MINUTES OF REGULAR MEETING, CITY COMMISSION, CITY: OF DANIA, FLORIDA, HELD DECEMBER 6, 1965. The City Commission of the City of Dania met in Regular Session in the Commission Room at the City Hall." Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S.BRICE FRANK SALVINO S. ELLIS YOUNG CARL ZENOBIA CITY ATTORNEY CLARKE WALDEN CITY MANAGER TONY SALVINO CHIEF OF POLICE MONTIE,SMITH BUILDING INSPECTOR CHARLES LINDEMAN - CITY CLERK MARY THORNHILL The meeting was called to order at 8:00 P.M. by Mayor Adams, r after which Invocation and:Pledge of Allegiance was held. 1. Minutes of meetings, held November 33 ;9; 12, 15 and 26, 1965, to -be approved,. A motion was made by Commissioner Zenobia to approve the minutes as read. (First Reading) ,f A motion was made by Commissioner Young that, on the recommendation of the City Attorney, the ,application for transfer be passed on ' first reading. Application for 2'COP License, Robert John Harpies 238, South Federal Highway. (First Reading) City Attorney Walden stated that Attorney„Leonard Fleet, .represent ing the applicant, was present. This location is' directly across the street from Dania Elementary School; and 4'or 5-years.ago' a beer and wine license was granted for that location through a Variance permit. The license was allowed :to lapse) 'so a new,applicant was : trying to get a license. Mr. Fleet explained that, although the location is;-in the vicinity- of the school, the place of business will only be open after 4:00 P.M. , therefore, should not draw any of the school children. Chief Smith stated that he did not feel that the issuance of the license would jeopardize the school in any way. A motion was made by Commissioner Zenobia to refer this to the Zoning Board and ask them to waive their public hearing' and make a recommendation to the City Commission'.: The motion was" seconded by Commissioner Young. �+ s� r ® Commissioner Young pointed out that, if a variance is issued, he did not believe they could restrict the owner to certain hours. City Clerk Thornhill informed the Commission that the application has been approved by the Chief of Police. Commissioner Young: In view cf''ifie, fact that there, has been recent informal discussion among.the Commissioners of the possibility of revamping the entire setup on taxicabs. . . . . A motion was made by ,Commissioner Young that this be .temporarily tabled. The motion •was seconded by Commissioner Salvino-. Commissioner Zenobia ;stated t1lat he believed this man was applying at this particular time,in order to operate along with the opening of the Jai-Alai. City Attorney Walden suggested that they award the man .a temporary permit mithvthe understanding that it would be a non-exclusive per- mit, also that.ittwould not violate any ordinance that,would be adopted: Commissioner Young withdrew his motion tottable; Commissioner Sal- vino withdrew his second to the•;motion. A motion was made by Commissioner Young to issue the Hollywood Yellow Cab Corp. , Inc. , a temporary permit, non-exclusive, and that we have a notarized statement on file that he.will honor any ordinance that this Commission may come up with, pertaining to the ' taxicab business .or-;license. Chief Smith asked, in the .event that it should take a long time to come up with this ordinance, could any other taxicab company that the Police Department should bring. in, could they apply,and, get a permit along this, same line. A motion was made by Commissioner Brice' to go on record to the . effect that-any legitimate taxicab company may apply.;.for..a temporary permit with the same restrictions as the Yellow, Cab Corporation per_. • mit just granted. Jacob Taylor, application for Auction License, 102 East Beach Boulevard. City Attorney Walden informed the Commission that, under the ordinance, it has been the practice to issue to Auctioneers a license on a day-today basis, and charge $25 for the. first day and $10 for each additional day, on the condition that the oper-. ator comply withr-.all the instructions. of the,Chief, of Police in • conducting the auction. Chief Smith stated that he checked out the applicant and found his record clean. Chief Smith requested that, if the license is issued, to have it stipulated that,the applicant would not hold any auctions on Sundays. • A motion was made by Commissioner Salvino to issue .the license for auctions, excluding Sunday, with the stipulation that .the applicant confer with the Chief of Police on each additional day that he wishes to hold an auction, and comply with any restrics tions set by the Chief of Police. All Mr. Marrone .was requesting tonight was a tentative approval so that'he 'can build the 'streets according to specifications and dig.,a canal ; Then when;;the,job is complete, '. before he is issued any building permits, :he will come in with his plat and have it recorded and approved for the third.reading;; This`- has been approved on.'two readings; 'but this will not.