The City Commission of the City of Dania, Florida, met in Regular Session in the Commission Room at the City Hall. • Present were: MAYOR-COMMISSIONER FRANK SALVINO COMMISSIONERS ROBERT GRAMMER VERA HILL S. Minutes of meetings held July 19 & August 2, 1965. A motion was made by Commissioner Zenobia to approve the minutes as read. The motion was seconded by Commissioner Hill, and the • roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Zenobia Yes Salvino Yes 2• Bills: GOODWIN, INC. Requisition No. 6 $ 54,882.98 • M. B. Bills for the month of July to be approved for payment. A list of the bills for the month; of July are attached to and `l. made a part of these minutes. A motion was made by Commissioner Zenobia that the bills be paid. Recommendations from August 10 meeting of Planning b Zoning Board. 1. Bovia Corporation: Request permission to construct Gasoline Station, 706 S. Federal Highway. • A motion was made by Mr. DiMauro that it be padsed as presented. The motion .was seconded by Mr. Tanner, and carried unanimously. Commissioner Grammer stated that he spoke to the Building Inspector and that on the plans there is shown a cut-back, which Mr. Erdlitz • agrees to give a right-6f;way to the. City, and Mr. Lindeman stated that, to his knowledge we have not received a deed for the right-of- way. City Attorney Walden suggested that any approval should be conditioned upon the receipt of the right-of-way deed. - • A motion was made by Commissioner Grammer to approve the plans as shown, with the understanding that Mr. Erdlitz will give the City the right-of-way dqed. 'Martin Steyer: Request variance on rear set back, from • 15 ft. to 13-1/2 ft. on apartment building. A motion was made by Mr. DiMauro to grant a Public Hearing, to be held September 14, at 7:45 P.M. Motion was seconded by Mr. Tanner and carried unanimously. • A motion was made by Commissioner Hill to authorize a Public Hearing to be held September 14, at 7:45 P.M. Mr. George Arearo: Request change of zoning from R31 6 R-]AA to R-3. • A motion was made by Mr. Kennedy to grant Mr. Abcaro a Public Hearing, to be held On September 14, at 8:00 P.M. Motion was seconded by Mr. Tanner, and carried unanimously. A motion was made by Commissioner Zenobia to authorize a Public .49 Hearing to be held September 14, at 8:00 P.M. Stirling Corporation: Request change of zoning from B-2 to C-l. • A motion was made by Mr. Tanner to. recommend that the request be denied. The motion was seconded by Mr. DiMauro, and car- ried unanimously. „-__2_ A motion was made by Commissioner Grammer to accept the Zoning ® Board's recommendation and deny the request. Sam Conforti: Request permit to build a storage building. • A motion was made by Mr. Tanner to advertise for a hearing for a variance to be held on September 14, at 8: 20 P.M. The motion was seconded by Mr. DiMauro, and carried unanimously. A motion was made by Commissioner Hill to authorize a Public Hear- ing for September 14, at 8: 20 P.M. The motion was seconded by Com- missioner Grammer, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Zenobia Yes Salvino Yes 7. Lillie Mae Timmons: Request City to vacate street right- of--way along S.W. llth Avenue, north of S.W. 2nd Place. A motion was made by Mr. Kennedy to table this until the two attorneys can get together to decide the question of the right- of-way. The motion was seconded by Mr. DiMauro, and carried unanimously. No action. B. Frank R. Hill: Request permit for a building. .. A motion was made by Mr. Kennedy to approve the plans as pre- sented. The motion was seconded by Mr. DiMauro, and carried unanimously. + No action. Mr. Thomas Tomasulo (Item#2 on the Agenda) now being present, was called. Mr: Tomasulo is bequesting Variance from R=2 to R-3 for Multiple Units, on the corner of S.W. 14th and 3rd Ave. A motion was made by:Mr. Tanner' to. grant a hearing for a var- iance, to be held September 14, at 8:30 P.M. The motion was seconded by Mr. Kennedy, and carried unanimously. ' A motion was made by Commissioner Zenobia to edvertisecforr,a_ hear- ing for September 14, a5 8:30.P.M. Mr. John Morel: Petition to rezone loth St. , N.W. , from 14th Avenue to the gas regulating plant, from B-1 to R-3. A motion was made by Mr. Tanner to grant a hearing for change of zoning from B-S .to R-3, to be held.September 14.. The motion was seconded by Mr. DiMauro, and carried unanimously. -3- f ® A motion was made by Commissioner Hill to authorize a public hearing for September 14. The motion was seconded by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Zenobia Commissioner Zenobia: I would like to ask a question before I vote, does Mr. Morel own this property? I don't .believe he owns the