MINUTES OF REGULAR MEETING, CITY COMMISSION, CITY OF DANIA,
FLORIDA,. HELD JANUARY 17, 1966.
The City Commission of the City of Dania, Florida, met in
Regular Session in the Commission Room at the City Hall.
Present were: MAYOR-COMMISSIONER JAMES G. ADAMS

• The meeting was called to order at 8:00 P.M. by Mayor Adams,
after which Invocation and Pledge; of allegiance to the flag
was held.
Minutes of meetings held December 20, 23, 1965 and
January 3, 1966 to be approved.

A motion was made by Commissioner Brice that the minutes be
approved as read. The motion was' seconded by Commissioner
Zenobia, and the roll being called, the Commissioners voted
as follows:

Planning & Zoning Board.
(2) Public Hearing: 7:45 P.M.: Church of the Living
God, request permit to complete partially existing

No'one was present representing the church or object-
ing to the request.

A motion was made by Mr. DiMauro to table this request
until a representative appears before the Zoning, Board
on behalf of the .church. The motion was seconded by Mr.
Erwin; and carried unanimously.

(3) Public Hearing; 8:00 P.M.: Robert Harpie, request
'variance for Beer & Wine License:
Legal: Lots 9, 10, 19 E 20, Block A, Nelson Park

City Attorney Walden stated that Attorney Leonard Fleet, representing
the applicant, has requested that this be continued over to another
meeting, as he could not be present tonight. Mr. Walden advised that'
it would be proper, if the Commission wished to do so.
A motion was .made by Commissioner Zenobia to continue this over to
the next regular meeting. The motion was seconded by Commissioner
Salvino, and the roll being.called,, the Commissioners voted as follows:

Acting City Manager Thornhill advised the Commission that the bill' .
was recommended for payment by Philpott, Ross & Saarinen.

Commissioners Brice and Salvino brought out the fact that they would
1 be making final payment before they knew if the Plant was going to
operate satisfactorily, if they approved payment.
A motion was made by Commissioner Brice to table this until we get
"either a letter from Philpott assuming the responsibility that this
plant meets the Federal Specifications; or that we get some assurance
of it, before we make this final payment." The motion was seconded
by Commissioner Young.
Commissioner Zenobia asked,of Attorney Walden, "if we don't pay this
man the money that the Engineer says we should, does he have any re-
course according,to the contract for paying him late?"
Attorney Walden replied, "No", not in a temporary delay such as this.

Mr. Houston stated that he understood that there was no auxiliary
power at the new'Sewer plant', and asked if% that was correct.
William Carney, Sewer'Plant Operator, 'replied that it was correct;
but they were investigating purchasing auxiliary power motors.

9 Public Hearing, 8:30 P.M.: Amendment to the schedule
of rates and charges to be charged and collected from
the users of the sanitary sewer system,of the City of
Dania.
• NOTICE OF HEARING: Whereas, as ;the, result of a public
hearing held ,on September 28, 1964; .the City Commission
of the City of Dania, Florida, adopted the following
rates and charges as the initial schedule of rates to
be charged and collected from the users of the' municipal
sanitary sewer system°of City'of Dania, Florida, which
• is now under construction,' to wit:
Single Family-Residence -. $3.50 per month, Plus:
$0.50 per month for each additional bathroom or
water closet. in'excess of 2.
Each unit of Duplex '-' $3.50 per month..
Each Apartment unit- $3.50 per month.
• Each Mobile Home - $3.50 per month.
Hotels, Motels, Boarding and Rooming Houses -
100% of water .bill.
Non-residential - 100% of water bill.
The purpose of the aforesaid amendment, if adopted, is
to eliminate the existing charge of $3.50 per month for.
each mobile home and to provide that the rates and char
ges for trailer parks and for any mobile homes"located
in trailer parks shall simply be 100% of whatever water
bill is submitted to said trailer courts and, mobile homes.
All persons objecting to the aforesaid amendment should
appear at the aforesaid meeting to present their objections.
Harvey Henann, Fiscal Agent of Barcus, Kindred E" Co. , stated that
the original schedule was adopted by the Engineer. He stated that:
he was there mainly to answer questions.

