O The City Commission of the City of Dania, Florida, met in
Regular Session in .the Commission Room at the City Hall.

The meeting was called'to :order at 8:00 P.N:.by Mayor Adams,
after which Invocation and'Pledge of, Allegiance were held.
City Clerk Thornhill reported that' City Attorney Walden is on
vacation and asked to be excused.
MINUTES OF MEETINGS held June 20 and July 5, to be approved.
A motion was made by Commissioner Salvino to approve the minutes
as read. The motion was seconded by Commissioner Young, and the
roll being called, the Commissioners voted as followsi

ORDINANCE: Concerning the disposal of garbage by the City
< of Dania. (Second Reading)
Attorney Dubow read the ordinance entitled:
AN ORDINANCE,repealing Section 16-31, Code of Ordinances, .
City of Dania, Florida, as same appears in the published
Code of Ordinances; City of Dania; Florida, adopted .on
Pebruary 7, 1955; .and adopting a new ordinance•to be known
as Section 16=31, concerning disposal of garbage by City..of
Dania, Florida; and providing that all ordinances .or. parts
of ordinances in,conflict.herewith be' repealed' to the
extent of such conflict; and providing that the ordinance
.' shall become effective as of its passage and adoption- on
third reading.'
A motion was made by Commissioner. Young that the ordinance be killed': .
and declared null and void. The motion was secondeddby.Commissioner '
Salvino, and the roll being called, the Commissioners voted as follows: '`

A motion was made by Commissioner. Salvino that the bills be approved
for payment. The motion was seconded by Commissioner Zenobia, and
the roll being called, the Commissioners voted as follows:

A motion was made by Mr. ,DiMauro to approve the plan as
presented. The motion was seconded by Mr. Erwin, ' and the.,
roll call vote was as follows:

A motion was made by Commissioner Brice that the request be denied. -

(3) Public Hearing, 8:OO P.M.: Robert Smith requests`
variance permit to' operate motor scooter rental :u
business.
• Address: 2451 N. Federal Highway (Tenneco Service
Station)
A motion was,made by Mr.>Jackson-to'.table this until the meet-
ing of August 9, 1966, in order to check with the Police
Department to find out about the previous trouble. . The motion .
• was seconded by Mr. DiMauro', .and! carried unanimously.
No action.
(4), Public Hearing, 8:15- P.M.: Johnson/Foster Funeral Home
requests permission to move a single-family residence
from 1640 Harrison Street, Hollywood, ,to '110 S.W. First
Street, Dania.
Legal: Lots 17 & 18, .Block 21,. Town.of. Dania
Address: 110 S.W. First Street;. `
A motion was made by Mr. Jackson to accept the plan as pre-
sented. The motion was seconded by Mr. Erwin, and passed
unanimously.
Attorney Dubow explained that there is an ordinance (No•, 416) which
outlines a number of requirements which must be followed in :order to;
move a home.
Building INspector Lindeman explained that the ordinance states that:
the house must be up to code requirements.

A motion was made by Commissioner Zenobia to accept`the recommendations
of the Zoning Board. The motion .was seconded by Commissioner. Salvino'.
• Attorney Dubow stated that the ordinance requires a public'hearing'and
it requires that owners within 300 feet of the proposed location must` . ' .
be notified. Attorney Dubow read a portion of the ordinance.
Commissioner Zenobia withdrew his motion. - Commissioner. Salvino withdrew 'his second to the motion.

A motion was made by .Commissioner Zenobia to authorize a Public Hearing
to be held August 1,-at .8:15 P.M. The motion was seconded by Commis-''
sioner Young, and the. roll being called, the Commissioners voted as'.•'

A motion. was made by.;Mr. Jackson-to accept the plan as presented
with the understanding that Mr . Gallet`will put .up the necessary
• bonds. The motion was seconded by Mr••� DiMauro;- and carried '
unanimously.
Attorney Dubow advised that'before, they can approve .it', they must hold
a public hearing.
• A motion was made by Commissioner Brice to authorize a Public Hearing
to be August 15, 'at 8:30 P.M.; The motion was :seconded by,.Commis

CITY MANAGER'S REPORT:
City Manager Goldberg requested permission to advertise for bids
for a new tractor.

A: motion was made by Commissioner Brice to authorize the City Manager
to advertise for bids for a tractor, to be accepted August 15, 1966,
at 8:15 P.M. The motion was seconded by Commissioner Zenobia, and
the roll being called, the Commissioners voted as follows:

City Manager Goldberg advised that Mr. Marrone requested that he. be
• allowed to install his own sewer lines in his subdivision and to
connect to the City Sewer System, but that there_ be no assessment
charge made against his property.
, Commissioner Young stated that we have ordinances pertaining to this
which states very plainly that all property having access to the sewer
• will be assessed on an equitable basis. Therefore, he did not believe
they have the right to allow his to do this.
Mr. Marrone stated that he was putting in his own sewers and he did
not feel he should be assessed.
p Commissioner Young asked if Mr. Marrone was putting in the force main,
lift station and disposal plant too.
Mr. Marrone: No.
Commissioner Young: Therets:your,answer..
Mr. Marrone then asked-if the City will; put'the lines in, and he will .
pay the City.
Attorney Dubow:istated.that Mr. -Walden has given his opinion on this
once before that. where -a man.wants- to connect up himself and lay down
•. his own pipes, he still nevertheless''must be assessed the same rate .
as any othereproperty; ;He.oited the two cases of Mr. Steyer,and Mr,
Arcaro.
Mr. John Farina representing Mr. Marrone stated that they were aware `
of the cases of Mr. Steyer -and Mr. Arcaro. Mr. Farina asked 'if it '
would be within the law,to say that.Mr. Marrone is to be assessed a
sum which is nott equal to the sum thatthe othercpeople are paying;
since this is a different,6ondition;; where the othercpeople,would
pay 5 or 6 dollars, ,could he be assessed possibly'3"dollars because.
he is tatting advantage of the sewage plant:
•, Attorney Dubow stated: ; I doubt' it'very much. I believe Mr. Walden
was quite clear, and there is no way to vary it.
Mr. Farina asked if, so long.as M B Construction Co. is not finished,
could this be treated as an extention to 'the system; would that be
effected by the bond issue.

Attorney Dubow: You mean, if the City Commission authorized a change `.
order?
Mr. Farina: That would be one v/ay,,. yes. . Anotherccontractor would
come in and build it for the City;nand' then assess Mr. Marrone.,.'.:That' ,
• would be one way of doing it, since you cannot. authorize.a change order'
at this time.

Commissioner Brice stated that if the City were to sewer all of the
areas in the City they'could not stand up under the financial burden.
The City Attorney .made the ruling, "that is what he is paid for, so
we have to abide by it."

Mr. Marrone asked if he`could use septic tanks, to which Mr. Dubow
replied he could, if he complied with the law. Mr. Marrone stated
that he would then use septic tanks. He was advised to check with
the Board of Health.
• Commissioner Zenobia stated that he believed that when they passed
the re-platting of the area, it was stated that Mr. Marrone would
have to hook up to the" sewer. He stated that he felt the same as
Mr. Marrone, that it was unfair, "but that is the ruling".
Mr. Marrone further stated that.he,would need a 6 inch water line
• to his property to. hook 'into.
Commissioner Young suggested that all this be presented to the City
Manager for his study.
City Manager Goldberg reported .that he had a meeting with Mr. Davison
• of the State Road Department and he has agreed to let us tie a maxi-
mum 15 inch drain line from the Dixie intersection East ofPthe rail-
road into the Sheridan Street drain. "If this is ,agreeable with the
Commission, I will so instruct them that this ,is. the desire".
Mayor Adams stated that he thought it would be desirable, sinoe"this ,
is what they have been trying to do for some time 'without any success':'
A motion was made by Commissioner Brice "to accept the City Manager's .
recommendation. The motion was seconded by Commissioner Zenobia.'
Commissioner Young asked if Mr. Philpott.was working on this.-now,
• will he need a resolution to authorize him to proceed. '
Mayor Adams stated that he understood that, about a year ago the Com-; ,`
mission authorized Mr. Philpott to" go ahead with this.
Commissioner Young stated that he remembered that they did authorize' -
him to proceed, but he claims' he:was never authorized. "If he has':the
feeling that he has not been authorized, then why don?t we. do that ,
at the same time?"
Commissioner Brice withdrew'his motion. Commissioner .Zenobia withdrew
his second.
A motion was made by Commissioner Zenobia to draw and "adopt a' resolution
authorizing Mr. Philpott to draw up plans and specifications for drain
age as outlined by City Manager also'to .accept- the proposal from :the
State Road Department to tie into_the Sheridan Street drain. The motion
was seconded by Commissioner Young, and the roll being called, the Com
missioners voted as follows;

City Manager Goldberg further reported that in his discussions with
Commissioner Adler he also requested that if there were •any funds left
over from the appropriation for ,the Dixie Road, that some of these ' ;
funds could be applied to the drainage. ,;;
• Bill Rhodes, operator of the Dania Beach,Grill, requested permission- .'
to do some remodeling by putting an addition on the rear, also he . :
asked if he could have an extension of -his lease.
Commissioner Young suggested that,"this should--be first discussed with
the City Attorney.

Attorney Dubow advised that the Charter requires that they approve
the extension of. the lease by ordinance.,

• Commissioner.; Brice proposed that. Mr. Rhodes di'sduss.'this. with )the
City Manager:who in turn will make his'recom.endations at' the next
Commission meeting.'
Commissioner Brice stated'_that,the, Commission hasvnot .had a,decision
on a City Auditor. `.Since' it. is Aso ,near budget: time;.:he suggested they
• take some action .on'it.
A motion was made by Commissioner Brice to accept the' recommendation,
which was presented at a prior meeting with the Auditors who are now
doing the books.
• A:-motion was made by Commissioner Zenobia to table .this until City
Manager Goldberg'has time to look over'. the, proposals and give "a re
commendation. ' The :motion was'seconded, by Commissioner. Young; and
the roll being called, the Commissioners :voted as follows:
