The new board member, Traian Thomas Popescu, was sworn in by Assistant City Attorney Eve Boutsis
so he could now perform his board duties and responsibilities. She explained that even though he was not
It the previous P&Z Meeting, tonight he could vote on the minutes listed on the agenda for approval.
II. APPROVAL OF MINUTES
1. Approval of Minutes of the Planning and Zoning Board /Local PZanningAgency from the
August 11, 2021 virtual regular meeting.
Motion was made by Albert Jones to approve the minutes of the virtual meeting of the Planning &
Zoning Board/Local Planning Agency for August 11, 2021 was seconded by Jonathan Thomas.

III. PUBLIC HEARINGS
1. RZ-063-21: The applicant, Leigh Robinson Kerr &Associates, Inc., on behalf of
Franmar Properties of South Florida LLCD., is requesting rezoning of property generally
located on the north side of Southwest 42 Street, between Anglers Avenue/Ravenswood
Road and Southwest 22 Avenue from Single -Family 6000 Residential District (RS-6000)
and General Business District (C-3) to Industrial -Research -Office -Marine Airport
Approach (IROM-AA).
Assistant City Attorney Eve Boutsis swore in Staff and the Applicant -anyone who would speak on this
application. For the record, during this agenda presentation, Derrick Hankerson logged in. With the
public hearing opened, Planning and Zoning Manager Richard Lorber gave a PowerPoint presentation
explaining the rezoning request from some single family residential (RS-6000) and some general
business district (C-3) to Industrial -Research -Office -Marine Airport Approach (IROM-AA). He showed
the location of the area on a map pointing out the four vacant properties of which some were C-3 and
some RS-6000 and if the rezoning was approved, it would be IROM-AA. The property totaled a little
less than an acre and was planned to be used as an extension of the existing bus company operations.
The applicant, Franmar Properties, operated Academy Bus providing charter bus services. They also
own the property to the south (in unincorporated Broward County) and were in the process of preparing
an annexation petition into the City of Dania Beach.
He went tlu•ough the criteria for rezoning found in Article 645 of the City's Land Development Code
(LDC) stating what the Board must consider. He further explained how the applicant responded and read
their comments into the record telling how it was consistent with the required criteria. The Community
Development staff was in general agreement with the applicant's zoning criteria statement and was
supportive of the rezoning request. Staff thought the current zoning was incompatible with the
surrounding land use pattern. It made sense in regard to the compatibility with the adopted future land
use plan and the existing land use pattern. The Board tonight must make a recommendation to the City
Commission. The City Commission would hold two public hearings. Staff recommended that the Board
recommended to the City Commission approval of the ordinance approving the rezoning. The Chair
called for board questions.
Board Member Jones wanted to know if there was any residential next to or adjacent to the subject
property. Planning and Zoning Manager Lorber answered that directly to the west of this property there
was a compound and a residential property on it. Notices were sent and the owner of the residential
property called. They discussed this application. The owner was not opposing this application at this
time. He did ask that when they came in for the site plan approval that when they come in to pave and
construct, there would be a wall on the west and landscaping to adequately buffer. Board Member Jones
wanted to know if there were any environmental restrictions and Planning and Zoning Manager Lorber
answered in the negative. This was industrial land use and would probably be a parking lot or parking
area. Board Member Jones wanted to know if there would be any mechanical repair, etc. and was told
that maybe in the future but for now, it was just for parking. In answer to a question regarding changes in
the future would they have to come back to the City and Planning and Zoning Manager Lorber gave an
example that if they wanted to build a building in the future, it would have to come back to the City.
Board Member Jones just expressed his concern if Academy Bus was planning on doing repairs, etc.
because he was concerned about where oil, etc. would go. Board Member Jones wanted to know if
drainage there was sufficient. Planning and Zoning Manager Lorber explained that when they review a
proposed development, engineering staff fully reviewed for drainage, etc. At this time, it was only a
rezoning, but there would be an environmental review by the City when there was a proposal. As there
were no further board questions, the Chair asked for members of the public who would like to speak for
or against this item.
The property owner to the west, Dave Reich, said that he did speak with Planning and Zoning Manager
Lorber and did say he was not against the rezoning but the buses were 13' high or more and he wanted to
know if there was adequate protection not to impact him too much. He would like to be involved in the
early site plan stage to mitigate this, especially environmentally (e.g., fumes). As no other board
members wished to speak or ask questions and no members of the public had questions/comments or
wished to speak, the public hearing closed.
Motion was made by Albert Jones to recommend approval of this agenda item (RZ-063-21) to the City
Commission and was seconded by Jonathan Thomas. Motion passed 5-0.
Assistant City Attorney Eve Boutsis said that the Board moved for a motion but it was not voted on
because she asked the applicant, Mr. Kerr, if he still wanted to speak. Mr. Kerr said he did not need to
speak but said that he would address what was brought up by Mr. ,Tones and Mr. Reich.
Motion passed S-0.
2. TA-060-21: The applicant, Community Development Department, on behalf of the City
of Dania Beach, is requesting approval for an amendment to the Broward County
Trafficways Plan deleting the SW 4�' Avenue (Dixie Highway) Traffic between Dania
Beach Boulevard and Sheridan Street.

