The City Commission of the City of Daniai Florida, met in Regular Session in The Commission Room•,at the City Hall. Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS ` GUS S. The motion was seconded' by Commissioner Zenobia, and the roll being called; the Commissioners voted as follows:, ' Brice Yes • Young Yes Salvino Yes Zenobia .Yes Adams , Yes Ordinance: Approving the plat of College Center. • (Third,Reading) City Attorney Walden advised that the applicant did not put up the required bond; therefore; he suggested that it be tabled. A motion-was made by Commissioner Zenobia to .table`the approval of the plat. Yes Adams - Yes Ordinance: Rezoning the NFk of .the.SA of the SW'k of Section 2-51-42, from existing zoning classification to A=1 zoning 6lassification. .(Second Reading) �• City Attorney Walden read the ordinance entitled: AN ORDINANCE rezoning the NFk of the SWk .of SWk of Section 2, Township 51 South, Range 42 East, said lands situate lying and being in Dania, Broward County, Florida; from existing zoning classification to A-1 classification. A motion was made by Commissioner Brice to pass the ordinance on second reading. The motion was. seconded by Commissioner Zenobia, ..' A petition was presented, signed by- approximately 11400 personsl', • objecting to the re-zoning and the construction of the amusement • park. y r Bob Houston objected and stated that he asked about rights-of-ways, asked that an agreement be drawn, on the head tax. And asked if thatl: agreement has been submitted. C Commissioner Zenobia stated that the Commission has not given an opinion that they were going for rights-of-ways. Regarding the head tax, he presented the following letter: "Gentlemen: A meeting was held by the directors of Pirate Ports of O Florida, Inc. , on May 4, in which the directors unani- mously voted for a head tax to bd assessed at 5C per head on the annual admissions to bbr theme Amusement Park. Since:. we are having a single-priced admission, the directors alsoagreed to collect this tax for the City of Dania if they so desire. To make available to an authorized representative of the City of Dania the main gate records for their inspections. Pirate Ports of Florida suggests that a formal written contract be drawn up by the City of Dania, approved by the commissioners, and then ratified by the stockholders meeting of Pirate Ports of Florida, Inc. For your information Pirate Ports of Florida had an economic survey made on the theme amusement park located in Dania. This economic survey was prepared by Economic Research and Development, Inc. , which shows there should be approximately 1,000,000 adult admissions per year to the park. Mr. McGoodwin, president of Economic Research b Development, Inc. , estimates .th t 5p for head tax should brin g in approximately $50.1000 per year for the City of Dania. It is the purpose of the'Pirate Ports ,of;Florida to co- operate with the City of''Dania on a voluntary head tax program, and we feel sure that the park will be something that the City of Dania can be proud of: Very truly yours, C. 'T. Robertson, President " Commissioner Zenobia: We have.been working on this fora year now, this is nothing new. I know that some of the people went around with these petitions and told all the'people that this is going to be a . "carnie", there has-been no advertisements, .and no hearings. That is not true. We have had a few Public Hearings on this, and we talked about it at other meetings that were not advertised Public Hearings. It has been in the newspaper.a number of.times• It is not new, we have been working. on .it for a year.. , It is .on 'the order of Disneyland, it is not a small thing. When this first started. off, Mr. Houston got ' up as he usually does and was against it. He said this is too small. s` . Now he is crying because it is too, big: He said 'we would never get the head tax. We are promised the-head tax; and we are getting the head tax. He said it is a carnie and' it only.has rides..' This is not so. - If you will look at the 'plan, which'we' tried to show you one night, the plan shows that it is not a carnie. The plan is sitting up right here. A few people that I have talked to:that were really dead-set against it after talking to these people with the petitions were very 4i much pleased. Now I would like to.say that if Mr. Houston would stop trying to cloud the issue and would quit getting up out of turn and let the Commissioners speak, we were elected and we are not trying to %! hurt the City of Dania, I think you will all get a true picture .of what is going on up here. It is not only this commission that worked on it. It is the past Commission. I think everyone of them is in agreement that it sbould go through, it is something good for the City .of Dania. They are going to hire over a thousand people. We need a payroll in .a this city. They are going to develop some undeveloped land. It is not _ too close to the school. . .there is 5 acres separating this from the school. I can't see how children are going to play "hookey" from school and go to this. If they are going to play I'hookey" they will play "hookey° anyway. I think that is a very poor excuse, and I just can't see it. - S? -2 4, Mr. Houston replied that he did not say it was too small. He then asked Mrs. Thornhill if she has received right-of-way deeds along 5th avenue for this property. Mrs. Thornhill replied "No sir.