pro- perty. Mayor Salvino called for Mr. Morel to step forward. Mr. Morel was not present at the meeting. Commissioner Zenobia then stated that he would pass on the vote. Commissioner Grammer then explained that Mr. Morel lives on part of this property, and he had about 17 names on a petition to get this property to be rezoned. And that they were requesting a public hearing. Commissioner Zenobia: I will vote yes for a public hearing. The vote now reads as follows: Grammer Yes Hill Yes Zenobia Yes Salvino Yes 10. Mr. Charles Russell, Branch Manager of Miami Area of ` Penzoil Company: Request permission to store their , products at 5 N.W. 3rd Avenue, Dania. A motion was made by Mr. Kennedy to approve the request as pre- sented by the Fire Chief, Mr. Lassiter. The motion was seconded by Mr. DiMauro, and carried unanimously. No action. Commissioner Grammer: Mr. Mayor, I would like to go back to Mr. Hill (Item # 8 on the agenda) . His plans are in order, and I think we should take some action on this tonight. I will be glad to go down- stairs and get the plans to show you that they are in order. City Attorney Walden stated that he didn't think it was necessary. If the commission wishes they can just mane a motion to accept the Zoning Board's recommendation. A motion was made by Commissioner Grammer to accept the Zoning Board's recommendation. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Zenobia Yes Salvino Yes 6. John B. Gudikunst, representing United States Concrete Pipe Company. Mr. John Gudikunst stated that his company is supplying clay pipe to'M. B. Construction Company. 'He stated that the Commission ought to consider an ordinance to establish a code for the connections that users of the Sanitary Sewer System will install in their homes. He ?.` stated that homeowners will install whatever they chose. He stated r that his company makes connections that would,be, acceptable for use. Commissioner Grammer suggested that;this be turned over to the City Manager to investigate, and report back on the second meeting of September. -4- ,r • 7. City Manager's Report: City Manager Salvino asked if the City Commission wishes to instruct the City Attorney to draw up specifications on the leasing-out of the Dania Pier. He suggested that they ought to hold it up until the second meeting of September to give more people time to bid. • A motion was made by Commissioner Zenobia to put the Fishing Pier out for bid; bids to dome in on September 20th, 8:15 P.M. , under the specifications that the City Attorney is drawing up. The motion was seconded by Commissioner Hill, and the roll being called, the Commissioners voted as follows: • Grammer Yes Hill Yes Zenobia Yes Salvino Yes • City Manager Salvino suggested that the Commission make a motion to change the first meeting of September from the 6th to the 7th of September, because of Labor Day being the 6th. A m otion was made by Commissioner Hill to hold the first meeting of September on the 7th instead of the 6th. The motion was seconded • by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Zenobia ' Yes • Salvino Yes , City Manager Salvino stated that, at the last meeting, the Commission authorized drawing up specifications for a motor at the Water Plant. He stated that he had not heard .from .Broome b Farina about this. He suggested the Commission make 'a motion accepting the bids on September', • 7th. Attorney Walden suggested that they make it for the second meeting of September. A motion was made by Commissioner Grammer to advertise for bids for • a motor at the Water Plant; bids to be received on September 20th. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes • Zenobia Yes Salvino Yes City Manager Salvino stated that they needed a motion on record to authorize the Mayor to sign Change Order #2 for piling at the Dis- posal Plant, for $21,210.00. A motion was made by Commissioner Zenobia to authorize the Mayor to sign Change Order #2. The motion was seconded by.Commissioner Hill, and the roll being called, the Commissioners voted as follows: Grammer Yes • Hill Yes Zenobia Yes Salvino Yes City Manager Salvino stated that WGMA requests the use of the Ocean north of the Dania Pier for a "Surfeo-rama Day" on September 4, from. • 7:00 a•:m. to 5:00 p.m. , sponsored by the Florida East Coast Surfing Association. He suggested that if ,the Commission wishes to Let them. use it, since we have no guards there, that they be asked to furnish -5- 4^ 0 their own guards for their protection. He stated there would be awards presented by the Pepsi Cola Bottling Company. He requested that the Commission authorize him to send them a letter of per- mission. A motion was made by Commissioner Hill to grant permission