The City Commission of.the City'of Dania, Florida, met in Regular Session in the Commission Room at the City Hall. • Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S. (Second Reading) , { City Attorney Walden advised that the Chief of Police has approved the application, subject to the approval of the State Beverage Dept. A motion was made by Commissioner Salvino. to approve the transfer on Second Reading: '" The motion was seconded by Commissioner Zenobia. Commissioner Young asked City Attorney Walden if the application will go to the State Beverage Commission after they receive approval `~> from the City, or can:they go to the Beverage Commission first? City Attorney Walden replied that they should go to the Beverage . 4' Commission first; then they will pick up the City License when they get approval from the Beverage Commission; then they go to the Tax Collector and,� •, , get -the State license transferred. The Chiefrs appro- val,- subject to the approval .of the State Beverage Commission, is a proper one. ' A motion was made by Commissioner Young to table the request for KI,. transfer until they get approval from the Beverage Department. Brice Yes Salvino Yes Young Yes Zenobia :.Yes Adams Yes r 0 w� iS -4- '=t,t t£ i 777777 Discussion on making a survey of the area in the City being sewered to determine the number. of accounts to be servided in order to arrive at a fair and equitable service charge.,; Commissioner Young stated that he felt it was a little premature at the present time,. since they don't have a report from the Engineer;' also, they don't even have the report from the Engineer as to assessing by front foot basis or square foot basis. Mayor Adams replied that he requested this discussion because he did not think they ought to wait until the sewers are completed to make some decisions. Commissioner Brice stated that this discussion was not pertaining i to assessments; they were merely trying to, gdt some information on the monthly charges. Commissioner Young suggested that the Bond Agent should be present. on such a discussion. " Commissioner Zenobia stated he also felt that the Bonding Agent and the Engineer be present. He further stated that he first would like to see what kind of report the .Engineer comes up with. y� A motion was made by Commissioner Young to table the discussion until such a time as they receive a report from the,Engineer; and at that time, that all interested parties. be appraised of the meet- ing (The Engineer and the Fiscal Agent) before any action is taken on it. The motion was seconded by Commissioner .Zenobia. Mr. Houston stated that he also felt that the people of the town, should be considered, and they should be informed so that there can be a fair and equitable rate set on the monthly charges. He suggested that they find out how many actual bathrooms there are in the. City; and let the public be so informed. Commissioner Brice stated that they were not taking any action on, .. this tonight, other than,asking for a survey, of how many there ae. "You certainly can't take any action on it until we know." The motion was seconded by Commissioner Salvino. 1 Commissioner Brice: Let me make sure I understand your motion. It is to come back to us for approval? ® Commissioner Young: I made that motion to refer this to the Cityt Manager, which would give him the right to call in anyone else he wanted to (including the water department) for tabulation and re- commendation. City Manager Salvino: . That is recommendation to the City Commission. A motion was made by,Commissioner Brice that the bill be paid. A motion was made by Commissioner Young to adopt and pass a reso- lution accepting the easements as presented. Yes' Zenobia Yes Adams Yes City manager Salvino brought up the question of Christmas Bonuses for City Employees. City Clerk Thornhill explained that it has been customary that, . after one year of employment an 'employee gets $25.00, for 6. month employment. . .$10.00, for 9 months`employment. . .$15.00, and 3 months' employment. . .$5.00. i; -6 ® A motion was made by Commissioner Zenobia to issue Christmas Bonuses according to custom. The motion was seconded by Commissioner Young, and. the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes ® Young Yes Zenobia Yes Salvino Yes City Manager Salvino stated that the Auditor's report would be ready • definitely by the end of the week. He also reported that he contacted Mr. Erickson of the State Road Department, also the County Engineer, regarding the bridge .going over to the public beach, and the Engineer . admitted that it was the responsibility.of. the County to repave the parking lot at the beach under, the bridge. It will be taken up with the County Commission tomorrow. He further reported that he spoke to Mr. George Lohmeyer' of the County Health Department regarding • the sewering of the City, of Dania, and he gave the+City an extention of time, until June or duly, to submit a plan for sewering the entire City of Dania. City Manager Salvino presented Change Order #8s in the Amount of $3,553.75, from Philpott Ross E Saarinen, which replaces Change Order #5. City Manager Salvino stated that he had not had a chance to discuss this with,either Mr. Philpott or Mr. Berry, so if the Commission wished they could :bring it ,up at the next meeting. . Commissioner Zenobia, suggested that` City Manager Salvino hold it until next meeting. • City Manager Salvino stated that he has an .estimate' on sewering Gulf stream Road as follows: The. first 600 feet`- $8,400 additional;. another 1000 feet .to the East QDePadro's Yacht Basin) ,= $61000; and . $3,000 more