The City Commission of the City of Dania, Florida, met in Regular Session in the Commission Room at the City Hall. Present were: MAYOR-COMMISSIONER FRANK SALVINO COMMISSIONERS ROBERT GRAMMER VERA L. HILL S. ELLIS YOUNG CARL ZENOBIA CITY ATTORNEY CLARKE WALDEN CITY MANAGER LESTER E. CULVERSON BUILDING INSPECTOR CHARLES LINDEMAN CHIEF OF POLICE MONTIE SMITH CITY CLERK MARY THORNHILL The meeting was called to order at 8:00 P.M. by Mayor Salvino. A 1. Minutes of meetings held June 4, 70 1965. A motion was made by Commissioner Zenobia that the minutes be approved as read. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes 2. Ordinance: Change of zoning from 9-3 to R-1, the area adjacent to College Homesites and College Tract. (Third Reading) AN ORDINANCE rezoning that portion of all that part of the W' of the E' of the NWk of the NW'k of Section 3, Township 51 South, Range 42 East, lying south of the south line of block 3, "COLLEGE HOMESITES" (P.B. 55, P. 17, Broward County), north of the north right-of- way line of S.W. 3rd street as shown by "COLLEGE TRACT, 2nd ADDITION", (P.B. 191' P. 19) Broward County), and f west of the, west right-of-way line of Phippen Road; said lands situate, lying and being in Dania, Broward County, Florida, which-is now zoned R-3 Classification to R-1 Classification; and providing.that any parts of said lands now zoned B-2 Classification will continue to have such zoning classification; and providing that all ordinances' or parts of ordinances in "conflict here- with be repealed to the extent of such conflict; and providing that this ordinance shall become effective as of its passage and adoption, on third reading. A motion was made by Commissioner Grammer to pass the ordinance on third and final reading. Ordinance: Change of zoning from R-1 and R-lAA to R-3, certain property in Section 35=50-42. (Third Reading) ..;p -1- AN ORDINANCE providing that the following described lands to wit, the W� of the SWk of the SEk of the NWk, less the W 25 feet for street and less the N 30 feet and less the S 50 feet of the N 80 feet for street and the W' of the NA of the NEk of the SWk less the W 25 feet for road in Section 35, Township 50 south, range 42 east; said lands situate lying and being in. Broward County, •Florida, be and the same are hereby rezoned from R-1 to R-lAA Classi- fication to R-b Classification. A motion was made by Commissioner Zenobia to approve the ordinance • on third and final reading. The motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes • Salvino Yes 4. Bills for the month of May 1965 to be approved for payment. A list of the bills for the month of May are attached to and made • a part of these minutes. City Manager Culverson recommended that the bills be paid. A motion was made by Commissioner Young that the bills be paid. The motion was seconded by Commissioner. Hill. • Mayor Salvino called for discussion. Bob Houston,::.from the audience, asked about the three bills frdfi Roger Charest, he wanted to know what they were for. City Manager'Culverson answered that they were for black-topping West Side Park. He stated they were under $500, and therefore under his jurisdiction. Mr. Houston asked if it was all one job, if so, it was over $1,000• City Manager Culverson answered it was not one job. Mr. Houston stated that they were,-�all done at once. City Manager Culverson answered they were not all done at once. He stated that each bill was under $500, each bill was at least a week or two apart, and he (Culverson) approved both of them. Mayor Salvino answered one check was for $396.00, dated May 20th; May 20th $274.00; and June 7th $490.00 for West Side Park. He asked Mr. Houston if that answered his question. Mr. Houston asked when Mr. Charest went into the paving business. City Manager Culverson answered that he hadn't the slightest idea, that Mr. Charest did the job, the job is completed, the job is done right, and that is all he (Culverson) has to say on the subject. Mr. Houston asked why Mr. Zenobia's. equipment was used over there. Commissioner Young: Well, I think he has the right to rent his equipment to anyone he wants. Commissioner Zenobia: Let me answer my own questions, Ellis. For " your information, Mr. Houston, I .rented my equipment to Mr. Charest. i i • He is not the only one I ever rented it to, I have rented equipment myself. And as far as bill-splitting, I think you are the past master of bill-splitting for the City of Dania. When you were in control of City Hall you were a great one for splitting bills with. a person named Robert Schumacker. I 'rented my equipment to someone else who is a General Contractor, and what he wants to do with it is up to him. Mr. Houston answered that.there was no question that Mr. Zenobia did the paving work over