AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, AMENDING THE
DANIA COMPREHENSIVE PLAN RE-DESIGNATING A PARCEL OF
LAND CONTAINING 2.771 ACRES MORE OR LESS LOCATED AT THE
NORTHWEST CORNER OF SHERIDAN STREET AND WATERMARK
BOULEVARD FROM COMMERCIAL TO RESIDENTIAL MEDIUM (16) ON
THE FOLLOWING PARCEL OF LAND, LEGALLY DESCRIBED AS: A

WHEREAS, the City of Dania, adopted the City of Dania Comprehensive Plan on April
11, 1989; and
WHEREAS, the Planning and Zoning Board for the City of Dania has held duly
advertised public hearings and voted to recommend approval of the land use amendment to
the City Commission; and
WHEREAS, the City Commission of the City of Dania has conducted a duly advertised
public hearing on October 16, 1996 pursuant to Section 163.3184 (15) regarding adoption of
the proposed land use plan amendment pertaining to the property described as follows:
A PORTION OF PARCEL "C" OF "US LEND LEASE PLAT NO. ONE", ACCORDING TO
THE PLAT THEREOF AS RECORDED IN PLAT BOOK 111, AT PAGE 44 OF THE

interest of the citizens of the City of Dania to adopt the amendment to the Dania
Comprehensive Plan pertaining to the property as herein described above, and
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this Ordinance.
Section 2. Approximately 2.771 acres of land located at the northwest corner of
Sheridan Street and Watermark Boulevard more particularly described as follows:

_Section 3. The City's land use plan map and certified comprehensive plan are hereby
amended to include the amendment and re-designation described herein.
Section 4. The City Clerk is directed to transmit this amendment to the Broward
Planning Council with a request that the Broward Planning Council re-certify the City of Dania
Land Use Plan.
Section 5. The City Clerk is hereby directed to transmit this amendment to the
Department of Community Affairs pursuant to Florida Statutes, Chapter 163.
Section 6. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict herewith be and the same are hereby repealed to the extent of such
conflict.

Section 7. If any section, subsection, sentence, clause, phrase or portion of this

ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portions of this ordinance.
Section 8. This ordinance shall become effective upon re-certification of the City of
Dania Comprehensive Plan by the Broward County Planning Council.

The Department of Community Alfairs has completed its review of the revised Dania Evaluation and
Appraisal Report(EAR), which the DeparmenY received on September 11, 1997. The Departm�t has
determined that the EAR is "sufficient'as defined in Subsection 163.3191(9), F.S. The City may now
proceed with the adoption of amendments, including amendments unrelated to the EAR Pursuant to Section
163.3191(4),the City must adopt EAR-based amendments within one year from the adoption date of the
revised EAR Therefore, the City must adopt the EAR-based amendments by September 2, 1998. The
Department is authorized to grant one,six-month extension for good and sufficient cause should the City
require additional time.
,.,A The adopted EAR includes numerous reeomrrnendations for the adoption of the EAR-based
amendmal ., including amendments to respond to changes in statutory,and rule requirements, to strengthen
and clarify existing plan provisions, and to complete studies relating to water quality, septic tanks, and
stormwater needs. In particular, we would like to emphasize the need for the City to coordinate with Broward
County, the Metropolitan Planning Organization and the Florida Department of Transportation in preparing
the Transportation Element. Similarly, the preparation of the Post Disaster Redevelopment Plan will require
significant coordination with Broward County. Department staff are available to provide technical assistance
as the City prepares the amendments.

The EAR is a report evaluating conditions city-wide at the time of the
Comprehensive Plan's adoption and at the time of the preparation of

assessment is made to determine the extent that the Objectives and
Policies have been achieved in the report. Changes or amendments
are suggested as needed to update the Plan or its Elements,
including reformatting Plan Objectives, Policies and Standards.
The purpose of the EAR Public Hearing is to adopt the EAR and
afford the public an opportunity for comments in accordance with
State Statutes and Rule 9J-5, Florida Administrative Code.