to go to the single house that sets on the Canal West • of the Yacht Basin. , City Manager Salvino stated that-the most impor- tant part was the first 600 feet ($8,400) , and that he talked to Mr. DePadro_the other day, and he stated that he would rather not hook up. Mr. DuBow, representing Mr. Arcaro, stated that his client was build-' ing apartment buildings in the area and would like to have the area ' sewered. City Manager Salvino stated that this is, just an estimate by Mr. Philpott; and that Mr. Philpott has not as yet drawn up any change orders on.it; but if the Commission wished to go ahead with it, then they should authorize Mr. Philpott to draw up the change order. • A motion was made by Commissioner ,Brice to authorize Mr. Philpott to draw up a Change Order to service. Mr• Arcaro's property. The City Commission referred Mr. Robinson to the City Manager and. . the City Engineer. City Manager Salvino stated that he needed clarification on garbage. pick-up from the City Commission. He requested that they express their opinion on what they expect,him to do. y ' f • Commissioner Brice requested City Manager Salvino to tell them what he has worked out with the businessmen of the City, "and then we can go from there". City Manager Salvino replied that he had a meeting with some of the businessmen; some of them had agreed to bundle 'up the boxes • and trash; some of them agreed to hire independent dealers and , take care of their own needs. He further stated that he received a letter from the Health Department stating that they were closing the dump as of January lst, and the City would have to use the incinerator. • City Manager Salvino further stated; Large Restaurants were all agreeable. They realized that they have been getting by on the small amount of taxes levied. I have been trying to leave the City in good shape, at least as good as I found it, and it is just impossible. I want you to clarify what I should do; I have tried to do some good, but I can't continue like I am. I • asked you to relieve me. as of the First of February.at the latest; but under the present conditions, I can't last that long. I want to get out by the First of January. But in the meantime, I want to do the best I can.for Dania. I am not leaving town. I have been in this vicinity for 49 years, and I intend to spend the rest of my life here. And I will do as much for Dania as I possibly can, but • I just can't stand the pressure, and I can't stand being pulled from all angles, I was trying to live up to your Charter, and I was trying to live up to your ordinances; but it seems that I can't do it without being pressured. Some of the. people has contracted for garbage pick-up, but they cancelled the contract and figured with a little pressure they would;get free 'service, .and-I can't blame • them a bit because some of ,our drivers maiie'a mistake with their neighbors, and they see that and they figure they are entitled to free service. But I could have corrected that easily without inter- ference. Commissioner Zenobia: You said you.are being pressured.. .by who? City Manager Salvino: By the City Commissioners. Commissioner .Zenobia: All.of the City Commissioners? City Manager Salvino: No sir. :, I went to 'Lauderdale today to take • care of City business; I came back and Mr. Carney said I got a call from the Mayor .today and he said = have got. to, go pickup the garbage at the trailer park. Well, I came to find out' that one -of ',our drivers, after being told several times'' tdisregarded my orders arid went across the street and picked up. theirs. So I don't blame this other one for calling in. We might as well pick them ,all up. If, you are going to •` pick one up, you might as .well pick them all up:; 'I don't hear any- thing except knocks, .and that is the reason I would like to have all five men publicly tell me what they want me to do. Mayor Adams: Mr. City Manager, I had a 'call..from the Hitching Post Trailer,Park. They wanted to know about their garbage; and I said "Didn't .you make arrangements with the City Manager about your gar- bage? And he said yes; but it didn't work out. He said they are picking up garbage from the trailer park across the street, why should they pick that up and not pick mine up? I said, when did they pick that up, and he said on Monday." So I called the City Hall to talk to you, and you werentt in, and Carney answered the ® phone, this was the second call, and I told him to ask you when you come in would it be possible to .pick up the garbage from down there because the man told me that hb .didn't have any arrangements for anybody to pick it up. So I only did. what I thought was right, and I don't regret anything that.I .did in respect; because I .think that until the citizens absolutely have a contract;rwe ought not'to leave them with this garbage. , What are they going to do with it? They can't take it out to the dump? -g- ,`, W.., ® City Manager Salvino stated that he talked to Mr. Justice and Mrs. Metcalf the other day,"and they both agreed to get private contractors statting today, if I-would pick up Thursday at one and Friday at the other one, which I did. I told our men to be sure 'and pick those two up that day. I can't blame Mr. Justice; because, like I said, our truck driver made a mistake and dis- regarded orders and went across the street and picked up theirs. Mr. Justice had a perfect right to get mad about somebody else getting the service and him not getting service. But I think this ought to be clarified today.. And. I don't think Mr. Justice is entitled to any more or any less service than anybody else. But I do say