AN EMERGENCY ORDINANCE OF THE CITY OF DANIA, FLORIDA,
AMENDING ORDINANCES NO. 02-97, 06-97, ORDINANCE PASSED
JULY 22,ORDINANCE
ORDINANCE NO. 11-97 , ORDINANCE NO. 12-
97 AND DINANCE NO. 13-97 FOR THE EXTENSION OF THE
MORATORIUM ON PLACEMENT AND INSTALLATION OF
TELECOMMUNICATIONS FACILITIES; PROVIDING FOR
SEVERABILITY, ORDINANCES IN CONFLICT AND AN EFFECTIVE
DATE.
WHEREAS, the city commission of the City of Dania enacted
Ordinance No. 02-97 declaring a moratorium effective through May
30, 1997, regarding the placement and installation of
telecommunications facilities within the City of Dania; and
WHEREAS, the city commission enacted Ordinance No. 06-97 on
May 13, 1997 , extending the moratorium through July 31 , 1997 ,
for placement and installation of telecommunications facilities
within the City of Dania; and
WHEREAS, the city commission by emergency ordinance on July
22 , 1997, extended the moratorium on telecommunications
facilities to August 12, 1997; and
WHEREAS, the city commission has passed on first reading on
July 22, 1997 , a comprehensive ordinance on telecommunication
towers and antennas ; and
WHEREAS, the city commission by emergency ordinance on
August 12, 1997 , extended the moratorium on telecommunications
facilities to September 12 , 1997; and

WHEREAS, the city commission by emergency ordinance on

September 23, 1997, extended the moratorium on
telecommunications facilities to November 30, 1997 ; and
WHEREAS, the city commission determined during its
discussions on the comprehensive ordinance on telecommunications
towers and antennas that the city' s staff needs to provide the
commission with data on revenue options, construction and
development in residential areas and revisions to the fee
structure and definitions for technical terminology within said
ordinance; and
WHEREAS, the city commission finds there is a reasonable
necessity for a detailed comprehensive analysis on the location

and impact of telecommunication towers and antennas within the
city; and
WHEREAS, the lack of minimum standards for
telecommunication facilities poses a great probability of
detriment to the character, nature and appearance of the city;
and
WHEREAS, the city commission has determined there is
insufficient time to enable the city to review the technical
information and data and adopt minimum standards for
telecommunication facilities within the city and an emergency
ordinance is required for a period of 10 days.

NOW, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE

CITY OF DANIA, FLORIDA that:
Section 1 . That Section 3 of Ordinance No. 02-97 as passed
and adopted on February 25, 1997, and as amended in Ordinance
No. 06-97, passed and adopted on May 13 , 1997 , as amended by
emergency ordinance passed July 22 , 1997 , as amended in
Ordinance No. 11-97, passed and adopted August 12, 1997, and as
amended in Ordinance No. 12-97, passed and adopted September 9,
1997 , and as amended in Ordinance No. 13-97, passed and adopted
September 23, 1997, be and the same is hereby amended to read as
follows:
"The City Commission of the City of Dania

hereby declares that the moratorium shall be
effective through December 10, 1997 , unless
otherwise extended by the City Commission. "
Section 2 . Except as herein amended, all other provisions
of said Ordinances No. 02-97, 06-97 , emergency ordinance passed
July 22, 1997, and Ordinances No. 11-97, 12-97 and 13-97 shall
remain in full force and effect.
Section 3 . That all ordinances or parts of ordinances and
all resolutions or parts of resolutions in conflict herewith are
repealed to the extent of such conflict.

Section 4 . That this Ordinance shall be in force and take
effect immediately upon its passage and adoption.
PASSED AND ADOPTED ON First Reading on the 25th day of
November 1997 .
PASSED AND ADOPTED ON Second and Final Reading on the 25th
day of November 1997 .