° . • Mr. Houston asked where are the right-of-way deeds. He then stated that the public has not been informed properly about this thing. He then accused Commissioner Zenobia of "pushing this thing ever since you have been on' the Commission" . • Commissioner Zenobia stated that he has not been pushing it, and furthermore he was accused at the last meeting of having the paving job, "I do not have the contract. I have a. bid in just like a lot of the other contractors have" . He then accused Mr. Houston of trying to cloud the issue. • 'Mr. Houston then again asked that they get an easement on the East side of this property. Mary Lou Houston stated that she personally took the petition around . and got 140 signatures, and the people were not informed about it.. • Commissioner Zenobia replied that it has -been well-publicized in the Fort Lauderdale News, The Sun Tattler, The 'Miami Herald, and .the Dania Press, more than one time, and on the front pages in some cases. City Attorney Walden reported on the status of the court suit brought on by.Hollywood, Inc. He stated that the City has filed a countersuit. • The hearing is set for either June 2nd or 3rd. He stated that an ' agreement is being drawn up to be signed by both the City and by Pirate , Ports of Florida. Building Inspector Lindeman stated that the County Health Department , wants a firm'committment from Pirate Ports in regards to sanitary • sewage. They are not 4oing. to allow any' septic tanks. He stated that Pirate Ports has.agreed to;put in',Sanitary, Sewers.• Reverting back to the ,Motion made by Commissioner Brice and seconded by Commissioner Zenobia that the ordinance be passed on second reading, the roll being called,-the Commissioners voted as follows: Brice Yes' ` ...Salvino Yes Young Yes Zenobia , Yes Adams Yes Application for transfer of 4 COP License from Elizabeth Sessa'to.John';Logan Henschen, Dania Bar, 1435 South Federal Highway. ?: (Second Reading) !. The motion was seconded by Commissioner Brice, and the roll being called, the Commissioners voted as follows: '. (1) Royal Castle, Request,permission to construct an addition to existing restaurant located on corner of Dixie Highway and South Federal Highway. A motion was made by Mr. Jackson to approve the plans as presented, with the stipulation that the new addition shall have a 6 foot setback off' Federal Highway. The motion was seconded by Mr. DiMauro, and carried unanimously. A motion was made by Commissioner Brice to accept the recommendation of the Zoning Board, with two exceptions - (1) That they be sure that this conforms with the widening of Federal Highway - (2) That the Royal Castle make provisions for a fence on 7th Street. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia ,. Yes Adams Yes (2) Mrs. Bernie Morris: Request to move house from front of lot to back of lot. Mrs. Morris was not present. A motion was -made by ' Mr. to table this request until the next meeting, June 9, 1966. The motion was seconded by Mr. Erwin, and carried unanimously. No action. (3) Public Hearing, 7:45 P.M.: William Bertha Booth, request for M-IA zoning on. following described pro- perty; also; to. vacate lOt '-alley in.Block 5 and 401 street between Blocks 5 & 9, known as Botanic Ave. The fact was brought out that William & Bertha Booth do not own the property in question. A motion was made 'by Mr. DiMauro to readvertise for a Public Hearing in the owner's name (Mr. Panzetti)•, hearing to be held June 9, 1966, at 7:45 P.M. The motion was seconded by Mr. Erwin, and carried unanimously. . ,• ® No action. (4) Carl Maccarrio request variance permit to convert two lots into three lots. Chairman Loury suggested that this be tabled to give the Board' ' emore time to study, and requested that..this .be'•put on the. Agenda for the meeting of.June 9, 1966. We will need the City's and the State Road Department's approval of a sight - presumedly in the area north of the Cut-Off Canal or along the Way Side Park. This would allow some landscaping to be done and a place large enough to have a ceremony for the dedication in the fall. The Beautification Committee of the Garden Club will be happy to meet with your official to select the sight be- fore presenting it to the Road Departmbnt. Our Club is very happy to see additional Adonidia Palms set out on the highway-and trust that in the near future we can work together to see .the "Avenue of Palms" completed from the canal to the south endtof town. Acting City Manager Thornhill read• a letter from the Dania Woments Club requesting the funds set aside in the annual budget for the operation of .the Dania Library. A motion was made by Commissioner. Zenobia to pay the Library Commit- tee of the Dania Womenls Club the amount of money that was budgeted. Yes Adams Yes Acting City Manager.Thornhill read a letter as follows: "Gentlemen: We would like to go on record with the City of Dania how much we appreciate the interest and promptness of your City employees when we had a near tragedy here at Port Laudania yesterday. { " Fortunately the man involved is out of the hospital and doing well. t ), The impressive thing was it seemed like only a matter,) of a few minutes after the accident that your men were on ' the scene giving first aid: Please extend our thanks to those involved. For the purpose of considering objections to the public to an amendment to the schedules of rates and charges to be charged and collected from users ?1 of the sanitary sewer system of the City of Dania, Florida. r, City Attorney Walden read the proposed schedule of rates and charges. ? as follows: $2.00 for each toilet or water closet in any type of building, improvement or trailer served by the sanitary sewer system; ^j , m $1.00 for any type of 'urinal in any type of building, improvement or trailer served by the sanitary sewer system; $1.00 for each sink connection in any type of establishment ® serving food to the public, where the establishment is served by the sanitary sewer system; $0.50 for any type of washer in any commercial coin laundry served by the sanitary sewer system. As to commercial laundries, the charges shall be based on the volume of water used or volume of waste disposed of as determined from time to time by independent resolutions adopted by.the City Commission. Mayor Adams called for objections. Objections were as follows: . 0 (1) Mr. Whittel, objected to method of assessment. He favored the basis of water usage. (2) Mr. John Justice, 945 South Federal, .wanted to know of a trailer is unoccupied are they still assessed. Commissioner Brice replied that it is based on a 12 month year. He pointed out that even though that trailer is not occupied, Mr. Justice still collects rent on that spot. (3) Mr. Beaver of Beaver Apartments, presented a petition . objecting to the Sewer Service Charges- (4) William McAlister, Hotel Poincianna (5) Bill Ross (6) Ashleigh, 3rd Place. (7) Mrs. Ammomon, Sunshine Villas. (8) Mr. Franklin, N.E. 2nd Place, ,' City Attorney. Walden read the resolution entitled: - u A RESOLUTION amending Resolution No. 1613 'of the City of Dania, .Florida, .adopted' Septembbi 28,.'1964;.'to,provide for a change or amendment-in the schedule of rates to be charged and collected from,.the-users. of the Municipal j• Sanitary Sewer System, of City ofiDania;.:Florida, and ratifying and 'confirming. said Resolution'Nol613_ in all other respects; and repealing all resolutions or parts of resolutions in conflict herewith;',.and providing that this resolution shall-become effective as of the date of its passage and adoption: A motion was made by Commissioner Brice to pass the resolution. •The motion was seconded by.Commissioner Zenobia, ;, Commissioner Young stated that 'he still'felt"" that this*as unfair to some of. the people "and until I '"feel that it`is_ going to be fair, at least to the majority of the people, ,I• am• going to have to oppose it" . For the purpose'of'considering '- objections to the application of Louis Marrone for. a variance ' permit, which if granted, would allow°the.construction of marina on the East 412 feet.'of the West -3/4 of the N' of the SW4 of the NWk of Section 35-50-42. ' . S r City Attorney Walden read the Notice of Hearing. City Attorney Walden explained that, regarding the •bond that is to be posted, Mr. Marrone asked if he could get a cash- bond for $37,000 through the bank and have the bank use the proceeds of that bond to pay for the O improvements. Attorney Walden stated •that he saw nothing wrong with that. Commissioner Brice stated that,he didn't like to:give a variance to someone when they (the: Commissioners) haven!t approved a plat. City Attorney Walden stated that they can give approval of the vari- ance on the condition that it .is.subjdct to the bond being put up, and everything being complied with. ' Charles Paoli was present, representing Mr. Louis Marrone, and explained Mr. Marrone's request. He presented pictures and plans. Mayor Adams called for objections. Those objecting were: (1) Russell Seay, 610 N.E. 2nd Place '(2) Mr. Franklin (3) Robert Nelson, .306 N.E. 2nd Court (4) John Kennedy, 609 N.E. 2nd Street' , (5) C.. F. (9) James DeCoursey, 614 N.E. 2nd Place (10) Mrs. Franklin Those in favor of the marina were as follows: (1) Carl Maccario (2) Attorney Paoli presented a letter signed by 3 persons in favor of the marina. Attorney Paoli, explained that there will•be no boat storage on any of the paved area, boat storage is_in, the water.. Repairs will be done while the boat'is in the water. These are'mnnor repairs. ' The only reason for taking a boat out of the water ,will be,to transport, it away from the marina in case it is a dead issue. A motion was made by Commissioner Zenobia 'to accept the recommendation of the Zoning Board, with the following restrictions: (1) Mr. Marone is to put the money in escrow with the Dania Bank as Agent for the bond, (2) No .large repairs, otherpthan ignition repairs, (3) No scraping, painting, or