The City Commission of the City of Dania, Florida, met in Special Session in the Commission Room at the City Hall. • Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S. BRICE FRANK SALVINO S: ELLIS YOUNG CARL ZENOBIA CITY ATTORNEY CLARKE WALDEN • CITY MANAGER TONY SALVINO CHIEF OF POLICE MONTIE SMITH BUILDING INSPECTOR. CHARLES LINDEMAN CITY CLERK MARY THORNHILL The meeting was called to order at 12:OO Noon, by Mayor Adams, • for the purpose of considering the bid for the paving of the Street Ends, in connection with the Sanitary Sewer Program: Commissioner Young stated that,ras far as he was concerned, there was a misunderstanding on the motion pertaining. to this at the last meeting. And he understood that he was not the only one who • misunderstood the motion. He stated that himself and two other City officials understood that the motion was to,refer the matter to the City Manager and.Engineer for.:tabulation' and recommendation. However, upon checking the tape recording. of this particular motion, . he found that,. instead of referring it for tabulation and recommen- dation, that the motion was made to'mefer: it to the City Manager and • Engineer for tabuiation and award.7' He further stated that he was the one who seconded the motion, 'but he'did not understand the motion. He stated that he could see no purpose in referring the matter to the City Manager and Engineer for tabulation if ,"the"bid is to be awarded anyway. In' view of this; and`in'view. of the fact that there is quite a bit of apparent confusion among the citizens in town, "at this time I would like to -hear the -feelings of the other Commissioners" . Commissioner Zenobia:. "You know'my_feelings, because I made the motion last time. I feel that we have been kicking this thing around ever since I have been on the Commissions ; We gave it out oncei' and then recinded it and said we would ,put it out for bid; ,which we did. The Engineer made all specifications for it, it was advertised for bid. We only, got one' bid on it;. •this.isn't!,the first time we only got one bid. As far. as.I am concerned'; I can't see anything wrong with it." Commissioner Zenobia stated that he •also heard different .prices quoted on the paving, the same as Commissioner Young. He stated that , he also heard that they did not have the Engineer draw up specifications;` # but they were drawn up by Mr. Philpott. "He recommends it. The City , Manager recommends it. I. think we should do it." ' Commissioner Brice: ' I am opposed to it, for the simple reason that I, do not see ever issuing any contract on a one-bid basis. ' What is. the : reason for having bids? Commissioner Zenobia stated that this is not the first time that a contractr_was'awarded on only one bid. Commissioner Salvino stated that they stopped the job once before. Then it was advertised and put out for bid, and he saw nothing wrong ., is with it. Mayor Adams stated that he felt that any bid for the City should at least have two bids. He felt also that they .should still get two bids on it. Commissioner Zenobia stated that thisis the„type of work that- a lot-'.!:' tc of contractors don't want to bid on: There .is a lot;of hand-work ax: -l- R �t:!'•- J _ r ® involved in it, and they would have to work along with another contractor; and the bigger contractors just won't bid on it, and . the small ones do mostly driveways and parking lots. Commissioner Young stated that another thing involved here is the fact that there is a lot of moving of equipment to consider. He • stated that, in cheeking. with a lot of citizens of Dania, the fact has been stated that it would be almost impossible to check the actual amount of asphalt used on the job. . Coptw Brioe stated that,, when he brought-up the question of square yardage, they said that they couldn't figure it by the square yard • because they didn't know the thickness of how much they were going to use. He asked how they are then going to figure out the tonnage- if they don't know what the thickness is going to be. Commissioner Zenobia answered that when a contractor gets his truck loaded at a plant, the tickets are marked and the weight is on them; • then the Engineer has to give the City Manager a schedule of paving the streets, and he can be there when the truck. comes. Commv Brice: That's right. But when he dumps it in that spreader, how do you know how much of it is going on the .ends and how much is going down the street? Commissioner Young replied that .if the street end. is 10' feet, and , it is a 20 foot street, then it is very simple. The specifications call for your. State Road Department specifications. The only pro- blem would be in filling up pot holes. He stated that he has no . objection to the bidding by tonnage as long as; it is checked out. • And it will have to be checked out before they can even approve pay- ment. Commissioner Zenobia stated that this was figured on a square yard basis by Philpott, Ross & Saarinen; and they came up with approxi- mately 700 tons, that is why they put that in the bid. This tonnage • basis is nothing new, it. is being done all the time., Commissioner Young stated that, for some reason, this appears to be a controversial matter which involves approximately $9,000. The Commission is in a "dual position" . If they authorize the work, and