City Hall. Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S. BRICE (ABSENT) FRANK SALVINO • S. ELLIS YOUNG (ABSENT) CARL ZENOBIA CITY ATTORNEY CLARKE WALDEN CITY MANAGER STANLEY GOLDBERG BUILDING INSPECTOR CHARLES LINDEMAN CHIEF OF POLICE MONTIE SMITH • CITY CLERK MARY THORNHILL The meeting was called to order at 8:00 P.M. by Mayor Adams, after which Invocation and Pledge of Allegiance were held. Mayor Adams reported that Commissioner Brice called and said • he would try to be present around 830 and asked to be excused until that time. Minutes of meetings held June''6 and June to be approved, A motion was made by Commissioner Zenobia to approve the minutes as read. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as follows:' Salvino Yes Zenobia Yes'' Adams Yes ORDINANCE: Concerning the disposal of •garbage by the City of Dania. •(First Reading) . City Attorney Walden stated that the City Manager, was going to make some recommendations to the City Commission concerning thr_ ordin- ance. Mr. Walden then advised that he wou d have the ordinance ready for the next meeting. City Manager Goldberg suggested that they consider: in the ordinance allowing free pick up of .up to four (4) .twenty-gallon cans per residential or commercial establishment on a twice-a-week pick up schedule. "This would in effect provide free garbage collection !` for the normal operation of residences and the majority of the stores" . Mayor Adams asked City Attorney Walden to include these changes and c ' have the ordinance ready for the next meeting. ORDINANCE: Providing for .hook-up to the Sanitary Sewer System. al' City Attorney Walden read the ordinance entitled: ' AN ORDINANCE defining "acceptance date" as same is used with respect to the Sanitary Sewer System of City of Dania, Florida; and providing for the publication and publicizing {;. of notice as to such acceptance date; and providing that it shall be unlawful after ninety days from the acceptance ,.',. date for any person, firm or corporation owning property or leasing property capable of being connected to the sanitary sewer system of the City of 'Dania to use spetic tanks on =" such property; and providing that the penalty for violations of such provisions shall be as set forth in Section 1-6, ' Code of Ordinances, City of Dania, Florida; and providing ; 1 for a permit,types of pipe, general conditions, person qualified to perform work with respect to the construction of lateral lines across private properties for the con- nection of provate properties to the sanitary sewer system of ® City of Dania, Florida; and providing that the permit for construction of lateral lines-.shall contain terms and con- ditions prohibiting the use of septic tanks on properties served by the lateral lines. A motion was made by Commissioner Zenobia to pass the ordinance on second reading. The motion was seconded by Commissioner Sal- vino, and the roll being called, the, Commissioners voted as follows: Salvino Yes Zenobia Yes Adams Yes ROBERT MARKHAM, TAX ASSESSOR: Request permission to explain the new property assessment. Mr. Markham presented House Bill 652-58, or Section 19303, Florida Statutes of 1966, along with a letter from Mr. Riesbeck, Attorney �. , for the Tax Assessor's Office. He presented a copy of the bill to each of the Commissioners, the City Manager, and City Clerk, to use in the preparation of the Budget. PUBLIC HEARING, 8:15 P.M.: Sanitary Sewer System Tentative Apportionment. City Attorney Walden read the Notice of Hearing, which was Resolu- tion No. 1727, entitled: A RESOLUTION finding that a' Notice of Hearing was properly published concerning a Notice of Hearing pertaining to the amendment of Resolution Number 1714 of the City Commission of the City of Dania, Florida; and further finding that no written objections have been filed. with`respect to resolu- tion number 1613 of the City Commission .of the City of. Dania, Florida; and adopting, ratifying and approving the tentative apportionment, referred to as the second tentative apportion-. ment, prepared by Broome & Farina, consulting Engineers; and ratifying and confirming"Resolution Number 1613 adopted on September 28, 1964, by the City Commission of the City of Dania, Florida; and amending Resolution Number 1714, adopted on November 1, 1965, .by the'City Commission of -the.City of Dania, Florida, and approving and ratifying said Resolution. �. Number 1714, as, amended;iand, repealing all resolutions or parts of Resolutions in 'conflict herewith; and providing that this Resolution shall become effective as of the date of its passage and adoption. Mayor Adams asked for any written objections. There were no written, objections filed. City Attorney Walden then read the Resolution No. 1727• Commissioner Zenobia asked when r: .City Attorney Walden got the' figures included in the Resolution. "We just had some new figures handed to us tonight. I think yours are wrong" . John Farina, of Broome & Farina, explained that included in the tentative apportionment, which was the apportionment list mentioned in the resolution, is all parcels within the sewer district included in that tentative apportionment. However, there are a number of 0 parcels that will not be sewered because we do not have an easement to get to them. These are intended to be taken out of the tentative., apportionment at the completion of the sewer program. There is apz�.'