The City Commission of the City of Dania, Florida, met in • Special Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S'. BRICE FRANK SALVINO (ABSENT) S. ELLIS YOUNG CARL ZENOBIA • CITY ATTORNEY CLARKE WALDEN CITY MANAGER STANLEY GOLDBERG CHIEF OF POLICE MONTIE' SMITH BUILDING INSPECTOR CHARLES LINDEMAN (ABSENT) CITY CLERK MARY THORNHILL • The meeting was called to order at 8:00 P.M. by Mayor Adams, after which Pledge of Allegiance was held. BILL: From Broome & Farina $ 7,676.20 • Mayor Adams stated that this bill was tabled from a previous meet- ing for further investigation. A motion was made by Commissioner Zenobia that the bill be paid. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: • Brice Yes Young Yes Zenobia" i Yes Adams - Yes • PUBLIC HEARING:, , Proposed Budget for the year 1966-1967 Mayor Adams requested that each'.person=wishing. to speak should - limit themselves to 3 minutes. City Manager Goldberg stated that the tax rate has .been dropped from 5 .5 mills to 4.11 mills; this years budget- is only.$60,000 over last years budget of -$728,000. This represents only an, 8% increase as compared to other cities of 15 to 20%• Salary raises ' given last year and were not included 'in last years budget account. . for $27,000. Proposed salary raises included in this years budget account for an additional $231000;= a total of $50,000. This means only $10,000 added in a.budget this year represents $789,000. This is considered a, very frugal figure made possible only by an increase in efficiency and co-operation. ,In"•addition to salary increases) other major, provisions 'of:',the .budget include $40',000 for streets; y, $18,000 for parks; $5,000 for building and meters; . and $25,B00 for , . contingencies; and $31,000 for special, projects. The hoped-for soon-to-be-completed sewer system and financially sound investment 0 and operation of the city is combined to give" substantial growth to Dania, an activity conspicuously absent in the City as compared to its neighboring cities, �.`:It-i ,'felt::::thate�strong•Zsu port-and'z proper administration and planning will provide Dania with important . progress beneficial to all of its citizens. ® City Manager Goldberg continued. "In light of ;the fact that there are very few things that we can think"of over the past year that are not increased substantially, in light. of the fact that all' of":the complaints and charges and what-have-you that we have heard throughout the county and throughout the state, that this budget as proposed- is a very reason- able and a very frugal budget, and I .believe that it is the minimum budget that we could hope for, and hope.for the ,ppogress that we all 11 look forward to in the coming .years. r' f; Mayor Adams pointed out that the budget this year represents 23%' of ad valorem tax, where in 1960 it was 35% of ad valorem tax. "So actually we are operating, as far ad valorem tax, on quite a bit less than we were in 1960." . Mayor Adams called for objections to the budget, Mr. Houston asked some questions about the budget, and pointed out a few items in the budget. He stated that, in his opinion, these items were overestimated and will not bring in the anticipated income. Mr. Houston and Bill Brooks both commented on the proposed estimated income from Pirate Ports. 1. Mr. Houston objected to the raises proposed for the City Commission, the City Manager and the City. Attorney. The Commission replied that they felt that the added work in connec- tion with the sewer program was 'reason enough-for the City Attorney's raise; and that when the Commission unanimously hired Mr. Goldberg .as City Manager they agreed ,that they could only hire him at $9,000 which was budgeted, but that when the new budget went into. effect he would get a raise. They also felt that he was a competent City. Manager and well worth the raise. Ed Burton, volunteer fireman, asked about salaries for firemen as compared to policemen. Commissioner Zenobia stated that proportionately they will get the ' . . same amount of money in 'raises. He also stated that: the Commission in past years has approved raises which the Chief has not given to the men. Chief Lassiter replied that he has contended for quite .a number of - years that a man coming to work at .the starting pay could, not possibly be worth top pay to the City in six months. He has set up a policy in the fire department, and he talked to the Police Chief 2 years ago, and he agreed with him; but he.has not carried out that policy, he has raised the men in six months- to top pay the same as men who have been here ten years. But basically; the Policeman's. duty and the Fireman's duty to the city is the same... There is no difference in their work or classification, or in their duties or loyalty or in their service to the city' except' the difference in working hours. Commissioner Brice disagreed with Chief Lassiter, "There are other things, such as the volunteer pay, that the firemen get that .the Police - Department does not get,,. And:that has been taken 'into consideration." Horace McCutcheon asked what.is the amount budgeted for capital improve ments for West Side 'Park. :: Commissioner Young replied that it is $5,000 (the same ass Frost Park)..; . Attorney Walden read the resolution