there. Commissioner Zenobia answered that he did not do 'the paving work. • City. Manager Culverson asked why Mr. Houston was not asked to come up to the microphone. Mayor Salvino requested that Mr. Houston please come up to the mike. • Mr. Houston answered that he •can!t stand that long. City Manager Culverson: Well, he can make the Sewer Program every morning at 5:30 and check the sewer, he can make these stairs, he can make everything, but he cant make it from that place to this microphone, and I would like to know- the reason why. • Mr. Houston answered that he can't stand too long on his feet with- out leaning on something. A motion was made by Commissioner Hill that the discussion cease. • Commissioner Zenobia: I would rather see this discussion finished, if you don't mind, Mrs. Hill. Mayor Salvino: Let's finish this discussion. Mr. Houston again began talking, at which point Commissioner Young stated that there was a motion on the floor, and he asked that the Mayor either declare it dead or discussion ceases. Mayor Salvino: This is a discussion. Commissioner Young: Well this is not discussion when you have a legitimate motion on the floor. You dispose of it one way or the other. Mayor Salvino: Well I asked for a discussion. Commissioner Young: It doesn't matter, the motion takes precedence over that. You either declare the motion dead or you. . . . Mayor Salvino: Well I declare the motion dead. Motion died for lack of a second. Mr. Houston: Now can I ask a question? Mayor Salvino: Yes sir. Mr. Houston: Are these three checks for West Side Park? City Manager Culverson: Separate and distinct. Mr. Houston: Isntt one of them for S.W. loth Street? City Manager Culverson: Well, now you have got me right off hand. Mr. Houston: Yes, I guess so. ',. -3- City Manager Culverson: . Dori-It say that, Mr. Houston, it is very smart to stand up there and criticize. But I am telling you what I know. The checks and everything that I have done are perfectly legal. You can sit there and blab all night long. Mr. Houston: I think you are a little out of order in the way. . . . City Manager Culverson: And you are out of order too, Mr. Houston. Mr. Houston: You are the City Manager here. . . . City Manager Culverson: You better believe it. I can be the City S Manager tonight and not tomorrow, so it don't bother me one way or the other. But you are an agitator-Mr. Houston, you have agitated ever since I have been here, Mayor Salvino rapped for order. . Commissioner Zenobia: I wish you two would stop arguing for a minute and let me get a word in here. . . .this seems to be a night to pick on Zenobia. Mr. Houston: I just want my questions answered. Commissioner Zenobia: I'm going to answer your question, Mr. Houston, just be quiet while I speak. Now how come you questioned that and you didn't question this check for $75.00 to Bill Rhodes? Mr. Houston: I don't know anything about that. Commissioner Zenobia: Well I do. That is something the Mayor sold to 0 the City, only he didn't have the guts to have the check made out to himself. Mayor Salvino: I did not sell anything to the City .of Dania.- - Commissioner Zenobia: Mr. Salvino, you showed it to me yourself. Mayor Salvino: I did not sell anything to the City of Dania. Commissioner Zenobia: Alright, I'm not through yet. I want to bring this thing out. . .don't try to blackmail me. How about this. . .how about Mr. John Kennedy? For a total of $1,187.50. How come you didn''t question those bills? Mr. Houston: Well, I don't know anything about those. Commissioner Zenobia: Well I do, if you don't know about things why 40, do you ask? Mayor Salvino: I'm going to ask for an investigation of this town. Commissioner Zenobia: It would be a good idea, Mr. Mayor. Mayor Salvino: That's right. I'm going to ask for an investigation, to clear all this stuff up. Commissioner Zenobia: I can bring bill' after bill up here, so don't try to pick at me, Mr. Houston. I rent my equipment-out, which I have a perfect right to do, just like everybody else has a perfect right to do. Mr. Houston: I'm still "going to get my question answered. I asked if these three checks were for West Side Park. Commissioner Zenobia: What is the numbers of the checks. . .I don't know:.