Planning and Zoning Manager Richard Lorber gave a PowerPoint presentation stating that the applicant
was Dania Beach and this was being presented for a proposed Trafficways Plan amendment. He gave the
background stating that the Broward County Trafficways Plan was the county's roadway right -of --way
preservation plan. It was a big map of all the main roads in the county. It specifies how wide each major
road should be.
There was a right -of --way requirement for developing parcels along designated trafficways, in order to
provide for enough width for an acceptable regional roadway network. On the Broward County
Trafficways Plan, the SW 4th Avenue (Dixie Highway) Trafficway was specified as a forty-two foot wide
one-way pair extending from Sheridan Street northward along either side of the FEC Railroad corridor to
Dania Beach Boulevard. Planning and Zoning Manager Lorber showed a graphic that depicted the
entirety of the link. What was strange was that on the east side (SW 0 Avenue), it was a two-way road
and a neighborhood with homes to the east. On the west side, it ran up Dixie Highway. There were
commercial buildings and residential properties right in this site where this plan says this roadway was to
go through.
The Broward County Trafficways Plan required properties along this way to dedicate up to forty-two feet
of privately owned land as right -of --way for purposes of future roadway development. The requirement
for additional dedication of privately owned land, whether for a portion of, or the entirety of the forty-two
foot wide dedication requirement, has proven to be an obstacle to the development and redevelopment of
several properties along the Trafficway alignment. There were breaks/gaps in the existing right -of --way
along this corridor, including fully developed commercial and residential properties that contain land
within the corridor, properties containing several existing buildings of a substantial value and other
factors which render the envisioned future Trafficway corridor as highly unfeasible. Failure to delete this
Trafficway from the Trafficways Plan would cause continued difficulties for the development of
properties located along its alignment and would contribute to the further economic stagnation in an
economically disadvantaged community. Partially because of this obstacle, there has not been good
development there. He showed a picture of some affected potential development sites.
What the City of Dania Beach would like was to request the county remove SW 4d' Avenue (Dixie
Highway) from the Trafficways Plan. This would allow neighborhoods to proceed with infill
development and vitally needed redevelopment with stability and certainty without the requirement of
future right -of --way dedications. Staff felt that the proposed Trafficways Plan amendment would be
beneficial to surrounding neighborhoods and was consistent with the City's Comprehensive Plan. A
traffic analysis done by the county would verify that granting this request would have very little impact
on traffic volumes, bicycles, pedestrian travels, etc. The Board has to make a recommendation to the City
Commission tonight. There would be one public hearing by the City Commission. The application and
the Resolution would be submitted to the Broward County Planning Council with a recommendation of
approval as there was no real road where this road was shown. The Chair called for board questions.
Board Member Jones said that he was familiar with SW 4'i' Avenue and explained how it maneuvered out
to Sterling Road. Then he explained how to turn back to S W 4`�' Avenue. He did not know a S W 4`i' that
went all the way to Dania Beach Boulevard. Planning and Zoning Manager Lorber explained where it
was and that there was a right -of --way between the railroad tracks and the storage facility. Planning and
Zoning Manager Lorber showed on a map where SW 4`h turned but on the Trafficways Plan, it did not
turn but just incorrectly continued through an area with buildings. Board Member Jones wanted to know
once this roadway was vacated, would it give more property to the property owners. He further asked
about access to these properties. Planning and Zoning Manager Lorber answered in the negative about
giving more property to the owners and explained that there was no problem accessing these properties
currently from side streets. Board Member Jones asked about the area by the FEC, if he would be able to
put a picnic area for his employees as the vacated area would not be utilized. Assistant Director
Community Development Lajoie said that this request was not a vacation of roadway. The roadway in
many places did not exist. There was just a future Trafficways Map that says the road should exist. As
property owners come in to redevelop a site, we have to review their proposed site plan against this future
roadways plan and in many cases, it required the property owner to dedicate or give land. In some cases,
it was half the property for this imaginary road not yet built. This was causing problems and was an
obstacle. Board Member Jones just wanted to ensure that no one could maximize or get something for the

