® The City Commission of the City of Dania, Florida, met in
Regular Session in the Commission Room at the City Hall.

The meeting was called to order at 8:00 P.M. by Mayor Adams,
after which Invocation and Pledge of ,Allegiance were held.
ORDINANCE: Concerning the disposal of garbage by
the City of Dania. (First Reading).
City Attorney Walden read the ordinance entitled:; ; `
AN• ORDINANCE repealing Section 16-3I, Code of Ordinances;
City of Dania, Florida, as same appears -in,the published
Code of Ordinances, City, of• Dania,:Florida,. adopted on .Feb
ruary 7, 1955; and adopting a new ordinance to be known as
Section 16-31, concerning disposal of garbage`by City of.
Dania, Florida; and providing that all ordinances or parts
of ordinances in conflict herewith be repealed to the ex?
tent of such conflict;, and providing that the•ordinance
shall become effective of it6-passage and adoption on third
reading.
Mr. Justice, Hitching Po'st .Trailer`Park, .objedted to the ordinance`
stating that he felt trailer:parks '•were' being discriminated against.`
Commissioner Young stated that he was not in'favor of the ordinance. ;, ,..
because 'he felt that a 'municipality was ;obligated to give a service
without discrimination, and, he.felt that it was discrimination to
charge some and not others.
k !, A motion was made by:Commissioner Zenobia to pass the ordinance on
first reading, and to have the City Manager look into it" a little.

ORDINANCE: Providing for hook-up to the Sanitary Sewer System..,
(Third Reading)
City Attorney Walden read the ordinance entitled:
AN ORDINANCE defining "Acceptance Date" as same -is used
with respect to the Sanitary Sewer System of City ,of Dania,
Florida, and providing for the publication and publicizing
of notice as to such acceptance date; and providing that
it shall be unlawful within ninety days from the,acceptance
date for any
person, firm or•;corporation owning property or

leasing property capable of being connected to the sanitary
sewer system of the City of Dania to use septic tanks on
such property; and providing that the penalty for violations
of such provisions shall be as set forth in Section 1-6', Code
of Ordinances, City of Dania, Florida; and providing for a
permit, types of pipe, general conditions, person qualified
to perform work with respect to the construction of lateral
lines across private properties for the connection of private
properties to the sanitary, sewer system of City of Dania, ; _
Florida; and providing that the permit for the construction
• of lateral lines' shall' contain terms and conditions prohi-
biting the use ,of septic .tanks on properties served by the
lateral lines.
Mr. Houston stated that .he. felt•$5.00 for each inspection was too
much, he felt that it should be,$5.00. only, no matter how many
• inspections.
Mr. Sinclair asked if the City plans on hiring any additional in-
spectors.
The Commission agreed that they would have +to in order to be able
to inspect them all within 90, days. . ,
Mayor Adams stated. that'from, the 'information that the Commission
has, the sewer system should be ready around the 1st of August
"If that is true; then .you have August, September and October` to
hook up", r'
Commissioner Zenobia asked if there could be an extention added onto-
the 90 days if they saw• that it was not going^to be'enough time.
City Attorney Walden stated that they could. .
A motion was made by Commissioner Zenobia to pass the ordinance on
third and final reading with the exception that 'the. fee be .changed. ; .
to $5.00 only. The motion was seconded by Commissioner Brice, and
the roll being called, the Commissioners voted as follows:

City Manager Goldberg read the bids as follows:

A motion was made by Commissioner Young to refer the bids to the
City Manager for tabulation and recommendation. The motion was .
seconded by Commissioner Zenobia, and the roll being called, the
Commissioners voted as follows:

Chief Smith stated that he has checked out the applicant and found
everything in order.
A motion was made by Commissioner Zenobia to approve the issuance .
of the license. The motion was seconded by Commissioner Brice, ,

A motion was made by Commissioner Brice that the bill be paid. The-.
motion was seconded by Commissioner 'Young.
Mr. Houston asked how much' money:M`B Construction Co., has coming,
and why he is being paid"without first cleaning up the 'City....
City Manager Goldberg 'explained •that' they did have a .conference
with'Mr. Mears and Mr: Philpott,'before,:the meeting.,, and they were
informed that they hope to have the lines in.operation around the
first of August. The cleanup will •fo]1ow that,, although some clean
up.is going on at,the present time. 'Mr. Goldberg added.that, besides
the $16,655.13 requisitioned for payment tonight, there is $131,696.94
which is being withheld pending final completion of the job.
Bill Brooks asked why the ,sewer plant was in.operation during all .the
rainy,weather. He stated "Mears activated it. Who is paying the bill
for that"?
Commissioner Zenobia stated that Mears did not activate it,..the City
did.
Mr, Brooks asked why should we do it. Mr. Brooks continued questioning
where the money was coming from.
Mr• Houston asked if Mr. Mears owes the City some money.
City Clerk Thornhill replied that,-he owes a current water' bill His'
bill for last month was $1,100.00.

Mr. Brooks complained about the construction company resurfacing
the streets without proper grade.u.
Commissioner Zenobia informed Mr. Brooks that, in regards to .the
• water, the Engineer said they are putting the water in to clean
out the lines. Also, the Engineer said they should activate the
plant, they should not leave it sitting, and they might as .well
run th e water in. •Then he found out from one of the Employees
that they were opening'manholes to allow the .streets and alleys
to drain.

