HomeMy WebLinkAbout86045 - MINUTES - City Commission I MINUTES OF REGULAR 'MEETING; CITY,COMMISSION, CITY OF DANIA, FLORIDA, HELD JUNE 6, 1966. • The City Commission of the City of Dania, Florida, met in 6 Regular Session in the Commission Room at the City Hall. Present were: MAYOR COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS BRICE FRANK-SALVINO S. ELLIS YOUNG CARL ZENOBIA CITY ATTORNEY • CLARKE WALDEN CITY MANAGER (ACTING) MARY THORNHILL CHIEF OF POLICE MONTIE SMITH BUILDING INSPECTOR CHARLES LINDEMAN CITY CLERK MARY THORNHILL The meeting was called to order at 8:00 P.M. by,Mayor Adams, after which Invocation and 'Pledge of Allegiance were held. Minutes of meeting of May 16, 1966. A motion was made by Commissioner Brice that the minutes be . approved as read. The motion was seconded by Commissioner Salvino, and the roll being called, .the Commissioners voted as follows: Brice Yes ., Salvino Yes Young Yes Zenobia Yes Adams Yes A motion was made by Commissioner Zenobia that a resolution be drawn and passed appointing'Stanley Goldberg City Manager at an annual salary of $9,000, to serve a 6 month probationary period, also to authorize him to sign checks and other documents of the City. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted ''as follows: Brice Yes Salvino Yes .. Young Yes ;.: Zenobia Yes Adams Yes At this point of the meeting Mr. Goldberg took the seat of the City Manager at the Commission table., , ORDINANCE: Rezoning the NE'k of the SW' of the SWk of Section 2-51-42, from existing zoning classification to A-1 zoning classification. :' City Attorney Walden read the ordinance entitled:... AN ORDINANCE rezoning the NE4 'of thd, SW� of the. SWk of Section 2-51-42, from existing zoning classification to A-1 zoning classification. Commissioner Zenobia asked if they could hold `a ,special meeting for Thursday and table this ordinance until then. a: A motion was made by Commissioner,, Zenobia to .table this until;' ": . Mayor Adams replied-there were not. A CONTINUED PUBLIC HEARING: For the purpose of considering objections of the public to the adoption of an ordinance concerning disposal of garbage by the City of Dania. City Attorney Walden read the Notice of Hearing published April 29, May 6, 6 May 13, 1966, concerning the definition of'types of dwellings to be furnished, the amount of cans of garbage to be picked up at each dwelling, and the size and capacity of the garbage cans. Mayor Adams called for objections and requested that the objectors stand up one at a time and give their names and addresses. • Bob Houston stated that he was not objecting, but he wanted to : know if there had been any delivery date scheduled on the two new garbage trucks that are on order. City Clerk Mary Thornhill replied there was not. Bob Houston suggested that, since they have hired a new City Manager tonight, they instruct him to make a study of the garbage situation; because he (Mr. Houston) felt that there was no::reason to change the arrangements. • Mr. Beaver, of Beaver Apartments, agreed with Mr. Houston, and stated that he too felt there was no need for an additional charge for com- mercial businesses. Gene Pellecia stated that he thought there was already an ordinance stating two garbage cans per dwelling,., so there was no need for this new ordinance or public hearing. Mayor Adams felt that this is. a public service that is due the business ti people. .There are restaurants in the city where the garbage has to be picked up once a day, which we cannot 'do. But he felt that we should '•' at least try to pick up garbage in the Hotels and Motels, but they cannot do it financially. Commissioner Young stated that in his opinion, the business people, � r which included the corporations, warehouses, restaurants, condominiums, co-ops, etc., ,are taxpayers in the City, and one of the main services. that the City renders to the taxpayer are sanitary services. Heper - sonally was against the passage of an ordinance of this type. However he felt that there should be a minimum charge for extraordinary amounts ` of garbage cans to be picked up, :for instance as in the case of a large restaurant. Commissioner Zenobia agreed with Commissioner Young in part, however. he felt that in Commercial units-there should be a larger charge than the one Commissioner Young suggested, .and. he did not feel that it should be limited to certain months of the year. Commissioner Brice stated that he opposed to the business of daily pick ' up to restaurants and such places as the'large co-op because he did not i see where the commercial establishments were entitled to more .pick up. per week than the private homeowners. He did not object to two cans _2_ e �4� ->> a twice a week for any commercial establishment. A motion was made by Commissioner Zenobia to table this until the next regular meeting to give the City Manager time to study the ® ordinance. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes CONTINUED PUBLIC HEARING: For the purpose of considering objections of the public 'concerning the adoption of an ordinance concerning charges and procedures for connecting to the sanitary sewer system. City Attorney Walden read the Notice of Hearing, published on April 29, May 6, and May 13, 196.62 and which contained the ordinance defining the acceptance date with respect to the sanitary sewer system and publicizing of notice as to such acceptance date. BIDS• 8.30 P.M. Laboratory Equipment for Sewer Plant: ' Diesel Electric Power for Sewer Plant and Pumping Stations. It now being 8:30 P.M. , Mayor Adams called for any additional bids. There were none. A motion was made:by Commissioner Young that the bids be closed. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes Going back to the Public Hearing regarding connection to the Sanitary Sewer System, Mayor Adams called for objections. Gene Pelliccia asked if he, as a homeowner, has the right to hook up his own line, providing he meets all qualifications. City Attorney Walden replied "Yes sir" . , Someone asked, in the event that a person hooks them up himself, does he still need the permit, per hook-up or per customer. City Attorney Walden replied that they do need a permit, and he thought it ought to be per hook-up. Building Inspector Lindeman suggested. that in Section 3 of the 'ordinance, it should be included "all fixtures" . He stated a lot of people have washing machines that drain into a drain field, and some people have extra toilets that aren't part of the living area, and some people. even have extra septic tanks. He suggested that the ordinance should state "all fixtures shall-be connected to the sanitary sewer system." Building Inspector Lindeman further stated that the word '"Orangeburg" should be stricken from the ordinance, since that is a trade name, it should be bituminous.:. He added that,th:is bituminous and clay, according to the South Florida Building Code, should be rebtricted -to single- family residences and duplexes. -3: I ' 0 Mayor Adams asked 'what does the South Florida Building Code recommend other than clay and cast iron pipe. Building Inspector Lindeman replied that most cities have discontinued ® the use of the other types of pipe because they have had so many bad connections. Most cities only allow the use of ;cast iron or vitreous clay. Building Inspector Lindeman further stated that;, astar as allowing the home owner to do their own work,. it should be specified that they are supposed to do it themselves,' not to hire an outside contractor. City Attorney Walden stated that an'outrof-town contractor who is not licensed in Dania would have no right to be in Dania doing this work. Commissioner Zenobia stated that he.thought that Mr. Lindeman meant that some man without a license could be going house-to-house, and the homeowner would be taking out the' permit. City Attorney Walden stated that he would try to include that. - Building Inspector Lindeman informed the people that-the-difference between Bituminous Pipe; and Cast Iron pipe is approximately 45C per foot for a 4" size, and he thought clay would cost'more than cast iron. He stated that in the' ordinance' it states that permits can be taken out by Plumbers, General Contractors, . and Engineering Contractors. He in- formed that when they hire a Plumber to do the job, he is required to have a Journeyman on the job at all times. He stated that, in regards to General Contractors and Engineering Contractors, he had no objections to anybody putting it in, as long as they are qualified. He stated that Engineers, in particular, should take a. special examination. "Actually, it is Plumbers' work, and it is against the law to do plumbing unless you are qualified in the City and in the State" . Commissioner Brice disagreed that it is Plumbers' work. . ."It wasn't plumbers who put in the. sewer lines". William Sinclair stated that this ordinance states that any other sec- tions of the code in conflict with this ordinance are hereby repealed, to the extent of such conflict: He stated that the latest change in �.' the Fort Lauderdale building code states that any house service connec- ted with sanitary sewers shall be made with cast iron pipe, this was the latest change, to comply with the South Florida Building Code. He suggested that the ordinance be redrawn i.n accordance with the accepted codes applicable to South Florida. A motion was made by Commissioner Zenobia to pass the ordinance on first xeading, ,with the amendment to eliminate. Bituminous Pipe and t071nclude that all fixtures 'must be connected to the system. The motion was seconded by Commissioner Brice, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes _. ® A motion was made by Commissioner Zenobia that an ordinance be drawn and passed that no more Engineering Contractors licenses will be issued