The City Commission of the City of Dania, Florida, met in. ,
Regular Session in the Commission Room at the City Hall.

The meeting was called to order by Mayor Adams at $:00 P.M. ,

Mr. Houston, from the audience, brought up the question of the
proposal that Lindfors, Waite & Company submitted when they were
hired, and questioned' the amount of the proposal" in,. regards to the
amount of this bill.
A motion was made by Commissioner Zenobia to table the payment of
the bill until.further. i.nformation is obtained. The motion was

all bids will be publicly opened,. and read'aloud: , The:.bids
will be based on.ifurnishing and'installi.ng approximately
5,800 L.F. of 8-inch water main complete with all necessary
valves, fittings, and appurtenances, otherwise,"known as

The City of Dania, Florida reserves the right to (a) waive
informalities in any bid; (b) reject any and all bids;"'(c)

Mr. Houston objected to the letting of the bids on the water line at
this time, on the grounds that the .City cannot afford it at this time,
and also, there is no .use in putting an 8" water line in to serve one
property owner.

NOTICE OF HEARING: ' NOTICE IS'HEREBY, GIVEN that the City Com-
mission of the City'of 'pania, Florida, shall conduct a public
hearing at 8:15 P.M. , Monday, February 7, 1966, at the City
Hall, City of Dania, Florida, for the purpose of considering
the application of •Pirates Ports;of. Florida, Inc., to rezone-;
the following described property, .to; wit,

Mayor Adams called for objections. They were as follows:
Ross Beckerman, Attorney from Hollywood`,' appearing for Sherwood
Spencer, representing Marie'Swanson, Hollywood, Inc, and.about
75 other property owners in the area. Mr. Beckerman read a
letter from Mr.. Spencer, addressed to the City Commission as
follows.
"IN RE: Proposed change of zoning.
G entlepen:
.We are advised that a,hearing will be held before you
' Monday, February 7, 1966, at 8:15 P.M. for the purpose of
considering the application of Pirate Ports -of Florida,'Inc. to
re-zone Parcel #2 from existing zoning. classification to A-1
classification (recreational and amusement district) , and at
8:20 P.M. to consider re-zoning for the same applicant .of the
property described in Parcel #1 herein from;existing zoning
classification to R-3 classification ,(parking).
On behalf of Marie C. Swanson, a widow, Hollywood, Inc. , .
a Florida corporation, and.other owners of property immediately ,
adjacent to the property sought.to be re= zoned, and in the im-. '
mediate proximate vicinity thereof, and all other interested
citizens of the City of Dania, we hereby protest such contem
plated changes of zoning.
There are many reasons for protesting, and obj eating :to
the contemplated changes of zoning, some of which are as follows:

® 1. The two proposed changes of zoning contemplate ex-
tending a proposed plan for a large amusement park and center
for the purpose of attracting many thousands of persons to a .
vast amusement park which reportedly will consist of various
carnival types of amusements, contrary to not only existing
zoning but the actual use of surrounding properties for single
• family residences. , ., ,
1 .2. If such use were permitted the great amount of vehi-
cular traffic generated would constitute a hazard to the safety
of the students attending school in the area, and particularlg
Olsen Junior High School.
3. Use of the property sought to be re-zoned' for a Coney
® Island type of extravaganza would result in great amounts of noise,
bright lights, and other undesirable features which would con-
stitute a nuisance to the nearby residents of si.ngle• family
homes, and. as such would constitute both a public and private
nuisance.
4. Removal of this 'property from single family zoning
use as projected and contemplated would destroy the' financial
basis for the proposed payment of the present sanitary sewer
system under construction. The cost of •the sewer system is
supposed to be paid for by special assessments and maintenance
charges to be collected on single family homes to be built in
this area in the future. Without .such''si.ngle family homes and
assessments there would not be enough`.funds to pay for the sewer,
which would cause.a financial burden upon all of the citizens
and taxpayers of'the City of Dania.
5. All zoning, and therefore re-zoning, must have a direct
relation to public health, safety, ,morals and'welfare of the
general public. Each of. these four,principles would ,be utterly
destroyed and,violated by the contemplated changes in zoning.
6. The ,legal conditions 'precedent 'to entertaining a
proposed change of -zoning have been completely ignored.
We respectfully request that this letter of protest be
read and,made a part of the minutes of the meeting of' February
7, 1966.