this. ..I came back from Lauderdale at noon, and I • understand that the trucks have already been there. And you gave orders to Mr. Carney to pick the garbage up, which was strictly against all regulations and rules that you didn't think the City Manager. .. . ." Mayor Adams: Mr. City Manager, Mr...Carney is sitting out there, • I did not give orders to Mr. Carney. City Manager Salvino: We11,_ I came back about 1:00, and he said that you told him to get a truck over there to pick the garbage up, and I checked, and it was already picked up. Mayor Adams: I asked him to tell you about the call we had, and I asked, to ask you could we pick it up. Is that right, Mr. Carney? I didn't give you any orders, I have no authority to give you any orders. • City Manager Salvino: That's altight, I just want to know what the City Commission feels like doing about it. .Today has already gone by, and I just want to know what you want to do about tomorrow. Mayor Adams: I just want to get it clear with these people sitting out here that I did not give any orders, because that is not my authority to give.any.orders. The only thing I try to do is work as a Commissioner should work, and when. I 'get these complaints. . . when Mr. Justice called,me I asked him if he had been in touch with the City Manager today; and he said I have tried and I haven't been able to get in touch with him. City Manager Salvino: I had to be in Fort Lauderdale this morning • to take care;of City Business; I had to go see Mr. Philpott; and I had to go to the Court House to see Mr. Alameda, and I just couldn't be here. But I did come back after,lunch. But that is beside the point anyhow, I just want to know what they are going to do from now on. I realize what caused your trouble was our driver disregarding my orders. Mr. Justice stated that he did try to get an independant contractor to pick up his garbage, but he was unsuccessful. . "As far as I am concerned, I don't mind paying a 'little something to haul my garbage; but I don't want to be discriminated against." He then asked the City Attorney to read the ordinance to the audience. City Attorney Walden stated that he would allow Mr. Justice to read it, but he himself would not read.it. "I will be glad to give you a copy of it though". ® Mr. Justice stated that when it comes to sewers, trailer parks are not classified as business; but when it comes to garbage service, they are a business. He asked to have it clarified. He stated that he would rather pay the City than to ,pay a private collector. But he didn't know if he was a business or not. • ' But if the City wanted to collect a reasonable fee for picking up garbage; it was alright with him. Commissioner Zenobia asked City, Manager Salvino if he has come .up r: with any reasonable fees. 3 4- •s ' n 1 City Manager Salvino stated that there has not been a survey made yet to find .out how much to collect each business. City Attorney Walden stated that this ordinance was passed in 1937s at which time there was no real problem with the garbage because they were permitted to use the City dump. But, if the City cannot afford to furnish free garbage service to everyone in town, they ought to rewrite the ordinance and adopt some schedule of charges for commercial users. Commissioner Zenobia stated that he agreed, but he did not think • they ought to cut them off at this particular time. A motion was made by Commissioner Brice to instruct the City Attorney to draw up a new Ordinance pertaining to garbage along these lines: 2 cans-twice a week for all private residences; businesses, Hotels, Motels and Apartment Houses, 2 cans pach::pick-up twice a week, except the months of December through April. The motion was seconded by Commissioner Young. Commissioner Young: I feel that we have a number of businesses in our city, and during the tourist season period each year, for possibly three months, they have an exceptional burden insofar as garbage is concerned. Then in the summer, the burden is in trash (tree clippings and such); so there does exist a burden. However, the burden has been here ,for a number of years. It isn't anything that has happened recently. I will also say that City Manager Salvino is within his rights to enforce an ordinance that is on the books; and we have two choices. . ..we either acquiesce to him per- forming his duty, which is all he is c)oing when he enforces the ordinance; or we have the prerogative of 'changing or amending or drafting a new ordinance. I do feel that, as far as the business establishments are concerned, a report should be made over the period of roughly a month, of how much or what.is 'picked up at what place, and then the cost of incineration Could be broken down to the actual burden to the City. But, he'felt that we, should do all we can to accomodate the businesses, ;especially now with the holidays coming up. Mr. Houston asked how much the City paid for repairing the garbage trucks last month. He stated that 'the City is in a state of emer- gency, and that if the City continues to, pickup all this garbage, "there is going to be some morning that� you are not going to be able to do it; because you have three of. the worst trucks that I have seen in any territory or any incorporated municipality around the County". He suggested that the City buy 2 20-yard trucks and keep the best one as an emergency truck, . 