The City Commission of the City of Dania, Florida, met in Regular Session in the, Commission Room at the City Hall. ` Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S. Pledge 'of Allegiance was held. 1. Minutes of meeting held November 12 1965, to be approved. y A motion was made by Commissioner Zenobia that the minutes be approved as read. , The motion was seconded by Commissioner Brice, and the roll being called; the,Commissioners voted as, follows: . Ordinance: Approving plat of the W. 345T of the N' of the SW� of the NWT of Sec. 35-50-42, less the S - 251 and less Dania Cut-off Canal R/W: '. (3rd Reading) City Attorney Walden read the ordinance entitled: AN ORDINANCE approving the plat'of the W 345T .of the N� „ of the SW� of the NW' of Section 35, Township 50 ,South, Range 42 East, less the South '251 and less Dania:.Cut-off Canal right of way; and providing that,all ordinances or. parts of ordinances in conflict herewith be repealed to. . the extent of such conflict; and providing that the or- dinance shall become. effective as of its•,passage and adoption on third reading. City Attorney Walden stated that he' understood that the applicant t; has not submitted a land plat) nor put up any of the bonds that are required. City Manager Salvino stated that he received a letter from Mr. Louis Marrone; owner of.the property, who requested a delay,'of 90 days for final reading. Ordinance: Rezoning Blocks 2, 31 4, 5 & "6, Hollywood Manors, from R-1, R-2 & R-WI Classification to R-3 Classification. (Third Reading), A motion was made by Commissioner Zenobia to pass the ordinance ® on third and final reading. The motion was seconded by Commis- sioner Brice, Commissioner Young asked exactly where this property is located, and if there were any objectors to this rezoning. Mr. . Robert Dubow] representing Mr. Arcaro, one of the owners, stated that'.there;Have not .as yet been any objectors to it; and that it is directly East of the Dania Golf Course. The roll being called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia . 'Yes Adams ', Yes 4. Ordinance: Establishing and adopting a "Civil Service' Plan for certain City employees. (Second Reading) Attorney Walden read,the ordinance entitled:' AN ORDINANCE creating a system of Civil.Service for certain oftthe employees of the City of Dania, Florida; and providing for the creation of a Civil Service Board; and providing that all ordinances or parts of ordinances in conflict herewith be repealed to the extent of such conflict; and providing that this ordinance shall become effective as of its passage and adoption on third reading. A motion was made by Commissioner Brice that this ordinance be killed" on second reading, and that the Commission make.a study of, .coverage of other departments other than the ones covered in this ordinance at.the first reading. Commissioner Young: Commissioner Brice, would you mind" tabling that .- rather than just saying "kill" it; it serves the same purpose. ' Unless '. the word "killing" would be in the realm that I am-not acquainted with. Commissioner Brice: What I mean is simply this, that I "do not feel , that the present proposed ordinance can be amended to the. extent .with out almost completely rewriting it. _Therefore, I' ask that this pro posed ordinance 'be dropped, or completely done away with, and start over. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted, as follows: Brice Yes Salvino Yes' Young Yes: Zenobia Commissioner Zenobia: On a point of order, 'I would like to say that• we did study this for about a year., We had.a proposal for all the l City employees, but I guess everybody thinks' it wasn't studied long enough, and I am going to have to vote No: " ° Adams Yes S. Public Hearing: 8:15 P.M. . Vacation and abandonment of street right of way. (An area adjacent to S.W. 11th Avenue at: S.W. 2nd Place) NOTICE OF HEARING IS HEREBY GIVEN that. the City Commission of, the City of Dania, Florida, shall conduct a public hearing at .. 8:15 P.M. on November 15, 1965, to consider objections of: the public to an application for the vacation and abandonment of . a street right of way legally described as an area adjacent' to S.W. llth Avenue at S.W.