-be the third ;. reading, only a tentativiidpproval. ' ` Commissioner Brice stated that he felt that there were certain restrictions on this, the mari has not put up -any ,bonds, theyrhave , no assurance that he will.complete it so he "is 'not willing. to even give him a tentative, approval until he, meets the requirements _. { that have been set up. City Manager Salvino stated that he received bills from M.B. Con- struction Company and Mr. Philpott after the agenda was made out. Commissioner Salvino asked what about .Station '"M". Commissioner' k Zenobia replied that he thought that was.`settled at the..last meet- ing. Commissioner Salvino stated that he.thought it;was. in the sidewalk right-of-way, but it is in the street right-of-way:' Mr. Farina, of Brmome & Farina, stated that he only lodked at it; he did not put an instrument on it, so he could not say exactly where it is. He stated "If ,the Commission desires, I will go out there with an instrument and locate it exactly-" City Manager Salvino suggested that Mr. Farina, go out there with' the instrument and the City Commission also. Commissioner Brice suggested that they get out the prints.and the change order that Mr. Philpott said covered Station I'M" and have the Commission go over them. Commissioner Brice stated that he would like to see this held up until'the`.next meeting. The roll being called, the Commissioners .voted as follows: - ` t ¢". The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: • Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes • 9• Don Ray, Re: Garbage & trash collection. Mr. Ray spoke on behalf of many of the businessmen in the City of Dania; in reference to Ordinance 1631, regarding removal of trash and garbage. He stated that a notice that he and other businessmen • in the City received said that they would be allowed 40 gallons of garbage pick-up per week. He asked if this did not mean 40 gallons for each trash collection, which they receive twice a week, or BO gallons per week. City Manager Salvino stated that Mr. Ray only has 2 small cans, • therefore, he is not "our problem" ; ''Our problem is these hotels, restaurants and businesses that have;'25,.,30 or 40 cans of garbage." He stated that the City either has to change the ordinance, or add . two or three more mills next year, ,if_they are going to continue like they have been. • Mr. Ray stated that he felt that this ordinance is discriininating against the small businessman; because there is nothing in the ordinance that says that he cannot"carry his,trash and garbage from his plaoe .of business to,his home and have `it ,picked,up. He stated that he wished the City Commission would consider a more feasible ordinance for the businessmen of Dania. He�felt that large businesses should be charged for extra pick up 'over and above normal trash col- lection; but that normal trash collection for businesses should be larger than for homeowners. Commissioner Brice stated that .the Commission .has to deal on the basis of whether a business is small or large to be fair and equit- .0 1 able for everybody. 'We can't solve all of the problems either; and . we are always willing to .listen to the suggestions of the public, and' then we will try to work it out to the best solution for everybody. one businessman pointed out that he is only- a resident of the City for six months of the year, but`pays'a full. year ,tax to the City. Mr. MacMillan stated that he is paying taxes on 6 lots and con- solidating the garbage into one load. He further stated that there is no more businesses in the City now than there were 5 years. ago, and the garbage has been picked up all these years. 0 Commissioner Zenobia. stated that there are more businesses now and also more residents now than ,there were 5 years ago. He added that, 5 years ago the salaries were less and everything else was less. ® Mr. MacMillan asked, since he owns 6 lots, how much garbage will they pick up for him. Commissioner Brice suggested that each businessman in the City of Dania take the time to write them their suggestion as to how they can arrive at a solution to this problem, then they can come up • with the best solution possible, have a public hearing on it, and let them know. Paul Pisculli suggested that garbage should be picked up according to the.amount of taxes and the amount of square feet, also the amount of people to serve. • City Manager Salvino suggested that *a committee of perhaps five businessmen of the City get together with the Commission to work out the problems. Mr. McAlister, Poincianna Hotel, stated that he can't understand • : why, since about the first of August, all of a sudden the pick-up has bogged down. He stated that he` felt that one of the problems was that the men don't have proper supervision. Boisey Waiters stated that "you cannot entice men to work for the City of Dania below minimum wages and expect to get top-notch per- formance. We must do something with the budget." He suggested that they appoint a committee to study the situation and bring their recommendations back to the Commission. City Manager Salvino stated that they will have a meeting,with the businessmen of the City, to be open to the public. 