DANIA CITY COMMISSION
NOVEMBER 24, 1981

Mayor Bertino announced the presence of Senator, Ken Jenne in the,audience.
1. A motion was made by Commissioner Donly, seconded by Commissioner Cook
to approve the minutes of the regular meeting of November loth and the
special meeting of November 17th, 1981. The motion passed unanimously.
2. Nanci Bright from the Broward County Trafficways Committee was present
to clarify the 80' right-of-way on SW 4th Avenue on the Broward County
Trafficways Plan. Discussion followed concerning property owners being
compensated for that land that may be used as a right-of-way on the
Trafficways Plan in the future. Ms. Bright informed the Commission that
the deadline for the City to request removal of this right-of-way from
the Trafficways Plan is December 1, 1981, and that this request will be
properly evaluated and that public hearings would be set faith regards to
possible amendment to this plan.
A motion was made by Commissioner Cook, seconded by Commissioner Adams to
request Broward County to remove the 80' right-of-way from the Traffic-
ways Plan which involves Sheridan Street to NW loth Street (4th Avenue,
4th Court, and Dixie Hight).
A motion was made by Commissioner Donly to amend this motion to instruct the
Building Department to prepare the necessary documents to have the Commission
rezone the areas in the corridor concerning the 80' right-of-way that is now
zoned Industrial to be down-zoned to C-2 Commercial .
City Attorney Adler recommended that the amendment be a separate motion.
Commissioner Donly withdrew his motion to amend and requested that he be
allowed to present another motion after the first motion is complete.
The original motion by Commissioner Cook passed on the following roll call
vote:
Commissioner Adams-yes Commissioner Donly-no
Commissioner Byrd-no Mayor Bertino-yes
Commissioner Cook-yes
Commissioner Donly then made a motion that the Commission initiate the process
< of rezoning the property in the corridor that is now zoned Industrial to be
rezoned C-2 Commercial zoning. Commissioner Byrd seconded this motion.

Commissioner Cook questioned this action due to this Commission already
approving a plan to build in that area being subject to the change in
this Trafficways Plan.
Mayor Bertino clarified the motion that the staff will go on with the
necessary process to start rezoning.which would stop the building of
warehouses along this corridor.
The motion passed on the following roll call vote:

Commissioner Byrd-yes Mayor Bertino-yes

3. A motion was made by Commissioner Donly, seconded by Commissioner Byrd to
continue the continuation of approval of the Traffic Engineering Agreement
between the City of Dania and Broward County. The motion passed uananimously..
4. City Manager Marant informed the Commission that '!r. James Lay who was award-
ed the bid for the 20' fiberglass Correct Craft, tabago model boat has de-
cided that he does not want the boat after all . Mr. Marant requested per-
mission to readvertise for bids for the sale of this boat acid assured the
Commisison that he will not readvertise until he has received a letter from
Mr. Lay stating his withdrawal from the bid.
A motion was made by Commissioner Cook to rescind the motion approving the
bid for the 20' fiberglass Correct Craft boat to Mr. James Lay that was passed
at the, October 27th regular meeting. Commissioner Donly seconded this motion.
The motion passed unanimously. '
A motion was then made by Commissioner Donly, seconded by Commissioner Adams to
readvertise for bids for the 20' fiberglass Correct Craft, Tobago model boat.
The motion passed unanimously.
5. Senator and Attorney Ken Jenne, representing Ves Carpenter Contractors, stepped
forward to request the Commission to vacate the street right-of-way located at
the northwest corner of Southeast Fifth Avenue and Sheridan Street, formerly
known as Hood Avenue.
City Attorney Adler informed the Commission that Mr. Jenne's request should
now be referred to the Planning & Zoning Board for their recommendation to
the City Commission as stipulated in the City Charter.
A motion was made by Commissioner Adams, seconded by Commissioner Cook to
refer the request from Ves Carpenter Contractors to vacate the street right-
of-way located at the northwest corner of Southeast Fifth Avenue and Sheridan
Street, formerly known as Hood Avenue,to the Planning and Zoning Board for
them to make a recommendation back to the City Commission. The motion passed
unanimously.
6. Commissioner Donly requested approval of the resolution requesting the legisla-
ture of the State of Florida to inact legislation levying an additional sales
tax with a distribution formula that is equitable and justifiable, and in
proportion to theneeds of the citizens of municipalities to provide necessary
and essential services.
A motion was then made by Commissioner Donly to approve this resolution with an.�
amendment to change Section 2 to Section 3 and add a new Section 2 stating:
"that a mandatory minimum reduction in property taxes for fiscal year 1981-82
levels equal to the increase in revenue to local governments resulting from
the one cent (4) sales tax legislation multiplied by the percentage of the
sales tax paid by Floridians be guaranteed." Commissioner Byrd seconded this
motion. This motion passed unanimously.
7. Mayor Bertino informed the Commission on liability insurance for municipalities
and the cost.