- 2nd Place. All persons objecting to the vacation of said street or right of way should appear at the aforesaid meeting to'present their. objections. City Attorney Walden advised the Commission that Mrs. Thornhill'. informed him that there is nothing on -file or on record showing that this property was ever dedicated .to the City.for rightAof way; therefore, .he did not feel that the 'City. actually has any- thing to vacate. However, he suggested that they call for objec-' ' tions. City Manager Salvino stated that he would -first like to'find' out . if the original owner wished to donate that right of way; , "we might be doing•something against the wishes of the original owner, because r, it has never been recorded or, been- platted, ;and we really have no thing. to do with it•'f Mr. Percy Johrison, representing ,Mrs.' Timmons, was-present and .stated that he believed the land was owned originally by the Phippens. City Attorney Walden stated'that:. he thought:'it would. be proper if City Manager Salvino would just write a letter to the owner (Mrs. Timmons) stating that we.have no record of ever,owning:the*right .. of way. City Manager Salvipo suggested that Mr. .Johnson check the abstract to see if there is a revertal clause in it; because. if there is, even if the City did vacate that portion)rit would then revert back to the original owner. A motion was made by Commissioner Young to table the matter. The motion was seconded by Commissioner, Salvino, and, the roil -being called, the Commissioners voted as follows: Brice ' . Public Hearing: 8:20'P.M. , Request of Z.B. Skinner for a permit to enlarge the existing yacht basin at 300 .North Federal Highway. NOTICE IS HEREBY GIVEN.that the .City .Cortugission of the City of Dania, Florida, shall conduct .a public Hearing at .8: 20 P.M. on November 15, 1965, at the City Hall;,City of Dania, Florida, regarding the request of Z.B. `Skinner and Cozy.Cove Marina, Inc. for a permit to .enlarge the existing yacht basin at 300 North Federal Highway, Dania,:Broward' County, Florida, be constructing covered boat'slips The legal description of said prop.erty,.is Lots 16 through,,212 Block 1, Poinciana Park. �. All persons objecting to the granting of. said permit should . appear at the aforesaid meeting to present their;objections. Mayor Adams called for=objections. There were no objections. A motion was made by Commissioner Young to approve the plans. The motion was seconded by Commissioner Brice. Commissioner Zenobia stated that; during the last heavy:rains.we . had, there was quite a bit of'water-washed from :this property into someones home; and he suggested that'some `sort of 'catch. basin .be installed' to take'the'water offinto the canal. Commissioner Young agreed to include in his motion thatadequate drainage be provided. Public Hearing: 8: 25 P.M. ,, Rezoning,of Florian .Isles 2nd Sec- tion, from B-1 Classification-to R-3• Classification. is ; -4- • r , ® NOTICE IS HEREBY GIVEN that the City Commission of the City of Dania, Florida, shall conduct a public hearing at 8125 P.M. , on November 15, 1965) at the City Hall, City.of Dania, Florida, concerning the rezoning of Florian Isles 2nd Sec- tion according to the plat thereof, from B-1 zoning Classi- fication to R-3 zoning Classification under the zoning ordin- ances of the City of Dania, Florida. All persons objecting to the adoption of an ordinance rezoning, said property should appear at the aforesaid meeting to pre- sent their objections. Mr. Berkley J. Florian asked what are the reasons for the request. • Mr. John Morel, owner of property on N.W. 10th Street, stated that he and some 20 other persons signed a petition asking for the re- zoning. He stated that they do not wish to see commercial buildings in that area, and as long as the property remained' B-1 zoning there was some danger of that type business going in there. • Mr. Berkley Florian, owner of many vacant lots in, the area, .!objected to the rezoning of the area: It now being 8:30 P.M. , the Mayor called for any additional bids for . the paving of the street ends. A motion was made by Commissioner Zenobia to close the bids: . The motion was seconded by Commissioner Young, and the. rol_l being called, the Commissioners voted as follows: Brice Yes Salvino Yes' Young Yes Zenobia Yes Adams Yes A motion was made by Commissioner Zenobia to 'deny the request for ' ` rezoning. Mr. John Morel stated that they were not through with the objections. Mayor Adams called for further. objections. Mrs. Auschon, who lives directly across from the property in question, stated that when she bought•her home she was told that it .was .all going to be residential. (1432 N.W, 9th, Street) Mrs. White, objected to the zoning remaining the same as presant for, : the same reason .as above.: Mrs. Freeman, 1437 9th Street,. objected to the business zoning for ' the same reason.. A motion was again made by Commissioner.Zenobia to deny the request ` . for rezoning for the reason that Mr. Florian bought'�.this; land at th'is't,; zoning, and when these people bought their homes, this'•land was.wned., this way. The motion was seconded by..:Comni,ssioner Salvino.;_ G Commissioner Young stated that he .was,.in,ay{npathy with both: parties .. involved in this; but he felt that.