BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA, FLORIDA: Section 1. That the proposal of Coastal Technology Corporation relating to professional engineering services relative to construction of the new Dania fishing pier, a copy of which is attached hereto as Exhibit "A", be and the same is hereby approved and the appropriate city officials are hereby authorized to execute same. Section 2. Dania Beach Boulevard Dania, FL 33003 RE: PROFESSIONAL ENGINEERING SERVICES RELATIVE TO CONSTRUCTION OF THE NEW DANIA FISHING PIER, CITY OF DANIA, BROWARD COUNTY, FLORIDA Dear Mr. Flately: Pursuant to verbal authorization from the City Commission, this is to confirm that Coastal Technology Corporation (Coastal Tech) will act on behalf of the City of Dania (City) as technical consultants relative to the City's request for proposals for construction of a new fishing pier. The following are proposed terms of agreement between Coastal Tech and the City of Dania: PART I - TECHNICAL SPECIFICATIONS Coastal Tech will prepare general technical provisions for construction of the new fishing pier. The technical specifications will become part of the City of Dania's Request For Proposals (RFP) for the new pier. The technical provisions will include the summary of work, minimum design requirements, construction materials, and utility construction. The provisions will include design standards and permitting requirements. Fees for Part I services are estimated at ......................... $1,500.00 PART II - MEETINGS AND CONSULTATIONS At the request of the City, Coastal Tech will attend City Commission meetings, public hearings, and meetings with respondents to the RFP to offer technical assistance with regard to construction of the new pier. Coastal Tech will assist the City to clarify technical questions and to issue addendums as needed to the RFP, prior to the receipt of the proposals. Coastal Tech will evaluate each proposal and generally advise the City as to the technical merits of each submittal. Coastal Tech will subsequently attend the City Commission meeting to conclude on the successful bidder. Fees for Part II services are estimated at ......................... $5,000.00 PART III - PERMIT PROCESSING Coastal Tech will prepare permit sketches illustrating general details of construction of the new pier. Coastal Tech will submit signed and sealed permit sketches and cover letter to the City for subsequent submittal to the regulatory agencies. If required by the City, Coastal Tech will respond to the completeness summary of the regulatory agencies to answer technical questions and generally expedite approval of the permits. Coastal Tech may perform additional environmental studies, hydrographic surveys, or geotechnical investigations, as may be required by the agencies, prior to issuance of the permits. These services may be performed under separate authorization. Coastal Tech will coordinate between the City and successful bidder to submit preliminary and final construction plans to the Department of Environmental Protection (DEP) Division of Beaches and Shores prior to issuance of a "Notice to Proceed" by the Department. Fees for Part III services are estimated at ........................ $5,000.00 PART IV -CONSTRUCTION ADMINISTRATION Coastal Tech will act on behalf of the City to monitor the progress of construction, administer the technical provisions to the contract, and make periodic site observations to ensure that construction is in compliance with the plans, specifications, and permits. Coastal Tech will review the contractor's periodic pay requests and make recommendation to the City for payment. Coastal Tech will perform a substantial and final inspection of construction and certify to the City and the regulatory agencies of project completion. The City shall make payment to Coastal Tech upon receipt of an invoice. Invoices not paid within thirty (30) days and not in dispute shall incur interest at a rate of 1.5 percent per month. The City agrees to pay any cost of collection including reasonable attorney's fees incurred whether or not a suit is commenced or an appeal is taken. If you wish us to perform the services described above, please issue a purchase order which will serve as our Authorization to Proceed. Should you have any questions, please contact me.
