0 The City Commission of the City of Dania, Florida, met in
Special Session in the Commission Room at the City Hall.

• The meeting was called to order at 3:00 P.M. by Mayor Adams,
for the purpose of getting further information on the Sewer
Project and the streets. Mayor Adams then turned the meeting
over to City Manager Salvino.
City Manager Salvino stated that Mr. Sparkman was present, who
• would bring the Commission up to date on the .rights-of-way;
Mr. Henann„ of Barcus Kindred 6 Company, was present, who would
bring them up to date on the financial end of the project; Mr.
Philpott was present to answer questions about the project; and
Mr. Mears, of M B Construction Company, was present to also
answer questions.
• Mr. Mears started off the discussion by stating that, he was
being held up in some places because of the the inability to
obtain some rights-of-ways.
Mr. Philpott then took up the discussion and answered some
questions as to why some areas were being served and some were
not. In regards to the trailer park in question, he stated that
they were unable to obtain the right-65-way to serve it. He then
suggested a few solutions to the problem.
Commissioner Brice asked Mr. Philpott about the problem on Federal
• Highway.
Mr. Philpott replied that they .suggested the ,sewers come off lst ' .
Avenues, both East D West, to serve the frontages along Federal
Highway in. order to avoid building a double sewer on Federal Highway.
Another reason for it is because most of the buildings on Federal
Highway have the plumbing in the back, and if they were served from
Federal Highway, they would have 'to tear up the whole inside of the .
building in order to getout the front.
Mr. Sparkman then reported on the -problem of obtaining easements
for the sewer project. He stated that they have 5 complete easements
and several half easements The half"easements are only 1� feet, in
which case there are property owners on both sides to deal with; rather.
than just the one. In 'a lot of cases, the lots .are cut'North 6 South
so that you have to deal with two property .own,ers to get to the "Y"
on the building facing Federal Highway. He stated, that.it. has been .
the policy of the Commission in the past to try:to acquire: these ease
® ments without any compensation; and these people'donit want to give
this property away, even though 'it is,just an easement. He stated
that he has had a lot of correspondence with the Atlantic'Refining ,
Company on the property on S.E. lst Avenue and Beach Road. After
several letters back and forth, they advised him that they don't want,
to give an easement because "it:would put.a cloud on the title". He
stated that he has several more 'in' the making. He stated that they,
lack about 40 easements; "but it is. my understanding from the Engineer. . .. .• .
that the fittings are already in,on the avenues where they comedown ,
where there has been one designated."._.

® Mr. Sparkman further stated that the City Commission, has agreed to
pay for any shrubery, survey corner markers, paving or concrete walls.
Commissioner Zenobia asked Mr. Sparkman "to clear a lot of rumors in
the town, will you let the City Commission and the people know how
much money you have received from the City for this right-of-way job?"
® Mr. Sparkman stated that he has received $250 and $370; he believed
that was a total of $620. He stated "This easement business is no
small job. (1) The Engineer's have to prepare the discription, (2)
He sends to the Abstract Company for a certificate of title, (3)
Then it goes to the Attorney for preparation of'the easement instru-
ment, then (4) it is up to me to go out and try to get them signed. .
• So there is a time lapse in there."
Commissioner Young asked Mr. Sparkman if he- had a recommendation or
a solution to obtaining the easements.
• Mr. Sparkman replied that in one case they wanted $2,006; in another
case, they wanted $300 a foot. He felt the property was not worth '
that much, but added that it was up to the Commission to decide what
they want to do. "But if you want the easements, .you are going to
have to put out a little money for them, I;:believe" .
• Commissioner Brice pointed out that it then becomes, a question of;
which is going to be the least expensive; to go around the corner
to serve Federal Highway, or buy easements.
City Attorney Walden suggested that the Commission consider getting. .
appraisors to appraise the easements, and then they would have some-
• thing to work with.
City Manager Salvino' stated that Broome & Farina were instructed at
one time to get ,estimates on, lineal feet and square feet; and they '.
came up with a request for from $1,000 to $1,500 'to do the work.
"I don't know if the City wants to pay that.much or not." `:
City Attorney Walden' stated that there is one point that has been
confusing to him: `"When I. first started on my part of this project;,'
I worked with Mr. Philpott's`Engineering'Firm; and I don't know what
the, dividing line is between .the two Engineering firms as to who has
the responsibility on .these phases'.- I really think that something
• ought to be worked out'on that." He further stated.that 'he. felt that
Mr. Philpott ought to have the last word•on even th'ese. estimates. He
pointed out that Mr. Philp6tt's`reconmendat16n. initially was,.to do it
on the square-foot basis. He did-suggest; though; that they get some
estimates' on the front-foot basis,-' '"But I wish someone would' teLl me
what the breaking!"point- is on these two engineering firms, because I
have got to work-with one or the other of them "
Mr. Farina stated ;that there was a mutual understanding between the
two firms that•Broome' • Farina would prepare the assessment roll.
Mr. Philpott stated that the assessment thing was not a part of their
contract (Philpott, Ross E Saarinen); and never has been. They did
make the preliminary survey ;however,`• to; see what the approximate- :
rate would be to raise $800,000_ in •th'e area served by the sewers.
Commissioner Salvino asked when is ,station "M" going to be, corrected
He stated that they paid $4,500 for the .lot,,_and ,the 'manhole is right
• in the sidewalk right-of-way. .
Mr. Philpott stated that they cannot move the manhole; but.they can'':
raise the sidewalk or lower the manhole
Mr. Mears suggested that they will fill in that property in,at no
cost to the City if the City will put in`a sidewalk to take care of
e'
the matter.