-;, sincethe• Zoning'Board has',given'' a unanimous recommendation, they couldnot turn them down ® Mr. Berkley J. Florian, Jr. , stated that, on the three lots remaining next to Mr. Morel, there was.not room to put a store; therefore, there would be no store going in there. Commissioner Young stated that Building Inspector Lindeman had a • difference of opinion on the voting of the Zoning Board, and he has gone downstairs to see if he can get the minutes real quick. Mr. Loury stated that he may be in error on the voting, but he thought' that it was passed unanimously. ® Commissioner Zenobia withdrew his motion to deny the request. Commis- sioner Salvino withdrew his second to the motion. 11. Bids: 8:30 P.M. , Paving of street ends. Mr. Houston asked how,many bids were received. He was informed that there was only one. He then suggested that this be tabled until they • receive additional bids. City Manager Salvino stated that it was discussed for 5 or 6 weeks, it was properly advertised, and Contractors had ample time to bid on it,:°therefore he saw no need to delay it any longer. He recommended • that they open the bid, and if it is within reason, they ought to award it; if it is not, they ought to reject it, and they will have •a "patched-up City" . A motion was made by Commissioner Zenobia that the bids be opened. The motion was seconded by Commissioner Salvino, and the roll being • called, the Commissioners voted as follows: Brice Yes Salvino Yes Young Yes Zenobia Yes • Adams Yes City Manager Salvino read the bid as follows: M. B. CONSTRUCTION COMPANY: Asphalt at $13.00 per ton, accompanied by a bid bond of 5%. • There were objections as follows: Charles DeMuzzio, stated that if Mears ,is going to do the work, he is absolutely against it in view of the job being done on the sewers by M. B. Construction Company. He further stated that the advertise- ment for bids did not clarify what they were bidding for. Mr. Elmer Nitzsche objected to M. B. Construction Company doing the paving of streets. Mr. Virgil Tarpley`-objected to the method of letting this contract, "because I don?t think there has been any engineering done on 'these streets at all.1 which is';going to affect the drainage. If you raise' the.-paveient an inch, you are going to hold an .inch of water in the intersections." Mr. William Ross stated that on S.E. Second Avenue, from about 4th . Street to Sheridan Street, "if this ,is an example of the way Mr.. Mears does his work in the center of ,the streets, you can't even' drive up that street." He asked why can't Mr.. Mears bid by the yard instead of by the ton. City Manager Salvino stated that some places take two inches, some places take three or four inches,. so it is hard to measure by.the . yard. ' The trucks will be weighed' when they are loaded, and we will have receipts for every truck load. ' _6- ; M'.a 0 Mr. MacMillan stated that they have let a contractowith a.contractor who was supposed to replace the streets in the condition they.were in before they were torn up., "If that is the case, I see no need..for wasting this money. He .can pave to the existing grades, put out streets back like they were, and then, when you do get a little money in your pockets, you can go back and fix them right. But I certainly • think it is foolish to throw money away now to change elevations on the street ends when this man has a contract to replace the streets as they were." City Manager Salvino: Mr. MacMillan, his contract doesn't include the ends though. • Mr. MacMillan: He is not supposed. to tear the ends up either. Commissioner Zenobia stated that the contractor cannot put the streets back the way they were, because they were in pretty bad shape. • Mr. Bob Grammer stated that the contractor is putting in black-top ' asphalt, where he doesn't need to; "he could put back sand and gravel, ` but he is not doing it': . He is giving us something that .we didntt have':" Mr. Mears stated that he has a contract to put the streets back to the original order; but there are two or three streets in town that are • asphalt, the rest are slag. Mr. Grammer stated that he wi" admit the man is a little slow; but; . he is doing a good job and giving us a better road than we had before. Mr. Panzetti stated that on Second avenue, which has been replaced,, : .' • there is a puddle of water there due to the extended elevation. Mr. Robert Kelly, S.W. 7th Street, stated that the street-ends .are . the best part of the streets "what about the middle, between the street ends?" He suggested that Mr. Mears finish up the job