property by expanding it in the future. His concern was that there should not be a way to profit from this
in the future. As there were no other board questions, the Chair asked members of the public to speak for
or against this item but no one wished to speak.
Motion was made by Albert Jones to recommend approval of this agenda item (TA-060-21) to the City
Commission and was seconded by Chair Robertson. Motion passed 54.
Board Member Hankerson asked to make a comment and said that some of the properties have easements
next to them but with no additional use granted. He has seen signs posted and if Board Member Jones
wanted to picnic on the land, he could come up against some resistance. Board Member Jones thanked
Board Member Hankerson for giving more clarity regarding land use on that particular portion of land.

Commission passed on 2nd reading the text amendment previously heard by the P&Z Board.

REQUEST
TEXT AMENDMENT
To expand the definition of a Medical Office use; per Sec. 725-30,
PUBLIC HEARING NOTICE
This item was duly advertised, posted and noticed pursuant to Article 610 of the Land
Development Code (LDC).
BACKGROUND
The Applicant, Lab Gurus LLC, is the owner of a clinical laboratory in a Commercial (C-2) Zoning
district. Per the justification statement provided by the Applicant, this laboratory performs
toxicology screening on urine samples as well as chemistry and hematology testing on blood
samples. The Applicant is one of many tenants occupying the one-story commercial plaza at 3316
Griffin Road.
Although Medical Offices are permitted in the C-2 district, Medical and Dental Laboratories are
not; per Sec. 110-20. On June 22, 2021, a violation was issued to the applicant for operating a
non -conforming use without a permit. In an effort to address the Code Violation, the Applicant
requests that the definition of a Medical Office be expanded to include laboratories that provide
diagnostic services to health care providers. This type of lab would be limited to 5,000 square feet
bLit would otherwise be subject to the same development regulations as a Medical Office.
The Applicant proposes the following amendment to the Unified LDC:
ARTICLE 725. —DEFINITIONS
Sec. 725-30. —Terms defined.
Office, medical. A facility provng services to the public by physicians, dentists,
surgeons, chiropractors, pharmacists, osteopaths, physical therapists, nurses,
acupuncturists, podiatrists, optometrists, psychiatrists, or others who are duly licensed
to practice their respective professions in the State of Florida, as well as others, including
but not limited to technicians and assistants, who are acting under the supervision and
control of a licensed health care practitioner. A space of 5,000 square feet or less,
consisting of facilities providing diagnostic analysis of medical tests (such as blood test
urinalysis, computerized tomography (CT) x-ray or other medical tests related to
diagnostic treatment) are to be considered as medical offices. Retail pharmacies staffed
by pharmacists that sell prescription drugs, nonprescription drugs or both and other retail
goods for sale to the public, are not medical offices. Offices for social workers and mental
health counselors are not medical offices. Pain management clinics, as defined in this
provision, are medical offices.
This text amendment will require two readings by the City Commission.
RECOMMENDATION
Recommend approval to the City Commission.
ORDINANCE NO.2021-
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
EACH, FLORIDA RELATING TO THE LAND DEVELOPMENT CODE
(LDC); AMENDING SECTION 725-30, ENTITLED "TERMS DEFINED" BY
(1) CREATING A DEFINITION FOR "LABORATORY"; (2) AMENDING THE
DEFINITION OF "OFFICE, MEDICAL" TO INCLUDE SPECIFIC NON -
LABORATORY USES; AND (3) AMENDING SECTION 11540, ENTITLED
"SCHEDULE OF PERMITTED USES" FOR INDUSTRIAL ZONED
DISTRICTS RELATING TO LABORATORIES; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Applicant, Lab Gurus, LLC, requests to update the Land Development
Code amending the definition of "Office, medical" to include specific facilities providing
diagnostic analysis of medical tests within its definition; and
WHEREAS, the Community Development Department recommended approval of the
proposed amendments to the Land Development Code in its report dated October 20, 2021; and
WHEREAS, the City Planning and Zoning Board, sitting as the Local Planning Agency,
held a duly advertised public hearing on October 20, 2021, and recommended approval of the
proposed Ordinance; and
WHEREAS, the City Commission conducted two (2) duly noticed public hearings
relating to the adoption of the LDC amendments; and
WHEREAS, the City Commission finds that it is in the best interest of the City to adopt
the amendments;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMIVHSSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the foregoing WHEREAS clauses are ratified and confirmed as being
true and correct, and they are made a specific part of this Ordinance.
Section 2. That the City's Code of Ordinances, of the Land Development Code, is
amended as follows:

Section 4. That all ordinances or parts of ordinances, resolutions or parts of
resolutions in conflict with this Ordinance are repealed to the extent of such conflict.
Section 5. That this Ordinance shall be in force and take effective immediately upon
its passage and adoption.

JUSTIFICATION FOR REQUEST FOR ZONING TEXT AMENDMENT
RE: OFFICE -BASED LABORATORIES
(1) Lab Gurus

Applicant Lab Gurus LLC ("Lab Gurus") is a licensed clinical laboratory located at 3316 Griffin
Road. Their business is to perform toxicology screening on urine samples as well as chemistry
and hematology testing on blood samples. All samples are delivered to the premises and stored
in refrigerated cases until tested and the results provided to the health care entity providing the
samples for testing for their patients.
In Florida, such office -based labs are regulated by the federal government through the Centers
for Medicaid and Medicare Services' (CMS) administration of the Clinical Laboratory Improvement
Amendments (CLIA). The use is accredited by the Commission on Office Laboratory Accreditation
(COLA) for office -based lab uses and all testing is quality control measured by the College of
American Pathologists (CAP). All testing personnel are licensed through the State of Florida as
required.
(2) Zoning
The City's Code of Ordinances, through its Land Development Regulations, currently relegates
all forms of "Laboratories" to a few Industrial -zoned areas of the City, as provided in Section 115-
40. The LDR do not have a definition of "Laboratory" which has resulted in typical, small, modern-
day laboratories which are regularly found within commercial business settings such as Lab Gurus
to be excluded. By way of example, in the City's C-2/Community Business zoning district, Office
uses, including business, professional and medical offices, are Permitted uses. The proposed
office -based limited testing laboratory is entirely compatible with other commercial office -based
uses in hours of operation and intensity. There are no noxious smells or noises that emanate from
the use and required off-street parking is nominal.
(3) Lease &Building Permits
Due to a mutual misunderstanding and clerical errors with the City, Lab Gurus entered into a lease
with the landlord of its current premises in 2018. In order to use the premises for its intended
purposes, they engaged the services of an architect and general contractor to build the space
out. Building permits and plans were submitted to the City for review and approval. The use has
been in operation since that time. On or about June 2021, City staff conducted a general
inspection of the plaza and identified Lab Gurus as not having the appropriate zoning paperwork
on file with the City. Further review revealed that "Medical and Dental Laboratories" are not

otherwise permitted in the relevant C-2 zoning district. However, City staff has inspected the
premises and has concurred that the use is compatible with other Office and commercial uses.
(4I Summary
The proposed zoning text amendment seeks to create a definon of "Laboratory" such that office -
based lab uses similar to Lab Gurus will be treated the same as other Office -based uses. This
amendment will facilitate ongoing business investment within the City by allowing this highly
compatible use to exist along with other similar uses. More intense "industrial" types of
laboratories engaged in large-scale scientific research, testing and manufacturing using
chemicals and substances will remain within the City's Industrial zoned districts.

Sec. 725-30. - Terms defined.
Laboratory. A room or building equipped for scientific experiments research, teaching, or for the
manufacturing of drugs or chemicals,
Office, business. Any office other than a medical office or professional office. Excludes financial
institutions.
Office, medical. A facility providing services to the public by physicians, dentists, surgeons, chiropractors,
pharmacists, osteopaths, physical therapists, nurses, acupuncturists, podiatrists, optometrists,
psychiatrists, or others who are duly licensed to practice their respective professions in the State of
Florida, as well as others, including but not limited to technicians and assistants, who are acting under the
supervision and control of a licensed health care practitioner. A space of 5,000 SF of less, consisting of
facilities providing diagnostic analysis of medical tests (such as blood test urinalysis, CT scan, x-ray or
other medical tests related to diagnostic treatment) are medical offices. Retail pharmacies staffed by
pharmacists that sell prescription drugs, nonprescription drugs or both and other retail goods for sale to
the public, are not medical offices. Offices for social workers and mental health counselors are not medical
offices. Pain management clinics, as defined in this provision, are medical offices.
Office, professional. An office that is not in the same building with any associated storage or warehousing,
and that functions with minimal on -premises consultation or visitation, in contrast to medical offices,
studios, financial institutions, and other establishments where business transactions occur largely on -
premises.

