The City Commission of the City of Dania, Florida, met in • Regular Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S. BRICE FRANK SALVINO " S. ELLIS YOUNG • CARL ZENOBIA CITY ATTORNEY ' CLARKE WALDEN CITY MANAGER (ACTING) MARY THORNHILL CHIEF OF POLICE MONTIE SMITH BUILDING INSPECTOR CHARLES LINDEMAN CITY CLERK MARY THORNHILL The meeting was called to order at 8:00 P.M. . by Mayor Adams, after which Invocation and Pledge of Allegiance to the -Flag was held. City Attorney's Report: City Attorney Walden read three times an ordinance entitled: AN ORDINANCE approving the plat.of the Subdivision known as 1ST ADDITION TO ROYAL PALM VISTA, same being "a plat of the West 345.00 feet ,of the N' of the ,SWk. of the NW'k . of Section 351 Township,"50 South, Range 42 East, less "the South 25 feet thereof, and less the Dania Cut-Off Canal right-of-way; said lands situate, lying and being in Dania, ,Broward ;County, Florida, and providing that , all ordinances 'or parts of"ordinances in conflict here- with be.repealed to the extent of such conflict, and providing that by: unanimous consent of all commissioners present, this ordinance has been read on first reading, on second reading.and on third reading at the meeting- of the City.Commission, City .of Dania, Florida, held ,on April 4, 1966) and providing that the ordinance shall become effective as of its passage and :adoption on third • reading. A motion was made.by Commissioner Young to adopt the ordinance on first and Becond 'readings,, as presented. ; The motion was seconded by Commissioner Zenobia. Mr. Marrone was present and asked why they could not pass the or- dinance on three readings. Commissioner Young asked if Mr. Marrone '- had his bond with him:tonight; He replied; no, Mr." Loury has the if, bond. He .suggested that.they,could make,,it' subject to approval and hold up the bond., , ' Commissioner Zenobia withdrew: his :§econd to the motion. Commissioner Young withdrew his motion. A motion was made by Commissioner Brice to -pass tkie ordinance on three readings, contingent upon: the ;fact' that *tte`• bond'i be ,in the • hands of the Acting City Manager'within 48 hours, or the action taken tonight is null and void. ,The motion was seconded by Commis- sioner Zenobia, and the roll being 'called, -the Commissioners voted as follows: Brice Yes' Salvino Yes Young Yes.... Zenobia Yes, ' Adams Yes 41 _y City Attorney Walden reported that at the last meeting Mr. Houston suggested that the City try to obtain 6- feet of right of way along the Western side of Federal Highway, South of Old Dixie Highway.. At that time, the City had already issued a permit to Atlantic Oil Refining Company allowing them to construct a service station. How- ever, last week, Mr. Lindeman because of the emergency situation, was instructed to temporarily stop the construction. Today, "after getting the legal,descriptions of the rights of ways that we would like to have, I wrote Mr. Erdlitz, of Atlantic Refining Company, out- lining what the City would like for right of way." Mr. Walden informed the Commission that legally they do not have the right to stop the per- mit, because the permit was given to.them at a time when they had met all requirements. Mr. Walden-advised that Mr. Carl Hanna, representing Atlantic Refining Co. , was in the audience.. Mr. Carl Hanna requested a letter from the City of Dania outlining what they request so that he can transmit it to the owners of the property. 0 He also asked how long the job was going to be stopped. ' Attorney Walden asked if the plan was set back far enough so ,that they can give the 6 feet. Building Inspector Lindeman replied that they have a 17 foot set-back , 0 from the property line to the first island. There is a required 12 foot set back, and the Engineer .has said ,they could move the island., back another foot. Commissioner Brice stated that since Mr. Walden has sent the letter out requesting the right of way, and since the Engineer has agreed to 0 set the pump island back another foot, he saw no reason for holding' the job up any longer. Commissioner Young stated that he would like to see the right of way ' deed for 195 feet in the hands of the City. . Bob Houston urged that the City not take any action until they obtain the right-of-way from the oil company. Commissioner Young suggested an agreement that the ,oil company will not put in sidewalks, signs or lights contingent upon receiving a determination from them as to the;dedication of. the. 6 