- Mayor Salvino: The checks total't0' $1,160 for West ,Side Park paving. City Manager Culverson asked .the Mayor how come"he knows that. 4 ` . • Mayor Salvino answered it was his business to know it. There is one check for $396.00, a check for $274.00, and a check for $490.00. City Manager Culverson: You better believe it, and every one was for under $500.00. Mayor Salvino again rapped for order. Mr. Houston: I simply asked if those three checks were for West Side Park, and I haven't got a definite answerc:yet. I asked if one wasn't for repaving on S.W. loth Street. City Clerk Thornhill answered that there was one for, not paving, but some rock put in on S.W. loth Street'between 2nd Avenue and Dixie Highway. The amount of that was $290.00. That is a June check, and it isn't in this batch. Commissioner Zenobia: That is not on this month's bills, Mr. Houston. You just had that one slipped to you a little bit too quick, that's all. That is on next month's bills. Mr. Houston: I would like to know how you got $290 worth of rock between S.W. 2nd and Dixie Highway. Commissioner Zenobia: Dontt ask me, I didn't put it in there. City Manager Culverson: Mr. Houston, can I ask you a question? Is all of them within the jurisdiction of the City Manager? Anything within $500, is that within the jurisdiction of the City Manager? Mr. Houston: Under certain conditions. City Manager Culverson: Is it, or isn't it? Mr. Houston: No. City Manager Culverson: It is. Within $500. You read the ordinance right here. I will read it to you any time that you want me to. Mr. Houston: There is a check that is made out for rock'.cbetween S.W. 2nd and Dixie Highway, which is a distance of about 150 feet. . . Commissioner Young: Mayor, I think that is out of order. That isn't even on this list that we are discussing now. Mr. Houston: If this fellow did a good job, I wonder why you criticize, why you don't want to give an answer. City Manager Culverson: I am giving you an answer, Mr. Houston, every- thing is within the jurisdiction of the City Manager. Everything is perfectly legal, and no matter .how .you try to twist it around, and turn people's minds around, it is legal, and I dont care what you say. Mr. Houston: It is not legal from this point. . .it was all authorized e at once, it was done by a man who is not in the paving business, he does not have a paving license,, and- the'fact of the matter is that Zenobia done the work. City Manager Culverson: Can you prove it? Mr. Houston: Yes. City Manager Culverson: No you cant. Get yourself a lawyer and sue me. Mr. Houston: What would I get out of you? City Manager Culverson: You would get nothing out of me, because you. have no case whatsoever. Y • 0 A gentleman from the audience stated that he wished to get on with the meeting. "Mr. Houston is not on the agenda, and if he has any- thing to say, let him (Mr. Houston) get on the agenda for the next meeting" . City Manager Culverson recommended to the Council that they take a • vote on paying the bills or not paying the bills. City Clerk Thornhill: We have a motion, Mr. Mayor, that the bills be paid, and a second. The roll being called, the Commissioners voted as follows: • Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes 5 . Recommendations from the June 8 meeting of:the Planning and Zoning Board. (1) Don Nelson - Request change of zoning from B-2 to C-1 on lots 1 through 3, Block 1, COLLEGE HOMESITES. This • item was tabled by unanimous vote due to the absence of Don Nelson. No action. (2) Mr. Arcaro - Request building,'permit;torconstruct 501 unit apartment building in DANIA DELMAR RESUB, tract • A. Due to Mr. Arcaro's absence, and a member of the audience stating that he was expected shortly, his request was postponed awaiting his arrival. While waiting forMr. Arcaro's arrival, the subject of the present R-2 R-3 zoning of the nursery property North of the Cut-off canal was discussed. There is presnetly no access to the property and the feeling was that it should be zoned Agricultural:. Mr. Sparkman recommended that, since the City of Dania had • no agricultural zoning, and with the chairmants permission, he obtain the county's agricultural zoning requirements and present them to the board for study item by item. Mr. L'oury recommended that Mr. Sparkman do this. It was agreed that on July 13th Mr. Sparkman would have the County zoning recommendations available for the board to study. No action. Item #1 continued: Don Nelson came in and presented his request for hearing to be held on July 13th. • Mrs. Panella made a motion to recommend that public hearing be granted for Don Nelson's change of zoning request from B-2 to C-1 on Lots 1 thru 3, Block 1, COLLEGE HOMESITES, to be held on July 13, 1965, at 7:45 P.M. Seconded by Mr. DiMauro and unanimously passed by roll call vote. A motion was made by Commissioner Young to accept the recommendation of the Zoning Board and authorize a public hearing for July 13, 1965, for 7:45 P.M. The motion was seconded by Commissioner Hill, and the roll being called, the Commissioners voted as follows: Grammer Yes ,' Hill 'Yes Young Yes Zenobia Yes Salvino Yes -6 ® Item #2 - continued - Mr. Arcaro came in at 8:00 P.M. with his architect, Mr. Ghezzi. Mr. Ghezzi presented copies of the Apartment Plot plan to the zoning board members for study. All members agreed that' the plan for parking did not conform to regulations. Also, it was brought out that there was a right-of-way discrepancy. Motion was made by Mr. Tanner and seconded by Mr. DiMauro that Mr. Arcaro meet with Mr. Lindeman, Building Inspector, and come back to the zoning board with his recommendations as to Mr. Arearo's plan. Motion passed with unanimous roll call vote. No action. 