the City signs the contract, a lot of the citizens will disagree with the method of awarding the contract,. and, by the same token, if they don't award the contract, in about 8 months time,. probably some of these same citizens are going to come around and say they should have taken.care of the street ends at the time that the equi P-, . . ment and everything was there in order to save the City a little money Y on it. A motion was made by Commissioner Young that this be referred to the City Manager and the Engineer for tabulation, investigation and recom mendation to the City Commission. Commissioner Zenobia: I'll second that for discussion, Mr. Young. Mr. Salvino, didn't you OK that recommendation from Mr. Philpott? City Manager Salvino: I think before you discuss a motion likethat, you should rescind the other motion that you already made I talked to Mr. Philpott, and I have a letter from Mr. Philpott recommending it; and I understood that, according to the motion, I could award the ,;s 0 bid if everything was in order. . .which we found in order. I don't • want to get in any discussion; but I think the City Commission ought to decide what they want done. But the last motion was to award the bid providing Mr. Philpott'.and myself found the.bid in order. , Mr. . +' Walden, you might advise us. A , City Attorney Walden stated that there is nothing official about the . , ' tape, that is merely for the Clerk's own use. So'if there is a mis understanding, then Mr. Young's motion should read`to dorrect, the .42 n rr ® minutes of .the meeting of November 15 to show that the motion should read as follows: To refer the. bid to the Engineer and City Manager for investigation, tabulation and. report.. In other words, showing it as a correction of the minutes. Commissioner Zenobia: I don't go along with that Mr.-Walden) because • I made the motion, . and',I know what I ,sa.id. City Attorney Walden: , Mr. Zenobia, if three Commissioners say it is wrong, then,it.is wrong and that is it. They misunderstood ,you. _ If_ the majority,think it was wrong and it needs correction, they have a right to correct it. ' p Commissioner Young: I will withdraw my motion for the purpose-of the Counsel's request. I will rephrase it to state to show a correction in the minutes. A motion was made by Commissioner Young' to correct the minutes of. the • last meeting to show: Refer to the City Manager and the Engineer for tabulation and recommendation and investigation. Commissioner Zenobia: I would second"it,' but I don't want to seethe minutes corrected; because I know the motion I made. .. • Commissioner Young: I am the one that seconded your motion, and I misunderstood it. City Attorney Walden: Let me make a suggestion, if you want -to do something to take some affirmative action; simply make a motion to rescind all action authorized by the motion that was adopted on Novem- • ber 15th, and start all over. Just rescind that one completely: .- A motion was made by Commissioner Young to rescind all action taken, at the last meeting on this matter. The motion was seconded by Com- missioner Brice, 0 Mt. Mears, M B Construction Co. ,: ISince all this is withdrawn', would like to withdraw my bid. . The streets will go back in, slag and all, according to the original contract. Commissioner Brice then accused Mr. Mears of trying to, put a'-little r' i pressure on now. He pointed out to Mr. Mears that the City:could alo 0 apply some Pressure, especially in regard 'tothe dry well-whchwasrde'!disrupted" and,never put back. Mr. Sinclair, N.W. 1st Avenue; asked- will the money for theistre'et ends be taken out of the Sewer money or from the General Pund:, • City Attorney Walden answered that it will be taken from the, Sewer money by authorizing a change order. Mr. Sinclair also asked if this .contract only included street, ends. •. City Manager Salvino replied that it only ,includes street ends where the sewers are going in. Mr. Houston asked, on the street ends that were damaged by the con struction company, who is supposed to repair them, the City or the construction company. 0 City Manager Salvino replied, that in his opinion, the damages should, be repaired by the Construction Company. Mr. Mears stated that anything they damage they will repair.: Mr. Houston pointed out that three weeks'ago they were supposed to have a meeting with Mr. Philpott, and as -yet this has not been done Ai -3 a fkl, i ri2ZNiy _,4i x 1 r L City Manager Salvino:replied that the City Commission has been , advised that there 'will be'a meeting. at 3:.00 next. Monday with Mr. Philpott, Mr. Mears and Mr. Sparkman: City Manager Salvino suggested that, at this meeting, they ought to discuss every angle of the Sewer Program. ..legal, rights=of-.ways; engineering and all. b . Mayor Adams asked City ,Clerk Thornhill to repeat the motion. City Clerk Thornhill: The motion .was by.Commissioner Young, seconded by Commissioner Brice, to.rescind all action taken at the last meeting ". on this inatter. Adams Yes Motion carried.. : A motion was made by Commissioner Zenobia to turn this over to the If City Manager and Mr. Philpott, for"'tabulation and investigation, and bring it back at the next meeting. of Monday, 3:00 P.M: ' It was pointed out that Mr. Mears withdrew his bid, so there was no action to be taken.