SUBJECT: TX-079-21: The applicant, the City of Dania Beach, is
requesting a text amendment to the City's Code of
Ordinances, to relocate the enabling language and create
regulations to co -designate street names.
REQUEST
TEXT AMENDMENT
To strike the existing language in the Land Development Code (LDC) and create
new regulations for co -designating street names in the City's Code of Ordinances,
Chapter 22 entitled Streets and Sidewalks.
The City's Land Development Code, Chapter 28, currently references the City
Commissions ability to name or number roads. This reference is being relocated to
Chapter 22 entitled Streets and Sidewalks where is it more appropriately located.
The following language will be relocated:
"The city commission is authorized and empowered to name or number any road,
subdivision street, alley or other thoroughfare wn the city limits and to change
such names or numbers. The fire marshal is authorized to designate and issue
house numbers for properties abutting upon such roads, subdivision streets, alleys
or other thoroughfares."
This is text amendment will require two readings by the City Commission.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COM1i�IISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the preceding "WHEREAS" clauses are ratified and incorporated as a
record of the legislative intent of this Ordinance.
Section 2. That Chapter 22 of the City Code of Ordinances, which Chapter is entitled
"Streets and Sidewalks", at Article I, entitled "In General", at section 22-7A, is amended to read as
follows:
CHAPTER 22
STREETS AND SIDEWALKS
ARTICLE 1— IN GENERAL
Sec. 22-7A. Authority of city commission to co -designation road, alleys, etc.
The city commission may, by resolution adopt after a public hearing, co -designation an 1
road, street, subdivision street or alley within the city limits. All streets shall retain their current
names as co-desi nag tion.
(a) GENERAL PROVISIONS. It shall be the responsibility of the City Manager's Office to
assign an individual to review, implement, and enforce the City's guidelines for co-
designating city streets. Such duties shall include, but no be limited to the following:
(1) Implement the regulations established for co-desi ng ating city streets.
(2) Facilitate citizen input through the process of notifying of property owners withing one
(1) mile of the roadway segment to be co -designated.
(3) Review all applications and advise the applicant as to whether or not the application
has met the requirement set forth in these regulations.
(4) Coordinate the Parks, Recreation, and Community Affairs Advisory Board and any
applicable Homeowner's Association and/or Civic Association review.
(5) Present the completed application and supporting documentation to the City
Commission along with the request for the City Commission's authorization to grant
or deny pplication requests, based on the established requirements. If the City
Commission issues a denial of such change,pplicant must wait two Q years to
re -apply.
(b) All individuals and organizations requesting to co -designate a City of Dania Beach street
must submit a City of Dania Beach Application for co-desi ng ating streets, a petition as
provided below, and an application fee as determined by separate resolution. All costs,
including notices, mailings, sign changes, staff time, etc. as determined by the City
Manager's Office, shall be the responsibility of the applicant. No application shall be
granted by the City Commission until after the City's receipt of payment of the application
fee and notification, mailing, signges, and associated costs. Actual physical or other
co -designation measures, including signa eg changes, shall not be performed by the City
until such additional costs over and above the application fee, as determined by the City
Manager's Office, are paid to the city.
(c) Petition. The applicant shall submit to the City Manager's Office the on ingti al copes
petition which clearly states, on each paged containing_petition signatures, the full intent