10. Correspondence: City Clerk Thornhill read a letter from Mrs. Martin C. Frost expressing the appreciation of the Frost family for the resolu- tion of sympathy adopted by the Commissioners of the City of Dania. • City Clerk Thornhill read a letter from Mrs. William Thompson, 36 B.W. 16th Street, Dania, regarding the property on the N.W. corner of South Federal Highway and S.W. 16th'Street. 'She requested that some- thing be done to clean up the property. • City Clerk Thornhill read a letter from Mr. Frank Eby, regarding S.W. 4th Street, between Federal Highway and Second Avenue. He stated that about a year ago the residents on this street paid a special assessment to pave this street, but after the sewer line was installed, two strips of asphalt paving were placed in the middle of the street and as .a result, "the street now looks worse than it ever did-" He requested that more,Asphalt be,laid to make the street of uniform surface: Mayor Adams asked about the property on 16th Street. Mr. Lindeman explained that there"was a permit issued for a newgasrstation, but work has been discontinued on it. There are four old buildings i there to be removed. Mayor Adams suggested:that the building inspec- tor and the Fire Chief go 'down there. and 'check' it. City Manager Salvino asked if the City hasthe authority to cancel the building permit until the property is cleaned, up. ® City Attorney Walden replied that, although the authority may be somewhat weak, if they went ahead and, cancelled it, they have got" the burden then to re-establish:_it.":He suggested that the City Commission.make a motion to authorize the City Manager to advise Standard Oil Company that the permit will be revoked within 10 days unless the property is cleaned ..off. 8 , A motion was made by Commissioner Zenobia to authorize the City Man ager to advise Standard Oil Company-that the permit will be revoked. ® within 10 days unless the property is cleaned off. The balance in that fund is $14,757.00. She explained that they have to close that account and notify the Housing and Home Finance Agency that the job has been completed and all pay- ments have been made to all contractors. • City Attorney Walden read the resolution entitled: A RESOLUTION transferring $14,757.58 from the Water Facilities Account to City of Dania Water Revenue Fund. • A motion was made by Commissioner Young to adopt and.pass the resolution as presented. The motion was seconded by Commissioner Salvino, and the roll being called„the Commissioners voted ,as follows: _ Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes 11. City Manager's Report:. City Manager Salvino reported that he checked into the 1928 Side- Walk assessments. He stated that they had by resolution cancelled Mr. Peterts assessment because he had donated right-of-way on Sher- idan Street; and he found out since then that Mr. Hitt has also do- nated right-of-way on'Sheridan Street, and he felt that Mr. Hitt should also be relieved of his assessment, Lots 16, 17 & 18, Block 3. Also he recommended that Lots 1, 2 & 3, Block 131 belonging to the Dania Baptist Church also be cancelled by resolution. A motion was made by Commissioner Young to adopt and pass a reso- lution cancelling the sidewalk assessments on Lots 16, 17 & 18, Block 3, belonging to Mr. Hitt; and also Lots 1, 2 & 3, .Block 13, belonging to the Dania Baptist Church Holding Company. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as follows: Brice c Yes Salvino Yes Young, Yes Zenobia Yes Adams Yes City Manager Salvino recommended that the City accept the bid of • Miami Fire Equipment Company for- 1090 feet of hose at $1.47 per . foot. The bids had been received' at the last meeting and were given to the City Manager for tabulation and recommendation. A motion was made by Commissioner Young to award the contract to the Miami Fire Equipment Company,_on the recommendation of the Fire Chief and the City Manager.. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: ® Brice Yes Young, Yes Salvino Yes Zenobia Yes Adams Yes City Manager Salvino stated that Mr. Sparkman delivered some deeds to his office for sewer easements; easements number. 38, 40 and 56. A motion was made by Commissioner Young to adopt and pass a reso- lution accepting easement #38, #40 & #56. The motion was seconded by Commissioner. City Manager Salvino presented two easements, #11 & #12, atra:!cost of $250 for shrubery; and recommended they pay it. A motion was made by Commissioner Zenobia to pay $250 for easements #11 & #12. Salvino stated that on easement #422 behind A. J. Ryan's office, there are two trees. The owner has agreed to donate the easement providing the City removes the trees. City Manager Salvino presented a bill from Luther Sparkman, as n right-of)-way agent, . for 55 hours @ $10._0b per hour, total of $.550.0c City Manager Salvino recommended payment .of the bill. ' .'' Yes City Manager Salvino presented a letter 'from Attorney Dubow, repre- senting Mr. Arcaro, to sewer Gulfstream Road., City Manager Salvino recommended that the Commission authorize Mr. Philpott to draw up a change order