HomeMy WebLinkAboutR-2008-116 Green Oaks Site Plan RESOLUTION NO. 2008-116 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY JODY OBERHOLTZER, MANAGING MEMBER OF GREEN OAKS LLC, FOR PROPERTY LOCATED AT 2960 SW 23Ro TERRACE, IN THE CITY OF DANIA BEACH, FLORIDA; PROVIDING FOR CONFLICTS;FURTHER,PROVIDING FOR AN EFFECTIVE DATE. WHEREAS,Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS,Jody Oberholtzer, Managing Member of Green Oaks, LLC., is requesting site plan approval (SP-74-07) for the proposed construction of a 33,000 square foot warehouse/office project to be located at 2960 SW 23`d Terrace, in the City of Dania Beach; and WHEREAS,the Planning and Zoning Board on June 18,2008, recommended that the City Commission grant the site plan request(SP-74-07),based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-74-07) for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit"A" is approved with the following conditions: 1. Provide a sliding gate and knox box at the south east corner of property on site plan, per agreement with neighboring property owner prior to issuance of a building permit(Planning Division). 2. Applicant must pay$17,878 for Tree Mitigation fees prior to issuance of a building permit (Landscape Consultant). 3. The following items listed in a notarized agreement between Mr. Oberholtzer and Mr. Kunzig: 1. The west side of the above mentioned easement will be used for emergency vehicles only. 2. There will be a sliding gate installed, that will be closed at all times, with a knox box. 3. The easement on the south side will act as an entrance. 4. The opening to the wall will not exceed 40 feet. 5. There will be a sliding gate installed to WHB Holdings, LLC existing building, situated approximately 19 feet to the south from Mr. Kunzig's property line. 6. WHB Holdings,LLC will be responsible for 60%of all maintenance and repairs of the 24 foot easement. 7. WHB Holding, LLC will maintain the south side of wall. It is further noted that the original site plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 8-4(p)of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 12 months from the date of this Resolution. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. 2 RESOLUTION 42008-1 I6 Section 4. Dania Beach Boulevard Dania Beach, Florida 33004 Re: Criteria Statement Nov 2 B 2007 Office/Warehouse Condos For Green Oak, LLC Planning Lots 8- 13, Green Oak Department Dania Beach, Florida Job No. 07-10-55 Dear Staff Members: This Site Plan Review application for the construction of an office warehouse building is consistent with the following criteria found in the Zoning Code: 1. Purpose (18.10) The Industrial-Research-Office-Marine (IROM) district is intended to accommodate marine, office, light industrial and research uses which are conducted within completely enclosed buildings and which have limited impact outside of a building. 2. Permitting Uses (18.20) These office/warehouse condos are intended for small marine related office, research, product development and testing, engineering development and marketing development as outlined in Section 18.20 of the Zoning Code. 3. Prohibited Uses (18.30) No prohibited uses are intended to be located in this facility. 4. Special Exception Uses No special exception uses are intended to be located in this building at this time. Any such use shall need review and approval by the Planning and Zoning Advisory Board and the City Commission as per Section 10.12 of the Zoning Code. 901 S. Required Conditions (18.50) (a) All activities shall be conducted within a completely enclosed building. (b) Due to the size and configuration of this parcel (600' street frontage x 131'-6" depth), we are requesting that loading and unloading areas be permitted in the front yard for those units facing the front yard. Setback and parking configuration requirements make it impractical to provide loading and unloading areas only on rear yards or side yards. (c) Access to loading and unloading areas allows trucks to enter and leave the site without having to back from or onto a public street. (d) No user shall produce smoke, harsh glare, or visual hazards, nor shall any use produce electronic interference with navigation signals or radio communication between aircraft and the Fort Lauderdale-Hollywood International Airport. (e) Written notice from the Broward County Aviation Department shall be provided stating the proposed site plan and height of the structure present no problems to that department. (f) This application will require site plan review by the Planning and Zoning Advisory Board and approval by the City Commission prior to issuance of a building permit. 6. Area Requirements (18.60) (a) The proposed building does not exceed 62 feet or 5 stores in height. (b) Buildings, structures and impervious surfaces do not exceed 70% of the total lot area pursuant to Section 29.10 of the Zoning Code. (c) Yards—This proposed site plan complies with all required yard setbacks. 7. Approval of Site Development Plan (18.70) This development shall be reviewed by the Planning and Zoning Advisory Board and approved by the City Commission prior to the issuance of any building permits. 8. Lawfully Existing Development(18.80) There are no existing structures on this site and thus there are no existing non-conforming conditions. Thank you for your attention in this matter.