'nd haul the garbage to the incinerator. He stated that the money is'.in_ the•budget. it can ,be' found in the budget. ' City Manager Salvino stated ,that' he asked for authorization to advertiseg for 3 new trucks a few months ago, and his request was turned down. Commissioner Brice offeredjan amendment to,the motion as follows: That the City Attorney follows along those lines, there may be some- thing that the Commission wishes,'to add to-it when he gets to the language of it, so as not to just bear .'it `right down to that. The ordinance calls for 10 gallons and not more than 40 gallons. Commis Brice stated that, what we are actually going to do is to let the p City Attorney advise us as to the• best!way.to draw up .this ordinance. "All this is is to get it started, (and then .there will be a public hearing on it for what the ordinance, agtually is that. we .are drawing, up. We have to get something started, but there may be changes at that time" . F.. Hill stated, that the .City gave some man the right to haul - junk cars, to a lot west,of the Canal, and that this man is hauling cars not only:from Dania, but from West Hollywood.and other places West. He stated that this man was running a junk yard with no city license. City Manager Salvino replied that he was not hauling from any place except Dania, that he was given permission to clean up the City of Dania. A motion was made by Commissioner Zenobia to authorize the City Attorney to, draw up specifications for 2 20-yard garbage trucks, packer loaders. Commissioner Brice stated that in courtesy to Mr: Tony Salvino, the Commission ought to act on his letter of resignation. City Manager Salvino;stated°that, he would attend the. next.meeting if the. Commission Ashed, but January 3rd would definitely be his last meeting. A motion was made by Commissioner Brice to accept Mr.: SalvinoTs resignation, effective as of ,January 4', 1966, with regrets. City Manager Salvino stated that. they'have worked all nightlong, but on the one he is referring to, ' they,did go home at ' 5:00; but as a rule, they stay until it is'repaired. Commissioner Zenobia stated that he',knew they`have worked all night, but he did not think it was right for the' ciew to walk off if there is someone without water; they should stay and ,fix it, and it. should be a matter of policy so that they. know they are supposed to stay., There should be some policy set,on it " -ll- }, kZt. 7 , ,. 4x -P, ® Mr. Bob Houston asked why does the City have to repair the water breaks when the construction crew breaks a line? Commissioner Zenobia stated that the City charges them. Mr. Bob Houston suggested that they call a plumber to fix it. • City Manager Salvino stated that if we order a plumber there, if he doesn't get paid, he will come to the City for payment. City Attorney Walden stated that the City could deduct the cost from Mr. Mear's next requisition for payment. • Commissioner Zenobia stated that they asked Mr. Mears not to work Friday so that there would not be any water breaks. City Manager Salvino replied that he sent Mr. Mears a letter stating that there would be =-one would be working on Christmas Eve day, • and if they did any digging "they are on their own" . He suggested that if they are going to work they should have their own plumber standing by. Commissioner Young stated that he would like to take care of a formality that has been skipped over for the past couple of months. • A motion was made by Commissioner Young to adopt and pass a resolution complimenting former Commissioner Vera Hill for her dedicated service to the City, state the length of service, and send her a copy .of the resolution. He stated that the surfers come much too close to the pier, and that he has seen them build fires under the pier. He stated that he has seen' their Police officers take abuse from the surfers; and asked if it wouldn't be advisable to consider moving the surfing area to the South section of the Beach; for the sake of the bathers, the fishermen, "and the surfers themselves. Police Chief Smith stated that he has" given its some study and has discussed it with the Pier Manager and some of the surfers, and ® that there have been quite a few arrest's under the new ordinance; but he thought that a life line should be put out a hundred feet or so North of the pier, and perhaps the surfers would see the line and adhere to it more than the• imaginary line that they are supposed to go by. He further stated that if they go to the South Beach area', the children may run into trouble with the Cityof Hollywood. Also, there is no parking facilities there for"the surfers. Mr. Bob Grammer stated that 'the City could: be into more law suits' if they erect the rope that Chief`Smith suggested; "if they happen to run into that rope, they could hang themselves; or they could catch their ankle on the rope and break a'leg, or they could hit the surf board." 'He;suggested they go 75 feet South of the Pier, and give them•a couple hundred feet south of that. Commissioner Brice suggested that the Beach & Recreation Committee look into it and come back with their recommendation. Mayor Adams recommended that, the' Chairman of the Beach & Recreation Committee meet with hie committee and bring his recommendation to the next meeting. Mayor Adams: I would like to take this opportunity to wish the Commission and all you folks' a veryMerry' Christmap and• a Happy New Year. Mr. Bill Davis, from the audience, stated Ehat he was in the Recrea- tion in this town for several years,, and he knew'the problems that are down there. He' stated�"I .heard the .other,day that the only man in the,City that did not get;a raiae was. the•Recreation Director. How come? I think he should be,given a raise"because he has a very responsible .job down there, and he has *done a pretty good, job." City Manager Salvino 'stated,`that he•,did not get. a:raise.'