entitled: A RESOLUTION officially adopting •and approving the annual budget of City of Dania, Florida;,'and` fixing the- amount and rate of taxation and making the' tax levy for :the.fiscal 5 . year 1966-1967; and repealing*all� resolutions or parts of resolutions in conflict herewith; and' providing.'that this resolution shall become effective immediately upon its passage and adoption. A motion was made by Commissioner Zenobia that the resolution- be passed and adopted with one change. . .that $23,000'be transferred from Sanitation to Special Projects. The motion was seconded. by Commissioner Brice, and the roll being called,..the,Commissioners ` voted as follows: +' ;; -2- >(• .... ® Brice Yes Young Yes Zenobia Yes Adams Yes • Commissioner Brice reported that at a recent meeting of the Erosion Advisory Board, they approved the installation of.groins, and at the meeting it ,was. understood that this would take place at the County Beach. An application has been .made to the Corp of Engineers for the erection of this groin at a location- that is. approximately 290 feet North,of_ the Dania Pier. A motion was made by Commissioner Brice to instruct the City Manager to enter a protest to the County Commissioners on the erection of this groin "because I feel that it would have an effect on the erosion of our beach". • Commissioner Young stated that he believed it should. be in the form of a Resolution. Commissioner Brice added "To adopt and pass a resolution". The motion was seconded by Commissioner Young, and the roll being • called, the Commissioners voted'as follows: Brice Yes Young ; Yes'. Zenobia Yes Adams Yes . , A motion was made by Commissioner Young ,to change the date of the next regular meeting from'September 5th. to. September 6th. Zenobia Yes, • Adams Yes APPROVAL OF APPLICATIONS FOR THE RENEWAL OF ALCOHOLIC BEVERAGE LICENSES for 1966-1967. • A list of Renewals of Alcoholic Beverage Licenses for 1966-1967 is attached to and made a part of these minutes. Reverend Jennings, First Baptist Church of Dania, objected to the renewal of some of the licenses which he felt were in violation, such as the Banyan Club and the Paradise Club. Chief Smith stated that there have been violations around the Paradise Club for Bolita, but he did not know of any inside of the Paradise Club. And, as for the Banyan Club, the City has just won their appeal. City Attorney Walden advised that in regards to liquor licenses, the only control the City has is the question of zoning, hours of closing, and that is about it. A motion was made by Commissioner Salvino that the applications shall be approved for renewal as presented. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Brice Yes ' Salvino Yes Young Yes Zenobia Yes Adams Yes APPLICATION FOR TRANSFER OF 2 COP LICENSE from Carolyn De Cesare to Jean Lurchin, The Hut Bar, 329 S. W. .13th Street. (First Reading) A motion was made by Commissioner' Zenobia that the application for transfer be passed on first reading. The motion was seconded by Commissioner Salvino, and the roll being called, 'the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes City Attorney Walden presented an application for a liquor license as follows: ® APPLICATION FOR 2 COP LICENSE John Quere, 129 North .Federal Highway, Dania. (Second Reading) City Attorney Walden stated that.�this application came before the .- Commission twice before. The first time' there was a question as to the proximity to the First Baptist Church The Building Inspector checked it out and found that it meets the distance of the zoning, .;,: requirements. The second time -it was a 2-to 2 vote by the Commission He advised that since it meets the zoning requirements; the'City has'`' very little choice but to issue the license. -4 T ••� 1. .. . Rev. CORRESPONDENCE City Attorney.Walden read a letter from Rev. Hudgins, Dania Methodist . Church inviting citizens of Dania to the Consecration`Ser''vices to'be held'on_Sufida9;. Septembeb 18, 1966 , and requesting City Attorney Walden to read 'the invitation at the meeting on behalf of the officials '.of the Dania Baptist Church. . Rev. Jennings asked if the Commission couldn't take some action on .the problem of the distance between churches and .liquor-serving establish- ments; perhaps in getting the:distance ,extended.' City Attorney Walden suggested ,that he and Rev. Jennings, get together and work something out. RESOLUTION: Granting the increase in compensation for City Employees effective September 1,• 1966 as provided in the annual budget for the fiscal :year 1966-1967. City Attorney Walden read the resolution entitled: A RESOLUTION fixing the compensation for certain Department Heads, effective, as of September'1, 1966; and repealing all resolutions or parts of resolutions 'in-.,conflict herewith; and providing that this resolution shall become effective e. as of the date of its passage, and adoption. in which the Department heads and other officers of the City of Dania, Florida, whose compensation -is customarily fixed by the City Commission, is hereby set and fixed as follows: • Department Head or Official Annual Compensation Stanley Goldberg - -$12,000.00 . The motion was seconded by Commissioner Brice. • Mr. Bob Houston stated that some of the people mentioned