The City Commission of the,City of Dania, Florida, met in
• Regular Session in the Commission Room at the City Hall.

The meeting was called to order at 8:00 P.M. by Mayur Adams,
after which invocation and Pledge of Allegiance were held.
Minutes of meeting held August 1, 1966' to be approved.
• A motion was made by Commissioner Brice to approve the minutes `
as read. The motion was seconded by Commissioner Zenobia, and `
the roll being called, the Commissioners voted as follows:

A motion was made by Commissioner Zenobia to approve the transfer
on second and final reading. The motion was seconded;.by Commis-
sioner Young, and the roll being called, the Commissioners voted

Application for 2 COP License, John Quere, 129 North
Federal Highway.., (First Reading)
Attorney Walden explained that -this was presented at the last meet
ing, but the Commission took no action because there was a question
of its proximity to the Baptist Church. He stated that he believed
the Building Inspector has verified, that it does not violate the
ordinance. He further stated that he teas requested by Mr. Burgess
to see if the Commission would consider passing,it;on' two readings
tonight, because'.of the delay on the first reading. '.
Chief Smith stated that he and Mr. Lindeman.`checked it "ouf today
® and found that it does conform with the ,ordinance. -However, he has
not seen Mr. Quere to fingerprint him.
A motion was made by Commissioner Young to pass the application on. `
first reading. The motion was' seconded, by Commissioner Zenobia, and'`'

® PUBLIC HEARING CONTINUED: Application of Mario Panzetti . .
and Angeline Panzetti to rezone all of Blocks 5, 7 B 9,
of North Wyldwood Park, from existing zoning classifica-
tions to M-1-A zoning classification, and the vacation and
abandonment of the 10 foot alley contained in Block 5 and
• the 40 foot street between Blocks 5 6 9 known as Botanic .
Avenue.
Mr. Panzetti stated that he is mainly concerned with changing
the zoning; therefore, he suggested. that they drop the vacation
of street and alley, and simply consider the change,of zoning: :

City Attorney Walden advised that they have the right to refer it
back to the Zoning Board for its recommendation; however, no fur-
ther Public Hearing is necessary by them. He added that the City .
Commission also has the right to go ahead with it. If they wish
to go ahead, since this is a change of zoning, they have to do it
• by ordinance to be passed on three readings.
A motion was made by Commissioner Young to adopt and pass an ordin
ante on first reading rezoning the above mentioned property to M-1-A, ..
and that all mention of vacation of property be completely.deleted,:
from the application. The motion was seconded by Commissioner 'Zenobia,
• and the roll being called, the Commissioners voted as follows

A motion was made by Mrs. Panella that, in view of the
recommendation of Chief Smith, the request be denied. „

City Attorney Walden advised that there need not be further action
• by the Commission unless the applicant was present. He was .not.

A motion was made by Mrs. Panella" to grant a hearing for a
variance to be held on September 13, 1966, at 7:45 P.M. The
motion was seconded by Mr. Erwin, and carried unanimously:

City Attorney Walden read the above threeitems together, and
suggested that, since they are all requesting Public Hearings, .the
Commission might consider them. all together.
A motion was made by Commissioner:;Young ,to authorize the Planning &
Zoning Board to conduct the three publi6 'hearings 'on ,the dates and
times as requested. The motion was seconded by Commissioner.Zenobia,

City Commission a request from,the, New England Oyster'House to add .
a 36 foot addition to their restaurant. He stated that they,were.

not providing for additional parking, since they, presently have
ample parking.
Commissioner Brice suggested that they present a plan showing the
parking that they now have.

A motion was made by Commissioner Young to approve the plan subject
to the investigation and determination of the Building Inspector as
to ample parking. The motion was seconded by Commissioner Zenobia,
and the roll being called; the Commissioners voted as follows:

Commissioner Zenobia stated that in reference to right-of-way on
Federal Highway, .the 'City, needs 17' feet on that side of the high-
way.
• A motion was made by Commissioner Brice to table:';this until a
representative can be present, or the City Attorney can discuss
this right-of-way with the owner. The motion was seconded by
Commissioner Zenobia, and therroll being called, the Commissioners
voted as follows:

Mayor Adams called,for ,any`'additional bids. There were none.