® A motion was made by Commissioner Zenobia to allow Mr. Mears to
lower the manhole to a grade established by the City and fill the
lot, at no cost to the city; and build a sidewalk at 65� a square
foot; subject to a change order. The motion was seconded by Com-
missioner Brice, and the roll being called, the Commissioners voted

There was a discussion between Mr. Broome, of Broome 6 Farina, and
the Commission as to the' difference between assessing the properties
to be serviced by the sewers by square foot and lineal foot.
A motion was made by Commissioner Brice to instruct the Engineering
Firm to give an estimate on the Lineal Foot on the total area, with-
in a price area of $400 to $600, based on time. The motion was
seconded by Commissioner Zenobia, and the roll being called, the
Commissioners voted as follows:

Mr. Sparkman was then instructed to make up a list of the persons
who are requesting payment for easements and submit it to City Manager
Salvino, who in turn will present it at. the next meeting.
City Manager Salvino stated that at the last meeting they held up the
payment of the bill of Mr. Philpott until such time as they could have
• a conference with him, which has been done. He then requested that
they approve the payment of his bill.
A motion was made by Commissioner Zenobia- to pay the bill. The
motion was seconded by Commissioner Young, and the roll being called,
the Commissioners voted as follows:

Mr. Houston asked why'the section about 1500.E eet east of Gulfstream
Road has been overlooked in the sewer;:program.
City Manager Salvino stated that there is a customer near DePadro
Yacht Basin, who is willing,to hook into the sewers; so that should
also be taken into consideration.' City Manager Salvino stated -that
he has a"letter that-he will bring up at Monday's meeting, from Mr.
Arcaro's attorney, asking for the City to go the balance of the 600'
feet down Gulfstream Road to take dare of the rest of Mr. Arcaro,ts
property; which would also take care of DePadro?'s Yacht Basin and
other customers in the area.
Mr. Philpott stated that he was not sure, but he would check, and
he thought that the area in question is part of the area to be served
by another pumping station, for which they have not yet constructed
the pumping station.(the area on Dania Beach Boulevard); but the area
on Gulfstream Road is served by��the pumping station on Second Street.
He further stated that they did not build any sewers anywhere unless -
there were customers to hook up to it, and there have been' extentions
made because customers have shown up since this started •8 years ago.

® Commissioner Brice suggested that the City Manager give the Commission
a list of the areas where.he has had requests for extention.
City Manager. Salvino asked .Mr'* Philpott if, after they decide ,to
extend it to certain places, he would come up with an estimate' of
how much money is left to do these things; so that .they.can present
it to the City Commission and let them decide what they want to do.
Mr. Philpott replied that he thought he could; keeping in mind that
they do not as yet have-the Federal Grant-money!,
A gentleman in the.audience spoke -about a ,60=unit apartment building
that Mr. Don Nelson is building on Stirling Road west of the rail-
road track. He would like 'to' know if he could.hook'into the system,
and if so, what his cost,would be. He stated that Mr. Nelson is
willing to pay the expenses to connect his 60 units into the system.
He wants to know, however, if there will be any, additional charge.
Commissioner Young stated that, according to policy: set some time
back, he would have to pay an assessment, plus the fact that he would
have to pay all the cost of connecting into .the system.-
Commissioner Brice suggested. that Attorney Walden give Mr. Nelson. his
legal opinion as to whether .the City can allow Iiim_•to tie into the, "
system if he is willing to pay the same assessment rate as any*other
property owner and the same sewage charges.
City Attorney Walden stated that Mr. Nelson would have to pay every-,
thing just like everyone else, even though he may have to pay twice
and extra; but he thought legally Mr. Nelson could connect if, the
Engineer says it is alright Engineering-wise.'
City Attorney Walden stated that he had an application to conduct , ';`
an auction gallery east of Royal Castle; and there is an ordinance
that requires, a $25 license the'first day and $10 each additional
day to conduct a public auction. This must be ;approved by,the Com-
mission. He wants to have a.sale 'Friday: ..
Commissioner Brice asked Chief,Smith if. he checked into it., ,
Smith replied that he did not;' and ,that 'it'is very important
that he be given the chance to check into it.
Mayor Adams tabled action,'on..the application until Monday night.
There being no further' busine'ss on the agenda, the meeting adjourned'."