were just given raises this year, possibly January or February. He stated .. that the City is in serious trouble on the sewers, and now "you are ., . coming along with raises not knowing how you will come out on the budget" . He stated that at the budget meeting he objected' to raises • for the Commissioners, the City Manager, and the City,Attorney. He stated that he didntt feel that anyone in the city earning. in excess " of $6,000 should be given a raise at this time: Someone from the audience. asked if the City Manager is still living on Miami, Beach, and if he had any intentions of moving to. Dania. • "I was under the impression that he had to ,be living in Dania, and. I was also under the impression that,this man was supposed to be on probation for 6 months." He asked how they can give a man "a $4,000 raise" when he is still on probation.' Commissioner Brice In the last ten years you have had a City Man ager about every two months. We went six months trying to find a man of qualifications to run our city. If you are going. to pick up some= body off of the street that doesntt.have any. qualifications, then pay..' them $8,000 or $9,000 a year and you are going to get.an '"8 or 9 thou- sand dollar man" . He stated that in his business "if we want .top. ' quality people, we pay for top quality people.„, He further stated7.. • "The same way with your Department Heads. We' have got. good people, . lets keep good people." He dontinued "We are showing our folks that we appreciate their loyalty,to our city, and we are trying to get the best out of them." Bob Houston asked why the Chief of. Police will be..raised to $7,500.00.' . and the Fire Chief $7,000.00. He 'asked why the difference in salary. "One is as important as the other's. i' Mayor Adams replied that the chief difference in that is that the Fire Chief gets paid for extra:,calls,' and the Police.d.o not get extra pay for extra time or extra duties. Commissioner Salvino stated that he agreed that Chief Lassiter should Y; get the same amount of money as Chief Smith. "He' doesn't 'get paid extra for calls during the day. He gets paid for calls after' S:OO through, 8:00 in the morning,. That is his off-time!' . Several persons from the audience asked what certain employees were being raised. Commissioner Young replied "The department heads are directly under ,the City Commission, the other:: employees of the` city'are under„the Depart- ment heads. It is up to the department heads to make.a recommendation" • to the City Manager on the allegation for length of service, etc." Reverting back to the motion to adopt and pass the resolution, the roll being called, the Commissioners voted as'follows: Brice Yes. . .. Zenobia Yes Adams Yes ° ' ;'4 ® ORDINANCE: Amending Chapter 18 of the Code of Ordinances, being the schedule of license fees charged for businesses operating in the City of Dania. (To be passed on three readings) . City Attorney Walden read the Ordinance entitled: • AN ORDINANCE amending Section 18-14, Code of Ordinances, City of Dania;, Florida, concerning the Occupational' License.-fees to be paid by persons, firms'or, associations engaging in any of the businesses, professions, or occupa- tions within -the City of Dania, Florida, and providing ' • that said section 18-14, Code of Ordinances, City- of Dania, Florida, except as amended herein shall remain in full force and effect and repealing all ordinances or parts of ordinances in conflict herewith,and providing that this ordinance shall be in force and effect immedia- tely upon its passage and adoption. City Attorney Walden read the ordinance in its`'entirety the first time, and by title only the second and third times. . A motion was made by Commissioner Brice to pass' the ordinance on three readings, so it can.go into effect immediately.;: The motion • was seconded by Commissioner Zenobia. Bob Houston objected to "rushing these things through without any discussion" . : Commissioner Brice stated;that .this is, being done after much study • of the surrounding areas. City Attorney Walden stated that the license year begins October ist, and if it is not passed on three readings tonight, they could . consider the final reading,on September 19, ,although that will push the City Clerk a little in getting out the notices. - It hasbeen' • the custom to send them out in advance. If they do not pass it'.on. three readings tonight; then they should 'instruct the City Clerk to withhold taking applications for renewals ,at this time,. because sheds not going to know .what ,to charge They will also have to give the people a grace period. in which'to"renew their license. • City Manager Goldberg stated that it was his understanding that for some time it has been discussed :that 'a good portion of the''aezisting license fees were extremely low, and should be. raise.d at%least to '' the minimum of the surrounding areas: He stated that the Commission, asked him to make a study of the surrounding.areas and a recommendation in regards to *these. CThe surrounding areas were studied and' the 'mini- • mum of what was found in. the surrounding areas is-the one''that"is being proposed. "If this has been brought up for several;years,, this'is'as . good a time as any to do something about it." .. He,further