.City of Dania, Florida,. is advertising for sealed bids' which -
will be received by the City.Commission of the City of Dania,
Florida, until 8:30. P.M. Monday, August 15, 1966, at which .
• ' time they will be opened and read aloud in the' City Commis-;
sion Room at the City Hall for the 'purchase .of a Rubber-tired
Wheel Tractor. '
Mr. Houston questioned why they advertised for Gasoline tractors . ;
instead of Diesel. He also asked what' they:were. going to use the
• tractor for.
City Manager Goldberg replied that they intend to use it for as
many purposes as they can. They. intend to-get' attachments to go '..
on,which may include all or some of the following items: Mowing
equipment, payloader equipment,' trench-digging''equipment, also they:'
A: intend to use the regular equipment. . ' r.

Mr. Houston 'suggested that they look further into the purchase of
diesel tractor instead of gasolire .
Mr. Tarpley also spoke on behalf of diesel tractors as opposed to
• gasoline tractors.
Mr. Houston stated that in regards to the mowing; he has paid
particular attention to the mowing around the City this last week,
and he wanted to compliment whoever was responsible for it. He
stated that this is the first time he has seen any real mowing done
• in the past year. He stated that, in. his opinion,, they did not need
any new mower or tractor, it was just a matter of putting someone
capable on the one they have.
City Manager Goldberg stated "That is the Public Works Department
you are complimenting" .
Mr. Houston: No, I am complimenting the driver who is on the, equipment.:
City Manager Goldberg stated that it is the same driver.
Mr. Houston: , I don It think so', not the one I,see. If it is, he has.
• picked up an awful lot of .knowledge"in the last week. He didn't'gain
any the year previously.
A motion was made by Commissioner !Brice to open the bids on the new
tractor. The motion.was seconded by Commissioner Young;. and the

Manager for investigation and recommendation. The motion -was seconded

PUBLIC HEARING:' 8:30 P.M. Objections to the approval of
the plat of Galman Subdivision.
City Attorney Walden read the NOTICE OF HEARING as. follows:
NOTICE IS HEREBY GIVEN that the City Commission of the City of
Dania, Florida, shall conduct a public hearing at 8:30' P.M. ,
OMonday, August 15, 1966, for the purpose of hearing objections
to the following application or matter:
Application of Jacque Gal-let for an ordinance approving
the plat of the subdivision to be .known as Galman Sub
division, and situated generally between Northwest llth
Avenue and Northwest loth Avenue, and Northwest 8th
Street and Dania Cut-Off Canal, said lands situate
being legally_described 'as follows, to wit:

City Attorney Walden advised Mr. Gallet that the City has an
application from the property owner to the East of the above
described property to pave N.W. loth Avenue. He asked if Mr.
Gallet would be stilling to pay•for half of it-. Mr. Gallet
replied he would.

A motion was made by Commissioner Young to pass the ordinance apn
proving the plot of' Galman's Sub, on first reading. The motion
was seconded by Commissioner Zenobia, and the roll being called,