.i",' p` -2- proximately 55 hundred feet that will not be assessed because they cannot be reached by sewers. This 55 hundred feet is included in the total 147 thousand feet. ® City Attorney Walden suggested that, since this is not binding, the Commission pass it and then work it out later. A motion was made by Commissioner Zenobia to pass and adopt the Resolution'. HALPRIN, request for Auctioneer's License. 1930 • North Federal Highway. City Attorney Walden reported that Chief Smith recommends that the auction be held on Sunday between the hours of 1:00 P.M. and 6:00 P.M. only. City Attorney Walden asked City Clerk Thornhill what the fee will be. • City Clerk Thornhill replied "$25.00 for the.first day, and $10.00 for each additional. day": A motion was made by Commissioner Zenobia that 'the Auctioneerts License be granted subject to the conditions. set, forth 'by the Chief of Police: The motion was seconded by Commissioner Salvino, and the roll being called, the,Commissioners.:voted 'as'follows: Salvino 'Yes Zenobia Yes Adams Yes • CORRESPONDENCE City Clerk Thornhill read a letter, as follows: "GENTLEMEN: • I would like to express my appreciation'to .yoii.and the members of your Police ,Department-for the assistance rendered during, the 'past, school, year. :;For- the fourth consecutive year we have not had a serious injury at any recommended school crossing or on a recommended school route. This could not have been possible with- out your assistance. There are many times throughout the school year that we must call on you and the various departments of your city for assistance and, I am .happy to say, at no time has there ever been delay in receiving the necessary help. Thank you again for your continued assistance. Sincerely, /s/ Myron L. Ashmore, Superintendent, The Board of Public Instruction " City Clerk Thornhill read another letter as follows: "Dear Mr. Goldberg: I was on duty on the morning of May 15, 1966, as. Fire Chief of the City of Dania. At such time, .an incident occurred which led to my suspension by the City Commission for a period of thirty (30) days. Last year, I completed ten (10) years of 'service to the City as its Fire Chief. During such period, I have properly been on constant call day and night to serve the city and.,its in- habitants in any type of ,emergency which might arise. I feel (continued) that the citizens of the community sincerely respect the Fire Department and that every citizen of the town stands ready to assist the department in any type of situation under the jurisdiction of the department. Largely, be- ® cuase of the respect and assistance of the residents in their attitude towards the Fire Department, it is my opinion that the city has the finest fire department in the State of Florida. . I sincerely regret the occurrence which happened on tfay 15, 1966, as I want nothing to happen which would tend to • injure or lessen the faith and confidence that the people of the city have in their Fire'Department. As you may ap- preciate, the Fire• Department can function efficiently only so long as it can depend upon the support of every responsible citizen in the city. The suspension has now ended and I have returned to duty as Fire Chief. Othan than expressing my regrets by this letter, I will make no further comments or statements 'concerning the incident. City Attorney Walden explained the situation to the" City. Commission, and suggested that the City Commission authorize .a Public Hearing be held on July Sth, at 8:15 P.M. A motion was made by Commissioner Salvino to authorize a Public Hearing be held on July 5th at 8:15 P.M. on the Zoning Boardts recommendation. City Clerk Thornhill presented a letter from Broome 6 Farina, Engineers approving and recommending the payment of the final bill for the lime silo. . A motion was made by Commissioner Salvino to approve the payment of the bill. REPORT City Manager Goldberg reported that the formsy accounts, and pre- vious yearst information have"be,eri.completed and are ready for the beginning of work on the proposed 1966-1967 budget for the city.: Copies of the various department budget forms have been submitted to the Department Heads for their recommendations. ..The employee co-operation in this regard';and.other matters;has. been extremely good and is resulting.in the 'smooth handling. of :the budget and