Commissioner Brice asked if the Commission was bound to follow
• through on this schedule when they"(The Commission) come: up with
the final cost of operation.
Mr. Henann replied that there is a restriction in the bond resolu-
tion with respect to rates,that states that they can make changes -
with.respect to equity, .but if they should make.a substantial change,"
• which would make the revenues inadequate„ so that it would hurt the
bond holders, and would' hurt the bonds,. it would be objectionable
and would not be permissible under the original resolution. , But,
any minor modification that would be in terms of equity to the re-
sidents of the community, so long as it did not have a substantial"
change upon the revenues, would" be acceptable.
Commissioner Brice stated that what he was mainly-concerned with was
the 100% of the water bill for commercial. He felt that his was not,
adequate, and may have to be, raised at a later date. -

Acting City Manager Thornhill.advised.that Building Inspector Lindeman
has taken the water accounts in'the sewerldistrict and has•come,;upiwith"
some figures, a copy of which has been furnished to`,each of the Commis
sioners.
A Commissioner Zenobia stated that, the:.three trailer parks that would :be :
involved if they took 100% of the.Water�bill, would amount to about

$923 for the year If.Commissioner Young's proposal, of $3.50 for
the first bath"and $0.501or,,each•additional bath, were accepted,
it would be $1,242 per year. " If. the charged $3.50 per month, the
same as for each house, it would be �71002.96 per: year revenue.
Further, he did not agree with setting up a rate tonight to be
p changed at a later date:
Mr. Houston stated that he felt they should deny this request and
go into the whole thing, "Now I, for one, am not going tm stand up
here and see Motels•go on 100% of' the water bill, any more than I
am trailer parks" .
A motion was made .by Commissioner Young to adopt and pass a. resolu-
tion placing trailer parks in, the same category with Hotels; Motels
and so forth. The motion was seconded by Commissioner Brice, 'and the

A motion was made by Commissioner Young' to refer the bids to the
City Manager for tabulation and recommendation. The motion was .

Mr. Houston suggested that the City,purchase .the packers without
0 . the trade-in, and try to sell the used trucks. He felt the City
would profit more by selling the used trucks themselves.

Acting City Manager Thornhill read a letter from the Dania Cham-
ber of Commerce, regarding the 1965-1966 booklet"The Dania Story",
in which they request that the City Commission take anfadvertisement
in the booklet. Costs as follows:

Acting City Manager Thornhill presented a letter from the Disabled
American Veterans, in which they request permission to sell Forget
me-nots in front of the Dania Bank, on February. l8 B 190 1966.

and to waive any licenses or permits that may be required. The motion
was seconded by Commissioner Zenobia,: and the roll being called, the

® Acting City Manager Thornhill presented a letter from the Fiesta
Tropical, of the. City of Hollywood, requesting an official car in
the Parade, to be held 'on. Friday, April 1, 1966, at 7:30 P.M.
The Commission referred it back to the City Manager for reply.
• Advertise for bids for the installation of a water line on
Taylor Road.
A motion was made by' Commissioner Young to advertise for bids for
installation of a water line on Taylor Road, bids to be received.
at 8:15 P.M. , February 7,,.1966. The motion was seconded by Commis-

