The City Commission of the City of Dania, Florida, met in Special Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER JAMES G. ADAMS COMMISSIONERS GUS S. BRICE FRANK SALVINO S. ELLIS YOUNG l CARL ZENOBIA CITY ATTORNEY CLARKE WALDEN (ABSENT) CITY MANAGER TONY SALVINO CHIEF OF POLICE MONTIE SMITH (ABSENT) CITY CLERK MARY THORNHILL BUILDING INSPECTOR CHARLES LINDEMAN ATTORNEY DUBOW 7 SGT. WM. JONES The meeting was called to order at 4:00 P.M. by Mayor Adams, for the purpose of discussion on.the New Fire Station. City Manager Salvino stated that there were changes made on the new Fire Station, authorized by the Engineer, the Building Inspec- tor, and others, because the City code did not allow certain things in the original specifications. He stated that the City Attorney suggested that they go along with the City Employees who authorized these changes; and he (City Manager Salvino) urged that some under- standing be agreed to with the Contractor, the Electrician, and the City so that the work can proceed. . Mr. Dubow, representing City Attorney. Walden, stated that he dis- cussed it this afternoon with Mr. Walden, and he indicated that the �- City should stand behind the employees who authorized the change, and to formally authorize a change order from the original speci- fications to the aluminum conduit; and then obtain a credit 'from the Contractor because of the substitution of this lower-cost material; and then go ahead and pay for the extras that have already been put in that have been authorized by the employees. Commissioner Brice stated that in cases of this type they have to depend upon the Engineer to tell them what is best or what is to be done. A motion was made by Commissioner Brice to accept the recommendation of the Contractor and Engineer, to use aluminum tubing and authorize the changes requested by the Fire Chief and approved by the Building Inspector. The motion was seconded by Commissioner Salvino. Commissioner Zenobia: I still don't know who authorized the Change Order; that is what I am trying to find out. J Mr. Farina, of Broome 6 Farina, stated that he authorized the changes. Commissioner Zenobia asked why Mr. .Farina did not put it that way in the specifications in the first place. Mr. Farina: What I was after in the specifications was not so much aluminum or galvanized conduit, because I feel that they are equal; what I was after was that it would be rigid galvanized conduit, that is a heavy-wall type of conduit rather than a thin-wall type of con- duit. I don't think that the building is cheapened any; I consider them equal. And the savings that we are getting from it is a savings ?. more or less in ease of installation. I would like to say one more thing; some of these changes were mentioned as being against the code. That is not true in all cases. This changing the switch to the out- side is for convenience; inside where it was, is permissable in meter .I IF III IN a' : -1- rooms such as we have at the Station. But it was not downgrading the building in changing to the aluminum; and it'.was a substitution,' rather than a change. There are these things that come`up, and in the specifications, in almost all cases, we. state "or a type equal", which could -mean by manufacture so long as the specifications are the same. In this case I donsider this a substitution, because it is heavy-wall conduit, which is what I was after in the first place. Commissioner Brice explained that the reason Chief Lassiter wanted the switch on the outside of the building is because, in of fire, they would not have to break into the building in order to turn off the electricity. Commissioner Zenobia stated that he could see that part of it, but when they let out specifications nothing- should be changed unless it came before the Commission. . The Commission are representatives of the people, who are the owners. Commissioner Young stated that the letter in question only mentions one change, but there are'about 13 changes. He, felt that any City Employee should know that any changes should go through the City i. Manager as administrator. If any purchase orders are made, they j , should go through the City Manager, and then it is up to the City 1; Manager to discuss it with the Engineers. or 'the Commissions. F Commissioner Young offered an amendment to Commissioner Brice's .. motion that the additions be deleted, with proper credit issued to the City; and then a formal proper request, through channels, be made through the City Manager, and then .it would be. up to him to . advise. The amendment was seconded by Commissioner Zenobia: A discussion arose between Mr..',Tognoli, Contractor on the Firer Station, and the City Commission, in which Mr. Tognoli admitted that he did not have written change orders on the changes.'• On the amendment, to the motion; ,the roll being called) the Commis sioners voted as follows: rr' Brice .
