1 . CONSENT AGENDA
MINUTES
1 . 1 REGULAR COMMISSION MEETING, OCTOBER 9, 1984.
A motion was made by Vice-Mayor Bertino, seconded by .
Commissioner DonLy to approve the consent agenda. The motion
passed unanimously.
2. APPOINTMENTS
2. 1 Commission Appointment to fill unexpired term of
Commissioner Robert "Bo" DonLy.
A motion was made by Commissioner Cook, seconded by
Commissioner Adams to reappoint Robert DonLy to the
Dania City Commission to serve the remainder of his
term.
The motion passed on the foLLowing roll call vote:
Commissioner Adams-yes Vice-Mayor Bertino-yes
Commissioner Cook-yes Mayor Byrd-yes
Commissioner DonLy-yes
2.2 Unsafe Structures Board; per letter from Eddie
Cornelius, Sr. regarding resignation,
AND
2. 3 Unsafe Structures Board; per letter from Anita Serpe
regarding resignation.
(Items 2.2 and 2.3 were addressed simultaneously.)
City Manager Marant advised the Commission of the
resignations of Eddie Cornelius, Sr. and Anita Serpe
from the Unsafe Structures Board and noted the necessity
for two replacement appointments to the Unsafe
Structures Board to be made.
Commissioner DonLy suggested that Letters of apprecia-
tion be sent to Eddie Cornelius, Sr. and Anita Serpe for
outstanding service.
A motion was made by Commissioner Cook, seconded by
Vice-Mayor Bertino to accept with regret the resigna-
tions of Eddie Cornelius, Sr. and Anita Serpe from the
Unsafe Structures Board. The motion passed on the
following roll call vote :

2.4 Appointment of Robert "Bo" DonLy as Dania Representative
to the South Broward Park District .
Mayor Byrd reminded the Commissioners of his desire to
be considered for this appointment and, temporarily
relinquishing the gavel, nominated himself. The
nomination did not receive a second.
A .motion was made by Commissioner Adams, seconded by
Vice—Mayor Bertino, to appoint Commissioner DonLy to
replace John Bertino as the City of Dania ' s Representa—
tive to the South Broward Park District . The motion
passed on the following roll call vote:

ADDENDUM ITEM :
2. 5 Reappointment of Mr. Thomas Sette to the Dania Housing
Authority (Mayor Chester Byrd)
A motion was made by Commissioner DonLy, seconded by
Vice—Mayor Bertino to adopt a resolution to reappoint
Thomas Sette to the Dania Housing Authority. The motion
passed on the following roll call vote:

Variances
4. 1 PZ-20-84, Michael L. Thomas, 1601 Griffin Road;
(Continued from .October 9, 1984 Meeting) .
t . Building Official Maxwell commented on the variance
request and the Planning and Zoning Board's
recommendations, and advised that if the variance is
granted, it should be contingent upon the project moving
ahead and being in compliance with the Land use plan.
Ross Beckerman, Attorney for the petitioner, stepped
forward to explain the three—part variance request :
1 ) To allow construction at a greater height than
allowed in an I—G zoning classification. He
(' explained that the hotel is designed to increase in
height from north to south to conform to avigation
easements .

The P&Z Board recommends approval for a building of
97. 1 ' in height contingent upon FAA approvaL .
2) To allow reduced number of required parking spaces.
Mr. Beckerman referred to a site plan and
t_ calculations prepared by the architects and
explained that the number of requested spaces was
originally 416 but was changed to 460 based on the
calculations submitted on 9/7/84. He explained
that the request for reduced number of required .
parking spaces is necessitated by the configuration
of the property and environmental concerns, but
j•;_!,; stated that as it wiLL be an "airport hotel", it is
assumed that many guests will arrive and Leave by
shuttle.

The P&Z Board recommends approval for a reduction of
required parking spaces, 460 spaces to be provided
contingent upon 633 spaces being the required number of
parking spaces required by the City of Dania when final
plans are reviewed. (633 parking spaces are assumed to
be the required number of spaces required, as calculated
by the developer' s calculations of September 7, 1984. )
. 3) Mr. Beckerman explained that the original request
for variance regarding size and percentage of
parking spaces no longer applies due to the fact
that the City has since enacted a Parking Ordinance
which the petitioner will comply with .
The P&Z Board recommends that size and percentage of
parking spaces shall comply with the City of Dania
Parking Ordinance.
Mayor Byrd opened the public hearing. Bob Mikes
suggested that project renderings should be provided
with such variance requests for the benefit of the
residents . Hearing Bob Mikes comment in favor from an
environmental standpoint and in opposition to cutting
back the number of parking spaces, the Mayor closed the
public hearing.
A motion was made by Commissioner Donly, seconded by
Commissioner Adams to approve the variance requests per
the Planning and Zoning Board recommendations, all
contingent upon compliance with the land use plan.
Discussion of the motion ensued regarding the viability
of a 30% reduction of parking spaces for airport hotels
not adequately addressed in the City' s ordinance.
A motion was made by Vice-Mayor Bertino, seconded by
Commissioner Cook to table this item until the next
regular meeting of November 13, 1984, in order to give
the developer time to provide more definite back-up
information to support the request. The motion passed
unanimously.

10. DISCUSSION
10.1 Discussion of Pembroke Pines Ordinance regarding Off
Road Vehicles/Cycles, on privately owned Land.
The Commission discussed the Pembroke Pines Ordinance, a
copy of which was requested and received by City Manager
Marant .
Vice-Mayor Bertino stressed the fact that the main
problem is that the Police Department has no authority
to control off-road vehicles being operated on privately
owned land without the property owner's cooperation in
prosecuting.
Commissioner Cook suggested that boats and water
vehicles be included in the proposed ordinance.
City Attorney Adler was directed to prepare an ordinance
similar to the Pembroke Pines Ordinance.

12. COMMISSIONERS COMMENTS
12. 1 COMMISSIONER ADAMS announced that on Saturday, October
27th, the Dania Lions ' Club will. sponsor a chicken and
rib barbeque at a donation of $6. 00 per person, from
3:00 to 7:00 p .m. at SW 4th Ave. & 5th St .
12.2 COMMISSIONER COOK - no comment .
12.3 COMMISSIONER DONLY thanked the Commissioners for
reappointing him to the Commission and for his appoint-
ment to the South Broward Park District Board.
12.4 VICE-MAYOR BERTINO - no comment .
12.5 MAYOR BYRD - no comment .
13. CITIZENS ' COMMENTS

13. 1 Mr. Robert Judd, of 40 S .E. 8th Street .
Regarding, Newspaper agencies and Ad agencies leaving
circulars, and newspapers on his property.
City Manager Marant quoted from Section 3-7 of the Dania
Code entitled "Distribution of circulars and handbills":
"No person, through themselves or their agents, shall
distribute or otherwise circulate handbills or other
forms of printed advertising matter of any kind within
the city without first obtaining a permit to do so from
the city manager."
City Manager Marant stated that requests for such
permits are very rare and that this is the first
complaint of this nature. He said that he would have a
Code Enforcement Officer respond to this type of
problem.
