The City Commission of the City of Dania, Florida, met in Regular Session in the Commission Room at the City Hall. ® Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS. S. BRICE FRANK SALVINO, S. ELLIS YOUNG (ABSENT) CARL ZENOBIA • CITY ATTORNEY CLARKE WALDEN ACTING CITY MANAGER MARY THORNHILL CHIEF OF POLICE MONTIE SMITH .BUILDING INSPECTOR CHARLES LINDEMAN CITY CLERK MARY THORNHILL The meeting was called to order at 8:00 P.M. by Mayor Adams') after which Invocation and Pledge of Allegiance was held. Acting City Manager Thornhill presented a letter from Commissioner. Young as follows: "Mayor, Commissioners and Acting City Manager . Gentlemen: I wish to inform you that I am entering the hospital this afternoon and will be unable to attend tonights meeting. I request that I be given an excused absence. Thanking you, /s/ S. E. Young, Commissioner " . A motion was made by Commissioner Zenobia that Commissioner Young be excused. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Zenobia Yes Adams Yes Minutes of meeting held February 7, 1966 to be approved. Brice Yes Salvino Yes Zenobia Yes Adams Yes Old Business: (1) Continued public hearing" to,consider the request of Robert Harpie for a".variance permit to allow the sale of beer and wine to 238'South Federal Highway. NOTICE IS HEREBY GIVEN that the City Planning E' Zoning Board, City of Dania, Florida, shall conduct a Public Hearing at City Hall, City of Dania, Florida, at 8:00 P.M. , January ll, 1966, to consider the request ,of Robert Harpie, for a variance permit which, if granted, would allow the issuance of a license to sell beer and wine at Lots ,9,-10, -19 & 20, Block A, Nelson ' . Park Hill, said property having a ,street address of 238 South' Federal Highway, Dania, Florida. The general subject of the application and the requirement for a variance permit pertaining to theproximity of the said to-' cation to the public school. " 7P All persons objecting to the gr'anting'`of the aforesaid variance ent their permit should appear at said hearing to pres objections. 0 City Attorney Walden advised that at the meeting of January 11, the applicant requested that the hearing be continued over until tonight, which it has been. The applicable ordinance states that no license shall be issued under the provisions of this chapter to any person at any location within 300 feet of any established church or school • measured by shortest straight line from main entrance to main entrance, except that in case of a school, the'nearest point of the school ground used as part of the school facilities. He further stated that the applicant owns a restaurant across the street from Dania Elementary School, and he wants a variance which would allow. him to escape some of the effect of this ordinance. Attorney Leonard 'Fleet, representing Mr..Harpie, requested that the Commission allow this license to be issued because Mr. Harpie could not make a profitable business out of the restaurant without the beer and wine license. • Rev. Jennings objected to the issuance-of this license because we have the ordinance prohibiting the issuance of a beer and wine license so close to a school. Mr. Jerry Pollack, representing the School Board, objected to the issuance of the license and informed the Commission that the Zoning • Board recommendedithaththe request_ be denied. He. stated that they. are not (the school board) requesting a new law, they.are .only re- questing that they do not grant an exception to an already existing valid law. Gene Pelliccia spoke on behalf of the issuance of the license. He • stated that the school in question is a grammar school with little children; there was a license in this place before, and this man is just as far away from the school as the previous owner. A motion was made by Commissioner Brice that the request, be denied, since the Zoning Board had a hearing, on it; and they recommended that • it be denied. Mayor Adams called for a second„to the'motion. He then passed the gavel to Vice-Mayor. Brice; and. seconded the'motion himself. The roll'being called, the Commissioners voted as follows: • Brice Yes Salvino Yes Zenobia No Adams Yes • Old Business: (2) Continued public hearing to consider the request of Pirate Ports of Florida, Inc. , for rezoning certain properties,in..the southeast .section of the city. City Attorney Walden advised'that he was not present at the last • meeting but he understood the question was raised as to whether the Commission could approve a rezoning,of an area less than that which was advertised, and the matter .was tabled until a legal opinion could. be given. He further stated.,that in his opinion the City could, after the initial public hearing at the last meeting, properly rezone a lesser area than what was advertised. He suggested that.if they are going to • do it, they do it by ordinance at three successive and regular meet ingsr He read the description:as follows: The E� of the NWT of the SW� of the SW� and the SW' of the NWk of the SW' of Sect. 2T Township 51 South, Range 42- East, Broward County, Florida, from. existing zoning classification - • to A-1 