10. Application for transfer of 2 COP License - Val's Drive Inn, 520 Stirling Road., From: Jewell Lee McNeal, to: Leo Brezial. QFirst Reading) A motion was made by Commissioner Young to approve the transfer on first reading. The motion was seconded by Commissioner.Zenobia, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes 7. Correspondence: City Clerk Thornhill read a letter as follows: "Mr. Lester Culverson, City Manager: As an agent for the Glen Falls Insurance Company, I am in a position to offer Umbrella Excess Liability Insurance to the City of Dania. This policy provides excess general liability and automobile liability limits and also protects the City from the exclusions and gaps of the primary policies. The covered hazards not normally included in primary policies are subject to a self-insured retention by the City. An Umbrella Liability policy comes into play when the limits of the primary insurance have been`:exhausted, or when a claim develops that is not covered by the primary insurance. Based on recent survey by their engineering department, Glens Falls has given me a premium quotation of $1,750.00 per year for a .policy with a $1,000,000 limit and a $25,000 self-insured retention. This recommendation is made on behalf of the above agent and we ask that it be presented.to the City Commissioners at the April 19th Council meeting. . Sowder, I hereby, as Health �? -7- • 0 Officer of Broward County, do officially remind the Dania • City Commission, in reiteration of the previous notice of March, 1965 (copy of letter enclosed) that plans for the disposition of garbage and putrescible trash should be duly given to the Broward County Health Department no later thant July 1, 1965 --such plans to eliminate the present illegal . dump currently being used for disposal purposes. These plans, after approval by this Department and the Florida State Board of Health, should be carried out no later than January 1, 1966, in accordance with the March, 1965, notifi- cation and Florida State Board of Health Survey Report. If there are any questions on this matter, please feel free to consult our Sanitation and Engineering Departments headed • respectively by Messrs. W. C. Galbreath and George T. Lohmeyer. I think, very shortly, one way or another, the City Commission will come up with . • the answer and be able to answer the State Health Department. B. City Manager's Report: City Manager Culverson: I have nothing, that was it. • 9 . City Attorney's Report: City Attorney Walden: Gentlemen, I was contacted by the Bank of Hollywood a few days ago. M. B. Construction Company has applied to the Bank of Hollywood for a loan, and- pertains to the Sewer Pro- gram, it will be approximately $130,000:00: The 'Bank of Hollywood • wants some assurance that when that money is released it will be paid to the Bank of Hollywood upon there being proper assignments and other legal documentations. The Dania Bank is,the trustee of the construction funds, `and: the bank cannot pay them out except to whoever you authorize. So I have been asked by the Bank of Holly- wood to obtain a resolution from you where you agree to recognize it as an ass;ghee concerning these funds, and authorize the Dania Bank to pay them, the,Bank of Hollywood, and I think it is proper that you adopt a resolution agreeing to do that, because you are not obligated of course to pay the contractor until the work is done and the engineer tells you to do that.m When you get to that • point, if they have been properly assigned,`, it will be OK to authorize payment to the Bank of Hollywood.. . City Manager Culverson: When we get through with this program there will- be approximately;$140,000 withheld on M.B. Construction Company for the 10%. Ain f right that the Engineer has, to pass it, and the City has to accept it, the .job as :complete and to,their satisfaction before this money is turned over? City Attorney Walden: Yes. The contract must be performed. Commissioner Grammer: Would that work when we have a performance and payment bond on this. Wouldn!t we have to get some kind of an • OK from the bonding company? City Attorney Walden: Well whenever that point comes, in other words, on the day that M.B. ordinarily would be entitled to it, on that day the bank of Hollywood wants it if they make this loan to him. So naturally it would be all conditioned upon every contract and