other city matters. City Manager Goldberg reported that he has.been investigating the method of cleaning the beach,. and,:finds that approximately $156 in cost are involved in this "more or :less!' hand method of cleaning the beach. He also checked other beaches in,-.the area on their ,method and is working out a more appropriate method of carrying out this ® work. City Manager Goldberg continued that he had a request' from Hollywood Federal Savings 6 Loan association,asking. if' they could accept,payment of water bills at the bank as'both''a service to the-"City and to their customers in a manner similar to"the telephone and .electric ''bills which • they presently accept. " " ® City Attorney Walden advised that if the Commission wishes to accept the proposal, they must authorize that a simple agreement be entered:_. into. A motion was made by Commissioner Zenobia that the City Manager and City Attorney draw up an agreement with Hollywood Federal Savings & Loan Association to collect water bills. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as follows: Salvino Yes 0 Zenobia Yes Adams Yes City Manager Goldberg reported that, in regards to the bids for the Diesel Electric Generators, the Engineer has .submitted'his recommen- dation, and recommends that the bid be awarded to the low bidder, Hugh F. Palmer, at a cost of $21;948.00., A motion was made by Commissioner Zenobia to accept the low bid, from Hugh F. Palmer, for $21,948.001 .to be paid out of the Sewer Fund. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as follows: Salvino Yes Zenobia Yes Adams Yes City Manager Goldberg informed the Commission that the Andros Ship- ping Company is considering requesting enlargement of their water meter. It has been the policy to inform the Commission of •any re- quests for service outside 'the City Limits: He stated .that they presently do have service,-however. This would just be an increase in size. He stated that they have agreed to. pay 25% more on their water bill. City Attorney Walden advised that-'they need a'.contract if the Com- mission wishes to accept. Commissioner Zenobia stated that this is off the new'.water line that was installed on Old Taylor Road, and they had sort of an agreement that they would not .serve, anyone;unless they came into the city. This was issued by mistake. City Attorney Walden ,stated•:that, in his opinion, where they sell water to these unincorporated areas, which they have been trying to annex over the years, he did not believe, they would 'ever succeed with them because the only thing the City has to offer them is water. Commissioner Zenobia suggested that the City Manager look into this a little further with the'owners of the property and see if they can come up with some sort of annexation agreement, and to get together with the City Attorney omit. The motion was seconded by Commissioner Salvino,' and the roll being called, the Commissioners voted as follows: Salvino Yes Zenobia Yes Adams Yes City Manager Goldberg reported that, .in regards-to the block that .the City owns, Block 172, Hollywood Central Beach, the Commission asked that he contact the surveyor in regards to the price of surveying the lots. They also contacted Hollywood, Inc. , in regards to a pos- sible swap of property. He presented a proposal from Berry & Associa- tes in the amount of $250.00 for the survey. ' City Manager Goldberg reported that he.received one. set of '!?As built" drawings of the sewer system. r ij.L 1 1'! iuq r.Yt .fr Y 1_': { City Manager Goldberg further reported, in regards to Dixie Highway drainage situation, that the Commission's Street Committee meet with himself and the State Road Department to see what could be worked out with regards to the. drainage system in that street. • CITY ATTORNEY IS REPORT City Attorney Walden reported that a month or so ago Emile LeMerdy,. applied to the Commission for a transfer of the beverage license of the Dania Country Club in. the'Thompson and his name. He has apart- ner by the name of Denis Rety. The State License has been issued in . the name of LeMerdy and Rety, and the City license should have been issued that name, or they can approve the. issuance that way. He suggested a motion to correct the application to show both names. A motion was made by Commissioner Zenobia to correct the application • to add the name Denis Rety. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as follows: Salvino Yes Zenobia Yes Adams Yes • Chief Smith announced that this coming Saturday afternoon, from. 2:00 to 5:00 at the American Legion Hall, Dania, they are going to have. an Appreciation Day for Officer Sam•Jones who just recently retired. He invited everyone to attend, including children. , • Boisy Waiters and Veta Mae Peterman askei to be heard regarding the. incident that occurred with Fire Chief; Lassiter.' Mrs. Peterman asked if the Fire Chief has been reinstated. City Manager Goldberg stated that he was suspended for 30 days. He served that suspension. His suspension is over,'and, he is back on, duty. ' • Mrs. Peterman stated that at the meeting held with the City Commission,' ' the Fire Chief and Police Chief j' it was-stated that he would be re- instated after a 30-day suspension, with a public :.apology.. , She stated, that they have .not !seen any statement`of' apology in,the paper. • Mayor Adams replied that it was in the Saturday afternoon paper, last. week. Reporter Bud Jenkins stated that' it•was either Friday or Saturday of .< last week 'in the South Broward Edition, of the Fort Lauderdale News..., Mrs. Peterman stated that it should have been in all of•the papers. City Manager Goldberg stated`that'it was given to all of the papers., Mrs. Peterman asked if,.a warrant has•;been issued to the Fire Chief. Chief Smith stated-that it has been issued: Mrs. Peterman asked if it is right'to,reinstate an officer or any official with "something hanging over his head until it has been cleaned up" , • City Attorney Walden stated that there is no law.or ordinance that requires the City to take any action while the`charges are pending in municipal court. There is no authority for the City Commission to take any action, in either the Charter or,the Code of Ordinances:',;:` , Boisy Waiters suggested' that a precedence has been set by the; former;`. County Sheriff Moschelle by virtue of the fact that he was withdrawn •• from employment at the time that his. case.was pending:.': r9- t IS it � I City Attorney Walden stated that there is a state law that requires that the Sheriff be suspended if he is charged with misfeasance or malfeasance on nonfeasance. But there is no such law in Dania. Boisy Waiters asked why there are no colored boys hired in the Fire • Department. Mayor Adams replied that if they have any qualified boys, they should put in their application. Mrs. Peterman asked if the Fire Chief will serve the West Side of town • as diligently as he will. the East Side of town. Commissioner Salvino, as assistant Fire Chief, replied "We will serve both sides providing they don't make statements and actions like they did on the last rescue call that we made there. There area lot of smart remarks ,passed around: And if they don't quit ganging up on us', • me personally:j. I am Assistant Fire Chief, I will not 'make a call there" . Mrs. Peterman suggested that that is more reason why there should.be a negro on the Fire Department who would not be afraid to go on-the West side. • Fire Chief Lassiter stated "There have been a lot of things said here tonight, and a lot of things said before, mostly concerning me. All I will tell you tonight is a statement,of policy of the Fire Department. The history of Fire Departments in the `United States has always been a history of service without any discrimination of creed, race or color. , And that has been especially true in, the .City. of Dania. There has. never • been a time in the City of.Dania since I have been here that there, has been any distinction of,the'races in our service. Everyone of you,know that. You know the type of service you have been getting over there.-;' And you know' the type of service that you have been entitled to over there. This was not a race incident. .You•made it a race incident." He stated that some people on the scene made it a race incident. ' "Fire • Departments have never had any race indidents anywhere, and especially here. We serve all the people equally. We always have, and we intend. to. But I am going to say this tonight. - -my record of my past perfor- mance to the people is open to anybodys inspection, and it` is not hard to inspect. Because anywhere I have been I have had, a good reputation:'' That is the only thing that I have, and I intend to keep it.- But I ' will tell you this. . right here and now. . . I am going to put the burden,, right squarely on you all. The Fire Department is ,a Department of Mercy. The only reason for our existance•. is io serve people who cannot' serve themselves. . .to put out their fires, to aid them when they injured, and when they are sick, and-when they are hurt)and when they are in- volved in accidents. . And when the time comes that we have to fight to • render that service, then the people responsible are not going to get '.. it if I have anything to do with it. .I have no intentions of fighting to render a service to a person That is .the only reason for the' exis- tance of a Fire Department, to serve people. And that is the only thing that we have ever done." Boisy Waiters stated that they cannot put this blame on their shoulders. "This blame rests on your shoulders. If you had used your head instead ': of your foot this would hot have happened."' Chief Smith stated "This is not going to do anything but cause bitter feelings.