other obnoxious operations, '(4) The workshop is to be restricted to no larger than 30' X 401 ,' (5) No boats are to be stored in the open, on chocks or otherwise; (6) This is to be used for.pleasure .boats only.,:The` motion 'was seconded-by. Attorney Walden read the notice of, hearing, in which was included a proposed ordinance providing for .the definition:'of housings, the _ amount of garbage cans permitted,' for both'.tesidential and commercial,. A and the size of garbage cans permitted. - T•, w Yj,ai m A motion was made .by Commissioner Zenobia to table this public hearing until the next. regular.meeting, June 6, 1966, at 8:15 P.M. The motion was seconded by Commissioner Brice, and the, roll being called$ the Commissioners voted as follows: • Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes 6 Public Hearing, 9:30 P.M. for the purpose of considering the objections of the public concerning the adoption of an ordin- ance concerning charges and procedures -for connecting to the sanitary sewer system. - A motion was made by Commissioner Brice to table the public hearing • until the meeting of June 6, 1966, at 9:00 P.M. The motion was seconded by Commissioner Salvino, 'and.the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes • Young Yes Zenobia Yes Adams Yes Resolution: 'Authorizing execution of an utilities agreement for the adjustment, change or relocation of certain utilities within the right-of-way limits of Old Dixie Highway Crossover. City Attorney Walden read a letter from the Florida State Road Department concerning Old Dixie Crossover. He then read the Resolution entitled: • A RESOLUTION AUTHORIZING EXECUTION OF AN UTILITIES AGREEMENT for the adjustment, change .or relocation of certain utilities within the right-of=way limits hereafter described, and pro- viding when this resolution shall take effect. • A motion was made, by, Commissioner Brice to adopt the Resolution. The motion was seconded by Commissioner Young; and the roll being called, the Commissioners votedas follows: Brice Yes Salvino Yes Young Yes _ •, Zenobia Yes Adams Yes Robert Smith,, application for license to operate a scooter rental at 2451 North Federal Highway, at Tenneco Gas Station. • Mr. Smith was present and expiained .his request: . S Brice Yes Salvino Yes Young Yes Zenobia Yes' • Adams Yes ROBERT MARKHAM, TAX ASSESSOR: $ 871.69 Acting City Manager Thornhill explained that this is for the list of property owners, legal descriptions, and such from the County Tax Assessor, in order for Broome E Farina to make the Assessment Roll for Sanitary Sewers. A motion was made by Commissioner Young that-the bill be paid. The motion was seconded by.Commissioner Salvino, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes Adamso ' Yes Commissioner Salvino asked if the Ideal"Trailer Sales has a license to sell trailers. Commissioner Zenobia stated that when Tony Salvino was City Manager he tried to contact the man to get his to come in and get a license, but he could never get 'in contact: with_ him. He has no license for trailer sales and never went before the Zoning Board or Commission about it. Also, he has more trailers in the park than he has a license for.. Commissioner Salvino stated that there is a bill downstairs for $398.00 for rock at the Colored Cemetery. He has had several com- plaints that the bill is too high. He asked Mr. Carney about it: Bill Carney explained that it is for a rock road in the Colored- Cemetery. It is for 420 yards of rock and 5 hours bulldozing time. The rock was 85� a yard,' which was lower than other prices, and the dozing time was 50¢ per hour cheaper than the competitive price. The bill includes both rock and dozing. Acting City Manager Thornhill reported that.John Farina delivered to the office the Tentative Sewer Assessment Roll. If the Commis- sion wishes, it is time to authorize a date for a public hearing for objections to the sewer assessment.r .'.t.. City Attorney Walden suggested it be held June 20. A motion was made by Commissioner Zenobia to advertise for a Public Hearing, on the Tentative Assessment Roll, to be held June 20, 1966. The motion was seconded by Commissioner. Brice, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes ?0, Zenobia Yes Adams Yes Mayor Adams: Most of you have probably read in the papers that we had an unpleasant thing to happen last Saturday night or Sunday _ morning. We did meet this morning, we had an informal meeting of the Commission, all except Mr. Brice, he couldntt be here. We had Chief Lassiter and the City Attorney,was here, four Commissioners.. Then this afternoon we met at 5:00 ,with seven representatives' ef•'the ^- Colored People, for about another hour and a half. . So.' you can see why we are weary tonight. To bring you up on the report, the Police Report .and all the information that we had, this occurred on Sunday Morning, Chief Lassiter kicked this boy. I think we have all agreed that it wasn't intentionally, but still we feel that.,. .the Commissioners ® feel that he must be reprimanded, so at this time I will entertain a motion from one of the Commissioners to this effect.