Acting City Manager Thornhill read a letter from Ed Freeman, Vice
President 6 General Manager of Port Laudania, regarding- Taylor Road) .
and requesting that the City installra traffic light on the corner
• of Taylor Road and US #1.
The City Commission referred the letter to Chief Of Police, Montie
Smith.
City Attorney Walden questioned whether Taylor Road is in the City
• of Dania, and informed that the City could not lay the water line
unless the property is in the City. He stated that they could_go
ahead and advertise it on the condition that they receive a report
from the City Engineer, Mr. Farina, stating that it is all in the
City.
.• Mr. Clark asked when they are going to'get the streets:repaired.
Acting City Manager .Thornhill .replied that she believed M B Con-
struction Company was going to be paving S.W. 2nd Avenue,, from
Stirling Road to Dixie Highway within the next few days.
• Mr. Gene Pelliccia asked what happend to Civil'Service for' the ,City .
Employees,:
Mayor.Adams replied that it was voted down for further study.. -
Mr. Pe]liccia stated that he has .heard the word -that .the-Commissioners
• rejected the plan, although it was a"hot issue" in'the'campaign pro-
mises that were made. He asked who voted against it:.
Commissioner Zenobia replied that he did not vote against it.
Mayor Adams replied that he voted'. against it for further study.
He further stated that he voted against it as it was presented, but
that did not mean that he was against Civil Service. He stated that
it would be brought up again in the future.
Acting City Manager Thornhill presented a letter from Mr. Jackson,
of Fleet Transport Company, located near the C-10 Canal, North of :.
• the City dump, in which they request the City furnish them with city
water. Mrs. Thornhill informed the Commission that Mr.'•Carney and
Mr. Farina gave Mr. Jackson an approximate figure, on what it would
cost to furnish them with water, and they also talked to him in .terms.
of his annexation to the City, In which case the City would furnish
them with water. The approximate. figurep to furnish water (without
Aw annexation) would be $4,200 to run a line approximately 200 feet. .
Acting City Manager Thornhill further,advised .,the Commission of the
checking that Mr. Carney and Mr. ,Lindeman have been making on the
,
® "unsightly and undesirable" buildings on the West side of town.
She asked if the Commission would like to take some action on it
tonight.
City Attorney Walden advised that the way it has been handled. in
the past, the City would send letters to the property owners asking
them to remove the undesirable buildings, and with a little co-operation
and pressure, the property owners have generally co-operated. The
alternative is to get involved in a condemnation proceeding, which
could involve some money. He suggested that the• Commission authorize
the City,Manager and himself to write a letter demanding that they
remove the unsafe structure.
Commissioner Brice stated that he would like to go on record in asking
the City Attorney to proceed with the letter "and see where we get". '
but he would not be, willing to start into dondemnation proceedingst
because "we get into legal technicalities there".
Acting City Manager Thornhill advised the Commission that she received
a telephone call from Luther Sparkman,.Right-of-way Agent for the City
of Dania; and he informed hernthat he has gone as far as he can in
acquiring easements for the sanitary sewer program, unless he can get
a little more information from the City Commission on what he .is to
do. He suggested an informal meeting with the Commission and advise
• them of his progress to date.
Mrs. Thornhill then presented a plan for the park across the street, '
adjacent to the fire station, for beautification.
The Commission referred the matter to the Parks & Recreation Committee. '
• Commissioner Zenobia stated that about 9 months ago, he brought up
the fact that the pool at West Side Park ,was empty of water and full
of trash, and the last time he looked at it, it was still the same.
He asked what the status of the pool is.
William Carney, assistant to the Acting City Manager, stated that the
pool was drained on the order of Tony Salvino, for inspection to have .,
some repairs done to it,..but it was never befilled. Mr. Carney stated '
that he has had it cleaned and refilled, and it will be worked three
times a week.
• Commissioner Zenobia further stated that he has had a few telephone
calls about this "new dump we have out here in town" . People want
to know what they are going to do about getting rid of the cars.
He stated that, the man is now beginning to put the�cars outside of
the fence.
Chief of Police, Smith, stated that he was there three times this
week and ordered the man not to bring any cars in there "until
he got rid of what he had in there" . Chief Smith stated that the '
man is being watched .daily'.
Bob Houston asked if the man has a license.
The Commission answered that he has.
Mr. Houston asked who issued that license.
Acting City Manager Thornhill stated that he has a license for selling.
• parts. The license was issued about four weeks ago by Mr. Salvino. ., .
Chief Smith stated that Mr. Salvino was trying to get the city cleaned
up. He knew this man who had a.wrecker, and he asked the man to haul,
these cars there, burn them and get rid of them. But instead of that,.
it got out of hand.
• A motion was made by Commissioner Brice to authorize the Chief of
Police to tell Mr. Ganey to sell'no more parts until he lives up to
his agreement with Mr. Salvino. The motion`was seconded by Commis-.

Chief Smith asked the City Attorney if'that motion gives ,him the
right to pick up. Mr. Ganey's license if he does not.co-operate.
City Attorney Walden stated that the Chief did have that right.
Commissioner Zenobia stated that about last April, the City allowed
some lobster boats to dock at the Dania Docks On an emergency basis, ,
when they had no place else to go. He stated that they are getting
very little rent from them, and now that •the park'is cleaned up , ..
(30 acre park) "we ought to get.,them out of there" .
A motion was made by Commissioner Zenobia to terminate-the lease
}, (15 day notice lease) and have them move "out. The motion was .seconded
by Commissioner Young.
Commissioner Brice asked if they felt that the park is sufficiently
cleaned up now that such action is justifiable -He stated that he
understood that the only problem with them is that'they have not been
collecting the rent from them for dockage.
Commissioner Zenobia: Well that is one,big problem,. but another is
all those crates they.havee around
u Commissioner Brice: We also have an awful lot of old refrigerators
and other things out there, and I don't,.,think that the lobster crates
are any more 'of an eyesore than. some of: the other things we-have out.
there. But I think that we should be gettingirevenue,;,and I don't
believe that we are,checking close enough to.,get. the,revenue _from each', .
of the boats.