stated that "If you do adopt this and you find that.one or two of these,may be 'a little bit out of proportion, if you find something.that could be adjusted, it would be far better to come back at the next council • meeting and adjust one or two than to let some of these other concerns who are willing to pay the fee go by the board another year. Mayor Adams suggested that this -be passed on first reading and they could have a special meeting. • Commissioner Brice suggested that they pass it on two readings tonight then have a special meeting for the final reading. Commissioner Brice . withdrew his original motion. Commissioner Zenobia withdrew his second. A motion was made by Commissioner Brice to pass this on, first and- second readings. The motion was seconded by Commissioner Zenobia, and • the roll being called, the Commissioners Voted 'as follows: -7- r. x S i �t Mayor Adams announced that there will be a special meeting next Friday at 8:O0 P.M. for final reading and any adjustments. CITY MANAGER'S REPORT • City Manager Goldberg stated that Mr. Phil Heller requested an opportunity to discuss the proposed improvements to and around the Dania Fishing Pier. Phil Heller stated that he.wants.to make an improvement to the Fishing Pier, he intends to put an artificial reef around it and • concrete pipes. This will be worked out by the University of Miami and Mr. Johnny Wilson of the Fort Lauderdale News is doing most of the planning. He introduced Mr. Wilson to explain anything the Commission might want to know. Commissioner Brice stated that it will have to meet the approval' • of the United States Department of Waterways; also, it will have to be considered under the erosion control boards. Mr. Heller stated that it will be subject to all of that. 'All I want is to get the option of. the lease subject to the completion of this thingl� . • Commissioner Brice suggested that Mr. Heller bring a drawing of what he proposes. Mr. Wilson explained in brief what they propose. • Commissioner Young asked a few questions,then he stated that the . artificial reef sounded alright to him, provided the Corp of En- gineers and all other"interested parties are satisfied. Mr. Heller stated that he has to go for quite a. bit of money on this project, and he wontt go for it .under his 5 year lease. If • he could get an option subject to the completion of it, he would be glad to go for that amount of, money. Commissioner Young stated that the City Attorney informs them that they should. have, plans or, drawings showing everything before they can take any affirmative'action on it: City Attorney Walden stated that Bill Rhodes, operator of the Dania Beach Grill, would also like to have his lease extended-to the maxi mum. The maximum;lease that the City can." ve to him without adver tising for bids is 1 to: 2O years. Therefore, Mr. Rhodes is request- c ing an additional 7 years: ' But Mr. Heller is requesting'an additional 15 or 16 years. .He further advised that if a lessee wants to improve Dania property that is' held in' a propriatory capacity, the .Commission is authorized to enter', into a�lease.transaction for a maximum term of 20 years. So obviously, before you .do that' you would have to`have some substantial details on the improvement, as to the type of improve- ment. CITY ATTORNEY REPORT:.- City Attorney Walden reported on the meeting with Mr. Philpott as 'to. the si-uation of the Sanitary Sewers. ' He stated that.in:January, 1965;' •, the City entered into the contract for the construction.of the Sewers • ' '` ® and Pumping Stations, with M. B. Construction Company. : That contract gave a completion date of 400 days. . He understood from the Engineers that the completion date should have been around the-First- of June. A meeting was held with Mr. Philpott and',Mr. .Mears in early July of this year. An estimate of completion at that time :was given as.'around August 1st. When the project was not .completed around August Pirst,`p 0 the Commission then instructed Mr".,'.,Goldberg and. himself ,to`have -various meetings with both the contractor and with the'Engineering firm " They have had the meetings all aimed at getting some estimate of. a' .completion "r date of the project so that it .can .be reported .to. the people. "- As of`ahis p 7 ' l ® date, he continued, they do not have an exact estimate from the Contractor as to his completion date. He was uncertain as to when he might complete. In turn, Mr. Philpott said that, since he does not have absolute control over the contractor, he declines to give an estimated completion date. Attorney Walden continued,tone ofethe problems that faces the people of the city is, in the case of new construction, they do not know whether to install septic tanks or wait until they can get sewered., Anot-her .concern that faces the city is our financial relationship` with the bond holders of the revenue bonds. From that point, they A had a meeting with Mr. Hennan, who represents Barcus, Kindred b Company, which is the financial company who bought the bond. And Mr. Hennan indicated to us that the City is •in no trouble at the present time over the bonds, although he is concerned about the mat- ter. Mr. Walden then read portions of the contract, in particular Page GC1, under