• Commissioner Zenobia asked City Attorney Walden what can be done
legally about the bill.
City Attorney Walden stated that it is the Engineer that advises.
Frankly "If you have lost confidence ini:the Engineer, you ought to
• get another engineer". "I don't see how you could let him continue,
and yet reject his advice-'' ,He is the only expert you have to advise
you.
Mr. Houston suggested that, before they accept this, that they call , . ,.
in another Engineering Firm to come in and pick out the defaults.
Reverting back to the motion to pay the bill, the roll being called,'', '

Commissioner Young asked the-City- Manager if .the bills were approved "
for paymenr.
City Manager Goldberg stated that the recommendation .was that they
be approved subject to the approval of the 'City Attorney..
A motion was made by Commissioner Young to approve the payment of

PUBLIC HEARING: . 8:30 P.M. Objections to the vacation and
abandonment of a part, of the alley located in Block 3',
South Dania Heights:.
O City Attorney Walden read the Notice of Hearing, published in
The Dania Press on June 17 S 24, and July 1, 1966, a portion of
which is as follows:
WHEREAS, Sam Calcagno and Luch Calcagno, husband and wife,
and Joseph Calcagno and Anna Calcagno, husband and wife,
• have previously made application to the'City Commission of
the City of Dania, Florida, for'the vacation and abandon-
ment of a part of the alley located in Block 3 of South
Dania Heights amended according to the•Plat thereof, re-
corded in Plat Book 61 Page 9, of the Public Records of
Broward County, Florida, with the part of the alley to be,
vacated and abandoned being more particularly described as
follows:
Commence at the N.W.' corner of Lot 10, Block 3, of
the amended plat of South Dania Heights, (etc.)
City Attorney Walden explained that in 1940 the City started a
A condemnation act to acquire 16 feet 'frontage along Federal Highway,
and the matter was. finally settled when the City agreed to vacate
the alley if the property owner would give the 16 feet along Fed-
eral Highway. Actually the City should -have gone through the 'pro-
cess at that time of vacating the alley, and the 'action was taken
in 1956 to vacate the property. The 1956 proceedings have' a slight
defect in that the Resolution Vacating the alleywas not adopted on
the same date of which the hearing was set. . And the property owner
now requests that the City do it all over again because he is 'trying
to sell the property. He stated that, in his opinion, it`is 'proper
that the City Commission do adopt the Resolution vacating the property.
Mayor Adams called for objections. No objections.
A motion was made by Commissioner Brice to adopt the Resolution
vacating the alley as described. The motion was seconded by Commis- .
sioner Young, and the roll being called, the Commissioners voted as
follows:

CITY MANAGER'S REPORT
City Manager.Goldberg reported'..that Commissioners Salvino.and Zenobia
and himself met with Mr: White of the State Road Department regarding
Dixie Highway drainage. They were informed that there ,was a .question .,
as to whether the State could'_use some of the funds which may result.. '
in savings and reducing' of•the,;road-size for,,the purpose .of drainage .
would depend on the' County's approval'.' Commissioner Adler requests a
meeting with them to discuss this,. and.he is advised that a meeting ;: .
will be set up in the near future. These.'two points will be discussed'
with the State Road Department officials:, First, :if they can use some
® of this savings in the reduction of the .wi8th of the Highway.towards .
the drainage of this road; Second, since this is a State and County, ;•
Road, the possibility of connecting it to the Sheridan Street drainage.
City Manager Goldberg presented a request from Mr. Weisman, of the K'
b W Motel on Dixie Crossover and Mr. Shindler of the State R'oad• Depart-
ment for the abandoning of a portion of a retained road right of way
reservation under the old Murphy.Act, and requesting' a Resolution .
from the City authorizing the State to reserve an 80 foot right of..way
of which we presently have 50 feet.

® City Attorney Walden explained. that it is referring to Lots 7 6 8,
Magnolia Park. The state Road Department has an existing right of
way, 50 feet from the center line of Old Dixie. The property owner
has requested that the State Department release .a portion of that
right of way. The Road Department.is willing to,do 'that if the City
® will go along, and the State' will in effect release everything but
40 feet from the centerline. "If you wish to do that, you pass a
Resolution recommending to the State that they release all of their
right of way except 40 feet from the center line" .
A motion was made by Commissioner Zenobia to adopt a resolution
• recommending that the State release all of -the right of way except
40 feet from the center line, as to Lots 7 6 8, Magnolia Park. The
motion was seconded by Commissioner Salvino, and the roll being
called, the Commissioners voted as follows: '

City Manager Goldberg stated that he received an invitation from Vice
President Humphrey to attend a conference in Washington from July 27,
1966 to July 30, 1966, for the purpose of meeting with the Vice Pre-
sident and other top-level officials regarding discussions of the
various assistance programs which are available, and how they may be.
of assistance to the City. City:-Manager Goldberg felt that it would
be beneficial to accept the invitation.
A motion was made by Commissioner Brice to instruct the City Manager
to attend the meeting. . The motion was seconded by .Commissioner
Zenobia.
Mr. Sinclair from the audience objected stating that it will cost
some money, and they can get a booklet from the Federal Government
outlining the assistance programs.
The roll being called, the Commissioners voted as follows:

Mr. Semmel complained about the water hazard on S.E. 3rd Place and
�. 3rd Avenue, in the alley.
Commissioner Zenobia stated that it' is a problem there, and suggested
that the City Manager check it out.
A;gentleman from the audience complained about campaign'posters 'from '
the last election still left on telephone poles and other places. He-
asked that they be removed. He asked if there was 'a law to that effect.
Mayor Adams stated that he felt that in order to put up signs., the
person should put up a $25.00 cash bond. And they ought to remove
them within 15 days after the election or they forfeit the bond'.
Commissioner Brice stated that. several meetings ago, one of the members ,
of the Pension Committee resigned, and the position has not yet .been
filled. He recommended Mr. William Ross to fill the vacancy.
A motion was made by Commissioner`Brice to appoint Mr. .William Ross to
® fill the vacancy on the Pension',Committee- The motion was seconded by
Commissioner Zenobia, and the roll being called, the.Commissioners k
