The City Commission of the City of Dania, Florida, met in • Regular Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S. Minutes of meeting held February 21, 1966 to be approved. A motion was made by Commissioner.Brice! tolapprove the minutes as read. The motion was seconded by:Commissioner. Zenobia, and the roll being called, 'the Commissioners .voted`.as follows: Bice 'Yes ' Salvino Yes • Young Yes Zenobia ; ' Yes: Adams Yes ORDINANCE: Rezoning the E' of the NW' of the SWk of the SWk of the SW' and the SVk of the NW% of the SW� of Sec- tion 2-51-42, from existing zoning classification to A-1 zoning classification. (First 6 Second Reading) City Attorney Walden stated that at the last, meeting the Commission passed the ordinance on first reading although the ordinance was not written out. Mr. Spencer, representing one of the objectors, . raised that issue. .Heladvised that it 'is 'permissable under the charter to pass an ordinance on more than one, reading.'at one meeting if it is agreeable to all of the:Commissioners. He' sug- gested that, to remove any question, they pass it on first and second readings tonight and have the third reading later. He then presented a letter from the, applicant in which he agreed to donate the right-of-way along. 5th Avenue. He further presented a letter. from Hugh. R.; Davis, .a registered land surveyor,, in which he certified that the parcel,described :in the ordinance is all-Bast of 5th Avenue. 17 A 'motion was-made by Commissioner Zenobia that the ordinance be read j' on first and second readings tonight.. A motion was made by Commissioner Zenobia to pass the ordinance on first and second readings. (First Reading) Acting City Manager Thornhill advised that she received a telephone call asking to withdraw that application for-transfer. No action. Application for transfer of 2 COP License from Lorraine Hermann to Carolyn.De Ceasare, The Hut Bar, 329 S.W. 13th Street: (First Reading) A motion was made by Commissioner Brice to approve the application on first reading. David L. Warrick to Robert & Nellie Fields, Sam E Joe's Bar, 601 S. Federal Highway. (Second Reading) A motion was made by Commissioner Young to approve the transfer of the license. Attorney Walden stated that Mr. Granger, principal owner of Swenorden, , Inc. , has filed with the State for his State License, and must pick up that license within 15 days from date of, filing. Mr. Granger .requests that the Commission approve the application on both readings tonight.,. A motion was made by Commissioner Young to approve the bill. A motion was made by Commissioner Brice to approve the bill for payment. The motion was seconded by Commissioner Young,. and the roll being called, the Commissioners voted as follows: • Brice _ Yes Salvino Yes Young . Yes Zenobia Yes Adams Yes Correspondence: Acting City Manager Thornhill presented a bill from Tognoli Bros. , and . stated that she did not know if the committee has checked the Fire Station out for approval. • Mayor Adams stated that they have not made the final inspection on it as yet, and that it is not completely finished. He suggested they hold up the payment of the bill. City Attorney Walden stated that by a' -special 1965 legislative act, the Broward 'County Area .Planning Board was given jurisdiction in the County over the granting of permits for the excavation and construction of ditches and canals. That Board is going to have .a public hearing on March 23 for the purpose of adopting some type of procedural rules as to the issuance of permits, and everyone in the County has,been invited, including the City of Dania,: :They-request that a representative attend the hearing. • City Attorney Walden ,advised that a Resolution was adopted about a year ago appointing Tony Salvino, .the .City Manager;'as the person to apply for Federal Disaster Funds in connection with the Civil Defense program. The .agency in. charge of- that requests that the. City adopt another Reso- lution amending.the .Earlier Resolution so that Mrs. Thornhill can make application. He then read a resolution entitled: A RESOLUTION amending Resolution No. 1712, of the City Commis- sion, City of Dania,, Florida, by substituting the name and title of Mary Thornhill, Acting,City Manager, for and in place of Tony Salvino, City Manager, and that Mary Thornhill, Acting City Manager, be- And 'she'is hereby.;authorized to execute for an 'in behalf of the City of Dania, Florida, a public entity established under the laws of the State of Florida an application and to file it and any other appro- priate documents in the proper State Office for the purpose of obtaining certain Federal Financial Assistance under the ® Federal Disaster Act. A motion was made by Commissioner Young to adopt the Resolution as amended. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows:. Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes i -4- 5 a City Attorney Walden stated that some few years ago the City adopted Y- ordinances so that the Police•& Fire Departments could benefit under State Statutes concerning Municipal Police Officer's Retirement Trust Funds or Municipal Fireman's Funds, in other words, Pension Funds. He advised that we did the basic work of adopting the ordinance, but we never set up any plan. Finally, the City set up its own private pension plan for all employees, and the insurance agent advised us at that time that we not proceed with the State Plan. He further advised that we have letters from the Insurance Commission asking that the City abolish the ordinance adopted three or four years ago if they have no intention of trying to get the State Funds. Commissioner Brice suggested that they just direct him (Attorney Walden) and Mrs., Thornhill to work it out. Attorney Walden replied that they would meet with the Fire Chief and Police Chief and make sure that they are not going ahead on it, and then bring the ordinance back to the next meeting. Acting City. Manager's Report: Acting City Manager Thornhill advised that some time.,ago they were discussing licensing of Taxicabs in the City, and She'thenapresented an application from Clarence's Taxi of Hollywood, listing Myron Wall Agency as carrying his insurance. Chief Smith advised that they have been making a special effort to get the cabs licensed, and just recently they passed an ordinance to license these cabs for $25.00. A motion was made by Commissioner' Brice that the license be approved. The motion was seconded by Commissioner Salvino, .and the roll: being called, the Commissioners voted as follows: - Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes Acting City Manager Thornhill advised that Fire Chief Lassiter would like to have the Commission set a date for the Fire Station Dedication. He "made a suggestion of a tentative date of March 26. A motion was made by Commissioner Salvino to have the Fire Station Dedication on March 26, 1966. The motion• was;seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes; Zenobia ' Yes Adams Yes Acting City Manager Thornhill advised,that. work has' begun, the con- tracts haize been signed, on the installation. of; the�water line on Taylor Road. Mr. Farina asked Mrs. Thornhilf if the Commission wished him to supervise the installation of this .line, .or was the City going to super- vise it. A motion was made by Commissioner Zenobia that the Engineer.supervise the job. The motion was seconded by Commissioner Brice, c . Commissioner Young asked what the charge�would, be by the Engineer, he' ® understood that normally it is ab6ut •4%, . Commissioner Zenobia stated that he, felt the Engineer should inspect it- as long as he drew up the plans and:_ppecificatigns. 1 Al 'dl .1 �.1 t a ly 5if o i8n Commissioner Brice felt that the Engineers should supervise the installation. Bob Houston asked how the pavement was going to be replaced there. ® Acting City Manager Thornhill replied that the pavement is not being dug up, they are driving it under the road. Reverting back to the motion that the Engineer supervise the job, the roll being called, the Commissioners voted as follows: • Brice Yes Salvino Yds Young Pass Zenobia Yes Adams Yes Building Inspector Lindeman presented a site plan for Pirate Ports, Inc. , and advised that it should be approved by the Commission before he can start issuing permits for it. Commissioner Brice suggested that Mr. Lindeman and Fire Chief Lassiter should look over the site plan to see that it meets the Ordinance in regards to access for Emergency Vehicles and Fire Protection and Police protection. City Attorney Walden advised that the Zoning Board must hold a Public Hearing for approval of the site.plan. Commissioner Brice suggested that the Building.Inspector, Fire.Chief, Police Chief, and Mr. Carney check it over and bring it back to the Commission. Acting City Manager Thornhill read a"letter as follows: "Gentlemen: On December 21, 1965 we were informed that the. City Commissioners had passed ,a,ruling that no. garbage would be collected by .the City other than for private homes, since then we have had' oui garbage collected by a pri- Vate concern. We have since learned that the Commissioners did not pass such 'a ruling and therefore we ask that, the City pick up our garbage in the' dsual manner. ' There are eighty eight owners •in residences here,: and we have forty seven garbage cans;iwhich "s not one can per family. Will you please consider this request at your meeting on March 7, 1966. Very truly your'g-jcloard of Directors, Mildred Ammerman, Secretary Commissioner Brice asked the people of the commercial establishments of the City go along with the City until April 1st, at which time a new ordinance, which ,is in the process of being drawn up, will be taken care of. He stated that as of April lst, they will go back to the old collection basis that they had before. The discussion arose as to how the garbage trucks were going to gain ® access to the property, since there is an ordinance" forbidding• City, garbage trucks to go on private property. It was suggested that Attorney Walden check