that_he has already started. . •. A motion was made by. Commissioner .Brice to hold the bid until we see what kind of work we are going to get from. the 'paving. "We haven't seen any paving done yet, how do we know that Mr. Mears is .going to do that kind of a job at,the•ends?" • The motion died for lack,of a second.' A motion was made by Commissioner Zenobiacto, turn this over to the. City Manager and Philpott, Ross & Saari.nen, for tabulation -of the r bids and awarding it. The motion was seconded by Commissioner Young; . ;..: and the roll being called, the Commissioners voted as follows: Brice No Salvino ' Yes Young Yes Zenobia Yes Adams No • Reverting back to Item,#8 on the,agenda: Commissioner Zenobia repeated his motion to deny the request for rezoning. The motion was seconded by Commissioner Salvino.: ® Commissioner Young: I have the 'minutes:here of the Zoning Board meeting at which they had a public hearing on.this. According -to the minutes: A motion was made;'by Mr. Loury to recommend .to the City Commission that the B-1 zoning be changed to R-3;' the'6tion was seconded by Mr. Tanner, and,'the roll being called, .the.vote was ..` as follows: Mr. DiMauro, No; Mrs. Panella; No; Mr.-Kennedy; -No; Mrs • Tanner, No; Mr. Loury, Yes. That means that our'Planning ,Zoning •b . . 3r O Board voted against the rezoning. The roll being called, the Commissioners voted as follows: Brice Commissioner Brice: In view of. the fact that we have a Zoning A Board to look into these things, I am going to have to vote Yes . Salvino Yes Young Commissioner Young: I feel as Mr. Brice does, that we must uphold the Zoning Board's decision, therefore I vote Yes Zenobia 'Yes Adams Yes Mr. Morel stated that he was going to frame his petition as an example of what this commission does in the face of a petition signed by 20 homeowners. 9. Public Hearing: 8:35 P.M. , Amendment to the initial schedule of rates to be charged from users of the sanitary sewer system. ' NOTICE OF HEARING concerning-an amendment to the initial schedule` of rates to be charged and collected from the. users of the muni- cipal sanitary sewer system of City of Dania, Florida. WHEREAS, since the adoption of>such schedule, it has been recom- mended to the City Commission of the .City. of Dania, Florida, that the schedule be amended 'to'.eliminate'the charge of $3.50 per month for each mobile home; and WHEREAS, it has been.further-suggested-to the City Commission of. the City of Dania, Florida, that the charge; to trailer parks and/ . or mobile homes should be 100% of water;lAils Mayor Adams called for objections to this amendment. Mr. Houston stated that he was not objecting,' but he did want to call their attention to a few things. He felt that $3.50 per unit per mobile home would,be too high!, He thought,-that a more thorough study should be made om the charges.., , He also pointed out that the 100% charge for businesses wa's'.not'-fair, because he .knew of many businesses in the city who pay a minimum water bill. He .suggested that the people also be instructed how to put. in the services; what kind of material they have to use, whether the owner-will be able to do it himself, and:many other things. First of all,'; they, should .find out what the businesses will,return. in a 12 "m6nth.period•with 100% of the water bill. Mr. Houston also stated that a cquple weeks ago the`City Manager was , instructed to get in touch with Mr. Philpott and have him attend a meeting . He would like to know'whether they.have heard from him or not "I see he has his bill here tonight". City Manager Salvino stated that he requested for him to -be at our . • last meeting and he was unable to be there. .He called his office today to see if he could be here tonight; he wasrout of town until Wednesday. City Manager Salvino ,stated`that he would call him:Wed nesday to find out when he can meet with"the Commission and they can have a special meeting with him. ® City Attorney Walden stated that it would not have .to`be a 'meeting, it could be public conference for. anyone who wants:to to attend. Mr. Pinta, S.W. loth Street, was objecting to the charges;for mobile .,,,, homes. . . q Mr. Elmer Nitzsche was objecting to the charges and also suggested'- that a'.thorough study be made. ' ® Mr. MacMillan also was objecting to the charges in regards to businesses. He felt that they should have a minimum charge to businesses of $3.50.. A motion was made by Commissioner.Brice to table this until the next Commission meeting to give more time to study other ways and • means of raising the amount of money that they are going to need to operate the Sewer System. The motion was seconded by Commis- sioner Zenobia. . Commissioner Brice stated that.this sewer system and the ,operation of the sewage disposal plant have to be paid for. He assured the • people that .the Commission is going to do everything in their power to make this a fair and equitable monthly charge.. He did not feel that they could tell the people tonight what their final monthly , charge was going to, be; whether they have a hotel, motel, mobile home or residence.",. 