foot right-of- 0, way; and providing that they, set the,island. back�one foot to comply with the state law. Attorney Walden suggested, that they.ought,to-have a letter from Atlan- tic showing that they agree to! the''se 'conditions; and agreeing that the 0._ permit will be amended to' agree. to `these conditions: A motion was,made by tommissioner Young that the plan be amended to { delete the items, mentioned, that the island-beset back an additional foot,. that no provisions be made for .the other, improvements until the City receives either the right of w,ay deed or a letter from the Company expressing their willingness to give the City the.'deed. The motion was seconded by Commissioner,-Brice,., and..the roll,being called, the Commissioners voted- as followse, Brice Yes Salvino Yes Young Yes . Zenobia Yes • Adams ,Yes Mr. Hanna: I would like to clarify in my own mind. . .what .is.required for us to start the job? 0 Attorney Walden: A letter agreeing to these conditions. ' Mr. Hanna: First we will have to hear from you as to the conditions'. r - - 2 r City Attorney Walden stated that at the last meeting they considered an application of Raymond Ross for a change of zoning on a parcel of land immediately South of the Atlantic parcel on Federal E Dixie Hwys. Mr. Ross was invited to tonight's meeting, but was not present. Mr. Walden suggested that the request be tabled until another meeting. A motion was made by Commissioner Young to table the request until the next regular meeting. 'The motion was seconded by Commissioner Salvino, and the roll being called, the' Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes Bids: Alterations to Recreation Building in Frost Park. (8:15 P.M.) A motion was made by Commissioner Young that the bids be closed. The motion was seconded by Commissioner Salvino,: and the roll being called, the Commissioners voted as follocgsr . CHILDS: (Accompanied by a bid bond) Work to be done in 45 days Item #1 $4,987.00 Alternate #1 _ 3,158.00 Item #2 2,402.00 `1 TOTAL $10,547.00 A motion was made by Commissioner Zenobia to reject all bids. ( Zenobia Yes Adams Yes Correspondence: Acting City Manager Thornhill presented a letter as follows: "Gentlemen: ® At a meeting today of the Civic Improvement Committee of the Dania Chamber of Commerce, the problem of the condition of the Planters of Podocarpus was discussed. As a member of this committee and as coordinator for the Dania Garden.Club, I was asked to bring this discussion to your attention. It was reported that many compliments have been received from visitors and citizens over this step towards "face-lifting" . the center block of downtown.;. But,. now we find that about six f` of these nice plants have died and need to be removed and re placed to keep this beauty alive: Since. the City. now has t . started the regular program of watering, we feel that we can expect these plants to thrive. Also, at the time of ordering from Mr. Brook we discussed the saucers for the pots and we feel that this addition might aid in holding ® the water fora longer pefiod of time so that the soil can soak more up. We feel sure that you are doing all in your power to push the planting of the rest of the Adonidia Palms planned for this phase of the beautification.of our City. Inter- est is growing in the cause to help make Dania more beauti- ful, and with the cooperation :of all we can certainly attain it. Laud.; concerning Lots 8, 12, 13 b 14, Sec. 28-50=42, requesting the City to adopt a resolution cancelling tax sales certificates of 1929 as to lot 13, and tax sales certificate of 1928 as. to lot 8, 12 6 14. A motion was made by Commissioner Young to adopt and pass a resolu- tion cancelling the .indebtedness for the payment of 10% of the amount. Commissioner. Right of Way Agent, Luther Sparkman, and City Attorney, Clarke Walden: Acting City Manager''stRepbrtt ` Acting City Manager Thornhill reported that at thelast meeting the d received bids for garbage packers and taking. into consideration the letter received from Tom Wood Equipment Corp.', they deduct6d $275.00, -4- from the bids submitted, which shows that Hollywood Ford is the low bidder. She advised that if the Commission wished to accept the bid with the trade-in, the amount would be $20,524.60; with- out a trade-in, it would be $22,124.00. O A motion was made by Commissioner Brice to authorize the City Manager to accept the low bid of Hollywood Ford, with the under- standing that the ,City has the right to accept