to serve .Mr. Arcaro's property and also DePadro Yacht Basin. A motion was made by Commissioner Young to refer this to Mr. Phil- pott for his recommendation before making a change order. Adams Yes y � ' City Manager Salvino presented a letter from the Broward County Traffic Association, and stated that they had, past City Commis- sioner Robert Grammer on their board, and they recommended that the City appoint a replacement for the Board-to represent the City of Dania. City Manager Salvino stated that it involves freight rates on lime and lumbef, in which Mayor Adams would be interested; therefore, he suggested that the Mayor would be the proper one for the board. Mayor Adams asked if any of the Commissioners would like the job; . they each in turn declined, so he accepted the appointment. City Manager Salvino presented bills from Broome & Farina as follows: Plans & Specs for Lime Storage Bin: $599.16 r Legal descriptions for Sanitary Sewer System, June - September: :'-'..i'::: 550.00 Plans & Specs for paving S.W. 7th Ave:. $167.05 Third Dim. rendering of Fire Station: $150.00 Plans & Specs for chemicals, Water Plt.: 232.24 Total: 12698.45 F A motion was made by Commissioner Brice to pay the bills. The motion was seconded by Commissioner.Salvino, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes Adams Yes City Manager Salvino. presented a bil4from Osborne Service & Equipment, for overhauling the City tractor; total $705.00 plus $16.00 for part; total bill: $722.43 A motion was made 'by Commissioner Zenobia to pay the-bill because of an emergency or ,unusual circumstance. Young Yes Zenobia ' Yes `.Adams Yes City Manager Salvino presented a bill from,LaCroix•Electric Company, for $2,398.02. He explained that a<lot of it dates back to September. He recommended the bill for payment. A motion was made by Commissioner Brice to approve the-bill for pay- ment with the stipulation that Mr'. LaCroix be' instructed' to. render his bills as near as possible on a 30-day basis, and where, any: amount is going to exceed $500, that he. get a purchase order for it; also, to include the bill of Rickards, with_ the same' instructions. The motion was seconded by. Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes . Young Yes Zenobia Yes Adams Yes City Manager Salvino stated that'Mr,. Tognoli.told him that he would like to plaster the inside of the .Fire Station, rather than leave it like it is. He (Mr. Tognoli) talked to:Mr..-liindeman and offered u`: 9 .(... r. i4 to do the work for $290; then he submitted a letter stating that he would credit the City with $75,.00, which would be the difference between the two jobs, so the total cost to the City would be $215.00 for plastering:' A motion was made by Commissioner Zenobia to approve, the change A order for $215. The motion was seconded by Commissioner Salvino, and the roll being called;, .the Commissioners voted as follows: Brice :Yes: Salvino Yes Young No ® Zenobia Yes Adams Yes City Manager Salvino presented a change request, for a safety measure, to eliminate parking where they have to pull straight in to the parking lot on Beach Boulevard. He stated that it does not involve any change in cost; there would be the same. amount of park- ing, but it would just change locations. A motion was made by.Commissioner Zenobia to authorize the Change, if there is no, extra charge involved. The motion was seconded by Commissioner Salvino, and the roll being called, the Commissioners voted as follows: Brice No Salvino Yes Young Yes Zenobia Yes Adams Yes City Manager Salvino presented another request for change for a - plaster partition between the kitchen and recreation room at the Fire Station. Fire Chief Lassiter explained that this was requested in the be.:. ginning, but it was omitted in the original drawing. A motion was made by Commissioner Brice to accept the change order. The motion was seconded. by Commissioner Young, and the roll being called, the Commissioners voted;as follows: Brice ;, Yes Salvino Yes Young Yes , Zenobia Yes Adams Yes City Manager Salvino presented a request to repair the. cash register at the Dania Fishing pier for $514.45, estimated overhauling. Commissioner Young stated that it was the intent .of the Commission to allow the operator of the Pier the right to use all City proper- ties there; and that it would be- in good mechanical order for him. Then after that it is up to him to maintain it. A motion was made by Commissioner Young to term. this unusual cir- cumstances, and that the City-Manager be authorized to have the' machine repaired or overhauled. City Attorney's Report: . City Attorney Walden stated that he .hid, nothing to report., ._ a, -10 " • ® Commissioner Brice stated that he would like to take up two items. A motion was made by Commissioner Brice to grant to the Superintendent of the Water Department and the Building Inspector the same pay raise that was voted to other Department Heads in September, the amount of $500. , and that a resolution be adopted to that effect. The motion ® was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes 6 Zenobia Yes . , Adams Ye's A motion was made by Commissioner Young to adopt a resolution trans- ferring sewer service charges for Mobile Homes to the category of Hotels, Motels, Boarding. 