for use 0 of the beach, providing they provide proper protection and super- vision; also that a local insurance agent shall provide insurance coverage. City Attorneyts Report: • City Attorney Walden stated that at the last meeting he was instructed to prepare some kind of an ordinance that would give the City an easier time prosecuting the obscenityotiffenses. He then read the proposed ordinance entitled: AN ORDINANCE PROHIBITING ACTS, OR MAKING IT UNLAWFUL TO COMMIT ACTS, OF LEWDNESS, OBSCENITY AND INDECENCY ON THE PART'OF HOSTESSES, WAITRESSES, ENTERTAINED EMPLOYEES AND PERFORMERS BEFORE AN AUDIENCE IN ANY COCKTAIL LOUNGE, BAR, SALOON, CABARET, NIGHTCLUB, RESTAURANT OR ANY OTHER PUBLIC PLACE WITHIN THE CITY OF DANIA; AND PRESCRIBING CERTAIN ACTS OF BEHAVIOR ON THE PART OF HOSTESSES, WAIT- 0 RESSES, ENTERTAINERS, EMPLOYEES AND PERFORMERS BEFORE AN AUDIENCE AT A PUBLIC PLACE TO BE UNLAWFUL; AND PROVIDING THAT IT SHALL BE UNLAWFUL FOR ANY•OWNER, OPERATOR OR MAN- AGER OF ANY COCKTAIL LOUNGE, BAR, SALOON,' CABARET, NIGHT- CLUB, RESTAURANT OR ANY OTHER PUBLIC PLACE WITHIN CITY OF - DANIA TO EMPLOY ANY PERSON TO COMMIT THE ACTS WHICH ARE 0 UNLAWFUL UNDER THE TERMS OF•THIS ORDINANCE OR TO PERMIT ANY EMPLOYEE TO ENGAGE IN THE CONDUCT OF ACTS PROHIBITED UNDER THE TERMS OF• THIS ORDINANCE; AND PROVIDING A PENALTY FOR VIOLATION OF ANY OF THE ACTS WHICH ARE UNLAWFUL UNDER THE TERMS OF THIS ORDINANCE; AND PROVIDING THAT ALL ORDIN- ANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH BE RE- PEALED TO THE EXTENT OF SUCH CONFLICT; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION ON THIRD READING. City Attorney Walden,.suggestdd that, if the Commission wishes to pass the ordinance on three readings tonight, they may do so by unanimous consent. ' Commissioner Hill asked if this ordinance .also included a 2:00 A.M. closing hour. City Attorney Walden stated that he has, a separate ordinance drawn • up concerning a 2100 A.M. closing hour. 4 . Commissioner Hill stated that at the last meeting she made a motion instructing the City Attorney to bring this ordinance to the next meeting, and also to include in it that they do close at 2:00 or earlier. • City Attorney Walden again stated that the 2:00I.A.M. closing ordinance was a separate ordinance. He then asked the Chief of Police, Montie Smith, what he thought of this ordinance. Chief Smith stated that this was the first time he had read it, but he thought it was a very good ordinance. He stated that it would take obscenity out of all of the places. -6- • • Rev. Hudgins, 48 S.E. 7th Street, stated that he thought it was a very find ordinance. He asked if this ordinance could be passed on all three readings tonight, also if the indecent billing and marquee would have to come down. City Attorney Walden answered it could be passed, if all the Commis- sion is unanimous. And that the signs would hav e to come down if they were in violation of our sign ordinance. A motion was made by Commissioner Hill to pass the ordinance on first, second and third reading. Commissioner Grammer stated that he would second Commissioner Hill's motion on first reading, then we could call a special meeting at the time that the other Commissioner (Young) , who is on vacation, , comes back to the City. He felt that, on something like this, there ought to be all five Commissioners present. Commissioner Hill stated that Commissioner_ Grammer has his right to a vote, but she felt that this is very important to our community, and she could not speak for Commissioner Young, but there are four of them present, and when one was missing, they ought to go ahead with the business on hand; therefore, her motion still stands. Commissioner Zenobia stated that he agreed with Commissioner Hill, that they should conduct business, but he would like to hear Com- missioner Young's thoughts on this too. He stated that he would ;. second the motion for a first reading, and then when Commissioner 3, Young gets back they can call a special meeting. But he felt every- body should be on record on this. He stated it is very easy to miss j: meetings, and "a lot of people do when something hot comes up" . • Mayor Salvino declared the motion dead .for lack of a second. A motion was made by Commissioner Zenobia to pass the ordinance on first and second readings. The motion was seconded by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Zenobia Yes Salvino Yes City Attorney Walden stated that, with respect to the ordinance on closing hours, the ordinance was very lengthy. He suggested that, if someone would flake the motion to adopt the ordinance he would then read it. A motion was made by Commissioner Hill to pass the ordinance on first reading. Mayor Salvino declared the motion dead for lack of a second. Commissioner Zenobia stated that he would not. go for 2:00::closing. 