City Manager Marant presented a report on the premiums paid by several
local municipalities and the coverage from Risk Management.
City Attorney Adler recommended that Dania he well covered for liability
insurance because he expects there to be alot of cases taken to Federal
Courts':
After further discussion, the Commission decided to keep the City's liabi-
lity insurance coverage as is; $500,000 coverage with a cost of approxi-
mately $7,300.00 per year.
8. Mr. Joel Vollinsky stepped forward to request the City of Dania to participate
in a joint public hearing to review the airport expansion project on January
27, 1982, at 2:00 P.M. and to advertisd the public hearing in a local news-
paper. He added that the Broward County Commission and the Fort Lauderdale
Commission voted on November 17th in favor ofhaving this joint public hearing
to be held at the Florida Department of Transportation Auditorium.
After further discussion, a motion was made by Commissioner Byrd, seconded
by Commissioner Donly to schedule a joint public hearing for 2:00 P.M.
January 27, 1982, to discuss the airport expansion project and the advertise
this public hearing in a local newspaper. The motion passed unanimously.
Mr. Vollinsky informed City Manager Marant that he should check the possibility
as to whether this item must be brought before Dania's Planning & Zoning Board.
Mr. Marant informed him that he would see to it that it would be brought up
at the December Meeting even though the Commission has already taken action
as far as advertising.
City Attorney Adler said he would review the City Charter to be sure that
Dania can hold a meeting in Fort Lauderdale. Mr. Marant added that he would
post notices and inform the press.
Mr. Marant then instructed Building Official Maxwell to see to it that this
item was placed on the agenda for the first meeting in January on the Planning
& Zoning Board. (This meeting would be January 5, 1982)
9. Citizens' Comments:
Mr. Stanley Rosenberg stepped forward to inquire about Houston Park and if
the information he has read in the newspapers was correct. City Manager Marant
informed him that the City had received $25,000 around September 1st from
Marine Conversions which is in conjunction with their contract. In addition,
Marine Conversions has applied to Broward County for platting and that this is
a timely procedure. He then stated that he had written a letter to Mr. David
Graham, Marine Conversions, with regards to their financing. Mr. Harant con-
tinued to say that Marine Conversions has not violated their contract, as of
this date, and that they have done everything they were-suppose• to do, in a
timely manner.
Mr. Carroll-SE 3rd. Place stepped forward to thank the City for cleaning the
catch basins in his area. He also commented on his high property taxes this
year.
Brenda Blackmon-20 SW 7th Avenue requested a meeting be set for the Parks and
Recreation Board.
10. Administrative Reports:
City Attorney Adler informed the Commission of a letter he has received from
the attorneys representing the Dania Shopping Center requesting permission to .
come before this Commission for building permits. He stated that he would in-
form them that the Commission does not have this authority and that it would
be improper for them to appear.
He also reported that he had sent a letter to the people who were going to
build bus shelters in the City of Dania. The letter gives them a 45 days
notice that the contract with them is cancelled, due to their not building
at-least 10 of these facilities in the first year of the contract.

11. Commission Comments:
Mayor Bertino read a letter from Judge George Shahood commending the City
of Dania Administration and City Employees and announcing his appointment
by Governor Bob Graham as a Circuit Court Judge, and that he would be leaving
the South Regional County Courthouse facility in December.
Mayor Bertino requested that an item be placed on the next regular meeting
agenda (December 8, 1981) concerning the concept of the City Commission hiring
an actuarial firm to come in and do an actuarial study of the City of Dania's
General Employee's Pension Plan explaining the exact costs to the City for
this plan.
Commissioner Byrd inquired about the progress that is being made for the
sewer construction in the area of Southwest 3rd. Place and 2nd. Place.
Mr. Marant informed him that he would check into this for him with Mr.
Farina the City Engineer tomorrow.
City Attorney Adler then explained that Mr. John Kelly from Broward County
Community Development does not want to start the contract on this construction
until every easement has been obtained that is necessary for this project to
begin.
Commissioner Cook informed the Commission of a very good turnout at the
Attucks School Community Awareness Program on Saturday.
Commissioner Donly reported that the Strike Force meetings are continuing .con-
cerning tax relief. He also added that he feels progress is being made.
A motion was made by Commissioner Donly, secodded by Commissioner Byrd to
adjourn this meeting. The motion passed unanimously.

Dear Mayor Bertino:
As you may be aware, I have recently been appointed by
Governor Bob Graham as a Circuit Court Judge and will , there-
fore, be leaving the South Regional County Courthouse facility
in December.
During the past three years, while assigned to the South
Regional Courthouse, it has indeed been nay pleasure to work
with the City of Dania. Your various agencies, including the
police department, code enforcement board and other departments,
have always been cooperative with nay office. Accordingly, I .
want to take this opportunity to commend your various departments
for their fine employees.
I would appreciate.your reading this letter at your next
council or commission meeting to enable me to express my thanks
to your commissioners, councilmen and staff.
If I may be of.any assistance to you or any of your council-
men as your Circuit Court judge, please do not hesitate to call
upon me.