the trade-in offer or reject it at the time of delivery. Yes is - Acting City Manager Thornhill presented requisition No. 14, ,from M.B. Construction Company, in the .amount of $3,946.73. , along with a letter from Mr. Philpott recommending payment. .. A motion was made by. Commissioner Young that the bill be paid, on the recommendation of the Engineer. . The motion was seconded by Commissioner Zenobia, and the roll being called, the.Commissioners ,E voted as follows: ft. Gaudio & Son, for installation of water. line on Taylor,Road, in the amount of $24,026.64; along with a letter from Broome & Farina recommend- ing the payment of the bill. ' A motion was made by ,Commissioner Zenobia that the bill'be paid. (First Reading) A motion was made-by Commissioner Young to approve the application on first reading. The motion was seconded by Commissioner Zenobia, "i and the roll being called; the Commissioners voted as follows: Brice Yes ; . Salvino Yes Young Yes Zenobia Yes Adams Yes Commissioner Brice stated that the Garden Club & Woments Club of Dania are again requesting the City Commission to take some action on the City Park across the street from the .City Hall. He suggested that the Commission take some action tonight:on it. c Commissioner Brice further advised that the potted plants along r: Federal Highway had been placed, in such a way so as not to be damaged by the automobiles. He respectfully requested that they be moved back to their original location because there have been ® at least four of them already broken. A motion was made by Commissioner Brice to advertise for bids for the repair of the pavillion 'at City Park; bids to be received May 2, 1966, at 8:15 P.M. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as • follows: " Brice Yes Salvino Yes Young Yes Zenobia Yes Adams " Yes Commissioner Brice directed Mr. Carney to have the potted plants on Federal Highway moved back ,to -their original locations. A motion was made by Commissioner Brice to instruct the City Attorney • to draw up the legal papers necessary and to 'advertise for a Public Hearing for the sewer monthly charges based on: $2.00 for Water Closet $1.00 for urinal $1.00 for every sink connection in.all Food-serving establishments • $ .50 for each washer in coin laundry Commercial Laundries to be based on the volume of water used, or waste disposed of. . Also, that the Sewer Assessment shall be based on $6.00 per front foot. Public Hearing to be held May 16, . 1966.,'. at "8:30 P.M. . A motion was made by Commissioner Brice to instruct. the City Attorney �. to prepare the ordinance on Garbage ,service`and advertise for a Public Hearing for May 162 at 8:45 P.M._.. The motion was.sedonded by Commis- sioner Young, and the "roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes • Young Yes' Zenobia Yes Adams Yes. Commissioner Zenobia asked Attorney_ Walden'if he had the ordinance ® ready for Sewer Hook-up. Attorney Walden suggested that they have the, Public Hearing May 16. A motion was made by Commissioner Zenobia" that.they hold A Public Hearing on May 16, 1966, at 9:30 P.M."regarding the hook-up charge. The motion was seconded by Commissioner Brice, and the, roll being . called, the Commissioners voted-as follows: . Z r Brice,. Yes Salvino Yes Young Yes Zenobia Yes Adams Yes , Commissioner Zenobia stated that a while ago,. when they were digging in the alley of S.W. 9th Street, for the sewer, it. was discovered that a certain .motei there hooked into the water system on his own. t He wanted 'to know if the ,man•has been billed. for,the water he has used. A motion was made by Commissioner Zenobia to, instruct the City Attorney to write'a letter to the owner of the Motel in question ,., advising him to come in and .discuss his water. bills. The motion was seconded by Commissioner:Brice. Mr. Grammer, from the audience stated that'it has been proved that the man has been hooked in.illegally, he should be fined for it. Zenobia Yes f1r Adams Yes , Mayor Adams advised that at the last meeting it was brought up about Beacon Ambulande Service being housed in the new Fire Station. This was referred to the Police 6 Fire Committee: That .Committee has met and decided that they do not have the facilities for :Beacon Ambulance; therefore, they recommended they do not accept the proposal. Virgil Tarpley, from the audience, stated that at Mullikin Park, the weeds are "knee high" . S'1 Mayor Adams asked Acting .City Manager tosee. that it is taken care of. �L ..