it out, work it out, then without further delay the City would begin picking up their garbage. Mr. Bill Brooks, N.E. 2nd Avenue, stated that the sea wall in his area. is deteriorating due to heavy equipment connected with the sewer program _ being parked there. He stated that he contacted Mr. Carney in regards to this two weeks ago, and Mr. Carney assured him that it would be taken ± .: care of the next day, and it has not been done. They have also .left a -6- 01 lot of gravel and rock in the grass which makes it impossible to mow. Mr. Carney stated that the Contractor said that that part of the work would not be taken care of until they get to the end of the job. That ® is the last thing that will be done (clean up) . Commissioner Zenobia agreed with Mr. Brooks and added that he felt that some of this should be taken care of now. Bob Houston stated that this conditio' nexists all over the City. He suggested that they hold up M 'V s check until he gets the lots cleaned i up, The Commission agreed 'to hold a special meeting for sewer complaints. They suggested Mary Thornhill set-the date and time and notify the City, Commission, City Attorney," Engineer & Contractor. • Bob Houston again^ suggested that they hold up Mr.• Mear?s check. Mayor Adams stated that his• check will -be held up. Commissioner Brice stated that the Garden Club & the Women's Club has some money they want to spend on the parktcacross from the City Hall. • They asked Commissioner Brice to bring it up before the Commission. They request that the Commission decide what they want.done with the park so that they can spend this money for the landscaping. They are committed to the County for the funds that they received from the County'. and if they don't use the money within" a certain length of time, they will lose about $300 of it. Commissioner Brice further stated that.they brought up the, fact that the plants that they planted along Federal Highway were not being taken care of, ,and they may lose,eome of them for lack of water. They asked if the Commission would see that city employees during the dry spell water the plants. He suggested that perhaps they could get some of the firemen to water the plants from time to time. Bob Houston stated that the City has gone to the expense.of. putting the plants in, and he felt-that the merchants along Federal Highway could " water the plants. • Bill Brooks stated that the merchants: on the East side of the highway are taking very good'care of the plants, but on the West side they are not taking care.of, them. "It is, a'-shame; but maybe with'a little pub-; . licity, we can get these people to ,take-care of them" .. t , Acting City Manager Thornhill advised that Mr. Carney had contacted the people along the highway, but received no co-operation. "I think a lot y' of people would like to•have'them, •so if they. don't. want to put a little h r, water on them we will move •them.". . She further_advised that she had spoken to.Mr. Carney about it, and"they were trying, to arrange a' small tank on s one of the trucks to water the plants twice a week. } , Acting- City Manager.Thornhill stated that the Commissioners asked to get prices on doing some -work on the .pavillion ori.the rear of the Chamber of Commerce Building. She presented three proposals as follows: ALPHA ROOFING COMPANY, ' 0 4-ply asphalt gravel roofs $253.00 Carpenter work to replace rotten lumber: $475.00 SIGNORE & SCIRPO, Complete job: $1;586.00 • APEX ROOFING: $ 737.00. . t � I l Commissioner Brice suggested that Mrs. Thornhill contact the Women's ` Club and the Garden Club:and tell them what we are doing so they will know that we are trying;to work out something for them. Commissioner Salvino suggested that Chief Smith put an extra man, either:Auxiliary Police .or Regular. Police, on Griffen & Federal Highway to ease up 'some of the traffic,at"the busy time of day. Chief Smith stated that it would be taken •care' of. Commissioner Young stated -that at the intersection of S.E. 3rd Avenue 6 3rd Place, the catch"basin has mud.and debris in it, and the drainage ditch '•is also clogged. He suggested:to either, contact the County to see what could be done. (Mosquito. Control) , or have some employee clean it out. Acting City Manager Thornhill stated that she and' Mr. ,Carney were over there this morning, and Mr. Carney was'going to make arrangements to get it cleaned out, either tomorrow, or -.the,next day. Commissioner Zenobia stated .that last week`the`Recreation Committee looked over the Recreation building at Frost .Park, and they agreed that the building should lie enlarged. ' The ,outside` paiio should' be enclosed and the wall between knocked out. A motion.,was made by Commissioner Zenobia to 'draw up specifications for the work ,at'the Frost. Park'Recreation Building, bids to be received April 4, •at 8:15 P.M The motion was seconded by Commissioner Brice. Commissidner'Zenobia stated that,�•at the same, time, they could" put .up the' plaque that Commissioner Young. made.a. resolution for.
