Byrd Commissioners: James Adams Robert Donly City Attorney: Frank Adler City Manager: Richard Marant City Clerk: Wanda' Mullikin Absent: Commissioner: Jean Cook A motion was made by Commissioner. Byrd, seconded by Commissioner Donly to excuse Commissioner Cook from this meeting. The motion passed unanimously. 1. Public Hearings: (Item b a) Mayor Bertino opened the public hearing on adoption of a re- on agenda) solution approving the millage rate necessary to be levied for the fiscal year 1982-83. Hearing no one speak in favor or opposition, the Mayor closed the public hearing. City Attorney Adler then read the resolution in its entirety. A motion was made by Commissioner Byrd, seconded by Commissioner Donly to adopt the resolution approving the millage rate (5.3170) necessary to be levied for the fiscal year 1982-83. The motion passed on the following roll call vote: Commissioner Adams-yes Commissioner Donly-yes Commissioner Byrd-yes Mayor Bertino-yes (Item a b) Mayor Bertino opened the public hearing on adoption of resolution . on agenda) for the final approval and adoption of the annual budget for the City of Dania for fiscal year 1982-83. Hearing no one speak in favor or opposition, the Mayor then closed the public hearing. A motion was made by Commissioner Donly, seconded by Commissioner Adams to adopt the resolution approving the final annual budget for the fiscal year 1982-83. Mayor Bertino expressed that if there is any monies left over at the time of the mid-year budget revisions, that he would like to see that money used towards further road improvements. Commissioner Byrd suggested that something should be done to re- pair the lights at Modello Park before they will have to be com- pletely removed at a larger expense to the City. City Manager Marant informed the Commission that he is aware of the problem with the lights at Modello Park and that he will review the situation on whether this will constitute spending a large sum of money or just make repairs. The motion passed on the following roll call vote: Commissioner Adams-yes Commissioner Donly-yes Commissioner Byrd-yes Mayor Bertino-yes r.` • ADDENDUM ITEMS: EMERGENCY RE UEST TO AUTHORIZE EXPENDITURE OF APPROXIMATELY $3 800.00 TO PURCHASE ONE 1 BRONZE RING GEAR FOR THE WATER PLANT: City Manager Marant explained that the ring gear for the water plant has worn out and that, at this point, water is being bought from the City of Hollywood due to this problem. He also added that finding this ring gear was quite a problem and that Dania will have to pay a 35% sur charge in order to receive this ring gear within an eight (3) week period. A motion was made by Commissioner Donly, seconded by Commissioner Byrd to declare this item an emergency due to the time problems. The motion passed unanimously. A motion was made by Commissioner Donly, seconded by Commissioner Adams to adopt a resolution approving the expenditure of $3,800.00 for the purchase of this ring gear without going out to competitive bidding. The motion passed unanimously. LAWSUIT AGAINST COUNTY ON ROAD AND BRIDGE TAXES: Mayor Bertino informed the Commission that the City of Coral Springs is attempting to unite cities in Broward County in a lawsuit against the County regarding.the distribution of the road and bridge taxes. A motion was made by Commissioner Donly, seconded by Commissioner Adams to declare an emergency entering into the lawsuit with Coral Springs against the County regarding road and bridge tax distribution, as this is being done next week and they need Dania's answer. The motion passed unanimously. A motion was made by Commissioner Byrd, seconded by Commissioner Adams to authorize the City Manager to spend up to $1,000.00 to enter into the lawsuit with Coral Springs and to authorize the City Attorney to contact Coral Spring's City Attorney and indicate that Dania would .,. like to be a party in this lawsuit. The motion passed unanimously. A motion was made by Commissioner Donly, seconded by Commissioner Adams to adjourn this meeting. The motion passed unanimously.