'It'has to be divided up among-,,the number of people in the sewage district. So whatever is passed at the next • meeting is not going to be,possibly your final figure, because we cannot know witil we get farther into the program and know exactly what the operation cost is going to be on the Sewage Disposal .Plant. Commissioner Young stated that in his opinion a trailer park was a business, just as; much as a hotel, ;motel or boarding house. , He felt . • that it was only fair and 'proper•to assess them the same as a business. Therefore, he suggested that the motion to table' be defeated so that "we can at least give the people effected the assurance that the City . , respects them as having legitimate businesses" . Commissioner Brice stated that he thought they were.voting. on the �. whole thing, .and 'not just'an amendment for the trailer'parks;' there- fore, he withdrew his motion. f Commissioner Zenobia withdrew his.second, but stated that on .trailer ' parks, on the Municipal Sewer Service Charges; most trailer parks are charged $3.00 for.the first. unit.,and $1.00 for each additional unit, • to make it a little "fair and equitable for the rest of the people in the City", instead of 100%' of`the water bill. Commissioner Young stated that this was.-not the; way it was passed in the original resolution. At the time that it was passed, they were promised some type of relief, .and he felt that :tonight, was the .night',. • to let them know just how they felt. A motion was made by Commissioner Young .to,adopt and:pass a resolu- tion transferring Trailer.Parks into the category of Hotels .,Motels, Boarding &' Rooming Houses. The motion was seconded by Commissioner Brice, and the roll being called, the Commissioners voted- as follows: • Brice Yes Salvino No Young Yes Zenobia , No Adams No Motion did not carry. 12. Bills for the month of October to be approved for payment. A list of the bills for the month of. October are attached`to. and . 0 made a part of these minutes. A motion was made by Commissioner Salvino.that the bills be paid The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted',as follows: Brice Yes, Salvino Yes Young Yes Zenobia Yes Adams Yes 9.'-, 13. Bills from: GOOMIN, INC. , Estimate #9 $132022.00 A motion was made by Commissioner Zenobia to pay the bill. The motion was seconded by Commissioner Brice, and the roll being called, the Commissioners voted as follows: Brice Yes Salvino, Yes Young Yes Zenobia Yes Adams Yes M. B. CONSTRUCTION CO. , Estimate #9 $692811.04 Commissioner Brice asked Mr- Mears if he could give. us.a time iness", because "we are now approaching schedule on the "street bus our Tourist Season" . Mr. Mears stated 'that they have been trying to get" off the main Pre- thoroughfares and work in the alleys?, but; the" recent weather pre { vented them from paving the streets. "We have until May to finish the sewer .job, which we intend to ,finish, if the weather will break, sometime in January-" Commissioner Brice asked if there is anything that he can do about the main thoroughfares now; even though it may delay some of•the laying. of the sewers in the remote areas. Mr. Mears replied that about the.best they,can do•in'weather like this is to maintain it in- the condition it is in. Mr. Mears further stated that on S.W. 2nd Avenue, near the school, they never got appo'val on the lateral. City Manager Saivino :stated- that the Commission authorized a change .. . order on it, but he hasn't received it yet. City Manager's Report: The City Manager stated that he-has a letter from.the Railroad Commission stating they had a meeting on Florida Power & Light Company and ordered them to reduce rates by $9,467,000; he stated that he didn't know when it is effective. i He stated that he had a Setter, signed by Peter.Broome, of Broome & Farina, in which he stated that he consulted with Mr. Peters of the Water Plant. Mr. Broome was calling our attention to the East corner treating tank at the Water Plant, and recommended that this be taken out of service, cleaned and painted before the coming tourist season. Estimated -cost of this work, $1.300.00. Cit.9 Manager Salvino requested authorization to advertise for bids and authorize Broome & Farina to draw up specifications'.