every agreement being fulfilled. Commissioner Young: In your opinion, Mr. Walden, is that proper? City Attorney Walden: Yes sir. i ® A motion was made by Commissioner Young to adopt and pass a resolution allowing M.B. Construction Company to negotiate a loan with the under- standing that all terms of the contracts shall have been fulfilled before the City has any obligations to turn any money over to the Bank. The motion was seconded by Commissioner Hill. • Mayor Salvino called for discussion. John Sessa When the City accepts the sewer program then M.S. has one year to stand behind the sewers, •right? City Manager Culverson: They will have approximately a year and a half when this program is through. :And the City does not accept it, unless it has the full authority and 'the recommendation of the Project Engineer on this job. John Sessa: In other words the City doesn't accept the job until approximately a year after he is done with the job, is that right? City Manager Culverson: Right'. Commissioner Young: It is guaranteed for a year. . Gene Pelliccia asked if it wasn't true that M.B. could not borrow on their bond. He asked what would happen if we should give him the money and he gets his money, then what? "The City of Dania is going to be left holding the bag." City Attorney Walden answered that he is going to borrow the money from the Bank of Hollywood, the amount of security that he wishes to pledge •or assign is retainage. The bank of Hollywood will not be able to make any claim to it one day quicker than Mr. Mears, M.B. What the bank is asking is that you recognize the assignment. John Sessa asked if the Bonding Company will allow us to do this. City Attorney Walden answered that it is going to be up to the Lawyer for the Bank of Hollywood to answer that question. All the City agrees to do is recognize the assignment and when the money becomes due and payable, the City agrees to pay it to the Bank instead of Mr. Mears. 4 The roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salsiino Yes 6. Bids: 8:30 P.M. , Voting Machines and Fire Station. A motion was made by Commissioner Young thattthe bids be closed on the Voting Machines and the Fire Station. The motion was seconded � . by Commissioner Hill, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes City Manager Culverson presented the bids for the Voting Machines as follows: SHOUP VOTING MACHINES: 7 Shoup Machines @ $1,823.00 each ;;i -9- • 0 0 ® AUTOMATIC VOTING MACHINE CORPORATION: 7 Automatic Voting Machines @ $1,599.00 each. A motion was made by Commissioner Young to refer the bids to the City Manager and City Clerk for tabulation, investigation and re- commendation. Yes A motion was made by Commissioner Zenobia to open the bids on the Fire Station. The motion was seconded by Commissioner Grammer, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes • City Manager Culverson requested that Mr. Farina, of Broome E Farina, be allowed to open and read the bids. Mr. Farina presented the bids as follows: • TOGNOLI BROS. Time of completion - 180 days $77,824.00 Accompanied by, bid bond of 5% of bid. HUGH F. PALMER:' Time ofcompletion - 140 days $77,984.00 Accompanied., by bid bond of 5% of bid. R. W. TANSILL CONSTRUCTION COMPANY: Time of completion - 100 days $79,000.00 Accompanied by .bid ,bond of 5%, of bid. EARL G. CHILDS CONTRACTORS: . Time of completion ,- :lN days $81,835.00 Accompanied by bid bond of 5% of bid.. A motion was made by Commissioner Young to refer the bids to the City Manager and Engineers for tabulation and recommendation. The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes Zenobia Yes Salvino Yes Chief Smith stated that we need an appointment of an Assistant Judge. He stated that Judge Black is leaving in July for most of July, and it is imperative that we have an Assistant Judge, and • that there was a case coming up which the Judge could not handle, since it is a former client of his. Commissioner Zenobia suggested that the City Attorney get us a judge for this one particular case while we decide what we want to do. City Attorney Walden answered that the City might do well to have a lawyer for this one case coming up, since it was a rather hard one. -10- r • 0 ® City Attorney Walden stated that he thought either Judge Black or himself could get a judge from one of the surrounding cities for this one case. A motion was made by Commissioner Zenobia to have the City Attorney or Judge Black obtain a lawyer for the one case coming up. The • motion was seconded by Commissioner Young, and the roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes • Zenobia Yes Salvino Yes City Attorney Walden stated that last year the Commission passed a resolution of intent concerning Old Dixie Highway in effect that the City would