Present were: MAYOR-COMESSIONER JAMES G. ADAMS COMMISSIONERS GUS S. BRICE FRANK SALVINO S. ELLIS YOUNG CARL ZENOBIA" CITY ATTORNEY CLARKE WALDEN CITY MANAGER . STANLEY GOLDBERG CHIEF OF POLICE MONTIE SMITH (ABSENT) BUILDING INSPECTOR CHARLES LINDEMAN (ABSENT) CITY CLERK. MARY THORNHILL The meeting was called to order at 8:00 P.M. by Mayor Adams. i . City Attorney Walden read the ordinance entitled: AN ORDINANCE rezoning the NE' of the •SW� of the SW� si of Section 2, Township 51 South, Range 42 East, said i. lands situate, lying and•being in Dania, Broward County, Florida, from existing zoning classifications to A-1 Classification; and providing that all ordinances or parts of ordinances in conflict herewith be repealed to the extent of such conflict; and providing that the f. ordinance shall become effective as of its passage and adoption on third reading. A motion was made by Commissioner Zenobia to pass the ordinance on third and final reading. , The motion was seconded by Commis- j,' ' sioner Brice. Commissioner Young asked if we have now secured the rights-of- ways and easements. City Attorney Walden replied- that they do have the deed. ' . Attorney Sherwood Spencer, representing Hollywood, Inc. , asked what arrangements have been made for sewers. Commissioner Brice replied that arrangements have been made for Pirates Ports to hook up with the City sewer and to take the line from their property line, which is the property that is not. in Pirates Cove itself; from there to -the theme park, the water line is to be extended by the City, which we have down Sth Avenue to the proximity of the street that comes out from Olsen School. That line is there, but there has to be some repairs made on it. Mr. Spencer asked, "When you approve a plat like the plat that you I' have up here tonight, do you require any bond to be put up for a subdivision plat, in so far as sewerage is concerned?" Commissioner Brice replied "Frankly, ,the bond has not been dis- cussed as to the sewers for the simple reason that Mr: Philpott has to give us the estimated cost." Mr. Spencer: It is my understanding that, usually on a sub- division plat, you do require some kind of' a bond to see that these improvements are carried out. I would like to respect- fully urge and ask Mrs. Thornhill that my objections be noted that no final approval be made on this ordinance until the satisfactory bonds are put up to assure that this sewer connection, will be made. -1- r , Commissioner Zenobia, asked, "Now that that question has been brought up, I would like to know. one thing from the City Attorney, do we have to worry about this bond tonight?" City Attorney Walden: No, the subdivision ordinance that was written several years ago has not been amended to actually pick-.up sewer bonds or sewer improvements. Commissioner`:Zenobia: They cantt open up without being hooked up to the sewer anyway. Commissioner Brice: We can't very well make them put up a bond until we know what it is going to cost. Bob Houston further questioned the sewer connection. He then asked if .the City has the Head Tax Agreement yet. x' Commissioner Brice replied that Mary has the letter. Mr. Houston stated that he is not interested in letters, he wanted to see agreements on it. He cautioned that these things should be worked out before they give final acceptance. He asked what they are going to do about Fire protection and Police protection down there; also garbage. service. He said there should be some agreement on those yi. things too. - ''; Robert Houston, Jr. , stated that the first obligation is to the people of Dania. He suggested that City Manager. Goldberg, who he understood has a lot of Planning 6 Zoning experience, should 'embark on a master zoning plan and decide what they want to'do with the whole east .side. He stated that he felt it ridiculous to..rezone the acreage that the amusement park wants and just leave all the abLtting property under residential or single-family zoning. '!Because obviously no .developer is going to go in there and' build, homes right next to them; and also, I don't think they are going, to build homes anywhere near them until they find out what kind of a buffer"zone you are going.to have around Reverting back to the motion �made'by 1.Commissioner Zenobia.and seconded by Commissioner Brice to pass the ordinance;on third and, final,reading, the roll-being called, the Commissioners voted as follows: �.;.