classification. Building Inspector Lindeman showed the Commission and the audience a' sketched map of the parcels in question. Commissioner Brice asked Mr. Lindeman if it was correct that all of the land that they were considering lies to the East of 5th Avenue. Building Inspector Lindeman replied that it was correct. A motion was made by Commissioner Zenobia that an ordinance be drawn and adopted on first reading rezoning the area that was just, mentioned, East of 5th Avenue,to A-l; also to include that the owner Mr. C. T. Robertson get together with the City,Attorney between now and the second reading, condidering right-of-ways and drainage. • City Attorney Walden. advised that it doesn't have to be included in the motion because, "you simply wouldn't pass it on the second read- ing if he did not give the right-of-ways'r: He then read the.ititle- of the ordinance as follows: • AN ORDINANCE rezoning the E' of the NWT of the SWk of the 9* and the S* of the NWk :of the SWk of Sec. .2, Township 51 Southi Range 42,East, . from existing zoning classifications to A-1 zoning classifica- tion. • He further advised that this is first reading, and if they pass it, then they do not have to show it_ conditioned upon the rights-of-way, being given., Commissioner Zenobia: Then I will make`a motion to .pass it on first . reading. . • The motion was seconded -by Commissioner Brice, and.the roll being called, the Commissioners voted as follows:. Brice,. Yes Salvino Yes 0, Zenobia, Yes Adams Yes Attorney Sherwood Spencer, from the audience, asked if they have just passed an ordinance on first reading that has not in fact been drawn. City Attorney Walden: I think, Mr. Spencer,..the exact ordinance will read exactly the way I have read it, and it is proper to do that. ' It goes into the records. Sherwood Spencer: Well, if I am correct, ,I think ,that we have just. passed an ordinance on first reading that in fact does not exist:, and I respectfully request that the minutes so .reflect. At this..time, Mr. C. T.-Robertson~showed a film of the"PSix'Flags of Texas") a-theme.amusementrpark'after which 'the. one' proposed for Dania will be patterned. Recommendation from the Engineer and. CityfManager.for the award of the contract for the construction�,of a water line on Taylor - Road. Acting City Manager Thornhill stated that.the Commissioners had :been. ® furnished a copy of the tabulation of the bids, -and'she then read a letter from the City Engineers, Broome,& Fariria as, follows: ` "This is to recommend that the Contract of the constructionf,o a water line on Taylor Road be'awarded ,to the.low bidder, A Gaudio 6 Sons, Inc., for .theirrbase"bid-of $24,047 62. ® /s/'John •Farina. . " City Manager Thornhill stated that ,she concurs' with; the Engineer's; recommendation, if .the.Commission wishes to award the contract., r ® A motion was made by Commissioner Zenobia to .award the bid to the lowest bidder, A. She requested that the Commission accept the easements so that they can be recorded before the work begins. A motion was' made by .Commissioner Bricb that a resolution-be drawn and passed concerning clay for the ba]lfields'. Legal: ' Lot l '&' 4, Block 7, Town of Modello (Dania) Address: 145 N.W- .5th Avenue: A motion was made by Mr. DiMauro to table this and hold a' special meeting for Tuesday, February 15th, at, 7:30 P.M., at which,time they-will ,bring plans showing parking and, set back. The motion was seconded by Mr. Jackson, and carried unanimously:' No action. (4) Louis Marrone: Request a variance or change of zoning to construct a marina. Legal: the W=3/4 of the;N-1/2 of the SW-1/4 of the NW-1/4 of Section 3.5r50-42. Address: N.E. 3rd Street 6 N.E. 6th Avenue. A -motion was made by. Mrs. Panella to recommend a Public, Hearing be held for a change of zoning on March 83 1966, at 7:45 P.M. The motion was seconded by Mr• DiMauro and carried unanimously. A motion was made by Commissioner Zenobia to authorize a Public Hearing for March 8, 1966, at 7:45 P.M. Ross, Jr.: Request rezoning: of a portion:of property located on Old Dixie Highway & Federal,Highway, from C-1 to B-2. ' Building Inspector Lindeman informed the board that Mr. Ross called and requested that this be postponed as he could not be present tonight. A motion was made by Mrs• Panella. to table the• matter until . Tuesday, February 15, 1966, at '8:00 P.M. ' The motion was seconded by-Mr. Jackson, and carried unanimously. No action. - ; (6) Mrs. H. H. (Bernie) Morris: Request to movehhouse from front lot to back lot. Legal: Lot 61 Block 13, Town of Modello (Dania) . Address: 63 N. Federal Highway. A motion was made by Mr. Jackson. to table this until.March 8, 1966, at which time Mrs. Morris is to present a petition A signed by surrounding property owners,within. 3001 of the area,. . The motion was seconded by Mr. DiMauro, and carried unanimously. No action. (7) Mr. Lamberth, president of Marine Life ,of Florida: Re .