acquire the necessary right-of-way and handle the drainage problems along Old Dixie Highway. That resolution stated that in consideration of obtaining the right;of-way :the' State would put in a four-lane highway. He added'that Mr. Culverson now informs him (Walden) that the State is willing to pave in a two-lane highway with certain cut-outs, and they request to amend the resolution from a four-lane to a two-lane. • City Manager Culverson stated that the State informed him if the Council so wishes, and they amend that section of the resolution, to a two-lane highway, we can almost proceed immediately on this program taking in drainage and so forth. . That is two-lane with a third lane for turn-off at all principal intersections. City • Manager Culverson recommended that the Council pass the amended section of the resolution. A motion was made by Commissioner Young to adopt and pass a resolu- tion allowing a two-lane highway; with a third lane for turn offs at all principal intersections. Also, he requested that a certified • copy be sent to the proper authorities (State Road Department and County) . The motion was seconded by Commissioner Zenobia, and the roll being called, the Commissioners voted as follows: Mr. Houston asked if anyone has seen the plans. City Manager Culverson answered that he had seen the original plans, but since the advent of the sewers this plan was no longer feasible. Commissioner GRammer asked *hen-this was going to be done. City Manager Culverson answered that Mr. Cox, the Engineer of the State Road Department, said it would take approximately 2 months to get it in operation, but that the job would be done before the tourist season starts. They have to co-ordinate this plan with the M.B. Con- struction Company. They are trying to get them as close to each other so as not to inconvenience the public to any great extent. Mr. Houston asked what about the drainage. City Manager Culverson answered that the drainage problem is to be taken care of by the City of Dania. Mr. Houston suggested that they hold up on the resolution until • things are straightened out, because no one here knows what they are doing right now. City Manager Culverson again recommended that the resolution be passed. Mr. Houston asked "What does this Commission do, just sit up here and listen to these silly arguments of yours, and then go ahead?" City Manager Culverson: No they listen to some of yours, Mr. Houston. ® Commissioner Zenobia: For your information, Mr. Houston, the Engineer for the State Road Department is Mr. Philpott; the Engineer for drainage for the City is also Mr. Philpott. And Mr. Philpott is in the process now of drawing up the plans for the road and for the drainage. We have $50;000 earmarked in this present budget for drainage, for that particular area there. • Mr. Houston stated that they have not answered his question. Commissioner Zenobia: . Mr. Houston, we have not seen the plans yet. We are not OKing any roads tonight, we are just giving them a chance to go ahead. 0 The roll being called, the Commissioners voted as follows: Grammer Yes Hill Yes Young Yes • Zenobia Yes Salvino Yes City Attorney Walden stated that in May the Commission had a late meeting at 10:00 P.M. , to consider certain complaints over one of the Nightclubs on the North end, and the State Beverage Department was here and went into great discussion about various offenses committed by two nightblubs at the North end. And attthathsame meeting Mr. Walden stated that the best control the City had was that of controlling the hours of closing. As a result he (Walden), was instructed to look into the matter and bring back certain re- commendations and proposed ordinances which would solve the problem to some extent. Attorney Walden went on to briefly review the history of the Night Club Ordinances for the City of Dania. Mr. Walden suggested that the City Commission control the hours of closing and have them close earlier, but back the hours of closing on all businesses or place selling alcoholic beverages to 2:00 A.M. , and they would no longer have any trouble with.night clubs. He made the recommen- dation that they do away with the extra hour ordinance. He suggested that the City Commission pass this proposed ordinance on two readings tonight, then Chief Smith.might go' up and talk with these people and see if they might want to compromise or straighten out. Then if they don't, then pass it on third reading. Attorney Walden then read the proposed ordinance entitled: AN ORDINANCE ratifying and confirming Section 17-29 of the Code bf Ordinances of City,of Dania, Florida, as amended by Ordinance No. 420 of City of Dania, Florida, with respect to regulations concerning the hours of sale of liquor, beer or wine consumed upon the premises