A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE
VARIANCE REQUEST SUBMITTED BY MANSEL AND JAMI JEFFERS FROM
THE BROWARD COUNTY ZONING CODE, SECTION 39-275 "YARD
ENCROACHMENTS FOR ACCESSORY STRUCTURES", FOR PROPERTY
LOCATED AT 4405 SW 35TH AVENUE, DANIA BEACH; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Broward County Zoning Code, Section 39-275, prescribes the yard
encroachment regulations for accessory structures,for properties within the City of Dania Beach;and
WHEREAS,Mansel and Jami Jeffers,property owners,have applied for a variance(VA-84-
07)to allow a six(6)inch side yard setback associated with the installation of an accessory building
for property located at 4405 SW 351h Avenue, Dania Beach; and
WHEREAS, the Planning & Zoning Advisory Board on March 19, 2008, recommended
approval based upon the criteria set forth in section 10.13 of Article 10,of Chapter 28,"Zoning",of
the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application for variance (VA-84-07) as described above
(from requirements in Broward County Zoning Code, "Section 39-275"a copy of which is attached
as Exhibit "A" is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are
repealed to the extent of such conflict.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

Subject: Special Engineer Inspection of Gazebo
To Whom It May Concern,
At the request of the homeowner, on March 1, 2008, Brennan Engineering, Inc.
performed a final inspection and approved the "As Built" 11' x 8' x 8' hgt. Gazebo
located at the NE Corner of the property.
Prior to this final inspection, the contractor was required to expose the framing
attachment to the footing and the overall framing of the gazebo. Further, an analysis of
the existing framing was performed and the contractor was required to retrofit the areas
as necessary. Once completed, all work was inspected and approved.
This letter is to certify that the "As Built" Gazebo, to the best of our knowledge and
belief, based on the inspections will support the loads required by the Florida Building
Code.