4. Public Hearing for objections to the adoption of a proposed J. '. ordinance by adding a new divid ion to Chapter 28, Code of Ordinances, to be designated aRecreation 6 Amusement District. . (8:45 P.M. ) City Attorney Walden read the ordinance entitled: AN ORDINANCE AMENDING ARTICLE IV, CHAPTER 28, CODE OF `.h ORDINANCES, CITY OF DANIA, FLORIDA, TO CREATE A NEW DIVISION KNOWN AS "A-1. RECREATIONAL AND AMUSEMENTS DISTRICT"; AND FURTHER AMENDING ARTICLE IV, CHAPTER 28, CODE OF ORDINANCES, CITY OF DANIA, FLORIDA, CONCERN- ING SAID "A-1. RECREATIONAL AND AMUSEMENTS DIS- TRICT" BY ADDING SECTIONS GOVERNING OR SPECIFYING -7- +yly 0 PURPOSE OF DISTRICT, USES PERMITTED, USES PROHIBITED, PROCEDURES FOR APPROVAL OF BUILDING PLANS AND SITE DEVELOPMENT PLANS, LANDSCAPING, HEIGHT, PLOT SIZE, YARDS, FENCES, PARKING, AND PUBLIC HEARINGS; AND PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH BE REPEALED TO THE EXTENT OF SUCH 0 CONFLICT; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE AS OF ITS PASSAGE AND ADOPTION, ON THIRD READING. A motion was made by Commissioner Hill to pass the ordinance on first, second and third readings. The motion was seconded by 0 Commissioner Zenobia. Commissioner Grammer: We said a while ago that we didn't want to pass an ordinance on all three readings because one commis- sioner wasn't here, and I feel the same on this ordinance. 0 The roll being called, the Commissioners voted as follows: Grammer No Hill Yes Zenobia Yes Salvino Yes Motion did not pass. A motion was made by Commissioner Hill to pass the ordinance on first and second readings. The motion was seconded by Commissioner Zenobia. • Mr. Houston requested that, if this company doesn't come in, he would like to see itespecified that it would immediately be rezoned to it's' present category. He also stated that, in the ordinance, it states that the parking areas shall be of a hard surface; he asked if it could be changed to "asphalt or concrete". City Attorney Walden suggested that the motion should include that one change, asphalt or concrete. The motion now reads: A motion was made by Commissioner Hill to pass the ordinance on first and second readings with one dhange,. that it shall read "asphalt or concrete9 instead of "hard surface" . The motion was seconded by Commissioner Zenobia, and. the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Zenobia Yes Salvino Yes City Attorney Walden stated that the Marinearium is asking for some rent relief. He stated that Mr. Mort Weston was present representing Mr. Tom Lamberth, operator of the Marinearium. Mr. Weston stated that there was a suit filed to stop the con- struction of the Marinearium at the beach. During the bourse of that construction there were hardships, and they put expenses upon completion of that construction. That litigation has now terminated. He was requesting an abatement. Commissioner Grammer stated that he felt they should give the man half, which would be 3' months, sinde he was 7 months behind. A motion was made by Commissioner Grammer that we split the dif- ference of 7 months, which would be 3' months. The motion was seconded by Commissioner Hill, and the roll being called, the 3b. Commissioners voted as follows: m Grammer Yes Hill Yes Zenobia Yes Salvino Yes City Manager Salvino suggested that this should b@come effective if it is paid in the next few days, not if he should wait another month. Virgil'Tarpley, from the audience, asked what the answer is on this lift station on N.E. 2nd Street. What happened, and who is ® responsible for it turning out the way it did. Commissioner Grammer answered that there seems to be plans sub- mitted along with Change Order #6, which had not come before the Commission while he (Grammer) was here, and he had not missed a meeting. It was OKtd to put it where it was, as far as the con- tract,:was-concerned. But it was going to be put in the right-of- way on the south side of the street, and we did spend $4,500 for a lot, and we still got it in the right-of-way on the north side of the street; but he didn't know why it was done that way. Mr. Tarpley asked if there was a record of that change order. • Commissioner Grammer answered, no, not that he could find or the City Manager could find; except he got a plan from Mr. Philpott about 2� weeks ago showing this change the way it was, and he said he got it OK'd from here. But they checked with the ex- city manager, and he said he had no knowledge of it being changed. Mr. Tarpley urged the Commission not to let this thing get by the way it is in view of the fact that the City is