HomeMy WebLinkAboutR-2008-006 Ippolito Site Plan and Waiver RESOLUTION NO, 3008-N6 A RE5OLUq'LON OF THE CITY OF DANIA REACH, FLORIDA,APPROVING THE SITE PLAN AND WAIVER REQUESTS SUBMITTED BY THE, PROPERTY OWNER TROY IPPOLITO, PRESIDENT OF T.H.➢., INC., FOR PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF SW 25Tu AVENUE AND SOUTH OF GRIFFIN ROAD, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;FURTHER,PROVIDINO FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article I ofChapter 8 of the Code ofOdinances ofthe City of Donis Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Article 20 "Supplementary Use Regulations' for "Planned Residential Development', of Chapter28 of the City Code of Ordinances ofthe City ofDania Beach, Florida, sets the area requirements for roes within the PRD-1 zoning district; and WHEREAS,Article 29"Pervions and Impervious Areas',rfCupur 28 ofthc City Code of Ordinances of the City of Dania Beach, Florida, sets the minimum pervions area requirements for uses within residential zoning districts; and WHEREAS,the property owner, tiny Ippolito,President of T.H.B., Inc, is requesting site plan approval for the proposed construction of 18 two-family villas,totaling 36 residential dwelling units in apriwite residential community,to be generally located on the west side ofS W 25to Avenue and south of Oriffm Road, in the City of Dania Bexh; and WHEREAS, the property owner is requesting a wrrver (WA42-06) to provide the following: a) 30% -39%pervious area for 12 ofthe 36 lot,(40%pervious area wormed for each lot); and b) 10 foot interior sideyard setbackm20 fret between buildings(PR0.l requires a 15-foot interior side yad, or 30 L'eet bclwccn buildings} and WHEREAS, the Plarudng wdZmdng Bowdon Sepmmber27,2009,recommended that the City Commission grant the site plmmgwst(SP-05 06),subject mcvm'nwntEfions,basal upon the criteria set foM in Section 8.4 of"into I of Captor 8 of the Code of Ordinances of the City of Dania Reach; and WHEREAS,the Planning and smiting Board on September29,2002,recommended thatthe City Commission Frontthe request for waiver(WA-42-06),subjewto certainwndinons,basedupon the criteria set forth in Sections 29.10 of Article 29 and 20.30 mArticle 20, of Chapter 28 of rho Code of Ordinmccs of the City of Lewis Beach, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA REACH, FLORIDA: Seufion1. Then that certain application(SP05-06) for site plan approval and (WA42- 07) request for waiver, capita orwInch are attached and made a part of this Resolution as Exhibit "A" arc approved with the following conditions to be addressed prior to issuance of a building permit. 1. Sheet SP-1 `Site Dun' inwnect, revise the fie luwing: Future Land Use dexignafion—eliminate 'plus allocation of 4 reserve units'. Parking cquirey—revisem 'S reserved required—revise to '3 reserved spaces pins a .25 guest spaces per d.u.' 2. Applicant to provide a tree preservation bond to asstw compensation for trees that do not survive preservation or mlocti on (Amount to be determined prior to Commission Review) 3. Applicant to pay to the Cit➢'s free Preservation Fund the value of the trees to be removed from the site (Amount to be determined prior to Commission Review). 4. Tree bond and mitigation amounts shall be deposited prior to issuance of my cicadng, filling, or construction permits (Landscape Consultant). 5. Tree removal permits shall not be issued until developer applies for a building permit and submits permit level drawings. 2 RESOLUTION 1,200tlL05 6. On Sheets P-2, 1,1, and LP-L F,-2, provide 4" X 4" tapping sleeve and value, 4" X 8" increaser (reducer) and S" G.V. (Public Services). ]. On Sheet L 1, do not plant trees over or adjacent to utilities (Public Services). 8- Recommend Installation of solar lighting (Public Services). 9. Submission of scaled fire Hew calculations to determine water demand requirements for this project (Fire Marshal). 10. Fire Department to perform on-site evaluation of fire flow test(Fire Marshal). It is further noted that the original site plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2. 'prat based upon the emend set forth In Scwdon84(p)ofArlmle l efChapmr 8, ofthe Code of Ordinances ofthe City of Dania Beach, all site plan approvals shall automatically expire and became null and void unless building permits are obtained on or before 12 months from the date of this Resolution. Section 3. Ihat all waelutions orparts ofresolutions in conflict with this Resolutionata reported to the extent of such conflict. Section 4. That this Resolution shall be in force and take effect immediately upon its passage and adoption.