CITY MANAGER'S REPORT:
•
City Manager Goldberg stated that he discussed with Mr. Stuart,
Stuart's Garage, the matter of his cutting off a portion of the
building which extends out into the Dixie Highway right-of-way.
He asked for the Commission approval to meet with Mr. Spencer,
Mr. Stuart's attorney, and Mr. Stuart in regards to negotiating
• the right-of-way.
City Attorney Walden advised that Mr. Goldberg didn't need the ap-
proval of the Commission just to negotiate.
City Manager Goldberg,rre.gardidg a memo to Commissioners and City'
• Attorney Walden in reference to M. B. Construction Co. , and' the
Sewer Project, requested the City Attorney. to look into the con-
tract with the Engineer and the Sewer Contractor to check the
responsibility and if necessary for him to contact 'the bonding
company.
• City Manager Goldberg stated, in regards to .Pirate Ports of Florida,
the question has come up as to the erection of a ride, which is a . .
structure which had been used previously; and there are no plans of
this ride, so that there is nothing which they could submit.to the
building department for the issuance of a permit. ' .Mr; Goldberg
discussed this with the City Attorney, Mr. Robertson and his engin-
eers, and they arrived at a tentative situation asking the engineers
to submit to the City a letter stating that they will supervise the
erection of the construction and certify as to the safety; this will .
be the way of handling this in lieu of the issuance of a permit, which
the City cannot do because they have no plans, and which they would
be unable to inspect otherwise. He suggested that perhaps the Commis- ;
• sion would like to make a motion to accept the letter from the ,engineer
in recognition of this method of.handling- this particular ride.
City Attorney Walden: The only problem on this is that ordinarily '
before any structure can be erected in the.City the ordinance requires
that the plans be submitted to the building inspector to examine them
• for purposes of many reasons, the most important one is safety:' As a
result the City controls the erection of any, type ofbuilding or strucF,' ,
ture. If it can be proven that this is an unusual type of structure
where they do not have plans, and you cannot reasonably gettthem, as .
a substitute all you can do is take this in writing from the engineer;.
that he will supervise the construction and .that, it will be constructed;,;;,
ii. in a safe manner. So I think that if, you want to ahead ,then. ". ,
„ . ought to do it by motion because it is an unusual'•situation,';and fur-,
ther, that it be understood that :no'kind of permitMor:approval.will -be
pp
given. So that, if, after the building.is erected and;:you.have the
statement in writing that it is a safe building, if it blows down,
the City will not be 'liable . Mr. Walden read the letter.as follows:
Mr. Goldberg:
"Re Pirate Ports of-Florida.
This is to virify 'our' discussion earlier this week in
regards to the construction, supervision and inspection of
the amusement ride now being constructed at Pirate Ports„
known as "The Wild Mouse".
We have been retained to supervise and inspect this con-
struction so as to .certify that the completed project,has' to
its conformance with sound engineering practice for this. type
of construction, and also as to its safety. "

Commissioner Brice stated that, 'since this .is an unusual structure,.,
perhaps an engineering firm would be better qualified to give us an
inspection of it and certify it than our own building inspector would - '
be.
Commissioner Zenobia asked "If this engineer can supervise, can't
he draw a plan for it?"
Attorney Walden replied "I would think: so, but he'says not-"
Commissioner Brice asked "In the case of a certification, if we
should consider this as on the recommendation of the Engineer that
he is going to certify it, why couldn't we require a bond to that''
effect that if it did not meet the specifications then he would
have to make the corrections?:r I hesitate to goon an engineer's
recommendation who is hired by the man. who is asking:for the permit.
I don't doubt that they are a reputable firm. .'But, like -you. said,
if it is up, how are we going to get it torn down?'r
A motion was made by Commissioner Brice that the City Manager be
instructed to require Pirates-Ports to post a ,bond based on ,the
letter of certification by an Engineering Firm and'that the City
has the right to call in an outside Engineering Firm to make an
inspection, and the cost to be borne' by Pirates Ports, the amount
of the bond to be decided by the City Manager. ' The motion was
seconded by Commissioner Young, and the roll being `called, :the
Commissioners voted as follows:

Mr. Houston suggested that the City should establish, a setback on
Federal Highway, which will eliminate condemning property along the
highway when the time comes for the widening. program.
Commissioner Brice suggested that the City Manager look into it and
report at the next meeting.
Mr. Houston asked what they intend to 'do with the old garbage trucks._
City Manager Goldberg replied that we,'are.in' the process of reorgani-
zing the Public Works operations, and he didn't want to say at this
time exactly what will happen to this piece of, equipment. They are
considering the possible use of.. some of the old equipment.
Commissioner Brice stated that, several weeks ago an ordinance was . :.
presented to the Commissioners in regards to animals running at large '
in the City. He suggested that',some.action'be taken on it, and that . '>
it be advertised for a public:hearing

Chief Smith stated-that he wholeheartedly endorses this leash law. ,
He has had complaints'about dogs running loose; and he felt that
any person who has an,-animal and cannot take him out on a lease
does not deserve them:
City Attorney Walden suggested that the ordinance be put' on the
agenda for the next meeting.
Commissioner Brice stated that it has come up to two or. three
meetings that they.draw up some sort of an ordinance on political
signs. He suggested that the City Attorney or City Manager prepare
such an ordinance and get it on the agenda for the next meeting.
There being no further business, the meeting adjourned.
