1955(6). Therefore, we recommend that subparagraph (b) also be replaced, with the following text: It is unlawful for any person to stop, stand, or park a vehicle within any such specially designated and marked parking space provided in accordance with this section, unless the vehicle displays a disabled parking permit issued under F.S. §316.158, or §320.0848 or a license plate issued under F.S. §320.084, F.S. §320.0842, F.S. §320.0843, or F.S. §320.0845, and the vehicle is transporting the person to whom the displayed permit is issued.