going to have to pay to have it moved one of these days, because there has got to be something done, it cantt stay there like it is. Mr. Houston asked was"-there a survey made on the lot. Commissioner Zenobia answered yes, the survey shows it being on the lot; but all of a' sudden a set of plans poppeddup with half of it being on the lot and half of it being out in the right-of-way. Commissioner Grammer stated that, as far as the contract was con- cerned, this man did have this change shown on the plans, so he did not think that the contractor was at fault, because the Engineer gave him this set of,plans. But, to his knowledge, he did not sub- mit it to the Commission. Mr. Tarpley asked who did the surveying on that. Commissioner Zenobia answered Pete Broome. Mr. Tarpley stated then he felt it would be his fault. • Mr. Houston suggested that this be followed through to find out just whots fault it was. John Sessa, from the audience, stated that the lift station on 2nd Avenue and 4th Street is supposed to be 2 foot out of the ground. • That one is sticking out about 6 foot out of the ground, it is also supposed to be landscaped. City Manager Salvino stated that he thought they were going according to sea level. Mr. Houston stated that, on Sth Street 6 S. Federal Highway, the cement had mixed in the truck for over 2 hours before it was poured, Y and when it was poured it came out in balls. i -9- City Manager Salvino stated that he checked into it, and the con- tractor stated that the cement was mixing in the truck for that length of time, but there was no water added to it until it was ready to be used. He also stated that there would be tests made on it. Mr. Bernard O'Connor, 221 S.E. 2nd Terrace, asked if the City would donate $100_.to sponsor a Junior Rifle Club. Mayor Salvino suggested that this be turned over to the City Manager and Chief of Police to check into. A representative from Beacon Ambulance asked what was decided about t them. City Manager Salvino stated that he and the Fire Chief have not had a chance as yet to check into it and make recommendations to the City Commission. Mr. Penta, 37 S.W. loth Street, complaining about trailer park on his street. The trailers are parked too close, and they cannot back out of their driveways. Chief Smith stated that he would be glad to check into it again. Commissioner Grammer: I have one thing that our good Mayor to the South wanted to know about 1-95. He says that we have three entrances off the turnpike and we don't touch the turnpike. But I will say this, all three entrances do lead to Dania, and that is what the signs say. He said some politician up here has some influence with the state. I don't know who he means, because there are several politicians-sin Dania. So if Mr. Zinkil will go back and think a little bit, up here at the Broward International Airport, which no part of Hollywood touches that airport, but they call it Lauderdale-Hollywood airport. So I think he is getting a little ahead ofehimself when he gives a rap to Dania about the turnpike. City Manager Salvino: I would like to explain that for the benefit of the audience. It is quite complicated how the State Road Depart- ment builds roads. There is a 7� gas tax, and the first 40 is pri- mary funds, the 5th and 5th cents are given to the county to pay off bond debts, and the 7th cent is also given to the county to build roads. Sheridan Street, Stirling Road, and Griffin Road are built by secondary funds. Mr. Zinkil's complaint was that they call it 820 instead of Hollywood Boulevard. Hollywood Boulevard was built by primary f.unds, and' the .State Road Department isntt about to call it Hollywood Boulevard, they call it the 820 exit, because it was a primary fund that built it. If it was City or county funds, of course, they would call it Hollywood Boulevard. I believe that is the reason € for it. Commissioner Grammer stated that on the new bridge they are building going North of AlA, to his knowledge they are running water mains to City property, which they have no right to as far as he knew. He �. stated that they were going to give some kind of agreement to us to work with us on this part of the beach. Commissioner Hill asked about the lime contract for the water plant. She stated that they had a letter some time-ago, in June, from Mr. Peters requesting that we consider this 'special kind .of silo for our a lime disposition at the Water Plant. ` He requested .that we look into and consider this, and I think we should before our contract comes up again. City Manager Salvino stated that•he has a request from a company to advertise. They would like to bid on this lime in bulk, that wouldn't have to be handled by hand.