In addition to the letter' Mr. Bebketman presented. a petition from
the property owners immediately adjacent to the property in question,
signed by 83 persons.
Acting City Manager Thornhill;presented. a letter,, addressed :to the
City Commission,, protesting the re-zoning of ,the property; 'signed .
by William H. Glenn; -.43 S.E.', 10th Terrace, Dania:
Mr. Robertson, representing Pirates 'Ports,. Inc. ,-presented his side' .
of the ,question. He stated that he has heard talk of a monorail,
which.he knew nothing about',' they,have.not purchased one; they have
purchased all their•irides :that -are going there; there is, approximately
50,000 sq. ft. of buildings that ,are going in; they have purchased
some 1,000 palm trees; they have an allotment of *150,OOO for land-
scaping in the park; the only exit and entrance contemplated�and` shown .
on the plan is on Sheridan Street. He further stated that he met with
the School Board, who were concerned about the traffic, and, after
looking at the plan, he believed they have withdrawn their objection.
He added that all of the amusement park will be'East of 5th Avenue,
there will be none of it to the West of Sth Avenue. He then sub-
mitted a letter to the Commission,which Acting City Manager Thornhill
read as follows:
"City Commission:
In reference to the West 20 acres we are requesting to be-
re-zoned, commonly known as St. James Park, development Plats B
" and Plat C, Pirate Ports hereby agrees, to never -use this 20
acres for either parking fort:the,amusement park, or the:,amuse-
• ment park itself. We will be glad to enter into a formal con-
tract or this can be incorporated as part of the zoning.„`Pirates
Ports intends to, at a later date, develop this 20 acres into.
® condominium type garden apartments.

Mr. Robertson explained that all of the parking will be done off
Sheridan street; none of it will be off Sth, 2nd, and never will
® there be an enhance to Pirate Ports off 2nd Avenue. At this time,
the road, is there until they get enough fill to go from the back
part to Sheridan, they are temporarily using that road by the
school. They have ordered a gate to be put there, and there will
be a fence completely around it.
• Mr. Houston objected to the rezoning for two reasons;r.one that there
would be no income .from sewer assessments without homes, in.that area,
and that there would be no'ellowance for drainage if that area is
built up.
Commissioner Zenobia asked Mr. Robertson if he would object to .the
• one piece being zoned R-3 instead of A-1:
Mr. Robertson replied that, at long as it is East. of 5th Avenue, he
had no objection. He further replied to Mr. Houston's question -on,
drainage "If you wilL-.note on this plan that we have submitted, ,there
are a series of lakes to be cut in there. We have authorized our
• Engineers to connect everything'with•conduits of ample .capacity. to
carry the drainage. I think we will help the drainage instead of. hurt.. ,
it". He added that they are planning to move 235,000;yards of fill,
which ought to bring it up above water; and''?a's vie do that, we will
put conduits in which should help the area to the West of it".
• Commissioner Zenobia asked Attorney Bob Dubow if they could amend .it
or if it would have to be readvertised.
Attorney Dubow replied that they would have to readvertise.
Mr. Robertson suggested that the Commission pass this A-1 zoning,
and he will withdraw the 2,054 feet that is R-3.
Attorney Dubow replied that, in his opinion, he has applied for A-1
and the Commission must either.pass it tonight, reject it, or.table
it; but they cannot pass it as another classification 'even .though 'that`
classification is.higher. He believed .that.he must have another notice'
of hearing published if he wants to apply fora different class of zoning.
Commissioner Brice stated that the Attorney says they have two alter-
natives, they can table. it and get Mr. Walden (City Attorney) to study this particular plat, on this A-1, and see if -we can do it without.re
advertising it by taking off that small portion of .it that is west,of:
5th Avenue; or we can turn it down.
A motion was made by Commissioner Brice to table it to get an opinion`.
from the City Attorney. The:motion was seconded by Commissioner Zen-
obia, and the roll being called, the Commissioners voted as follows:

Spencer stated that'he would like the re.ord to show that their ob-
jections were exactly as shown in the letter and petition, which were
meant to cover both parcels.
Several unidentified persons from the audience stated their objec-
tions to the rezoning.
Mr. Robertson withdrew his request for R-3 zoning.
A motion was made by Commissioner Zenobia to deny the request for
rezoning to R-3. The motion was seconded by ,Commissioner Brice, and.: ,.