without first passing a test, at a fee of $25.00 for the testa The motion was seconded by Commissioner Brice. Also included in the motion: The test will be given by the General Contraetor's Board; this test ®: will be pertaining to the sewer laterals only. City Attorney Walden read the notice as follows: NOTICE IS HEREBY GIVEN that the City Commission of the City of Dania, Florida, shall meet at 8:00 o'clock P.M. on Monday, the 6th day of June, 1966, at the City Hall in said City for the purpose of hearing any objections or. remonstrances that may be. , made to the improvements in- the following described street, or public thoroughfare, the nature and extent of .the work to be done, the kind of materials to be used and the estimated cost of the improvements being hereinafter set forth: (continued next page) ' -5- r 9 n .V\, i .L.r .1y✓. - .. A motion was made by Commissioner Brice to advertise for bids for • the improvement above, bids`to be received until-Tuesday, July 5, 8:30 P.M. Halprin, application-for Auctioneerts Occupational License, 1930 North Federal Highway. • Mr. Moriarity was present representing Mr: Halprin, and explained that this auction will be held at the Hi-Way Drive-in.Theatre, and explained that this auction, if granted, will be held each Sunday, from approximately 8 or 9:00 A.m. to approximately 4:00 P.M. • Mr. Halprin explained that they will open for inspection around 8:00 A.M. but the auction will not start until around 2:00 P.M. A motion was made by Commissioner Young to refer the application to the Chief of Police for investigation and recommendation. Adams - Yes Correspondence: City Clerk Thornhill presented a memorandum from Bill Rhodes regarding the 4th of July celebration. Items listed asifollows: (1) Blocking off of the street in front of the Dania Beach Grill (2) Permission to cover parking meters on July 4th (3) Request for the City to supply manpower, as they have in the past, to decorate the Beach, to be done Saturday, July 2nd. (4) Request for the City to replace the 4 picnic tables that were ruined during the last hurricane. . Bill Rhodes explained that they will have the same type of celebration., that they have had every year, with the exception of the fireworks. Commissioner Brice stated that he personally would like to see a patriotic celebration. He felt that our youngsters were growing up without any appreciation of some of our National Holidays because they are being commercialized. '( -6- Mr. Rhodes stated that they were having a meeting next Tuesday night at the Dania Bank, and he invited the Commissioners to attend if they had any ideas. A motion was made by Commissioner Zenobia to close off the street in front of the Dania Beach Grill, to cover the parking meters, to have some city employees help put up decorations', also the Chief .of Police and the Fire Chief will be in charge of safety on the beach. The motion was seconded by Commissioner Salvino. Commissioner Young stated, just as a point of information, this is to in no way interfere with the Leaseholder's rights on the Dania Fishing Pier and Marine Life of. Florida. It was turned over to the City Manager to check into the purchase S<' of the tables. r i . The roll being called, the Commissioners voted as follows: ' Brice Yes Salvino Yes Young Yes 3 Zenobia Yes Adams Yes Mayor Adams suggested that Commissioner Brice attend the meeting at the Dania Bank to go over the Fourth:of July Celebration program. City Clerk Thornhill presented a letter from the Dania Garden; Club regarding the selection of a site for 'the "Blue Star Marker" . They presented two sites and asked the Commission to indicate their first and second choice; the sites being: The' southern point of the Way- Side Park even with the first white post; '10' in from the Highway. The second choice, to the East of the white post that marks the entrance at the center of the Wayside Park area, just above the 40 mile speed limit sign, 10' in,.fropn•the highway. Commissioner Brice informed the Commission that the Women's Club was asking for the Commissioners '•to approve ,the site, 'because final ap- proval must come from the'Highway;Departmtnt: . He stated that they prefer the site at the point of 'the Wayside Park. A' motion was made by'Commissioner Young%to give them approval for either site, whichever would be agreeable with the State Road Depart- ment. Adams Yes . . �• ` City Clerk Thornhill. presented a letter.'from .Lindfors,"Waite & Co. , Auditors, in which they gave a price for the annual audit for this fiscal year. She suggested that; if it is agreeable with the Commis- sion, that they be allowed to begin work on the audit for the fiscal, year, and to help with the preparation of the budget for the Sewer Program. A motion was made by Commissioner Young to table this, since there was a difference in the anticipated' cost last year and the actual bill, to give the Commission