6 Rooming Houses. . The motion was seconded by Commissioner Salvino. City Attorney Walden advised that it would be necessary to have a Public Hearing before adopting a resolution. Commissioner Young withdrew his motion. Commissioner Salvino with- '; drew his second to the motion. A motion .was made by Commissioner Young to advertise for a Public Hearing for January 3, 1966, at 8:15 P:M. The motion was seconded by Commissioner Salvino. Commissioner Zenobia asked if, when the Sewer Program was first ,started, there was an ordinance._making a charge of .100% of the , water bill for Hotels � Motels. Commissioner-Young replied that there was a change which established a tentative rate. The roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young; Yes Zenobia Yes > Adams Yes A motion was made by Commissioner Zenobia to adopt a resolution to give all Patrolmen a $300 per year.raise, Sergeants $500 per year, regular Firemen $300, Lieutenant $500 per year. The motion was seconded by Commissioner. Brice. Commissioner Young stated that he would like to see that tabled ., because, under the informal discussion, there were certain other items that were mentioned; and he felt, in all.fairness, that they should table this until the next meeting. He then made a motion to table. The motion to table died for lack of a second. Mr. Houston asked where the money was coming from for these raises. Commissioner Zenobia replied that there was sufficient money. Boisey Waiters asked why all City Employees were not given a raise, not just certain ones. They should- go,from the. Garbage collectors on up. Commissioner Brice explained that they are only taking care ,of the people that were not taken care of on the First of September. "Every one else in the entire City got a raise except the ,ones that were men �. -11- © tioned here tonight, including the Garbagemen, the Trashmen, and all of them." Salvino presented a request from Jack Kallen regard- ing the juvenile si,tuetion in the City of Dania. He proposed a sports program for the juveniles, and requested a donation of $100 for football insurance. Commissioner Young stated that we have several good, reputable organizations in town who attempt to he341 children; who attempt to give them activity. "But, frankly, if the City is going to donate $100 to one or two or three, then where are we going to draw the line?" He further stated that if they establish a pre- cedent of donating to one, then he felt that every civic organi- zation in town has the right to come to the City and make the same request. And if they give to one, then they would have the moral obligation to give to the rest of them. , Mr. Paul Pisculli stated that he received a letter from the Cham- ber of Commerce Beautification Committee stating that his property at 249 S.W. 14th Street needs attention and is not an asset to the community, due to it's condition. City Manager Salvino replied that perhaps the letter was sent in error. Mr. Blmer Christian stated that youngsters are using the parking lot,designated for free parking for occupants of the Fishing Pier, when they bring their surfboards to the beach. He felt that, since there was su¢h a small portion of the parking lot designated .for the Fishermen, it was not fair for the youngsters to take up all the spaces. Commissioner,Young reported that last, Sunday he saw some youngsters building a fire beneath the pier; the officer went down and told them they couldn't do it, and they just laughed at him. He stated that also, the surfboards go right under the pier and cut the fish-' ing lines: City Manager Salvino:stated .that he and the Chief of Police would look into it; and, if there was any action to be taken, they would make their recommendation to `the City Commission at the next meeting. Mr. Bill Maffie, Manager of the Chamber of Commerce, stated that, in reply to Mr. Pisculli, .November was declared,Paint-Up Fix-Up Month in Dania. A Committee was,appointed ;to. check the property in Dania and send letters to people who had trouble with their properties. He apologized for Mr. Pisculli having taken the letter as personal, "but if his property needed cleaning up, this is what it was there for-,' 0 Mr. Houston asked about the City audit. City Manager Salvino stated that 'it would be ready December 15, 19652 and it would be open to the public to' look at. Mr. Houston asked if he could have'a copy of it, which he would be Y glad to pay for. City Manager Salvino replied that he could have one. -12- t . Mayor Adams stated that, in regards 'to Mr: Bill Carney, he believed he was by-passed when-the Commission appointed the other Department Heads; he,suggested a motion to re-appoint Mr. Carney. Plant Operator; also, until the time that he takes over the full duties of the. Sewer Plant, that, he work under the direction of the City.Manager to. take,care of''the.''complaints,that..come in.