Attorney Dubow advised that this request should first"go before the ' .
Planning E Zoning Board. The request was therefore referred to the*
Zoning Board.

Correspondence.
Acting City Manager Thornhill presented a. letter, addressed to the
Mayor and City Commissioners, from-the Board of County.Commissioners,'.
signed by Jack Wheeler, Clerk, in regards to Mr. S:'; Ellis Youngts:.. .
status as a member of the Board.of County Beach Erosion Advisory
Committee. The letter stated that Mr: Young has not attended' a meeting
since June, 1965; and they request the appointment of a new represen
tative of the City of Dania to serve on the board'. They further request . , .
that, in the event a new member. is appointed, that the board .be advised ,
of the recommendation.
A motion was made by Commissioner Zenobia.to appoint Mr Gus Brice to
the Board. The motion was seconded.by Commissioner'Salvino; and the

r, Acting City Manager Thornhill read a letter from David Volkert and
Associates regarding the possibility: of .the City of Dania supplying
wholesale water service, through a master meter, .to Broward ,County., ;
at a point to be determined on the'west,:line of the City, to:,the

A motion was made by Commissioner Brice to advise the County that the
City of Dania:would be ,glad to furnish. them water to this particular
area, and that the City Manager be instructed to work out the most
feasible place for them to tie in. The motion was seconded by Commis—
sioner Zenobia; and the roll being called, the Commissioners voted as
follows:

Acting City Manager Thornhill read a letter from Florida Eastcoast
Railway Co. , addressed to the Acting City Manager, regarding the NW
5th Street crossing, stating thatin June of last year they called
on former City Manager Culverson to discuss this crossing, but they
have heard nothing from the City in regards to this crossing. They
40 suggested that the matter be brought to the attention of the Commis-
sion for action.
Acting City Manager Thornhill explained that they want to either close
or put up signals at the railroad crossing that goes into• the Aircraft
Fittings Corp. , just North of the Dania -Off Canal. She further
explained that the City entered into an agreement with the FECRR in
May of 1948 that, should any signal, lights be needed at 'any crossing,
it would be the City's responsibility to install them.
Police Chief Smith stated that since there is so little traffic at
that crossing, and since there have been no accidents at that cross-
ing, he ,saw no real need for a light there at this.ti.me.
No action.
Acting City Manager Thornhill read a .letter addressed to the City.
Commission, from Mr. Martin Steyer, in which he stated that. in' March
and April of last year he met with city officials.to discuss sanitary
sewer service to a, parcel of property, which he intends-.to develop.
The property is located outside of the area being sewered.. He further '
stated that at a Commission meeting of April 19.., 1965, the .city' agreed
to allow;Mr. Steyer to connect to the sewer if certain conditions were.
met. He further stated that he is now prepared -to meet all conditions
and would appreciate the approval of the present "commission so that he
may proceed with his plans.
Mr. John Farina, representing Mr. Steyer, read the motion from the
Commission meeting of April 19, 1965, in which the City agreed to
allow Mr. Steyer to connect to the -sanitary sewer system if Mr. Steyer
agreed to meet with certain conditions. Mr. Farina .advised the City
Commission that Mr. Steyer now agrees to meet with these conditions.
A motion was made by Commissioner Brice to instruct the City Attorney
to draw up a formal agreement or contract with Mr. .Steyer. The' motion
was seconded by Commissioner Zenobia, and the roll being called,. the
Commissioners voted as follows:

Acting City Manager Thornhill presented a final bill.-from Tognoli Bros.,
for the construction of the New Fire.Station. • The bill is in the amount
of: $15,735.71. She further; explainhd that there is still a retainage
of: $11,617.89 until the final: inspection. It has been approved- by the .
Building Inspector.

