Commissioner Cook to approve the consent agenda. The motion
passed on the following roll call vote:

2. RESOLUTIONS
2. 1 The title of a RESOLUTION OF THE CITY OF DANIA, FLORIDA,
AUTHORIZING THE CITY MANAGER TO COMPLETE THE
ARRANGEMENTS WITH CARIBANK FOR A LOAN IN AN AMOUNT UP TO
TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000.00) AT THE
INTEREST RATE OF SEVEN AND ONE-HALF PER CENT (71/2) PER
ANNUM AND PAYABLE OVER A TERM OF FIVE (5) YEARS TO
FINANCE REPAIRS AND MODIFICATIONS IN THE CITY SANITARY
SEWER SYSTEM; AND AUTHORIZING THE' APPROPRIATE CITY
OFFICIALS TO EXECUTE ALL DOCUMENTS NECESSARY TO CLOSE
SAID LOAN TRANSACTION was read by Mayor Byrd.
A motion was made by Vice-Mayor Bertino, seconded by
Commissioner Adams to adopt the resolution authorizing
the City Manager to borrow $250,000.00 from Caribank at
7-1/28 interest for 5 years to finance repairs and
modifications to the City Sanitary Sewer System. The
motion passed on the following roll call vote:

M. PHIPPEN'S SUBDIVISION" , AS RECORDED IN PLAT BOOK 2,
PAGE 90, OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA,
LESS THAT PORTION USED FOR PHIPPEN ROAD AND STIRLING
ROAD RIGHT OF WAY. SAID LANDS SITUATE, LYING AND BEING
IN BROWARD COUNTY, FLORIDA, FROM ZONING CLASSIFICATION
OF RM TO C-4 ZONING CLASSIFICATION UNDER THE PROVISIONS
OF ORDINANCE NO. 100 OF THE CITY OF DANIA, FLORIDA, AS

Clinton F. Hill, the petitioner, stepped forward to
request rezoning property located at 602 Stirling Road
from RM (Residential Multi-family) to C-4 (Commercial)
zoning classification.
Mayor Byrd opened the public hearing. Hearing no one
speak in favor or opposition, the Mayor closed the
public hearing.
A motion was made by Vice-Mayor Bertino, seconded by
Commissioner Donly to adopt the ordinance rezoning Block
"C" of "George M. Phippen' s Subdivision" from RM to C-4
zoning classification on second and final reading. The
motion passed on the following roll call vote:

The land surveyor for Jacques Gallet, the petitioner,
stepped forward to request plat approval for "Carib
Plat" (property located on the Northeast corner of
Stirling Road and SW 12th Avenue) .
Mayor Byrd opened the public hearing. Hearing no one
speak in favor or opposition, the Mayor closed the
public hearing.
A motion was made by Commissioner Donly, seconded by
Commissioner Cook to adopt the ordinance approving the
plat of "Carib Plat" on second and final reading. The

William P. Brook, the petitioner, stepped forward to
request rezoning of property located at 1400 Griffin
Road from A-1 (Agricultural) to C-4 (Commercial) zoning
classification.
Mayor Byrd opened the public hearing. Hearing Bob Mikes
comment on the need for a treed buffer area on the north
canal side of the road, the Mayor closed the public
hearing.
Building Official Maxwell explained that the Planning
and Zoning Board recommended approval of the request
with the stipulation that a 10 foot "buffer" area
(trees, etc. ) be placed between the sidewalk and any
proposed commercial buildings.
A motion was made by Commissioner Adams, seconded by
Commissioner Cook to adopt the rezoning ordinance with
the stipulation that a 10 foot "buffer" area ( trees,
etc. ) , as recommended by the PSZ Board, be placed on the
north side of the road in lieu of the south side. The

5. VACATION OF RIGHT OF WAY (BY RESOLUTION)
5. 1 PV-34-84 - Kristin Hayes Coker, Keith and Schnars, P.A.
Kristin Hayes Coker stepped forward to request vacation
of a strip of land approximately' 160.11 ' x 15 ' on the
south side of Griffin Road, east of Bryan Road due to
the County's trafficways plan downgrading.
A motion was made by Commissioner Donly, seconded by
Vice-Mayor Bertino to adopt a Resolution vacating the
property legally described in PV-34-84. The motion
passed unanimously.
5.2 PV-40-84 - Bond/Vitolo, N.E. 20th Street.
and
5. 3 PV-41-84 - Bond/Vitolo, N.E. 24th Street.
John A. Bond, Attorney for the petitioners, stepped
forward to request vacation of a strip. of land
approximately 15' x 1120 ' on N.E. 20th Street and to
request vacation of a strip of land approximately 15' x
570 ' on N.E. 24th Street.
A motion was made by Vice-Mayor Bertino, seconded by .
Commissioner Donly to adopt a Resolution vacating the
property on N.E. 20th St. as legally described in
PV-40-84. The motion passed unanimously.
A motion was made by Vice-Mayor Bertino, seconded by
Commissioner Cook to adopt a Resolution vacating the
property on N.E. 24th St. as legally described in
PV-41-84. The motion passed unanimously.
6. REQUEST FOR FUND APPROVAL
6.1 Request by the Police Department to replenish their
Investigative Account (Law Enforcement Trust Account) in
the amount of $1, 308. 10.
A motion was made by Vice-Mayor Bertino, seconded by
Commissioner Donly to authorize the Police Department to
replenish the Law Enforcement Trust Account in the
amount of $1, 308.10. The motion passed unanimously.
6.2 Request by the Police Department (Detective Division)
for Monies in the amount of $2,000.00 for the purpose of,
use during drug investigations.
A motion was made by Vice-Mayor Bertino, seconded by
Commissioner Donly to authorize disbursement by the
Police Department of $2,000.00 for the purpose of use
during drug investigations.

11. DISCUSSION
11. 1 RESOURCE RECOVERY. Mayor Byrd
The Commissioners discussed their individual positions
as to whether or not the City should lend its support to
the League of Cities in its attempt to develop a back-up
resource recovery plan should the County' s fail.
While Mayor Byrd and Commissioner Cook expressed
confidence in the County's plan and felt it unnecessary
to spend money to have the League of Cities duplicate
the County's efforts, Vice-Mayor Bertino, Commissioner
Donly and Commissioner Adams felt that the cities should
be ready to do something if the County does not and that
a feasibility study and general plan of action by the
League of Cities should be supported.
All the Commissioners agreed that the cities
contributing the waste should participate in the control
of the resource recovery plants.

13. 1 Commissioner Adams commented on the General Employees
Pension Board meeting and said that ,the amendment to
Ordinance No. 268 which would allow elected officials to
be included in the pension plan will be on the agenda
for the next Commission meeting of August 28th.