� questing permit to paint directional sign on New Kath- erine Hotel. Fy. . Building Inspector Lindeman explained,that^since ,this is a directional sign; which .is.outlawed in the City,.,the only way he can have it is to:get'a variance• • A motion was made by Mrs. Panella to recommend a Public rf Hearing for a variance permit, to be held March 8, 1966, at 8:15 P.M. The motion was seconded by Mr. DiMauro,. and carried unanimously. • A motion was made by Commissioner Brice to authorize a public hearing for a variance permit, to be held March 8, 1966, at 8:15 P.M. Mr. Loury requested Zoning.Consultant Howard Burgess to study this for a couple months 'and comeback with recommendationsp . also to look into the possibilities of, Ml or MIA zoning.` • No action. The motion was seconded by Mr. Erwin, , and. carried unanimously. Legal: (Legal description obtained from Parcel Two of City Ordinance No. 462) Address: -This property located approximately 195'feet South of Dixie Highway and Federal Highway on west side of street. A motion was made by Mr. Erwin to have the, Planning E Zoning Board waive their public hearing, and. to recommend to the City Commission that it be passed as presented. The motion was seconded by Mrs. Panella, and passed unanimously. E. Goulden, representing Wilco Industries, Inc. , request permission to rent "SWIM-SLIMS" at Dania Beach. Mr. Goulden distributed pamphlets .to the Commission and the audience and explained how the "SWIM-SLIM" works. He asked ;permission to rent them on whatever portionrof the beach the e City Commission would specify. A motion was made by Commissioner Brice to instruct the Recreation Committee to investigate and report back at the next meeting. Acting City Manager Thornhill presented the correspondence, as follows: "I represent Atlantic Coast Cable TV, Inc. , which corporation wants to apply to the City of Dania for a permit to install.a e community antenna television system in the City. As you.may know, many cities in the United States have already granted permits to private firms to, install what is known as a CATV system. This system comprises a centrally located. antenna- to serve all the homes, in the community, with the television signals • running by electric lines to the individual homes like a telephone wire. Using this system greatly improves tele- vision reception, eliminates interference and extends the distance for good reception up to 100 miles. The system also gives additional television programs such as a 24 hour time and weather information, 24 hour-stereo or • hi-fi background music. The reception,of colorotelevision is particularly enhanced.. For this service a nominal charge is made to the home owner on a voluntary basis to subscribers. To install the sybtem in the City of Dania, the corporation needs to secure permission from the City to install its poles along City streets, alleys and easements,, along City-owned property, or permission to merely run a line and to rent utility poles or any in existance. For granting a permit the City would be paid 4% of the gross receipts. At your earliest convenience, I would like an opportunity ' to bring the proposal in more detail to the City Commission either in a conference meeting or a regular meeting. /sl Very truly yours, C. Shelby Dale " Commissioner Brice suggested that, since there has been so much controversy over the country about this cable TV, he would like the City Attorney to look into this as far as-granting of the franchise, whether it could be exclusive, .etc. , "In an effort to aid worthy graduating Seniors who_fifid it extremely difficult to continue their education because of . family economic status, the Attucks High School Scholarship Committee is again sponsoring its, annual .Senior Workday, on ,,, February 24, 1966. Acting City Manager Thornhill advised the City Commission that they received the adgenda for the Fort Lauderdale-Hollywood Urban Area Transportation Advisory Committee meeting to be held Thursday, March 3, at 1:30 P.M. in the conference room at the Broward County Court ® house, if any of the Commission is interested in attending this meeting. Acting City Manager Thornhill advised that the New Firestation is almost completed, and she asked Mrs. Wall, our Insurance Agent, to give us a quotation'on covering this building. She advised that when the building is accepted; by the City, the.,Builder's Risk'Insur • ance will be cancelled. Mrs.: Wall gave a quotation on insuring the building for $7,000 and the contents'for $3,000 for fire extedded- coverage, vandalism and malicious mischief: The premium on that, to add it to our Public Institutional Policy, will be $306.74, effec- tive the 21st of February until January 9th, 1967 when the other policy expires. Mayor Adams explained that they have been unable to get the complete Police 0 Fire Committee together; they have however looked the building over individually and there are several things that they,are not satis- fied with. These things do not amount to very much, but he (Mayor Adams) would be in favor of holding back around $2,000 and pay him the balance`-- • which Would be approximately $9,000. Commissioner Brice asked, if they should pay him the $2,000 would that' in any way relieve him (Mr. Tognoli) . City Attorney Walden advised that they would not relieve him of