A motion was made by Commissioner .Salvino.to pay the final bill of Tognoli
Bros. , in the amount of $15,735.71:'• The motion was seconded'by Commis
sioner Zenobia, and the roll being;called, the .Commissioners voted as '•

Acting City Manager Thornhill advised the Commission that Mr. Tognoli ,
0 has requested a final inspection on the building.
Commissioner Brice stated that, .inasmuch as we do not have an Engineer
to make the inspection, this final inspection should be made with the
Building Inspector.and some representative of the Commission. He •did
not feel that Mr. Lindeman should make a final inspection.on a pr6jectT
of this size.
Mayor Adams suggested that.the Police & F.ire.Committee make the final
inspection along with Mr. Lindeman.
Acting City Manager Thornhill informed the Commission that Mr: :.Tognoli

told her that the Builder's Risk Insurance that he has been carrying
on the building will no longer be in effect, now that the' final "bi11
is being presented. And if the City wants it insured, then they{."the .
City) will have to insure it:
Acting City Manager Thornhill presented another letter, addressed 'to '
0 the City Commission, regarding the repaving of the street,in front;bf
Stuart's Garage and requesting that the City-take some action; .signed
by Robert Fuer, Attorney of Hollywood.
Commissioner Brice stated that.Mr. Stuart called,him about .this and
he asked of .Attorney Dubow "We were informed'that until we;.accepted '+
his (Mr'. Mears of M B: Construction.Co.)', or his;completed work, that.
all we could do is ask his -co-operation; that we couldntt step in; `
and, if we did, we would violate our contract• - He asked Attorney .

Attorney Dubow replied thats from:what he has seen.of.the;contract,
he is under no obligation to go _in and pave the street the:next,day
after he rips it up. The geneial rule in town has been ,that, the
streets are ripped ups 'and generally they stay ripped up for :about
6 or 7 months: Unfortunately this seems td°present a special problem
for Mr. Stuart; -but '!I don't think as a taxpayer he has any more right
• to require. the City to go•in' there and take steps to prevent any spe-
cial injury to him than any other..person "would." Mr. Dubow.-further
stated that he did not think.the 'City`� Ld: any right.to compel 'him to,,
pave this any f aster�than�he• would any.other road in the City.
Mr. Sinclair, stated: that "the specifications state that within 15
•, days after backfi]ling. of ,the' trench .that temporary'.paving shall be
installed, or permanent paving, at.the discretion of the contractor.
Therefore, he saw no reason for Mr. Stuartts inconvenience, since

Mr. Houston suggested that if the City was not so quick to hand Mr.
Mears his check they might get some action out of him.
Acting City Manager Thornhill stated that both Mr.,,Carney "and herself
® have contacted the Engineer and Mr. Fletchers who is the for for'•?
M B Construction Co. , and they promised that they would sweep: up the,
dirt and get something done there, but so,far they have failed to do'..
anything.
Commissioner Brice suggested that Mrs. Thornhill call: Mr. Mears to
morrow and tell him that she has his check for him whenever he fixes ,
the street-in question.

® Take action on bids for the purchase of two garbage trucks.
Mayor Adams explained-that at the last meeting this was,turned'over
to Mrs. Thornhill, Acting City,Manager,for tabulation and recommen-
dation. „
® . Acting City Manager Thornhill? advised that, after going over the bids .
and talking to several.different dealers and other people, she recom-
mended that the City' reject the bids andgive a little more study to
specifications and advertise at:a later:.date, if that is the wish of
the Commission.
A motion was made by Commissioner Zenobia to reject .the bids at this
time. The motion was seconded by Commissioner Brice. "
Mr. Houston asked what the reason was for rejecting the bids.
Commissioner Brice stated that the bids ;are too close together, and.
he felt that they could do abetter" job of, negotiating. They also ' .
wanted to rebid them with-the truck and then the body separate.