time to think it over. The motion was ' seconded by Commissioner Salvino, and the roll: being called, the Commissioners voted as follows: Brice No r.4 Salvino Yes Young Yes Zenobia No Adams' - Yes is a ® City Clerk Thornhill informed the Commission that in todays mail she received a notice of a public hearing for a change of zoning .from the City of Hollywood which affects the City of Dania. She suggested that a representative of Dania attend the meeting, of the Planning & Zoning Board, which is to be held June•13, 1966: It concerns Lots 5 thru 99 • of Block 172, Hollywood Central Beach. A 'change.of zoning from RA41 Single Family to RC18 Multiple Family zoning. She informed the Com- mission that the City of Dania owns Lots 1 thru 4.-of Hollywood Central Beach. City Attorney Walden informed the Commission that, regarding false • arrest insurance.,, we have had a number of` suits filed against the City over the year. He stated that a. month or 'so ago we had'a suit of this type filed against the City, which was turned over to the City's insur- ance Agent, Myron Wall Insurance Agency, and the City was informed that the policy did not cover the City, simply the police officers individ ually. He suggested that the City Commission; in a sort of emergency • , measure, contact 'some other insurance 'agencies .to see if we can get coverage. He suggested that,; if they find they cannot get coverage, they set up a large reserve in the budget to Cover this type of loss. Acting City Manager!s• Report: • Acting City Manager Thornhill reported that Mr: Fred Bray, Broward County Health Department, was in the office about 10 days ago. He has been checking on the pool at Westside Park. He advised that the City has to paint the pool immediately,, because they have the summer recrea- tion .program coming up, and the pool is in poor condition. She stated that she has two proposals; one for sandblasting and painting (2 coats) ' $575.00, and another for Sandblasting $375.00 and Painting $347.00. Commissioner Young asked if Mrs. Thornhill had gotten a report on this from the Westside Park Supervisor. Mrs. Thornhill replied. that she did 'not. She added that Mr. Bray told A her that the pool would have to be .sandblasted,because the fungus had penetrated so deep that it would have to be sandblasted in order to paint it. She presented the proposals ,as follows: GEORGE GEISLER: . Sandblasting & Painting $575.00 • NORM AN MC DUFFIE:. . Painting $347.00 A & L PAINT CONTRACTORS: Sandblasting .$375.00 • - A motion was made by Commissioner Zenobia to declare this an emergency and to have the pool painted and sandblasted by George Geisler for $575.00. The motion' was' seconded by Commissioner Brice, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes ® Mr. Barkwill asked what is going to be done about the alley behind his house (loth & llth S.W.) . It was suggested that he write a letter to the City Manager stating his complaint, and it will be taken care of. A gentleman from the audience asked about the puddle of water that accumulates near the Kentucky Fried Chicken restaurant. Mayor Adams replied that there are plans to rebuild Old Dixie Highway. Another gentleman asked. if .the City has a dog ordinance, and if it has, how can they enforce it.' Commissioner Brice stated that an animal ordinance has been drafted • but it has not been approved by all five commissioners .for advertising. Someone in the audience stated "I would like to. welcome Mr. Goldberg as Manager of the City of Dania, and wish him success and good luck" - Mr. Goldberg made .a short speech;expres'sing his" appreciation of their confidence in him, and stated that-he will serve as he feels -is proper • to the interest of the City. A motion was made ,by Commissioner Zenobia,to change the'meeting date next month from July 4th to July-5th. , The` motion,was seconded by Commissioner Young, and the roll being' calledi the Commissioners voted as follows: • Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes Commissioner Zenobia expressed his thanks to"Mary Thornhill for the good job she had done as 'City Manager "for about the 10th .time" . Commissioner Brice: We will all second that one. • Commissioner Young welcomed Mr• .Goldberg and assurred him that "since , he had unanimous vote of the City Commission, he is certainly free to call on any or all of the Commissioners for assistance or whatever he' may need, until such time as he can get his feet on the ground. We wish him luck, and I am sure we' all hope that.he will be with us for the next 20 years" . Mayor Adams stated that "Mr. Goldberg, like all of us, is just a human being, and I am sure fie is.going to. make some mistakes. If he doesn!t, it will be a miracle. So I, would like ,to call on.the "public to,be unanimous along with the Commission, and instead of drying "to; Find fault with Mr. Goldberg, letts try to see the good things that he does.