any obligation by making a partial payment. He further suggested that the City make Mr. Tognoli furnish them an affidavit that .he has paid all the bills before making final payment. Commissioner Brice suggested that, since this was turned over to=the Police & Fire Committee before to inspect, which consists of three • Commissioners, they should be allowed to do what,they. think best. ;. Commissioner Zenobia asked Mayor Adams, as head of the Police 6 Fire Committee,, what was his recommendation; did he recommend paying all but $2,000. Mayor Adams recommended paying $9000, which would leave $2,617.89. A motion was made by Commissioner Zenobia to pay Tognoli Bros. $9,000. The motion was seconded by`Commissioner Salvino, and the roll. being called, the Commissioners .'voted as follows: Brice : Yes Salvino Yes Zenobia Yes Adams Yes Acting City Manager Thornhill!advised the Commission that at the last. ® meeting she presented a bill from Lindfors, Waite & Co:, for auditing. It was tabled from the last meeting. She stated that she spoke.to.. Mr. Freeman on the phone, and he stated that due to the fact of, the sewer work, which had never been done before, the auditing .took`more time than they anticipated; which accounts for the .fact,of. the bill' being in excess of the $3,000, -which was .the figure they.quoted in ® 1965. She presented their bill of .$4,797.00 for the General Fund, '.*' Water Fund and Sewer Fund work.; That is approximately. 856 .hours Mrs Thornhill stated that, for the time they spent here, and the amount of . work that they did, she felt that their bill was justified. ;`- mfr., a " A motion was made by Commissioner Brice to pay the bill. Frost, & Louis Ghezzi. She asked that the Commission accept the deeds for recording. r A motion was made by -Commissioner Zenobia to accept the deeds. Broome & Farina today laid out quite a few of the easements for M B Construction Company to go in and lay the laterals, so they will be working on that for the next few days. Mr. Sinclair, representing the American Legi6n, of Dania as American- ism Chairman, announced that be' is, Americanism Month, and the Legion tomorrow night will be showing a film called "Communism in Action", the hall will be open to the public; and,he extended an invitation to all present to attend. Mr. Robert Dubow, representing Mr. George Arcaro, stated that Mr. . • Arcaro has obtained some plans for .apartments on:Gulfstream Road; . however, before he presents them to the Commission, he would like to be certain of whether he will 'get the additiona1, 300 feet of .Sewer that he needs to sewer the entire-project. He then presented a plot plan. • A motion was made by Commissioner Salvino`to authorize the. Engineer to draw up a change order, and authorize the City Attorney to draw up an agreement with Mr. Arcaro.. The•motion was seconded• by Commis sioner Brice, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Zenobia Yes Adams Yes A motion was made by Commissioner Brice to instruct the City Manager and Mr. Carney to draw-up specs and re-advertise for garbage trucks, bids to be received March 21, 1966. Adams Yes Commissioner Brice: I would like to make a motion pertaining to. this junk yard situation we Piave: To- instruct the. Chief of;Police' 1 to lift the license and see that the man ,carries out the .instruc- > ' tions, as he has been instructed by,the•Chief of Police, and close' . it up. In connection with that, Mr. Stuart has agreed'that• he will' help the City by moving all trucks or cars that can be towed away,, • o to an area that he has out in the County where he can dispose of them, without cost to the City.. Mr. Grammer, from the audience, stated that about 9/10 of them cannot be towed away "what are you going to do about them?" 0 Commissioner Brice stated that 'we are stuck with what is out there that cannot be towed off. Gene Pelliccia stated that at the last meeting when this came up - Chief Smith was given Power of Attorney to go out and pick up the: ® man's license, so why was the man given a 60 day extension. Commissioner Zenobia asked Mr. Stuart if he would like to make a statement for the record, of what he will do. Mr. Stuart stated that he will.elean up everything that,he can • haul out, but the bodies that he .has stacked up, will need a semi- trailer to get them out. And anything that the City has in the City he will take them out. Chief Smith: Do you mean junk cars that are in the'City now'that , we need taken out? Mr. Stuart: Right. A motion was made by Commissioner Brice to instruct the Chief of Police to lift the license and close up the dump. Attorney get together with the members of the 'Civil Service Board, and draw up a Civil Service Plan for all city employees. . ® Commissioner Salvino requested that Mr. Carney, or someone, make a survey of the north end of the City along Federal Highway,, to clean it up. Commissioner Brice stated that he would like to ask the City Manager_ to ask Mr. Philpott to give us"an estimate- of what the cost would be;, • to service the property on Federal7Highway and S.W. .10th Street,swhere we are unable to get easements.