and by package, bottle or container; and ratifying. and confirming Section 1 of Ordinance No. 474 of City of Dania, Florida. A motion was made by Commissioner Hi3.1 to adopt and pass the ordin- ance on first and second reading. Commissioner Zenobia answered that there are*some racks downstairs that hold bookkeeping equipment, and he stated that the Mayor unloaded these off his truck and said ?!Here are some things I am selling to the • City" , Bill Rhodes stated that some time ago he remodeled the Dania Beach Grill, and all his equipment he took out of that Grill and stored it in Mr. Salvino's barn. He had these filing cabinets that were of no use to him. He stated that he felt Commissioner Zenobia owed • him an apology. He went on to explain about a showcase which he had sold to the City for use on the Pier. City Manager Culverson: Just a second, Bill, let's clarify this a little bit. Mr. Zenobia is free and clear of this whole deal. It is not what you are talking about. As long as you brought it up, which I .was going to say nothing about, but I was taken down to a warehouse by Mayor Frank Salvino, who said he has a bookcase. He said "I will sell these bookcases to the City of Dania for "X" amount of dollars." We came back to the City Hall, and he said, and I quote 'We will bill it to Mr. Rhodes. I don't want my name on it" . Now who's equipment it is, I don't know. • Bill Rhodes: It was my equipment. . .all that stuff. And there is still some more,down there if you want it. Commissioner Zenobia: I can only go by what the Mayor told me, and ' that was his exact words as I said before. But, as I said, if it is not so, I will apologize. Bill Rhodes: It is not so, believe me. Commissioner Zenobia: Then he should use a better choice of words when he is doing something. • Bill Rhodes: You should have checked with me first before you brought it in public, which looks to me like it is good for slander. Horace McCutcheon, President of the West Side Civic Club; stated that he is here is regards to .two articles which appeared in the paper. �. The statement was made by some of the Commissioners pertaining to the West Side. Last week the article stated 'that this Commissioner carried a member of the press around .to show..her the poor condition of the West Side Park. This is fine, but we are surprised that this - _ commissioner didn't really show herethe condition of the West Side Park. The first thing that you will notice is that we don't have • ' benches in the park. This condition has been' there for at least two years. We have contacted various Commissioners, past Commissioners, present Commissioners, and as of today there has been nothing done about ' this. Five weeks ago there was an old restroom on the property torn down, with no expl�ination of when we would have another, but this condition is still there. The debris is still on the park. Someone going through this park at night could trip on it, and that would cost;,: ., -13- t' • 0 ® the City some money. Also, the field is unlit. These conditions are not in the other park. We made a survey of Houston Park and Frost Park. They have a very nice beautiful park, and they have a very nicely lit field. We are wondering why we Gantt have the same thing on the West Side. We are asking for no more or no less than what you have on the East Side. Mr. McCutcheon then read a letter from himself to the City of Dania, regarding a committee for the West Side. Mayor Salvino: You mentioned some City Commissioners; would you mind mentioning the names of the City Commissioners? Horace McCutcheon: Mr. Carl Zenobia, and Mr. Robert Grammer. Commissioner Grammer: Which one of the articles was me and which was Zenobia? Horace McCutcheon: The one pertaining to the City Manager was your article in the Fort Lauderdale "Paper. Thenone that Zenobia mentioned came out in the Hollywood Sun Tattler. Commissioner Grammer: What was the article? . Horace McCutcheon: You said that some group from the West Side was trying to put pressure on the City Manager. Commissioner Grammer: You better go read the article again. There was a reporter came up to me and asked did I know of any oftter going on to oust the City Manager. I 'said "No, I do not", but the only. thing that I have heard from the West Side, ,and I have heard it from you, that you didn't think Mr-.• Culverson was working like he shoUd be with Mr. Thomas." And I think if you will read the paper, that is what it said. Horace McCutcheon: What we had to say to Mr. Culverson, we came here as a committee. There 'was me, Mr. Waiters, and' Anna White, in the presence of Mr. Zenobia and`Mr. 