the General Conditions; Page GC3, Control of .the•Work; - on Page GC4, Owner's right to terminate Contract; Attorney Walden further advised that Mr. Mears has said that he has faced too many problems, such as the inability to find labor, and in regards to the Park Street line, he suspects that.somebody "Sabotaged" the line, and he is investigatingthat. Mr. Walden advised Mr. Mears . that althoughtthe City sympathizs with Mr. Mears, they have no right to get involved in these phases. Attorney Walden advised that, as far as the completion date is con- cerned, they have been unable to obtain a reliable estimate of .a completion date as of today. With that problem in mind, he and Mr. Goldberg have had a number of discussions with Mr. Philpott as to what to do. They have the choice of invoking the "Owner's right to terminate the Contract"; but, if they do that they.are going.to get involved,"This is Mr. Philpott's opinion, and .I am inclined to go along with him", in further delays. Mr. Philpott feels that it would be necessary to re-advertise this contract and, prepare new plans and specifications, and under the assumption that all contractors are facing these labor problems;• and .the .uncertain item,as to when the new contractor might ,come .in and take over and complete the job. So the alternative, quite frankly is to go along with Mr. Mears as long as he shows any willingness and progress and works on the' job. �"While I don't think Mr. Philpott is entirely satisfied with what he is doing, Mr. Mears is doing something on the job, and it is Philpott's recommendation to the City; that we.do everything we can to do-operate with Mr. Mears to get.him to 'finish the job and get him out of town". Mr. Philpott feels .that the problem is merely in time, not in"the quality of the job. He feels that the job will meet his (Mr. Philpott) standards. Mr. Philpott,'is thoroughly satisfied with the money. that,is retained by the City, approximately $130,000.00, is more. than ample to pay for the remaining work, to ,be-done. .. In summing up, Mr.' Walden stated that Mr. Philpott's estimate of the situation, is that first, the quality will not be a problem; .secondly; the money will not be a problem; but . we all recognize the time factor as. a major serious problem. Mr. Walden stated that, in his own opinion from sitting in on these meetings, he felt that the least amount of time would be 30 days, and the most 90 days. "If Mr. Mears disagrees with that, of course, he can speak for himself" , Mr. Mears was present and asked his attorney to read a 'transcript.• pertaining to a discussion between Mr. Mears and.'officials of' the Hollywood Bank & Trust Company, on September l; 1966; approximately 1:30 P.M. , concerning the attempttby Mr.,. Mears to borrow money from_.'.: the bank. Mr. Mears then .explained that ,he has had ads in several papers trying: to get help and trying to do theirJob. Mr. Houston stated that they also sympathize,w3th'it4r • Meads,, but that L won't help him. "I want to see this city back ,in .shape before this";:: .:` d� -9 4 p season. We had enough criticism around here last year from the Hotels, Rental places and every place else." Charles DeMuziio, told Mr:. Mears that he- felt that the City was going along'with;°Mr'. 'Mears now he (Mears) ought to give in a little and go along with the City' Malcolm.Holding stated that he -had planned .to pick up a building permit within the next few days for a building for $75;000. ` The - plans are all completed; but he was going to have to recommend to the owner of this property to. hold off on construction of it until. such time as we.have some definite .commitments- from• somebody on' a • completion date. . Another gentleman complained' that he wanted to open a laundry, but he cannot do it-until the sewers are completed. Mayor Adams asked Mr. Mears if-he ,had, anything,,he could tell these - , • people on a possible completion date. ' Mr. Mears stated that he didn't want to bring it up at; this time because the investigation was not completed, but he felt that then, ;:; job was "sabotaged" on Park Street. The laboratories are working, on it to find out definitely what was the cause of- it. He stated' ' ' • that at the time he called the Broward"Sheriff's Department, who referred him to the Dade Sheriff's Department, who in turn _referred him to a private laboratory in Hialeah, Applied Research Laboratories. r' . He stated that it was reported to the City.Manager; City Attorney, and also the City Commission. • Mr. Houston asked Chief Smith if he received a <report. Chief Smith stated that he got a report this morning from the City Manager, but he has not had any actual comolaint. Mr. Houston asked Mr. Goldberg when'he got the report. q. • City Manager Goldberg replied that he got the report the same time , as the City Commission, which was.about 2 weeks agos: Mr. Houston stated that he felt they should designate' the2Police to make a thorough invest igation`,' find the man who was injured, -and find • out how it happened, if it.happened,,.and clear this City.of any Sabo- . Cage. Mr. Mears .stated that there wasn't anyone injured. Mayor Adams requested Chief Smith to make an investigation: There being no further business, the meeting adjourned.
