FLORIDA, HELD DECEMBER 23, .1965.
The City Commission of the City of Dania, Florida, met in
Special Session in the Commission Room at the City Hall.
Present were: MAYOR-COMMISSIONER JAMES G. ADAMS
COMMISSIONERS GUS S. BRICE (ABSENT)
FRANK SALVINO
S. ELLIS YOUNG

?: The meeting was called to order at 11:45 A.M. by Mayor Adams.

City Manager Salvino stated that the meeting was called for the
j: purpose of taking action on Change Orders.
City Manager Salvino presented Change Order #8, in the amount of
r' $3,553.75; which takes care of three items: Mr. Griffey, 2nd Ave.;
(: behind the School at S.E. 2nd Ave.; and S.E. loth Terrace, Mr. Jus-
tice.
A motion was made by Commissioner Young to approve Change Order #8
for the three items mentioned by the City Manager, on the recommen-
dation of the City Manager. The motion was seconded by Commissioner
:< Zenobia. -
Commissioner Zenobia stated that there was a change order #5, which
would have taken care of the trailer park. He asked if there were
going to make another change order to cost more money.
City Manager Salvino stated that he understood that change order #5
starts from S.E. 2nd Avenue, providing they have the 7' foot addi-
tional right-of-way, in an alley. This one would go,down to S.E.
10th Terrace. There is a sewer on 8th Street, but it dqes not
handle the Trailer Park. This, one,will handle the Trailer Park.
The Change Order'#5 would have been a mistake and would not have
serviced the trailer park if it had been carried. through:. .

City Manager Salvino brought up awarding the, bid on the work at the
Water Plant. He stated that 'he understood that insprevious years
another company had done the job for a lot less money than was bid
on, but he understood that .this'�year it iiivolved: a lot more work.
This involves painting inside and outside.of the Water Tank. Mr. '
Salvino asked for the recommendation of the City Attorney, since
tt the man did not presentea sealed bid., but that was only a tech:hi-
#' cality. He recommended that they award the.bid :tonight before the
tourist season gets under way. Low:bid. is $3,024.00.`
City Attorney Walden stated that it was alright legally; since the
City says "lowest bid" not "sealed bid!'....`
A motion was made by Commissioner Zenobia to award. the bid to the
X' lowest bidder. The motion was seconded by Commissioner Salvino,
Commissioner Young asked if the bid has the recommendation of the
.x- Engineer.

City Attorney Walden stated that in 1956) Mr. Leto, .the owner
of Leto's Court, applied for a building permit to construct the
North motel unit on his motel property. At that time the new
building had not complied with the set-back requirements of the
City. Further, at that time, Mr. Leto owned the adjacent. parcel
to the North of the motel. So he got his permit in 1956 by enter-
ing into an agreement with the City where he agreed to treet both
the motel parcel and the parcel to the Northr,as the parcel; that
is, he would never sell a part of it without selling all. And that
cured the set-back problem. , Then, at .a meeting in September, 1962,
Mr. Houston, the Lawyer, appeared before the Commission,. without
being on the agenda and without advance correspondence with the City,
and asked that'the City release Mr. Leto from that understanding;
because at the time he wanted to sell the motel and this agreement
z, was causing him a problem in the sale. The City, did agree to go
along with that and authorized that a resolution' be written up to',
release Mr. Leto from his covenant. The agreement was that whoever
owned the property would not make any additions to the motel, and
that all future construction would comply with the set-back require-
ments. Because there was nothing on the agenda about that, Houston .
agreed at this meeting that he would check out the legal description
getting the surveys and prepare- the necessary documents including
the necessary resolution. Mr. Houston did not do that, and about
three months ago Mr. Paoli, a Lawyer in Hollywood, contacted me on
behalf of Leto asking that we follow through on the matter. :Paoli
had recently sent me the necessary release, declaration and other
documents that would accomplishwhat the Commission agreed to do.
I have checked out.all papers .submitted by,Paoli, they are in order.
I think no further resolution is required; but perhaps a motion
authorizing the present.City Manager to sign these,documents.
Commissioner Young asked the City Attorney if everything was in order.

A motion was made by Commissioner Young to authorize the proper City
q4t Officials to execute the necessary. papers on this matter. The motion
was seconded by Commissioner. Zenobia, and the roll being called, the
Commissioners voted as follows:

There being no further business, the meeting adjourned.