'Grammer. Mayor Salvino: Thank you, anybody else in the audience have anything' to bring up? Commissioner Grammer: Wait a minute, Mayor. The man has put a charge against me he •said he never had. Now he knows good and well that the pressure was put on the City Manager to hire Thomas back. Not only by you, Horace, but by a whole group of you right down in the City Managerts office. Now letts get the facts. Horace McCutcheon: We asked that he hire him back. - Commissioner Zenobia: No, no. . .it was pressure, Horace. I know pressure when I see it. Chester Byrd: I think you are right, Mr. Grammer. In a way you are � . right. But Horace objects to the word "pressure" here. This is the only thing he objects to, the word "pressure". But we wanted Thomas back. And we requested this to all of you to give us Thomas back. So in that respect, it was pressure, I guess you could say it was pressure. We wanted him back and we asked you to turn a deaf ear to your City Manager and give us our man. And you gave him to us, which we appreciate. So I think that it was pressure in that sense. You also mentioned that some of us felt that Culverson hadn't given us a square deal, and Mr. McCutcheon denied that he said it. I imagine you heard me say that, because I did say it. I told Mr. Culverson that I didn't think that we were getting a good deal from him. I am to be convinced yet that we are. —14- ® Mr. Eager, 12 Street and 2nd Avenue: This is the third time I am asking the same question, Mr. Mayor. To your knowledge does the City Manager live in the City? Mayor Salvino: No sir. • Mr. Eager: He doesn't.. OK. Do you get a vacation? Mayor Salvino: No sir. Mr. Eager: You don't? • Mayor Salvino: I do once in a while. . Mr. Eager: I mean, do you get a paid vacation? Mayor Salvino: No sir. Mr. Eager: How come the City Manager, being here one year, gets two week's vacation with pay? Thank you. City Manager Culverson: Don't run away Mr. Eager. I would like to invite you when you get through. I would like to invite you down to 143 S.W. 2nd Street, in Dania, where I have a home, and after the • meeting tonight I am going to serve some cocktails and you are entirely welcome to come down. And it is not going to cost you a penny. Here is the rent receipt, sir. The gentleman who rented me the house is sitting right here in the audience, and so if you have any argument about it, you can take it up with the gentleman. The rent has been paid. I am now a resident of the City of Dania, so . • I would like to save you this trip of walking from there to the microphone inquiring about me. Mr. Eager: I still don't know why you got two week's vacation.with pay. City Manager Culverson: Well that is a problematical thing, Mr. Eager. • The Council approved it if that is what you want, most of the Council. Commissioner Young: The Council approved it in majority, and the Mayor signed the check. What else do you want? Mr. Eager: Well the paper said that he signed his own check. • Commissioner Zenobia: Don't always believe everything you read in the paper. Mayor Salvino: Well the Mayor is going to be a little more careful when he is signing checks from now on. Gene Pellicdia asked if it is possible to appoint someone to handle - the assessments on the sewers when the time comes. We should have someone to handle it when the money starts coming in. ' Commissioner Young answered that the assessment portion is allocated •, in the bond issue for a period of the first ten years of the bond. He assured Mr. Pelliccia that adequate records of the assesstneht1list and the receipt books, etc. , will have to be kept in order. City Clerk Thornhill explained to everyone, on the suggestion,of: Mr'. Houston, how the assessments on the sewers would be handled. • Nick DiMauro asked why don't they have swings, slides, and sandboxes at Frost Park for the little children" so that the small children . . will have something to do while the parents are watching the older children playing baseball. Mayor Salvino suggested they turn it -over to the City Manager:to.work .':. out something. _15 ® Chester Byrd asked if some houses in the area of S.W. 2nd Street, which were not there when the sewer program originated, could be given serious consideration to be added to the sewer program. Commissioner Zenobia answered that the Sewer Program only takes in a certain area and these houses that it was extended to were in that area. The area Mr. Byrd is talking about was not included in this area, but as soon as the City finances allow, these other areas will be added on. Mr. Sinclair suggested that the Commission look into the methdd used in sending out notices to property owners on zoning changes. • He claimed that a year ago there was a zoning change across the street from him and he was not notified. A motion was made by':Commissioner Young that the next regular meeting shall be held on Tuesday, July 6; because of the 4th of July holiday.