of the petition, and which is signed by the owners of fifty percent LbM/ol of the properties
which front on, back on, or have a mailing address containing the name of the affected
street.
(d) Criteria Considered When Reviewing Request To Co -Designate Street. All applications
requesting that a City street be co -designated will be reviewed by the City Manager's
Office for completeness and submitted to the City's Parks, Recreation and Community
Affairs Advisory Board for review and recommendation prior to submission to the City
Commission for consideration. Reviews and Final Determinations will be based on the
following criteria.
(1) Whether or not the request proposed to co -designate the name of a local roadway, street
or alley.
(2) Whether or not the name requested is already being utilized in the immediate or
surrounding neighborhoods, other parts of the City, and/or Broward County.
(3) Whether the requested segment of a particular street to be co -designated will cause
confusion when the segmentation is not created by a natural landform or waterway.
(4) Whether or not the name requested is perceived to be immoral or offensive to portion
of the City's citizenry.
(5) Whether or not the street requested to be co -designated has an existing co -designation
(no more than one co -designation should be authorized).
(6) Whether or not the applicant has met the requirements referenced in this code and have
the support of the surveyed and affected property owners.
(7) Whether or not the street or the existing name of the street requested to be co -designated
has significant historical value to the City.
(8) If named after a person, the person must be deceased without a criminal, fraudulent,
immoral, or offensive history.
(9) If named after a corporation, the corporation, or other non -natural person, must have a
reputation without a criminal, fraudulent, immoral or offensive history.
(e) Notification of Street Co-Desi nag tions
Mail notification of a co -designation request shall follow the requirements identified in
the City's Zoning variance procedures located at Section 610-20, of the Land
Development Code (LDC), with the exception that property owners within one (1) mile
shall be noticed of such request.
2. Newsnaner notification shall follow the same requirements identified in the City's
Zoning variance procedures located at Section 610-20, of the Land Development Code
LDC .
3. Signs developed according to the same requirements as those providing through the
City's Zoning variance procedures located at Section 610-20, of the Land Development
Code (LDC). The signs shall be posted for thirty(30) dgys prior to submittal to the

City Commission at the beginning and end of the affected street and not more than
1,000 feet apartbetween the two street ends and at all intersections with principal
arterial roadways, as defined by the City.
4. Any costs incurred by the City for mailing, notices, sin changes, and other out-of-
pocket arterial roadways, as defined by the City must be paid by the applicant.
5. Following a Final Determination by the City Commission, the City shall be responsible
for providing notice of any approved changes to the City's Fire Department, Police
Department (Broward Sheriff's Office District II Office,) the United States Postal
Service the Broward County Property Appraiser's and Tax Collector's offices and
other applicable governmental agencies.
(f) Automatic Denial. An application shall be denied for the following reasons:
1. A request is made to co-desi nag to any of the following major roadway
North/South Roadways:
• US1/Federal Highway
• Interstate 95
• Dixie Highway
• Beach Road/North Beach Road
• AIA
• US 441/ State Road 7
• Anglers Avenue / Ravenswood
Road
• Gulfstream Road
East/West Roadways:
• Stirling Road
• Sheridan Street
• Dania Beach Boulevard
• Park Street
2. An application is not submitted with all requirements identified by this section.
3. A portion of the street has already been co-desi ng ated.
4. A request was proposed and considered by the City within two (2) years of the date of
submittal of the application.
5. Another street has already been so co -designated or is concurrent) being for
co -designation with the same name, unless the streets are continuation of the same
roadwayacross a north/south or east/west division line.
6. The individual after whom the street is to be co -designated had been convicted for a
felon�or any crime involving moral turpitude or had pending charges of a felony on
any crime involving moral turpitude at the time of his or her death.
7. The corporation or other non -natural person, after whom the street is to be co -
designated must have a reputation (and its officers and representatives) without a felony
criminal, fraudulent, immoral or offensive historv.
8. The street was named prior to 1949.
(g) Parks Recreation And Community Affairs Advisory Board. After the application has been
fully reviewed by the City Manager's Office, it shall be submitted to the Parks, Recreation
and Community Affairs Advisory Board. The process generally utilized by the Board for
other matters shall be utilized for the co -designation of Streets process. However, the
decision of the Board shall be advisory only and shall be submitted to the City of Dania
Beach City Commission for a Final Determination.
(h) Final Determination. The City Commission shall make a Final Determination of rg anting
or denying an application. In doing so, the City Commission shall have absolute discretion
for co -designating a City of Dania Beach street shall be handled by the City Commission
as an ordinance requiring two readings, one of which shall be a Public Hearing. Final
gpproval shall required a 4/5 vote of the City Commission.
(i) Waiver of Guidelines. The City shall consider a waiver to any_portion of these guidelines
for procedures except for Section f, entitled "Automatic Denials," if by a 4/5 vote of the
City Commission the Commission agrees to such a waiver of said portion for an other
ther
reason.
Section 3. That Chapter 28 ,entitled the "Land Development Code", at Article 700 Entitled,
"Code Administration And Legal Provisions", Section 700-150 entitled "Authority Of City
Commission To Name, Rename, Number Or Renumber Roads, Alleys, Etc." of the City Code of
Ordinances, is amended to read as follows:

Section 4. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 5. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed to the extent of such conflict.
Section 6. That this Ordinance shall be effective immediately upon its passage and
adoption on second reading.
